We met with *************************** of HIGHER POWER SOLAR LLC, sales rep for SUNERGY SOLAR LLC August 31, 2022, to discuss purchasing solar panels for our house. I took several notes during our meeting capturing the details that ****************** had told us. ****************** was referred to us by our neighbor who had solar panels installed just days prior to our meeting. We were told that when we did our tax returns for 2022, we would receive a $28,000 tax rebate check from the government for purchasing clean energy and that we would sign this check over to SUNERGY SOLAR LLC for payment towards the purchase and installation of the solar panels totaling $70,939.00 over a 25-year period at ****% rate. Payments would be withdrawn from our checking account from GOODLEAP, a third-party financial institution. If we chose to keep the check for personal purposes, our monthly payments would increase from $201 per month to $291 per month. Our present electric bills run up to $390 per month depending on the season. This is before the recent energy price hike. A savings of about $200 each month. We were assured that there would be no out-of-pocket expenses. We had our tax returns completed in ***********, **. When questioning where it was indicated in the returns of the $28,000 tax rebate check, the agent sat ** down in a conference room and explained that the government doesnt provide ** with a check but with a tax credit of only $21,000+ payable to only ** over a 4-year period. The agent indicated this was a case of FRAUD. We contacted ****************** and he proceeded to tell us that we misunderstood him. After an unpleasant discussion he said we owed this $28,000 to SUNERGY SOLAR LLC within 16 months of the solar panel installation or our monthly payments would increase to $291. Whole sales pitch was fraudulent and deceptive as we are liable for $28,000 OUT-OF-POCKET payable to SUNERGY SOLAR LLC. We're looking at financial ruin!!!! Want out of contract and solar panels removed!!!

Higher Power is a Sales companmy they writes up contracts with home owners depending on the needs and wants of the homeowner, they ************ contracts us Sunergy to install and maintain the system after install.

On 9/9/2022 we filed the NOC

On 9/18/2022 we got approval from the *** to move forward and we scheduled the install 9/20/2022

from 9/20/2022 we called to get the inspection scheduled and we couldn't get all parties involved together due to conflicting schedules of the home owner and the inspector until 12/6/2022 and scheduled for 12/8/2022 and we will get results 12/9/2022. which we passed.

from 12/7 - 12/19 we had to wait on the customer to sign applications for us to move forward, we filed the paper work same day 12/19/2022

12/20/2022 we mailed out a reimbursement for the loan payment the homeowner made. "MAILED OUT REIMBURSEMENT FOR 1 LOAN PAYMENT $201.86"

on 2/1/2023 We got PTO permission to operate which is required by law top go through the utility company.

because of the delay in the net metering application on 3/9 we "MAILED OUT REIMBURSEMENT FOR 1 LOAN PAYMENT $201.86"

As far as the sales rep telling the home owner how much the tax credit is we have no knowledge of it, but we do have some text from the rep to the home owner we have attached.

At this time the customer system is up and running and everything we have been contracted to do is done!

I am rejecting this response because:

First, the timeline provided is mainly correct. The Sales Rep stated that we would be reimbursed for solar panel payments to GoodLeap while solar panels were still not in operation.  We contacted the Sales Rep directly and we received only two of four reimbursements requested.

Second, you are aware of the Sales Rep's conversation with ** regarding the $28,000 Tax Credit "Check" from the government for purchasing solar energy as you are in possession of the letter and materials sent to you via **** Certified & Return-Receipt.  We are in receipt of the Return-Receipt card with signature of receipt.

To resolve this matter, we, the homeowner, want:

      - The solar panels removed from the roof/house

      - Repair of our roof after solar panels and brackets are removed. To be inspected by the ******************* Building Inspector that roof was properly repaired. Roof was only two weeks old when solar panels were installed.

      - Desolve the $70,938 contract with GoodLeap

      - Desolve the $28,000 owed to GoodLeap of the so-called Tax Credit Check promised by the Sales Rep. ***** the Sales Rep ******** ** that we were getting a physical check and to sign that check over to GoodLeap towards payment of the solar panels, our monthly payments are now HIGHER THAN BEFORE THE SOLAR PANELS WERE INSTALLED.

If the above resolution is not agreed upon, we have no problem taking this matter public to include HIGHER POWER SOLAR, LLC, SUNERGY SOLAR, LLC, and GoodLeap.

This company has been a complete headache to work with. *** called emailed texted with workers and still nothing has been settled. My roof was repaired by them after storm because I would lose warranty on panels if I went elsewhere but now the panels damaged arent covered under warranty all of a sudden and they have me paying monthly for panels that are not connected or working. They also had a dumpster company knock on my door with just me and my newborn home to aggressively complain they were scammed and Sunergy will not pay them for the dumpster in my driveway and he would not take it until it was paid. The job was supposed to start Feb 21 it didnt actually begin until March 2nd and its still not done as of April 14th2023. They had me pay for work in full they havent completed going on 3 weeks now on top of not fixing damaged panels as my warranty is basically useless. *** tried calling to get it settled but I have no other recourse then to come to here to make others aware of the work they do or lack there of. Also the things promised for my panels was all a lie. My best advice if they come to your home trying to sell you panels slam the door as fast as you can.

