I was trying to access EV chargers at your ******************** location at 12:52am on 11/10/22. Gates were up around the mall. I stop at one of the gates and it listed the number to call EV Charger Access ************ and security asked where I was, and they stated that they would send someone security over to open the gate. I called 10 minutes later since no one came, and I was told there would be no access since the chargers were unavailable. The Electrify America app stated that the charging station was open 24 hours, and that the chargers were available. The security crew called a supervisor who said access was at their discretion. There are many red flags here. I called Electrify America and they said the chargers are open 24 hours, but some properties won't allow access. Simon Property Group should not have an "EV Charger Access" sign if you have no intention of letting someone in. There should be coordination between Simon and EA to not misinform the public that a charging station is available and "lure" EVs with limited range to come to your combined facility. It's potentially very dangerous where you would leave people stranded. Your security staff feigned compassion, even though a truly compassionate person would open the gate and allow access. This seems like a lawsuit waiting to happen. Someone runs out of range after being denied in subzero temperature. That's not where I am going with this. Just get it right and fix it. Yes, I do think that I am owed a sincere apology for my treatment in the wee hours of the morning today.Finally, I might guess that you have received some tax break or incentive for putting a Public Charging station in your mall. That's why I think you have the sign on the gate - for compliance. There is something wrong here. Fix it.Business Response

Thank you for giving us the opportunity to respond to the allegations raised in your complaint. ** charging stations are accessible 24/7 at ********************.
After the stores and restaurants close for the evening, all entrances to the mall are secured. The entrances are then re-opened at 6am the next morning. At each gate, there is signage indicating that anyone wishing to use the ** charging stations after hours must contact security to get access to the property. We have spoken to security and reviewed the current policy on accessing the ** charging stations. Therefore, this situation should not occur going forward.

I write as Legal Counsel to Humane Long Island, a nonprofit educational and advocacy group. Simon Property Group has a clear policy of not permitting the exhibition of animals on its properties. https://www.peta.org/blog/simon-says-wild-animal-acts/ Yet on November 3, 2022, *************************, proprietor of the ****************, exhibited sloths, which are nocturnal wild animals, in the parking lot of ***************. ****************** has pending criminal charges in the ************* for illegal possession of wild animals, change of use without a permit, prohibited use, and illegal occupancy as well as in the ***************** for erecting an unpermitted structure believed to be a tiger cage. ****************** is also the subject of several animal cruelty investigations, including one for tasering a tiger under his care. ****************** and **************** are the subject of a temporary restraining order (Order) issued in the *************, which is where he exhibited the sloths in violation of multiple town ordinances. I am legal counsel for *************** and Simon Property Group. Neither *************** nor Simon Property Group had a lease or any other type of agreement with Mr. ************;to display, sell, or exhibit sloths or any other animal or wildlife or for any other purpose. Further we were not aware that ****************** was onsite at ********* at any time including on or about November 3, 2022. Had we been made aware of this activity, *************** management and security would have taken steps to prohibit this.
Finally, if we become aware of any such activity in the future, rest assured that it will be immediately addressed.

According to ******* Statute *******, otherwise known as "******* Deceptive and Unfair Trade practices Act," following the federal Uniform Deceptive Trade Practices Act, which allows for consumers and enforcing agencies to file suit for deceptive and false trade practices like *************** advertising, when a business, in this case Simon *************** in ********* *******, ********************* filing representative and ****************************, General Manager, promised one leasing price only to later disclose and demand a higher figure, after the business moved into the space assuming the lower rent offered.This prima facie case exposes Simon MM, INC. of repeatedly promising to rent space at an offered price only to later demand a higher one after move-in. The renter interviewed other kiosk tenants and they related the identical ruse of baiting them in at one rent price, only to later demand a rent increase under the purpose of "paying a ******* sales tax for kiosks." In addition to using the fraudulent ************* maneuver, Simon, after I moved in, began construction on center court where I was situated, cordoning off traffic and curtailing normal foot traffic and healthy commerce. I asked for help, for relocation as it was clear I would not make rent due to construction interference. Simon MM promised they would move me, dragged their feet until the first of the month, hoping I would again pay the higher than advertised rent despite failing to address concerns. Renter is asking for termination of the lease and a full refund of $500 deposit. Complaints are simultaneously being filed with ************* regulating agencies, including but not limited to the office of ***********************, State Attorney General, and the ************************ in ****************Upon advice of legal counsel this filing is the basis for related state and federal lawsuits under the Unfair Trade and Practices Act and the Uniform Deceptive Trade Practices Act, respectively.Business Response

We will agree to terminate your Lease effective August 31, 2022; which is the date that you vacated the kiosk with no rent or taxes owed. We will also agree to refund you the $500 Security Deposit that you gave at the time of Lease execution. In exchange for terminating the Lease and refunding the security deposit, we require you to review and sign the attached document signifying that (1) the lease is terminated; (2) Simon Property Group will refund the security deposit to you; (3) you will not have any further debt or obligations to Simon Property Group; and (4) you release ******************* and Simon Property Group from any and all claims you may have in connection with your lease.

On July 9th, I placed an order on https://www.simon.com/giftcard in the amount of $4035.60 for eight (8) $500 gift cards. This order was confirmed via email. I later received an email on July 13th stating my order had shipped (attached) again confirming the pricing for eight (8) $500 giftcards + fees and delivery.On July 19th I received Seven (7) $500 giftcards in the mail and immediately reached out to the company to resolve the issue of my stolen $500. I received a response asking for the proxy numbers of the cards I DID receive. After providing the proxy numbers requested I received no response and can only assume the company has no interest in helping me resolve the issue of the stolen $500.I also attempted calling the phone line on 5 occasions, following instructions outlined on their website to reach a representative (attached). The instructions did not work, and there was no way to report a card loast or stolen without the 16 digit card number. I obviously could not provide that information as the card was never sent to me.$500 is a significant amount of money for an individual to be left high and dry on and I would like help holding Simon Property Group accountable.Business Response
