the balance of $197.74. Please note that
this is for bundled services and all equipment charges are not included in the
balance Afni is collecting upon.
The account is for services established on August 1, 2020,
until ******* considered the account delinquent on May 5, 2022. The service address associated with the
account is *** ********* ***** ******* ********* **** ***** ***** ****** ** *****, which is the same address the consumer listed on this
complaint. Afni mailed the initial
notice of the account on or about September 11, 2022. On November 6, 2022, Afni furnished the
credit reporting agencies with notice of the account.
On December 1, 2022, Afni received this complaint. This was Afni’s first contact with the
consumer. In response, Afni ceased
communication and initiated an investigation. Afni has attached copies of the
account billing statements to this response; these are provided as validation
of the account. To address the
consumer’s concerns, this complaint is the first notification Afni has received
from the consumer regarding a dispute on this account. A signed contract is not always required to
initiate ******* services, as orders for services can be taken over the phone
or via the internet, which are considered verbal and electronic signatures,

I recently reviewed my credit report and Afni Inc is reporting to the bureaus on an account that continues to show as valid. I am disputing this now as I have no dealings with this company. I am not liable for this debt with Afni Inc if there is any (it is showing as $369). I have no knowledge of this company or its existence. I have not been provided with any original contract stating that I owe them any amount of money or that I have signed any contract with them. I also have not given any verbal, written, or electronic authorization to report anything to my credit reports. I am demanding that this information be deleted immediately as it is affecting my financial abilities. Due to this hindrance, I am unable to further obtain credit, increase credit, and to lower my current interest rates and monthly payments.

AFNI, INC.failed to notify me about reporting derogatory info. to Equifax, Experian, and Transunion In section 603(p) 15 U.S.C. ss 168s-2(a)(7)(A)(I); “The notice required under subparagraph (A) shall be provided to the customer prior to, or no later than 30 days after 03/26/2022, furnishing the negative derogatory information to a consumer reporting agency described in section 603 (p),’ 15 U.S.C. ss 1681s-2(a)(7)(B)(I). Plus broke commercial law under UCC § 9.501 that all notices were timely and properly given by dated certified mail receipt. They were not met. I asked for documentation & received no response.
Also, AFNI, INC." failed to give me my "Mini-Miranda" five days prior to placing this derogatory item on all of my credit reports, per Section 807(11) & FDCPA §809, which is $1000 per violation and the state of TX allows treble damages.
Under § 809. Validations of date and Mini-Mirandi under Section 807(1)AFNI COLLECTIONS,*** ****** ** ******, President/COO failed to send me my initial communication before placing this alleged derogatory status on my credit reports further violating the FCRA, I understand that according to the Fair Credit Reporting Act, failing to provide this notice can result in a penalty up to $2500 and can be enforced by the FTC, and that my state attorney general can also enforce this with a $1000 penalty as well.

concerns, Afni mailed the initial notice on or about March 8, 2022, with no
notice of returned mail. The initial
notice contains the mini-miranda. When a
consumer submits a dispute through the credit reporting agencies, Afni responds
directly to the credit reporting agencies. Therefore, Afni has complied with its obligations. Afni will send a request to the credit
reporting agencies to remove the account from the consumer’s credit
report. Please be aware that it can take
the credit reporting agencies anywhere from 0 to 60 days to update consumer
credit reports. Afni has no control over
how quickly the credit reporting agencies update consumer credit reports. However, this does not mean that the account
is not due and owing, simply that Afni will no longer furnish the account to
the credit reporting agencies. Afni

I got a collection notice for account #************ stating that my company, Twigs and Thyme, did not pay the ****** account and is owing $1368.34. This account goes back to 2018. I or my company have NEVER had any accounts with ****** and do not owe them a single cent. We pay all our bills on time and this is a fraudulent account and does not belong to us.Business Response

This is in response to your BBB inquiry. Afni appreciates the opportunity to respond
to the consumer’s concerns. On September
8, 2022, ****** forwarded the subject account, ****** account #: *********, Afni, Inc. account #: ************, with Afni for collections on
the balance of $1,368.34.
The account is for services established on February 6, 2018,
until ****** considered the account delinquent. Afni mailed the initial notice of the account
on or about October 24, 2022. Afni has
not and will not furnish the subject account to the credit reporting agencies.
On November 9, 2022, the owner of the business spoke to an Afni representative
and stated that this account was the result of fraud. On November 10, 2022,
Afni mailed the business a fraud packet which details how to have the account
investigated as identity theft fraud.
On November 10, 2022, Afni received this complaint. In response, Afni ceased communication and
initiated an investigation. To address
the consumer’s concern, the account was updated as potential identity theft as
the owner denied knowledge of any service with ******. Afni encourages the owner to visit ******'s
fraud website at ********************, which discusses the process and
documentation needed for the fraud investigation. Placing a fraud alert with
the credit reporting agencies is a suggestion and not required to investigate a
fraud claim. The consumer may also
contact ****** directly if they have any questions regarding the fraud process
at ***** ********* Again, Afni has not
and will not furnish the subject account to the credit reporting agencies. Afni trusts this response has addressed the
consumer’s concerns, but if questions remain, or if they would like to discuss

As stated in my complaint, this is not my account and I will need a letter stating same from the collection company and ******. I have already reported the case as identity theft with ******.