Prior to the storm the homeowner didnt we mentioned we actually reimbursed them for the loan, we also had a hard to time get things scheduled with the home owner, but we finally did and got the system up and running on 8/11/2022

On 10/6/2022 Unfortunately a Hurricane hit and the home had damage by the storm, Originally they told ** they only had 1 solar panel that was damaged.

On 10/10/2022 We sent a tech out to diagnose the system (free of charge, we have a $399 service fee) and it was actually A couple panels shattered, and the cords are ripped out. There is damage to the roof as well. Possibly needs a re roof. I sent the documents so we can get the Public Adjuster sent out to evaluate damages.

On 1/13/2023 the home owner decided to move forward with the re roof and, they mentioned to ** over the phone that they were waiting on insurance money before they could put a new roof on. Because of the huge effect in the area things took much longer to order and receive materials, to schedule for dumpsters, to get crews to travel due to so much damage and material being scarce.

On 2/21/2023 we were only able to schedule the removal of panels & re roof, we had issues a dumpster truck we had got into an accident and we had to reschedule a few days out, the home owner was not happy and expressed that and we completed everything 2/24

on 3/9/2023 the roofing inspection passed and then we were able to schedule the reinstall of the panels 3/22/2023

the Home owner didn't feel they should be responsible to cover the act of God, aka the hurricane that destroyed the roof, and some of the solar system.

on 4/11/2023 We decided to take the loss and sent a crew out to resolve the issue

on 4/20/2023 we resolved all issues and everything is up and running as it should be!

April 2022 - Nice young sales person solicited and I agreed to **ntract. He promised there were weekly meetings, project management and regular updates. In reality, I have never been able to get anyone at this **mpany to return a call. People answering the phone can ** firm they see all the times I've called.Contracted in April. Panels installed in November. Inspected and not installed as per requirement. Had to move a section in order to pass inspection. It's now one week before the one year anniversary of signing date, and the work is still not finished. And I can't get anyone to tell me when they will be done. A rep showed up randomly one day to activate the service and was surprises the electric wasn't done. Promised to help schedule. Nothing. Today, 4/13/2023 - the City advised the electrical permit application hasn't even been submitted yet. I've called every other week for the past 4 months - and no one **uld tell me this? Today is also the day when I have ceiling water damage from last night's rains. Right below where the panels are installed. 2 hours ago, I was told someone would call me back. Just called again, no one even knows who is the overall project manager of my ac**unt. Have I paid out any money yet - no. But this whole process has been a **mplete waste of money and labor. Who is funding Sunergy, that they have no sense of urgency to see these **ntracts through? And now I have a damaged roof - which was near brand new when they touched it. I want the panels removed. I want my roof restored. I want my ceilings fixed. I want Sunergy to get a better understanding of customer service and project management. And I want a thorough investigation of their business and business model/plan/finances. Something is not right here. I do not re**mmend this **mpany at all.

This was an unfortunate event where an installer stepped on an area he shouldnt have and then didnt report it to use to handle right away we were unaware until the ********* called to inform us on 4/13/2023

On 4/14 We send our crew out to evaluate and they couldnt find any damage and or water marks in the attic or around the solar panels on the roof.

we went back out 2 more times to do dry wall prime and paint the damaged areas to make this right with the customer.

on 4/21 Unfortunately the roof wasn't actually fixed and the leak happened again, we sent a crew out but we couldn't see where the leak was coming from to completely fix it.

As of 4/28 so we hired a roofing contractor to help resolved the issue by to go out to assess the issues  when it was raining and fix them,

since then we have had no issues and we have our warranty that is still active as well. for the future.

All micro inverters where over surged. ****** states that the Enphase micro inverters are not warrantied in the event of a power surge. I am well aware of that. My system has surge protection that was installed by Sunergy with Sunergy logos on it. They sent me a bill for the micro inverters and even included cost for labor. How does this not fall under the warranty from Sunergy for installation? I have read the contract. All they told me was that there "service tech" said that the micro inverters where fried from too much power. This company installed all the components for this system and fried micro inverters has resulted from their installation. I have contacted Sunergy customer care and service manager. It is truly appalling that this is up for discussion. This is the worst business i have ever had to deal with. Feels more like a scam than anything. I can see why ******************* ended there partnership with Sunergy.

The equipment we installed doesn't protect against power surges from the utility company.

The customer needs to speak with Enphase and their local utility provider.

