Dear Better Business Bureau and Mr. **************************** name is **** ******, and I am the President of Overland Bond and Investment Corporation. I am writing in response to the complaint filed by Mr. ******* D. ***** regarding his purchase of a used vehicle financed through our company on October 26, 2021.
First and foremost, I want to express our sincere apologies for any distress Mr. ***** has experienced regarding his vehicle.
To summarize the situation: Mr. ***** purchased a used vehicle with a 30-day warranty provided by the dealer. At the time of the sale, the dealer encouraged Mr. ***** to consider an extended warranty for additional coverage against potential mechanical issues, which he ultimately chose to decline. Unfortunately, after eight months of ownership, Mr. ***** began to experience mechanical problems with the vehicle and expressed his desire to swap it for another unit.
As a financing company, our role is to provide loans to customers for vehicles they select. We do not sell vehicles, and we cannot dictate to the dealer the terms of a sale or facilitate a swap of collateral, particularly after the expiration of the warranty period. The purchase of a vehicle, especially a used one, inherently carries risks of mechanical failure, and it is standard practice in the industry to recommend extended warranties to mitigate these risks.
While I understand that unexpected repairs can be burdensome, I want to clarify that it is not the lender's responsibility to cover maintenance or repair costs for a vehicle post-sale. We have a hardship department in place to assist customers who may be facing financial difficulties, but choosing not to fulfill one's financial obligations is not a viable solution.
We appreciate Mr. ******* business and are committed to assisting him with any financial concerns he may have regarding his loan. I encourage Mr. ***** to reach out directly to our customer service team or our hardship department to discuss his situation further. We are here to work with him to find a reasonable path forward.
Should you need any additional information or clarification, please do not hesitate to contact me directly.
Sincerely,
Zury Rivera
President
