I signed a contract to replace pool cage destroyed by Hurricane *** with Fabri Tech on 10/10/22. Wrote and mailed a check for deposit of $5328.00. The check cleared my account 10/18/22. In March (7) I started calling or emailing to see where I might be on scheduling. The "mailbox is full" was a constant. Calling through the main number I was able to leave voice mails but still no reply. I finally spoke with *** on 4/4. I was told they were running about 4 weeks out following final measure. Employees were sent 4/5/23 to perform the final measure. May came and went without a word. As I had neighbors providing access for me, I decided not to involve them in this debacle. Upon my return to *******, 6/23/23, I started my phone calls. .I was promised last week in July. After days trying to verify we were still on target, On 7/26/23, I called ******************** to discover that no permit had been filed for my address. I emailed the salesman to terminate my contract. I got phone calls!!! With promises! After 3 months experience with lies, I am done. I asked that my deposit be returned within 5 business days. It has been 8 business days and the deposit per the office staff has not been sent. "They'll probably send it soon." is what I'm told.

Hello, ************** the office is processing your refund still. We should have it out in the next day. As you were told we would refund all monies given less the work that was completed for you. Yes we are extremely far be hide as the area has seen a large amount of damage enclosures out there from the storm and we are doing our best to keep up the demand for new enclosures. I'm sorry the communication was not up to your expedition. We strive to communicate as much as possible when information is available. Once again we are sorry were not able to complete your project as planned per your request to terminate the project.

We signed a contract with FabriTech in February of 2022 after receiving approval from our ***. The ***************** rejected the first permit due to setback requirements; the second was rejected again due to setback requirements. In May of 2022, a third permit was approved for an 8 x 40 enclosure, a size much smaller ( 14 x 40)than our signed contract indicated without informing us. They came and dug up our backyard and began placing the forms for the footer. When we reached out to them, we were told that the Village of ****** approved, again with no explanation. We halted their work until we could get things straightened out with the Village of ******. In July, once I found out that a variance was needed, we completed the paperwork, and the variance was granted in January of 2023, and I notified Fabri Tech. The concrete work was poured in March and inspected at the beginning of May. In the meantime, I received a notice from my *** for an unsafe job site and a potential fine. They removed the forms and rebar. It is now July 26th, and I am still waiting, and again, I have received notification from the *** for non-compliance. Each time I phone Fabri ************** if they answer, I"m told I need to be patient because of the hurricane, and I am referred to my salesperson, who is not timely with responses. But this appears to be the company's standard of operation. Again, I am facing a fine from the ***, and I am still waiting for an answer on when I can expect the enclosure to be installed. Mine is not a small job; even with the minor variance issue, it should not take a year and a half to complete. I promptly paid my deposit and the invoice for concrete work; we would like the same consideration for finishing the installation.

On 11/23/2022 I signed a contract to have my pool cage replaced. I paid $4,884.00 on this contract and was told it would be a few weeks. Well it's now July 24th, 2023 and I haven't heard a word from the company. I've tried calling and if and when I get someone, no one can give me a date as to when I can expect something to happen.

We signed an order for a pool cage in August 2022 and paid a deposit of $7,212.13. Construction should start in November 2022. Unfortunately, after Hurricane *** hit ******* on 09/28/23, the start of construction was delayed. From December 2022 we tried several times to get in touch with Fabritech without success. All emails went unanswered. On 01/13/2023 we received advice from the lawyer *************************************** and instructed her to have an assembly date fixed in writing. Since we were on site ourselves for 4 weeks from 04/05/2023, we asked for construction to start on 04/06/2023. This was then also confirmed by Fabritech. Unfortunately construction did not start on 04/06/2023. Several phone calls from us and ************************* were necessary for the construction workers to come on 04/10/2023. They did the preparation for the foundation and left the site on 04/11/2023. Another two weeks and countless calls later, the concrete for the footer arrived. The next construction workers came only after we had repeatedly asked for them on 05/01/2023 and laid the travertine. The cage itself was only started after we left on 05/22/2023. We received the invoice for the remaining payment on the same day, even though the work had not yet been completed. One door and the lanai window trim were missing. All work was finally completed on 06/19/2023. Unfortunately, our guests who were on site during the unannounced assembly of the cage reduced our rent. We have deducted this reduction as well as the legal fees incurred. Now Fabritech has registered a lien on our house. We expect that this will be deleted and the cost of our work will be deducted from the final bill.

    Business Response

    Date: 08/01/2023

We will not deduct the cost of the invoices from final payments as an attorney was hired prior to ** beginning the work. We were in the middle of one of the largest most destructive hurricanes to have ever hit the US. We would have been happy to refund the customers deposit and let them go elsewhere to have the work done before we started the job.

    Customer Answer

    Complaint: 20338072

I am rejecting this response because:

That doesn't correspond to the fact. We hired the lawyer because we weren't getting any replies to our emails. The point here was that it didn't start and we weren't given a start date. If we hadn't hired the lawyer, the cage probably wouldn't have stood to this day.

We are aware that the hurricane did a lot of damage and that's why it took longer. That was never the problem, but that we didn't get any answers. Also, when asked what it would cost us if we canceled the order, we never got a sum. Except that the costs for the permit and the architect have already been incurred. That's why we had the cage built.

We were also promised a start date, which again was not met. We also don't understand why assembly wasn't possible within the 4 weeks in which we were there ourselves.

We offer you to still transfer the $1000. With regard to the reduced rent of our guests, we ask for a credit note. It was really more than enough time and we also knew when there would be guests in the house again. It could certainly have been timed differently.