Last February, 2022 a pleasant young man from Sunergy Solar came unsolicited to my house selling solar panels. He promised that by going solar my FPL bills would be eliminated, except for a connection fee of about $10-12 per month. From the onset I told him and his trainer that I had to replace my roof, but they said not to worry about it, to just call them when I was ready and they would come over and take them off and them back on after roof was replaced. They never mentioned there would be a fee for this. I called about 4 months ago to have the solar panels removed so my roof could be replaced and they told me it would cost $2,244 to do the job and $633 for an extra solar panel (I requested the extra panel because my average FPL bill was $80 at the time). I was so upset that I didn't want to talk/communicate with this company agin, but I contacted them again to have my panels removed because I really need to replace my roof. This time they said that it would cost me $4,488.00. I emailed them asking if this was a mistake and a week later they replied stating that pricing went up this year, that labor and material costs have risen so they have to update their pricing accordingly. I would understand an increase, but double in just 4 months!? I was afraid to ask how much an extra panel would cost. Going back to the promises...The salesman promised that I would get $10,000 in tax incentives and that I should wait until this year to claim it. It's actually just over $8,000. They told me the total cost was going to be $30,000 but it's truly a little over $34,000. They also said it would be very easy to get home insurance. This is not true, either. I called my solar rep but he denied having made any of the promises I mentioned above. The rep told me that if I they replaced the roof then I wouldn't have to pay for the removal of the panels and they would replace my shingle roof for $21,840. I already have a company that quoted me $16,800. This is a deceptive company.

      Business Response

First I want to say we build proposals around the homeowners current electric bills and the average they have over the past 12 months, if that average changes and they consume more it is not accounted for.

In this case unfortunately ****'s home is now consuming much more electricity, maybe due to leaving lights on, or maybe the hotter months we've had, maybe an upgraded TV or appliances, we do not know but from the electric bills if you look you can see the home is now consuming more than when we gave the proposal.

If ****'s home were using the same amount of electricity then this would be true. We have tried to explain this to **** and offered to do an energy Audit for him to show him this but he has declined.

We include Removal and re-installment of the panels if we are to do the roof job for you, if someone else does it yes we have a fee, we have to coordinate with them, and work around there schedule and its not as seamless if you were to have allowed ** to do it for you.

**** decided he wanted another company to do his roof for him so we charged him $4039 to remove the panels one day with a full crew, then to return another day to reinstall them, then to diagnose the system and get it back up and running with a technician.

**** would not provide ** the other company's quote so we could try to match, as well as he would show ** the material or product to help ** compare apple to apples and not to oranges....

As far as ******************* going up if he keep using more electricity and FPL has rate increases ****'s bill will continue to rise because of this, We offered to install panels for free if he were to buy more panels at cost, but to this point **** has declined.

As far as tax returns, you  get a 30% tax credit and we highly recommend that everyone consults there Accountant or verify the tax rebate because some wont get it and other may have to spread it out over 2 or more years. This is something we tell everyone and if ***** estimate of income was off this can happen all the time but it doesnt mean he wont get the credit it just means he will have to request an extension because he didnt have enough income to get it all in 1 year. We have explained that to him but **** is certain he was going to get a larger amount. we are not tax professionals.

I enlisted Sunergy Solar to install additional solar panels to my existing system. During the process, I showed them the existing install and how it should be done with a tile roof. They AGREED they could install panels on a tile roof like what I had originally. What I got was NOT what I paid for.Pictures clearly show the less than professional installation they did on my roof.I did not go up and inspect the work, I should have! but I did not. The state inspector did not go up on the roof or he would have seen the horrible install they did.The removed the tiles, installed a bumper style bracket to my roof which is incorrect for a tile roof. They did not put back the roof tiles as instructed. Instead, the used some flimsy aluminum c*** that did not properly fit or seal my roof. NOW, my roof has been exposed to elements unprotected and the aluminum is coming undone leaving even more of an exposure..I demand they fix this problem and they responded with "it passed inspection".DO NOT USE this company for anything related to Solar!!!!!!!!!!!!!I am now having to hiring an attorney and *** them for all costs associated with the fix along with the support contract I will now have to pay for related to the fact they are not reliable as a company to handle any type of repair to my system. On a Further note, the rep I worked with during the install was good enough to get a team out to fix the wiring they royally messed up and was not to code. I had ******************* exposed in my garage attic there we definitely a fire hazard. Now that she is gone, NO ONE there cares to fix or make right what their incompetent teams of so called experts did. I cannot believe what I saw when I went up to clean my solar panels of Pollen.See for yourself!!

