This is a complaint against Synerprise Consulting Services for violations of the Texas Finance Code. On June 7, 2023, I sent a dispute letter requesting verification of the debt associated with the account numbers ************* ************* *** ************. Despite my timely and valid request, debt-buyer, Synerprise Consulting Services failed to provide the necessary verification documentation within the 30-day period, as required by the Texas Finance Code. This violation allowed Synerprise Consulting to continue collection activity on the alleged debt, resulting in statutory and actual damages to me. I respectfully request that this debt collector immediately ceases all collection activity related to the disputed debt and promptly removes any negative reporting on my credit bureau file. On June 2, 2023 Synerprise Consulting Services used my bank account info to fraudulently withdraw $213.44 from my checking account for a debt that was paid off in 2022. I did not authorize SCS to withdraw funds from my checking account this year. My account was already paid in full.Business Response

Please be advised that Synerprise Consulting Services, Inc. has investigated this matter. The payment ran on 6-2-23 was a clerical error. We had initially setup a payment plan with the consumer in March of 2022 and the account was to be paid off on 6-2-22. The final payment was accidentally set up for 6-2-23 instead. We will refund the $213.44 to the address provided the BBB, but will wait 10 days to make sure the check is not returned. This will bring the balance owed back to $213.44. The basis for my dispute SYNERPRISE CONSULTING SE, Date: September 14, 2019, Account#: ********* Amount: $3,654, SYNERPRISE CONSULTING SE, Date: September 14, 2019, Account#: ********, Amount: $9,601, - was required to notify me prior to 09/14/2019,09/14/2019 or no later than 30 days after. SYNERPRISE CONSULTING SEfailed to notify me about reporting derogatory info. to ******** ********* *** ********** In section 603(p) 15 U.S.C. ss 168s-2(a)(7)(A)(I); “The notice required under subparagraph (A) shall be provided to the customer prior to, or no later than 30 days after 09/14/2019, furnishing the negative derogatory information to a consumer reporting agency described in section 603 (p),’ 15 U.S.C. ss 1681s-2(a)(7)(B)(I). Plus broke commercial law under UCC § 9.501 that all notices were timely and properly given by dated certified mail receipt. They were not met. I asked for documentation & received no response. Also, SYNERPRISE CONSULTING SE" failed to give me my "Mini-Miranda" five days prior to placing this derogatory item on all of my credit reports, per Section 807(11) & FDCPA §809, which is $1000 per violation and the state of Texas allows treble damages. Under § 809. Validations of date and Mini-Mirandi under Section 807(1) Synerprise Consulting SVS, **** ** ***, Owner failed to send me my initial communication before placing this alleged derogatory status on my credit reports further violating the FCRA, I understand that according to the Fair Credit Reporting Act, failing to provide this notice can result in a penalty up to $2500 and can be enforced by the FTC, and that my state attorney general can also enforce this with a $1000 penalty as well. Synerprise Consulting Services is causing damage to my credit score for something I have no knowledge of. This is a violation of rights under the Fair Reporting Credit Act and I would like this removed. Not only do I have no knowledge and this is inaccurate, it is also a duplicate on my report. We show the original charge as $2349, there were payments/adjustments totaling $2117.64, leaving the amount of $231.36. This information can be further verified with the consumer's insurance company by requesting an explanation of benefits from 9-21-21. On October 20, 2022, Synerprise Consulting SE received my dispute letter requesting verification of the debt they are reporting to the credit bureaus as account number ************. I did recall having any obligation to any creditor in the amount they claim I owe. As of today, I have not received a reply to my request for verification of the account the debt collector is reporting to the bureaus. The debt collector violated 392.301(a)(3) of the Texas Finance Code when they continued collection activity on an account they failed to validate after they were notified in writing within the specified 30 days. I am respectfully requesting the prompt removal of the account from my credit report. I am making every effort to resolve this matter without presenting my case before a courtroom jury in my community. I look forward to your cooperation in this matter.Business Response
