Five Late Payments are on my credit report, July, August, September, October and November 2016. I paid off the loan and was told these bad marks would not be on my credit report. I am asking that Lendmark Financial honor that agreement , as we are in good standing and remove the marks. In July 2016, I was removed from my home, and forced to pay 60 percent alimoney, plus child support. I walked into Lendmark, talked about it, was told if I took another loan to cover this one it would not be on my credit report. I have done my best to make amends, and I would appreciate it if Lendmark Financial came through on their part and made these red marks go away.Business Response

Thank you for bringing this to our attention. Lendmark had the opportunity to review the complaint and will address each of the customers concerns as follows.
Lendmark has completed an investigation into the customers, *******************, dispute and has submitted a request to each of the three credit reporting agencies (CRAs) that we report to, to delete the tradeline associated with the 0218-000072 loan account. Please note that the CRAs are separate entities from Lendmark and Lendmark does not control the amount of time it may take for the CRAs to process this request. If 30 days have passed since the customer received this correspondence and the customers credit report does not reflect this change, we ask that the customer contact ** in writing at *********************************************************************.

I have payed off all my accounts with Landmark Financial well over a year and a half ago. I still receive publications via postal mail and harassing phone calls from them on a daily basis despite me explaining to them I no longer what to be on their contact list nor want to have anymore business with them. I just want all contact to stop at this point!Business Response

Lendmark Financial Services has violated my consumer rules under the ****.Lendmark has furnished an account to the credit reporting agencies without my written instruction. To whom it may concern, Lendmark had the opportunity to review the complaint and will
address each of the customers concerns as follows. The customer, *************************, entered a
loan agreement with Lendmark Financial Services on November 26, 2018. At the
point of sale, the customer was given a copy of ******************* Privacy Policy to advise the
customer of what information can and cannot be shared. As stated in the Reasons we can
share your personal information section of the privacy policy it states: For our everyday
business purposes such as to process your transactions, maintain your account(s), respond
to court orders and legal investigations, or report to credit bureaus; or as permitted by law.
Does Lendmark Share? Yes. Can you limit sharing? No. Lendmark has only shared the
information which was outlined in the Privacy Policy. Should the customer want to limit the
types of sharing, they can call ************ for further information or questions. The
customer was provided with a credit disclosure in addition to the loan agreement and
privacy policy. The credit disclosure outlines Lendmarks intentions as it relates to credit
reporting: Fair Credit Reporting Act Notice: We may report information about your account
to credit bureaus. Late payments, missed payments, or other defaults on your account may
be reflected in your credit report. The Fair Credit Reporting Act requires that Lendmark
accurately report information to the credit reporting agencies. As the information reported
to the credit reporting agencies regarding your account was accurate, Lendmark is unable

I am rejecting this response because: The **** creates statues that creditors has to abide by. If your practices are going against federal statues that are placed to protect the consumer and creditor, no matter whats stated in your agreement it is still against federal law.The law states a creditor can not furnish an account without the consumer written instructions. So if your agreement states we are going to furnish an account without your written instructions, than that is illegal and you have written proof of a federal statue that you all are breaking.

I first opened the loan in ******************************************************* even behind. On October 2021 I was having Financial trouble and was behind on my loan payments. The loan company offered to help, and as the advice of the loan advisor they talked to me about re-financing and the ways it would help so I accepted. Unfortunately for me this did not help me at all! As of now I am in a new loan and owe $1,000 more than the original loan! I find this predatory lending practices as she offered me BAD advice on purpose. On top of this in May of 2022 their manager verbally agreed to remove $600 worth of interest if I paid $388. The record will show I made the payment and they did NOT remove the interest! I would have just kept my original loan and eventually caught up my payments. They preyed on me needing help and talked me into a bad loan with a higher interest rate on purpose. I intend on paying my loan, but they gave me bad advice to keep me in debt and make their company more money and this is not right! I feel like I have been scammed into a bad loan!Business Response