    Sincerely,

    *******************

Even before we closed on our home last May, we signed a contract with Fabri-Tech for our lanai. ******* was super quick to schedule an appointment and full of knowledge. He was the best part of this whole process We paid 1/3 of the project as a deposit (about 5k). In September, they showed up and started working on the patio. We had zero knowledge that they would be coming, but they did a great job. They left a little mess, but it was fixable. As of that date, they have collected all of our money (remaining 10k) and the only remaining project is for the screen to get installed.Fast forward to July 2023, now 15 months after we signed our contact. No one from the company has ever followed up with us about the status of the screen. My husband followed up from time to time, getting contradicting information. I then emailed our rep at the beginning of June. I have emailed every week for our records, and still no update. She has not answered the past 2 emails., and it has now been 1 month since I originally reached out with zero help. I work in **************** myself, and this would never be acceptable. **************** should be there to help and make the process easier, not turn it into a nightmare.

My wife and I met with the FabriTech salespeople at our home to discuss the addition of an Elite roof to our home and the refitting and reconstruction of the pool cage around our existing pool in January of 2022. This work is similar to jobs that have been done in our neighborhood by FabriTech. To start the project, we signed an agreement and sent the deposit Check in February 2022 for 30% of the project cost. We then started to work with our *** to get approval. We received approval from the *** to proceed in August of 2022.The project was initiated by FabriTech in October of 2022. On October 26, ********************************************************************************************************** preparation for Elite roof installation. The next day, October 27, 2022 the same two men came and installed the Elite roof. One mentions that the usual time frame for cage completion is two weeks after measurements are taken, which is the next step. On October 31, 2022 one of the FabriTech crew came out to take the measurements.Since the end of October we have not been able to get a status or an estimate for when we might get completion of the project. Its now going on 7 months since the project was started and our pool cage has remained partially open. We dont understand why the project was started if there wasnt a clear path to getting us completed within a reasonable timeframe. We are unable to even get a return call or a return email. We are seeking completion of the project. We understand that many business such as this are extremely busy but we are looking for a time frame or estimate for when we can expect to be completed.

I am replying with in the 10 days as requested.  The work is not completed as the business indicated.  It appears that some material was delivered yesterday and was left on the front lawn.  Hopefully it will be completed today or tomorrow at the latest.

The initial reply was targeting last Tuesday or Wednesday.  I do appreciate some movement on the project but am concerned about complaints from neighbors if this is not done soon.

We signed a Notice of Commencement for installation of a screened patio on May 09 of 2022, we paid a progress payment of $2142 when concrete footer was poured on 22 Nov. 2022. (Six months later was a unacceptable delay)I have gone to their office in **************** three different times to complain and check on progress and seem to get the same results, nothing. They do not answer the phone, the voice mail boxes are full and I am unable to leave a message. The only reasonable contact I have is to drive to their office. I have asked them if I owe them money?? No. Still no progress. Maybe you guys can contact them to see if they are still in business??

We initiated a lanai project with Fabri-Tech on January 12, 2022. We supplied a check of $5500 on January 18 2022, to get things going. The company deposited it on January 20, 2022. It is now 14 months later and we are still waiting for the lanai to be completed. The foundation and travertine patio was installed in December 2022 and that part was immediately paid for by us. We didn't understand that we would have to pay piecemeal throughout this process even though they have our $5500 down payment. The total estimate is $15,865. We've heard all the excuses and reasons why they are so backed up. But it is aggravating to know that new pool builds are getting their lanais long before ** non-pool residential customers. We, like others we know, have called, emailed, and texted and have at times been treated badly. We want them to finish the job now. This is ridiculous.

    Business Response

We are very far behind, and it got even worse than the hurricane, your contract clearly states that there is a down payment a deck payment and a final  payment so this  should not have been a surprise. My last step-father (passed away in May 2022) signed a contract October of 2021 (w / down payment of 8k paid in Dec. '21) to replace the pavers and pool cage at the back of the house. The Notice of Commencement was sent to the Village of ****** around August 18, 2022. The pool cage was removed and pavers project is complete; however, the pool cage has not been installed yet. The new owner of the house (purchased Jan 25, 2023) spoke to Fabri-Tech on 2/20/23 and they said they are waiting for a crew to be assigned to the job. Most of the time the General Manager, the Sales manager, office staff state that it will be a couple weeks. They (including the owner) all have been contacted numerous times and are well aware of this project / job being well over-due to complete. In addition, the Sales Manager called me about needing a final payment for the paver project in order to schedule the pool cage project and stated the the project would commence as soon as the payment was received. He also stated the components were on a trailer and ready to be delivered. I sent the payment (cashier's check) a few days later. The Sales Manager acknowledged on Nov 2, 2022 that it was received and I have not heard from him since.I truly believe Fabri-Tech is taking on more lucrative jobs due to the demand coming from the hurricane victims. In the meantime, the new owner and the Estate are suffering as a consequence. The total contract for the pool cage is $19,533 in which $29,299.50 (total cage contract + 150% **** per the Property Purchase Agreement) is being held in escrow at the title company and will be forfeited to the new owner soon if the cage is not installed in due time.

In March of 2022 we initiated a screen enclosure project for our front and back lanai areas. We issued a check for 11k ish for a deposit in April of 22. . Nothing happened until I called in October requesting to cancel the order (weve decided to put house on market. This was explained to Fabritech) when we were told it could be completed by December. So we decided to continue w the project. Now its February and we are sitting with a half completed project and no lanai at all.now they have ****** of our money. And we cannot put house on market. And no insight from Fabritech as to when we can expect completion. They explain that the pool company jobs get priority and cite staff shortages. These people continue to advertise for new business yet cannot fulfill even the most aged contracts.

We are expecencing major delays not only due to contracted work with the pool gc being extra busy before the storm. We have had many issues with aquiring additional labor to help with the extra ampunt of work added. I will reach out to the homeowner today and give an update.
