I requested BigSky Club to cancel my subscription on 1st September since we were moving to different state

As a proof I attached the rent agreement our new apartment with the signatures of (Members and Apartment Owners) but we still get a response from them that the details are not valid.

I tried to highlight the requested details (names of required parties in agreement but I still receive the same response) .Though the request to cancellation was raised but I was being charged on 19th Oct 2023 and we released(after checking in the Gym)

Now since they has still not accepted by proof documents I will again be charged for the month of November 2023.

I'd been having issues to cancel my gym membership but customer services had been very unhelpful with me and being very unresponsive I'd like to cancel this gym membership as soon as possible.

      We’ve researched Edward
Cahua-Hernandez’s membership and see that he would be able to cancel his
membership at any time with a 25 day written notice to our billing company, ABC
fitness, but as of the date of his letter (9/18/2023) he had not yet supplied
that written notice and still has not as
      of today (9/25/2023).

We will submit a request to
      cancel the membership for Edward.

His final bill date was on
9/20/2023 giving him gym access until 10/19/2023, and no further action is
      necessary on his part.

I moved to *** ****. Called the gym to cancel and was told I had to call a third party service. They weren’t open until the end of the holiday weekend and when I called I was told you cancel via email and it takes 30 days so you’re still liable for any membership payments. I sent the email and contacted the gym management number given to me and spoke with Holden. He stated that he’d cancel my membership and I’d avoid any further billing as long as I emailed a piece of mail with my new address. I still got charged and when I called Holden acted as though he’d forgotten that he said I wouldn’t be charged and said he’d contact the gym manager for approval. Two weeks later I sent a follow up email and was told they denied the request.

I told the person I signed up with behind the desk that I was looking for a month to month plan. And they put me in a yearly plan forcibly without my authorization. I called to try and have to corrected and they told me to contact the club. I did that . They tell me to contact the number that told Me to go to the office . I they are sending me in circles and charging me while they do it . This is an otter scam . And this needs to be investigated. I am no the only person they are doing this to . I payed month to month until may once I realized I received a charge for 100$ for a plan that’s supposed to be “30$” a month. At this point I just want out of the big sky program entirely . I don’t want to do business with scammers

      We have looked into *****
******** agreement and have found that they have signed up for a membership at
their home or online outside of a Big Sky Facility, not in the club as they
stated in their complaint.  The membership
options are clearly stated as 12 month commitments online before they arrive at
      the actual membership sign-up.
Additionally, it is mentioned in the sign-up process on the contract
before they complete the agreement that the membership is a minimum of 12
      months.

      ***** currently owes Big
Sky $169.34, however, we have waived the late fees that were added for
non-payment, bringing their past due balance down to $116.84. ***** has
actually only paid for one month of membership since they joined on
3/02/2023.  They have never paid $100 as
      stated in the complaint.

      It looks like ***** does
still have 11 months remaining on their membership that they would still be
responsible for, unless they are relocating at least 15 miles from a Big Sky
location or if they need to cancel due to medical disability. We do not allow a
cancellation for a busy work schedule.

We do offer an option for
members to transfer the balance of their memberships to another non-member for
a fee of $25 as well.

Big Sky has committed no errors or
misrepresentations with regards to ***** ******** membership agreement, and we
expect that they live up to their signed-on responsibility as we always live up
      to ours.

I am rejecting this response because: I just want to cancel after I made a payment . The next charge was 86$ once I seen the new bill. I stopped going once I seen the bill. I don’t want anything to do with this company . Just close my account . The cancellation processs is designed to bring people who don’t want to to stay with them in debt . And pocket off of it . It’s a scam. The 3 other gyms I’ve been too are nothing like this . As previous mention. I signed up for a monthly . No contract . But I’m in a contract and yo get out I have to move ? That doesn’t make any sense . Good look to any future numbskulls willing to fall into this obvious trap

My reason for canceling my account is due to a disability that I have. When I joined, I signed up for personal training and disclosed my injury to the trainer. Unfortunately, the trainer continued to give training exercises that I was unable to perform due to my injury. The trainer also seemed frustrated that I could not perform certain exercises. On day one, I disclosed my injury history with him and he never made it a point to remember. This was extremely unethical and really took all of my confidence and ultimately I stopped going. Knowing about contracts, I paid for the remaining trainings and canceled future trainings. I went 3 times and I felt extremely uncomfortable. I would like Big Sky to provide the total cost needed to cancel this account and I will issue payment. I would hate to get attorney involved for the disability and race discrimination that I experienced ay Big Sky in *********.

I had called to cancel do to the fact the my schedule with work, school, and my internship and me not be able to make it to the gym because I’m not able to make it for the hours they have the gym open. I was told if I send in my school schedule and work schedule etc my membership would be canceled. I never got a response back from that and I’m still being charge till this day and still not able to make it to the gym hours because of my work a school schedule. I would not recommend signing up for big sky because they will have you bind to a contract that no matter what’s going on in your life they will continue taking your money for their own benefit. Cancel my membership big sky it’s not that hard! I can’t make it to your crappy gym hours!

