Pursuant to 15 U.S. Code 1681b - Permissible Purposes of Consumer Reports, any information reported on my consumer report requires explicit written consent. Mariner includes an initial disclosure regarding credit reporting in the **** Act Notice and in the Privacy Notice, both of which were provided to Ms. ****** at the time her loan was originated, and annually as required. To further clarify, credit reporting is clearly identified in Mariners Privacy Notice, and in 15 U.S. Code 6802, as a type of sharing that cannot be limited by a consumer.

I took out a loan with Mariner Finance four years ago and used my car as collateral. I paid the loan on November 7, 2024 and have yet to receive my title. I keep calling them and they told me that they sent the paperwork. I have never received anything. I called them in December, January and February *************). I went to a title place cause that is what they told me to do and they gave me a paper saying that it is the document that they need to fill out to send to **********, **. They know what to do but are giving me the run around. Attached is the paper that they sent me saying that the loan is paid off and the document that the title place gave me. I took out an original loan on 04/07/2023 for $2000.00 and have been making payments every month since. I went on Vacation last year and wanted a little more money so I went in with my title to my car and got another $1000.00 on 9/30/2024. The original agreement was I can get my title back when I paid back what I got loan FOR MY TITLE. Mariner Finance tells me I have to pay off the entire balance of the loan $6751.16. When I called to speak to the original women I signed agreement with of course she no longer works there. Extremely rude and unwilling to work with me. I am asking for my title back when I pay $3000.00 toward the balance of loan since the title was not included in the beginning of this loan. Website also does not allow you to screenshot anything for proof. Company gives you ZERO documentation upon signing loan. Mariner Finance states the loan is only from 09/30/2024 so how did I get a money from them prior to this date with proof from my bank accounts. If you have no records of loan prior then I do not owe anything other then what is owed on my car for the loan. Money was transferred from my checking account when deposits where made. My son had SS benefits in a separate account that was transferred to my checking account ALL documentation provided as well.Business Response

Ms. ****** entered into a loan with Mariner on April ******. Ms. ****** made (4) four of the required thirty-six (36) loan payments before applying for additional funds for vacation. Ms. ****** was approved for an additional $4,034, using her 2015 ****** Altima as collateral securing the loan. On September 30, 2024, Ms. ****** applied for more funds in the amount of $1,000, and was approved, resulting in her current loan with Mariner.
As a courtesy, we would like to remind Ms. ****** that her account is currently past due for the February and March 2025, contractual payments, and the account has an approximate payoff of $6,907.36. Mariner will release the lien on Ms. ******* vehicle when the loan is paid in full.Initial Complaint

I have a loan thorugh Mariner Finance. I have been paying on this loan for a few years now. My balance seems to be staying the same. I have asked them many times to put my payment date at the end of the month and they keep saying they aren't allow to do that. It make it very hard for me to keep up when my rent and other important bills are due the 1st of the month. I have gotten so many late fees that it seems thats all I am paying. This is making me struggle more to take care of myself and my kids with just paying late fees and being behind. I have been paying around $520 for 24 months which is $12,480. Thats a lot of money taken from me and my kids. This should almost be paid off.Business Response

Ms. ********* entered into her current loan with Mariner Finance, LLC (Mariner) on February 29, 2024. As described in Ms. ********** loan agreement, finance charges are based on a simple interest (interest bearing) calculation applied to the unpaid principal. If the borrower is late or misses payments on a regular basis, more interest is accrued, and it will take longer to pay off the loan. If payments are paid in full and on time,the borrower will avoid paying additional interest charges and late fees. A review of Ms. ********** account confirms payments are frequently received after the required due date.
While Mariner is unable to honor Ms. ********** request to change her payment due date from the first of the month to the end of the month, once the account is up to date, regular payments can be made prior to the due date without penalty. Additionally, in order to further assist with Ms. ********** concerns regarding her account, on March 11, 2025, ************ spoke with the Vice President, ****** ****, who reviewed the account in detail and reviewed all applicable resolution options with her.

