Loan officer ******** at ********************* at cmg financial ***** *****. ******** switched from her old company to Rose lending. Unbeknownst to me when I submitted all my info for pre-approved it was done through her old company so a month later I had to resubmit EVERYTHING again. The process took over a month. I had 2 employers ( primary/full time that id make 2 years with in a little over 2 months and the part-time I'd been with since 2015). My employment verification was done a month before closing via email in which HR had to keep informingthey couldnt release info because the lender wasn't providing a signed ROI and she had to send 4 emails reminding them they needed to send it and after 2 weeks they finally did what was required ( still over a month prior to closing date) .Original closing was set for june 24th and pushed back 3 times. I set up utilities and bought things for the particular home spent THOUSANDS ( over 5k) of dollars including the inspection and appraisal. I scheduled movers, took off work ( had to keep changing and recalling pto because they kept switching closing date). I ended my lease at my current residence and my storage lease. Once the appraisal came back it came back for lower than i offered, with the *** loan that was the last opportunity i had to get out of buying and not lose my ******* money and the lenders last opportunity to tell me they wouldnt offer me the loan but of course they didn't. Instead i asked the seller to lower to appraisal amount and they did. Fast forward to a week before closing. I had just caught the bug but didn't know it i get a call from ******** stating i can't close and they cant offer me a loan because i hadnt been with my 2nd part-time for 2 years ( they verified employment months prior.So I couldn't close because i no longer had a lender. I lost $3000 ******* money,$400 inspection fee, $850 appraisal is all im asking to be returned and not including all the other money lost due to their negligenceBusiness Response

I am rejecting this response because:
Everything mentioned is a completely inaccurate and exactly why im in the situation im in because they company doesnt listen, lies, misleading and clearly isnt competent in their field. The screen shots i show do not show anything was declined it clearly shows it was charged , and with fraud protection it needed me to verify and i did and notified ******** that i approved it. In addition the amount charged is the amount your loan officer ******** advised in which was charged with supporting evidence in the screen shots of text messages from ********. I never asked for anything to be placed on hold. The issue was i was gifted funds and advised i would be ahead of time and ******** stated id only need a letter from gifter to later be told they wanted the gifters entire running bank statement. She wanted url present on statement and for security the bank doesnt offer that so she asked i get them teller stamped. I told her i could get my own stamped but not the gifters and the gifter was unable to take off work so i may have to wait until the next pay day and not use the gifter funds. ******** told me that was ok to just get mine stamped and she'd " magically " make the stamp appear on the gifters statement ( i have all of this in text message but unable to uplaod this far in complaint but can provide if not resolved and goes to litigation) What i placed on my application was accurate in addition to the w2s i provided for each employer and my entire tax return. You spoke to the director ******** T ( director of my previous employer AEC in 2020 in which i only held ONE postion) who confirmed my employment (although im no longer employed there and the company was bought). I explained to ******** several times that i had 3 different employers all in healthcare and attended school 2020 ( AEC and Seton ( only current 2nd employer). I also explained to her that although there were 3 different w2s its the exact same company and each location is owner in partnership by different doctors. Regardless of whom required the earned money due to rose lending negligence, lack of due diligence and incompetence I lost the funds solely as a result of Rose lending companys actions and 0 of my own. Another lie told was that i wasnt able to obtain a pre-approval but clearly the pre-approval pre qualified letter was submitted with this complaint. Furthermore discover confirmed that due to fraud prevention it was initially declined until they notifed me and i gave consent. The appraisal company tried again an hour later and it was approved, 3 hours after approval the appraisal company refunded the card.

I am rejecting this response because all monies lost are a direct result of **** City Lender and no other oustide individual or company. I'm simply asking for my ******* and inspection money back lost not inclusive of mental health medical bills incurred as a result of this matter or mental anguish or the additional monies lost I can't recover spent towards the property that wasnt obtained due to *****************.

I am rejecting this response because ***************** again isn't being honest. The ******* money was not refunded to me and no one told you that via email because it never happened and I confirmed with ***** at alamo title company no email of such was eber sent to you in addition the release of ******* money which is the official legal document clearly shows the ******* money went to the sellers because of lending failing due to again ***************** negligence. I wish rose city lending would have some ethics, morals and integrity for once and make their wrongs right. I lost $3200 for ******* and option fee!

I am rejecting this response because: it's very evident at this point that both CMG and Rose **** have zero integrity and are filled with lies and back pedal when the truth is presented ie. ******* money. I'm not sure if the comprehension skills are non existent but I'll reiterate because that seems to be the fact. I only lost the ******* money due to CMG's incompetence and negligence and therefore it is their obligation to refund the ******* and option fee, however if it can't be resolved here with BBB Ill advise my attorney file litigation with the courts and allow them to determine the negligence after presenting the abundance of evidence I have of correspondence with the loan officer from their team. I want to ensure that no one else is done the way I was done by CMG and will do. You clearly verfied both my employers as a Paralegal with the state of texas and my part time employer months prior to closing and should have disclosed you were unable to offer me a loan prior and because you ******** failed to do so I lost a significant amount of money in addition to my mental health.

I am looking to close the Escrow Account and get the Escrow Waiver because of a constant mismanagement of funds:First, CMG Financial failed to pay supplemental taxes obligations due on January 3, 2022. I learned about it when I received a delinquency letter from the tax collector, which was upsetting and disrupting. The tax collector also added a late fee charge that CMG is not willing to cover. I had to cover the supplemental tax out of my pocket because CMG would not pay for it alleging there were no enough funds, even though there were over $4000 available.Then, on February 16, 2022 CMG misplaced $426.98, that was not returned to the account until May 20, 2022.CMG Financial stated they paid some tax obligations on February 3, 2022, but records indicate they did so on February 16. Furthermore, those obligations were due on May 2, 2022. They paid it almost 2 months in advance.Lastly, CMG account projections keep being completely wrong (twice in less than a year), making it impossible to plan accordingly. We are now requested to add $1096.99 for a future shortage of $80, in April 2023.CMG Financial denied the escrow waiver request stating that the loan to value requirement must be under 80%, and now it is at ****%. I am requesting to waive those requirements due to the mismanagement of funds reoccurring constantly: omission of tax obligations, misplacement of funds, pay obligations two months before they are due and miscalculation of future obligations are all solid reasons to request the closure of this account.Business Response

We bought our house with CMG in February using a USDA loan. After the purchase, we started doing work to the kitchen and our neighbor started putting huge trees in the driveway blocking access. It turns out, they approved a loan with no legal driveway (the driveway that is there isn't even the correct material!) or rights to easement even though they were supposed to ensure we did have those basic things. Everyone I speak with is saying it's not their problem at CMG that they sold us a home that doesn't even qualify with the basic requirements of a USDA loan. We can not move in and at this rate will lose our first home because we can't sustain paying our huge mortgage and huge rent and we can't leave our family homeless! It's disgusting that we are experiencing this because of CMG's lack of due diligence and will probably have to go into bankruptcy hiring a lawyer!Business Response