      We’ve researched Aljenae
*********** membership and found that they did originally join Big Sky on 8/10/2022
in which they received 2 months free, and their dues began in October 2022.
They joined for a 12-month agreement. We’ve attached a copy of the agreement.

      It looks like ******* does
still have 3 months remaining on their membership that they would still be
responsible for unless they are relocating at least 15 miles from a Big Sky
location or if they become medically disability. The agreements don't allow for cancellations due to busy work
schedule and Big Sky has not changed it's hours since ******* has become a member.

As a courtesy, if ******* would like to transfer the remaining months of membership to someone else we'll waive the normal $25 fee.

Big Sky has committed no errors or

I am writing to file a complaint against Big Sky Fitness, a business located in ********, **. I believe that the company has engaged in unfair business practices and I would like to request your assistance in resolving this issue.
Around Jun 2022, my 15-year-old daughter enrolled in the gym program online using my credit card and my name. However, my daughter was the actual user of the gym facilities. In September of the same year, my daughter was no longer able to attend the gym and we contacted Sky ***** Fitness to cancel her membership. However, we were informed that the membership could not be cancelled due to the exit clause in the terms and conditions, which stated that the membership could only be cancelled if the member moved 15 miles away from the facilities or if they suffered from a long-term disability.
I found this exit clause to be unreasonable and stopped paying the gym fees. Recently, I received a collection letter requesting payment of the outstanding gym fees in the amount of $324.69 without explicitly explaining how the fees were calculated either.
I believe that the exit clause in the terms and conditions is excessively restrictive and makes it difficult for members to cancel their membership. Furthermore, the details of the exit clause were buried in the terms and conditions, making it difficult for my daughter to notice when she enrolled online.
I also noticed that many people were complaining about unreasonable cancellation policies. I would like to request your assistance in resolving this issue and holding Big Sky Fitness accountable for its unfair business practices.
Thank you for your time and consideration.

      We’ve researched ******
**’s membership and found that she did indeed join Big Sky on June 24, 2022 with
a 1-year membership term, she also received her first 2 months free of dues
      with a 12-month commitment.  We’ve
attached a copy of her agreement. (Please note that it specifically states 12
      payments.)

One year gym memberships are not unfair
fair business practices, and in fact, commonplace. ****** used Big Sky for 4
months, and only paid for two months of dues and neglected to pay her annual
fee.  Mr. ** also stated that he
contacted Sky ***** Fitness, perhaps he contacted the wrong gym, as that is not
our name. When Mr. ** decided to stop paying for the gym membership, he signed
his daughter up for, it resulted in the account being sent to our Collections
Agency.  Because ****** is a minor, we
will remove her account from Collections status.

Big Sky has committed no errors or
misrepresentations with regards to Ms. **** membership agreement, and we expect
that she will live up to her signed-on responsibility as we always live up to
      ours.

My 15 year old daughter signed up for what she thought was a student gym membership. Big sky only allows signing up online. She accidently signed up for a regular membership for 1 year. She is 15 and the contract is not valid but the gym will not cancel the membership. We would like to cancel the membership. I have a 19 year old with the same issure but she was over 18 so I am not sure if that can be canceled.
      ******* ****** + ****** ****** are their names.

      We’ve researched *********
membership and found that she did join Big Sky on 6/04/2022. She joined during
a membership promotion which gave her 2 months free as well as a start-up fee
of $0, when the member signed up for 12 months.

      Ms. ****** opted for a
year long commitment, even though for students (ages 13-22), we also offer a one-,
two-, three- or four-month membership at the club. Students age 13 and older
are able to join Big Sky and use all the same amenities as adult members, with
no restrictions. The memberships were done online at home and therefore, Big
Sky has no way of knowing if the membership was signed with or without a
      parents’ supervision.  The membership has
a credit card in ******* ******** name, her mother.

      We’ve honored the father’s
request and have canceled ********* membership going forward.  As for ******, she’s not a minor so she’ll
have to complete the term of her membership agreement.

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.

Comments:  Big Sky was aware of ********* age because she physically went to the gym explaining she was in high school and wanted a summer membership.  She was told everything had to be done online and she can get 2 months free - tricking her into selecting the 1 year contract instead of the student membership online.  I attempted to visit the gym in person to correct the mistake but was rudely turned away and was told to email the online 3rd party - which to me is a way for Big Sky to hide these disputes by hiding behind another company.

Also it said no set-up fee but I was charged an annual membership anyway - which to me is a set up fee.  I accept the contract cancellation but do not appreciate the poor business practices and taking advantage of kids.  With all the bad reviews on BBB I am surprised they can still get away with their business practices.  It is too bad they have to operate this way.