I had solar panels installed in July 2022 by Sunergy. These panels have not worked since day 1. Every 10 of the month I pay a monthly premium of $167.38 for panels that have never worked. I have contacted this company on multiple occasions asking what the issue is and why they are not working. After Hurricane *** hit in September 2022, I contacted the company and they sent someone out to check the panels. All this person did was take pictures and nothing has been done since. Every time I email the company I get the response this issue has been escalated and we will be in contact. Im over it at this point. We got these solar panels to help lower our electric bill and value to our house. The only thing they had added is stress! I want out of this loan/contract and move on.

      Complaint: ********

I am rejecting this response because:

Ive had panels on my roof for 9 months that do absolutely nothing. I keep getting the response we are working on the issue clearly you are NOT. As for my loan payments I have to send in a screen shot of my bank account to you to even get my refund! Not have I received my payment back since the beginning of January! Im over this runaround and games Im tired of paying a monthly premium and now paying a higher monthly payment for my electric bill due to the increases which is the whole reason I got the solar panels to avoid that situation! Im over this company and the bs that we have been dealing with for 9 months. I do not want these panel, I want out of the loan and move on!

      Sincerely,

      ***********************

Sunergy has costed us thousands upon thousands of dollars and refuse to take responsibility for their mistakes. We spoke to them yesterday and the conversation did not go well. They gaslighted ** and told us that we were producing MORE than enough energy from the solar panels, our usage was just high. We agreed that our usage is high but we are actively working on getting this resolved. However, we checked our bills and the monitoring system and we are only generating around 140 kWh to 250 kWh the past few months and the most ever was around 440kWh. They said 140 was more than enough for a home! Meanwhile our neighbors are averaging from 850 kWh to **** kWh! The average home in ******* uses around **** kWh per month so in the 3 years weve been using Sunergy they never ever offset our electric bill or came close to it. They took no responsibility for the lack of output coming from their panels and kept pointing fingers at our usage. We said we get the usage part but we are NOT OUTPUTTING enough. We were promised we would pay $30/month at most for our electric otherwise they would add more panels but we have never seen a bill anywhere near that. Probably never under $150 from the electric company. They will not come look at our panels to see if they are working or add more. They will continue to take your money and give you the run around for years until your warranty expires and theyre in the clear. We do not want these panels on our home and would rather go with a different company. Our bills the past few months have been $790, $645, and $485 for electric plus our payment for the solar panels. The amount of emotional turmoil and financial burden this company has caused our family is absolutely ruthless. They do not care about their customers.

I want to apologize if this process has been frustrating, thank you for reaching out. I reviewed your account and your monitoring system, I attached a screenshot from the monitoring portal as well. It looks like your system is producing an average of **** kwH or more per month. Based on the full year usage of 2022 you averaged **** kwH every month. If you want us to look more into this, we can do a utility bill evaluation. Please send the past 12 months of Utility bills and we can review them. Please send them to **************************************** Thank you.

I paid over $34,000 for solar panels to be installed. That is not the issue. The issue is there is not enough and in the contract it says they would install up to 3 more if I was not generating enough energy to run my home. Last year I was only 33 % grid independent. I've sent in my electric bills as was requested over a year ago. They kept telling me I was producing enough and did not need the panels. So again I sent them in last year. They did not respond via phone or their support email. I asked what would happen if I found as the year went on that I needed it once the year was up and he said they would honor it. I requested the 3 extra panels within that first year. They still said I did not need them. I disagree. I want this company to make good on their contract agreement.

This company has ruined our life. Literally. We are now going to be filing bankruptcy all due to this company. I had 53 panels installed 3 years ago. I was promised by the sales rep after seeing my electric bills that 53 panels would be more than enough to cover our electric bills plus bank some, so I would only pay a connection charge each month. I pay $375 a month for my solar loan ($77,000)and thought wow what a great deal! My average electric bills ran around $300 in winter and $600 in summer, which the sales rep saw and knew. My panels have NEVER generated more than $180 in any given month! Who in their right mind would agree to pay $375 a month to save an average of $175 off their electric bill? If my panels produce $200 a month (and that's stretching it as it never has) it would take me 43 years just to break even on my loan! So after 43 years (when I am 83 years old) I would THEN start seeing savings! I pay so much more now than I did before going solar. I have fought with them for 3 years. They (**** and ***** mostly) have lied and said several times they'd come measure my roof and add another 40+ panels plus upgrade my current panels at no charge to help generate more power. They sent someone out twice to measure the roof and once they realize how many more panels it will take to help us they stop responding. They're at the point where they won't even respond to me now. Check the BBB reviews and see that over 80 other complaints are EXACTLY the same as mine! This company will tell you that they're putting enough panels to cover your electricity, but the panels don't even generate what you're paying for the loan, then tell you sorry we said in the fine print we won't guarantee how much power they generate. I would be satisfied with having the solar panels only generate what I pay each month for the solar loan of $375 so I'd break even each month and not save anything. They rob you blind! Horrible company.
