On June 24, 2025, in the morning, an individual called my telephone number and woke me up. He did not identify himself or state his reason for calling. He asked for (my wife's name). The only reason I gave the telephone to her is because she is a medical professional whose clients sometimes call my number. The caller immediately went into a typical scam dialogue. She hung up. I consider this a harassing telephone call and a dishonest invasion of my privacy. I traced the number to Berlin Wheeler in Topeka, Kansas. Neither one of us owes any unresolved debts to anyone and we have not received any proof of any debts.Business Response

Please see attached.At the time of the call, our representative followed standard procedures to confirm the identity of
the person we were attempting to reach. As part of this process, the representative asked to speak
with the individual associated with the account. Once the call was transferred, our representative
began the process of identifying themselves and the nature of the call as required under
applicable debt collection laws. The call was then terminated by the recipient.
We had no prior indication that the phone number was not associated with the intended party,
and the call was made in good faith as part of our standard account resolution process.

Berlin Wheeler falsely stated that there had been written notice. AFTER the complaint was filed, Berlin Wheeler finally sent a copy of the debt that they claimed was owed. The case may be closed because we will pay the bill to the creditor. Berlin Wheeler should try to change their procedures to be accurate, more honest, and not so hyper aggressive out of the box.Initial Complaint

I had written a note disclaiming this debt when I last received a letter, and without acknowledgement of my correspondence, Berlin-Wheeler continues to harass me. I'll go ahead and copy the text of the letter sent here: I am in receipt of a letter from your office demanding payment in an amount of $84.59. The “creditor” is listed on the claim as ******* ****** **** & ********, the alleged account number ************. I know of no debt owed to this entity, so deny owing it. Your letter , having no merit, has already been annoying enough, so I thank you in advance for closing this file." In addition please provide the contract signed between COX COMMUNICATION, notarized and sworn under penalty and perjury for BERLIN WHEELER, INC ability to collect this alleged debt. 12 CFR Part 1006 - Fair Debt Collection Practices Act (Regulation G) § 1006.2(g) Definitions. (g) Creditor means any person who offers or extends credit creating a debt or to whom a debt is owed. The term creditor does not, however, include any person to the extent that such person receives an assignment or transfer of a debt in default solely to facilitate collection of the debt for another. 12 CFR Part 1006 - Fair Debt Collection Practices Act (Regulation F) (2) The term debt collector excludes: (i) Any officer or employee of a creditor while the officer or employee is collecting debts for the creditor in the creditor’s name; (ii) Any person while acting as a debt collector for another person This account are inaccurate under 15 U.S.C. 1692g validation of debt. In October 2022, I was ended my service with *** Communications, and it was communicated to me that there was no further payment made on the account as long as I returned the equipment (modem), which I did. In early 2023, a debt collection with Berlin Wheeler appeared with a $0 balance, with *** Communications being the original creditor. There was never an account in collections, and neither *** Communications nor Berlin Wheelers did, nor have done their due diligence to correct an error that was clearly made on the part of the original creditor.Business Response

This is not a duplicate complaint and does not have template language. I made the complaint against Berlin Wheeler and *** communications separately on BBB as I was unsure who the complaint goes to. I received an email back already from BBB saying they can not find *** communications as a company and that the debt collection agency is who I should go through, so I am.

03/21/2024, was opened using the same demographics as provided by the consumer in the
making of the complaint.
Copies of the original billing is also being included in response to the BBB complaint with the
same referral to id***********.com. Please complete the identity verification form and submit the

My rights have been violated by Berlin Wheeler Inc as I did not provide written permission to the creditor to include any information on my credit profile, in accordance with 15 USC 1681b2. Furthermore, their actions appear to constitute Aggravated Identity Theft under 18 U.S.C. §1028A. They have knowingly transferred, possessed, or used my means of identification without lawful authority, which is a felony punishable by up to 2 years of imprisonment, in addition to potential civil liability. I have sent Berlin Wheeler notarized certified mail and still have yet to receive a response, and still see this error on my credit report.Business Response