      Sincerely,

      **** ******

I’ve been trying to cancel my membership due to me being restricted from the gym dr orders. I need two or three knee surgeries starting September 26th and will not be able to attend the gym for up to a year or more. I’ve given them plenty of proof my drs have even reached out but no proof is good enough and to be honest it’s really not their business all they need to no is I am not able to be in the gym and have no attended for 5 months due to injury of my knee. They legit will not let me cancel. *** ******* customer service told me I could cancel they then reached out to the gym manager who said I couldn’t cancel I could only freeze my account. I told them to freeze it until my membership was up in March 2023 the customer service told me I wouldn’t be charged for the months it was frozen. I then look in my emails and find the email from after the phone call saying my account is frozen but all the monthly charges while it is frozen will add up to the end. This gym is a big scam. I don’t no why they make it so hard for people going threw actual hardships to cancel.

      We’ve researched ******
*****’s membership and found that they did in fact join Big Sky on 1/10/2022. We’ve
attached a copy of their agreement.

      It appears that ******’s
account is currently frozen until March of 2023, and if their Doctor
recommends, we can freeze as long as is necessary. While it is frozen, the
member is not paying anything, and any months frozen will extend the length of
the agreement by the same number of months. It does clearly state in ******’s
membership agreement that memberships in contract may only be cancelled due to
relocation further than 25 miles from a Big Sky location or due to permanent
disability. While we are sympathetic to ****** needing to go through multiple
knee surgeries, it is not considered a permanent disability and ****** will
need a gym for rehabilitation more than ever upon return from surgery.

Big Sky has committed no errors or
misrepresentations with regards to ****** *****’s membership agreement, and we

A local gym invited my minor daughter to subscribe to a gym membership. when she wanted to cancel, they refused and demanded that she continues to pay for the remaining 12 months. Also, they kept harassing her with emails and threatened to send her to the collection.
I contacted the management by email and phone and explained that what they are doing is illegal because a minor can't be held accountable for any contract or agreement anywhere on this planet, and they still refused to cooperate.

      We’ve researched *****
************* membership and found that she did join Big Sky on 9/03/2021. She
joined during a membership promotion which gave the new member 2 months free as
well as a start-up fee of $0, when the member signed up for 12 months. We’ve
attached a copy of the agreement.

      It looks like ***** does
still have 1 month remaining on her membership that she would still be
responsible for, unless she is relocating at least 15 miles from a Big Sky
location, or if she needs to cancel due to medical disability.

      Ms. *********** opted for
a year long commitment, even though for students (ages 13-22), we also offer a one-,
two-, three- or four-month membership. Students age 13 and older are able to
join Big Sky and use all the same amenities as adult members, with no
restrictions. Her father, who is the author of this complaint, is also a member
of Big Sky and also joined on a similar membership promotion where he received
3 months free, and coincidently was present at Big Sky at the same time as
      *****’s membership sign-up.

Big Sky has committed no errors or
misrepresentations with regards to Ms. *************
membership agreement, and we expect that she live up to her signed-on
responsibility as we always live up to ours.

I am rejecting this response because: Could you please read the details of my complaint? The business response doesn't add anything to what I already mentioned. IT IS ILLEGAL TO ABIDE CHILDREN BY CONTRACTS. IT IS ILLEGAL TO EVEN SIGNUP CHILDREN FOR A GYM MEMBERSHIP WITHOUT THEIR PARENTS CONSENT. IT IS ILLEGAL TO HARASS CHILDREN WITH COLLECTIONS.

      Sincerely,

      **** ***********

      We are sorry that Mr.
*********** feels this way. Many minors sign up with their parents account
information, either in person or online, and in the case of *****, she actually
signed up with a credit card which was in her name, and her father was present when
      she joined.

      ***** used the membership
regularly, and paid for her usage.  Does
Mr. *********** feel that his daughter should have received a free membership
because she is a minor ?  Again, we have
many minors who sign up for membership and reciprocate by paying for such
      membership.

      As a courtesy, we have
cancelled *****’s last remaining month of membership.

Once again, Big Sky has committed no errors
or misrepresentations with regards to ***** ************* membership.

      If Mr. *********** is still
not content with this resolution, we can also cancel his membership, as a
      courtesy.

I am rejecting this response because: This is not true. I wasn't there when she signed up and never gave consent. Do you have a proof of that? Please present it. It is not about the money. It is about your illegal practices of signing up children without their parents consent and harassing them with collection. You should be held accountable for that.

      Sincerely,

      **** ***********

At this point it’s just amusing the Mr. *********** continues to
reject our answers that are just the truth.  Mr. *********** was in the building on the same day around the same time
that his daughter signed up and our proof is our computer system that tracks
the check in’s.  But Mr. ***********
would rather continue to complain that we should not sign up young adults.  We’re 100% sure that Mr. *********** was well
aware that his daughter joined the club because she was using it for
months.  Did Mr. *********** think that
she was just using the club for free ?  Didn’t he ever question his daughter on what type of membership his
daughter had ?  And coincidently her
membership was the same membership that his son has had for the past 3
years.  It’s obvious that the only reason
Mr. *********** started this complaint was because he was looking for a reason
not to pay for his daughter’s membership.  That's probably why he and his son continue to patronize the business on a regular basis.
