Select Decks and ******** **** Timeline -6/1/23 @ 3:00pm – ****** *** **** met with ***** *** *** at Select Decks showroom. ***** *** *** made start date first week of July with a lead time of 4-6 weeks. -6/7/23 – contract was signed and deposit made of $34k. -11/1/23* ***** messaged ****** *** **** on dashboard acknowledging our “patience as they have been dealing with field crew challenge. With an estimated start date of 11/20/23.” Materials were dropped off in our front yard and went untouched for weeks. Footers were dug and their failed inspection. -12/19/23* ****** contacted her lawyer and he advised her to ask ***** for a date the project would resume requested by her lawyer. He answered that day and said they were waiting on green light about footers still. -**** has been calling and texting ***** through this time period, with no response from ****** -1/17/24, ***** sent us a message on the dashboard they are waiting to resume the project due to the weather and thanks for our patience. -2/2/24, ***** messaged on dashboard “decent weather and going to get going on things”. He sent an electrician out to run “some things” before they put the decking down and then the roof. Electrician came and ran everything he needed to. -2/2/24, ***** came into our home to check on the project and T***** was currently 9 months pregnant. She asked if the deck could be done prior to our Sons arrival of 4/7/24 and ***** said “close but no problem” -2/6/24, installment of $34,485.87 paid to select decks. -3/5/24, another installment paid to select decks. -3/19/24, message to ***** on dashboard asking when our project can resume. No response. It is now 5/6/24 and our project is unfinished and ***** has yet to respond to us to contact us back. **** has called and texted ***** multiple times between 3/19/24 – 5/6/24. $100k in the hole and only framing has been done.Customer Answer

We signed the contract for this project, which consisted of a deck and patio, on February 3rd. The contractor promised to have it finished in time for my daughter's high school graduation party at the end of June. Once we signed the contract and made the initial payment of $19,033.82, no one came to our house to start working until the end of April. On May 6, we made another payment of $19,033.82. At this point, the deck was still not finished. On June 20th, we paid $17,130.44 to Select Decks as payment to start the patio phase of our project. You can see in the emails I attached that James specifically stated, "Patio guys needed payment by Friday (June 16th) to start today (June 19th). On June 20th, we made the payment. As of today, October 16th, we still do not have a patio. The contractor and owner of the company, James *******, moved some dirt in preparation for the patio. We realized that we needed a retaining wall which was not part of the contract. The contractor stated that he would get us estimates to build the wall. We waited over two months before we hired someone else to build the retaining wall. We contacted the contractor, James *******, and asked for our money back ($17,1304.44), having no faith that he will ever finish the job. He has refused to give us our money back. We also found out that the contractor, James *******, does not have a contractor's license in the state of West Virginia. Additionally, the contract (see attached), is missing many requirements per West Virginia state code.Business Response

Contracted to complete a deck for us in March and was to be done by May at the latest. We do not have a deck and currently have unsafe living conditions with no previous deck (demo'ed with no timeline whatsoever for finishing). I have reached out on multiple occasions for discussion and have heard no response. They currently have our 15k down payment.Customer Answer

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.
We signed contract and placed down payment of $15,627.10 to SelectDecks in February 2023. There were significant delays to the start of project. Our pre-existing deck was demolished in August 2023, leaving dangerous living conditions for approximately 6 months. Specifically, SelectDecks left a two story drop from a sliding glass door secured only with a single piece of plywood. Given our safety concern with a toddler in the house, we tried contacting Mr B****** repeatedly. We were forced to hire a separate contractor to better secure/reinforce the sliding glass doors. Other than sparse text message correspondence, we were unable to contact Mr B****** of SelectDecks on the phone. After giving Mr. B****** and SelectDeck multiple chances to rectify the situation, we terminated our contract in approximately December 2023. Thereafter, Mr. B****** failed to refund the deposit that was made in February on the contract. We obtained legal counsel and were prepared to initiate legal action, but with legal counsel, we were able to contact Mr B******. In order to avoid the cost of litigation and the excess damages, Mr. B****** signed a binding agreement to refund the payment in pre-determined installments. Unfortunately, the agreement was broken by Mr B******, as he only refunded one installment of $3000, leaving $12,627.10 still unrecovered by us. We are now in process of finalizing all of the damages, and we will institute a civil suit, and we intend on contacting the Pennsylvania Attorney General’s office to determine whether criminal prosecution is available.

I used Select Decks for an extensive decking project in 2018. After multiple situations where the owner was caught in lies and several broken timelines, we fired the contractor and finished the project ourselves. At a later time we sold this house and came to find out the owner of this project has stolen listing images for our house and is advertising as his work to gain more business. I think people need to be aware of this contractors inept skills and habitual lying tendencies. Also, he has stolen intellectual property and pawned it off as his own work. In the attachments below you can see an agreement to stop work in early September, but as the second image shows his website is using images I took that next winter of completed work.Customer Answer

At the time this issue was raised the business was using a 3rd party for website, social media, etc. They were unaware of the circumstances related to this project and were simply pulling photos from a shared drive. When the homeowner requested removal of said photos we made that request with the vendor and they were subsequently removed.