Thank you for bringing this to our attention. Lendmark had the opportunity to review the complaint and will address each of the customers concerns as follows.
The customer, *************************, entered a new loan agreement with Lendmark Financial Services on October 25, 2021 when the customers previous loan balance was paid through renewal. The customers new original balance was $4,416.18 which was financed for a term of 48 months with a first odd payment of $203.96 and monthly payments of $173.79, starting on December 1, 2021.
The customers interest for this loan is calculated using the daily simple interest rate. This means that interest accrues on a daily basis on the unpaid portion of the principal balance. When the customer makes a payment, the interest that is due from the date the last payment was received, will be collected before any portion of the payment is applied to the principal.Therefore, if the customer is unable to make full payments on their due dates,they will have to pay more interest than they would have if they paid on time.It is even possible that if the number of days between the payments is too great, the amount of interest due may actually exceed the payment amount resulting in no reduction to the principal balance that month, as the entire payment will be applied to the interest due.
On July 12, 2022, after the branch had received a call from the customer, the Assistance Vice President of the region called the customer to discuss how the interest for this loan accrues and to review the outstanding interest balance with the customer. The Assistant Vice President was unable to reach the customer but left a message on their voicemail.
As of the date of this response, the Assistant Vice President has not received a call back from the customer. ****************** encourages the customer to call the Assistant Vice President back at ************ to reach their office or ************ to discuss the interest situation further.

Lendmark charged my bank account a second time after I made a payment in person resulting in my account being overdrafted. Lendmark was notified and asked to reverse the charge but the representative refused saying first that there was no such transaction in Lendmarks system then saying there was and asking for bank statements that show the transaction and overdraft fees, and that if I came into the office it'd be taken care of. I sent that information and drove in from Concord to ********* only to be told that the bank information was insufficient decays it didn't have my name. I pulled up my bank information on my phone and showed the representative. She said it has to come from a bank. I then sent bank statements that showed everything requested. At that time Lendmark was responsible for ****** plus ***** in overdraft fees. All legitimate transactions that day became overdrafted due to Lendmark running my account negative. It has been 3 days and Lendmark is now still refusing to reverse the undue charge and my account has gone nearly **** in overdraft penalties due to lendmark charging my account with no payment due.Business Response

Thank you for bringing this to our attention. Lendmark had the opportunity to review the complaint and will address each of the customers concerns as follows.
The customer, ***********************, entered a loan agreement with Lendmark Financial Services on December 29, 2021. The customers original balance was $7,094.46 which was financed for a term of 48 months with a first odd payment of $269.52 and monthly payments of $244.30, starting on February 3, 2022. When the customer also authorized a recurring Automated Clearing House (ACH)transactions by signing a Recurring ACH Form to start drafting on February 3,2022.
On February 2, 2022, the customer called and advised they would like to make a payment early. During that call the customer advised they would like the recurring ACH to be canceled and commence on the March 3, 2022, payment. For payments in March through June 2022, the customer has made their payments though the recurring ACH agreement.
On June 30, 2022, the customer visited a ****************** branch in *********,**** to make a payment on the loan. On July 3, 2022, as the customer was on recurring ACH, another payment was pulled for the account.
On July 7, 2022, the customer called ****************** to advise the second transaction caused the customers bank account to overdraft and the customer advised they have accrued overdraft fees in a result of the July 3, 2022,transaction. Lendmark advised the customer that we would have to be able to review the customers situation for possible remediation but asked the customer to provide a bank statement showing both transaction balances and the overdraft fees that were accrued as a result of the second transaction.
The customer initially provided some screenshots only showing one of the transactions and the documentation did not have the customers name nor did the documentation highlight the balance of those transactions or overdraft fees that were a result of the Lendmark transaction. The customer advised to the branch that they did not want to provide the bank statement with the information required to investigate this situation.
The customer called the ****************** branch on July 8, 2022, to request that the recurring ACH on this account be cancelled and Lendmark has removed the recurring ACH from the customers account.
Lendmark encourages the customer to provide a bank statement showing the customers name, the transaction amounts, and any overdraft fees and provide that document to the ********* branch.