This letter serves as my final attempt to resolve this matter before I pursue legal action against your agency for violations of the Fair Credit Reporting Act (FCRA) and Fair Debt Collection Practices Act (FDCPA). ********** entered into the loan in question with Mariner Finance, LLC (Mariner)on February 1, 2022, when he refinanced his prior Mariner loan. *********************** defaulted on his loan, the account was referred to a collection attorney, and judgment was awarded in favor of Mariner on September 12, 2022. On May 5, 2023, Mariner received a final payment in the amount of $1917.34, which satisfied the judgment.
Reporting accurate credit experience data is an essential obligation of data furnishers under the Fair Credit Reporting Act. Mariner makes accurate account information available to the Credit ****************** (CRA) on a monthly basis, and each *** has its own internal policies that determine how the information is displayed in the credit report and for how long. Based on our review of Mr. ******* account, the information furnished by Mariner to the nationwide credit reporting agencies including that it is a paid collection account, is accurate. Given this, we are unable to honor Mr. ******* request to alter the information. Mr. ******* has submitted several automated credit disputes claiming both inaccurate reporting, and fraud in relation to his loan,all of which have been thoroughly reviewed and confirmed as accurately reporting.

Jan 6 there was a loan added to my credit profile. Jan 11 I submitted a dispute to all credit bureaus, filed a police ***ort, and visited the financial whose loan it was. Branch manager did not provide me with any docs for the loan. Jan 28 I received dispute results from ****************** both denying removal as they say it is my loan. I then returned to the financial and requested loan docs again. This time assistant branch manager provided me the docs. she also informed me a utility bill was used as proof of residency & a fake ID was used as proof of identity. Information besides my name, birthday, address, & social were falsified. This Includes previous address, phone number, place of employment, items put up for collateral(I don't own any of what's listed), debit card info, ID number, email address, how long at employer, and how long at residence. March 7th I received a response for the second dispute filed with ********** denying removal. March 10th I returned to the financial and spoke with the assistant manager questioning if they can close the account and what can she do about this. She informed she was unaware of the legalities & said they only provide information relating to the loan to the bureaus. I then called costumer service. The *** gave me the legalities and informed me credit bureaus will continue to deny removal of loan until the financial completes investigation. She also informed me that the fraud alert was only placed on the account last week & the process could take a couple more weeks. She told me to stop filing disputes until they are done with investigation because the credit bureau only ***orts the account as it is standing and that they are not informed of the fraud alert until they've reached a decision. I would like the business to look at the ** provided against my actual ID & verify the information provided for the loan; as it is all false; & remove this loan from my ***ort. Friday, March 7th, 2025, ****** fianc called to request a loan with 1 of our cars as a collateral. Life had suddenly kicked our legs out from under us that first week of the month, including the sudden passing of my sister, and we needed help. The lady on the phone had said we were approved for a $2000 loan with $167/$168 a month repayments. We told her our incomes, the fact that my fianc was still technically employed by *************** but due to the hurricane affecting business was on temporary Furlough for 3 more weeks before he was to come back in, but that they had him on hurricane-based temporary unemployment and still got a little from ******** weekly. She said that was fine & everything went through. We showed up to the Asheville Branch on ****************, only to be told that they weren't going to do the loan even though they told us they would & that we were approved, because they don't count temp. Furlough as income. They lied, took advantage of a family in deep distress, gathered that family's personal information, and then backed up and said "Oh, nevermind! we don't know why we said yes to you, but we are saying no now".Business Response

I have recently pulled my consumer report and noticed inaccurate items being reported on my consumer report that needs to be deleted. These items that are being reported are unauthorized and INACCURATE. The reporting of such inaccurate information has caused severe damage and or injury to my character, my general mode of living, my reputation, and my ability to uphold my standard of living. These items are as follows: Creditor: MARINER FINANCE Account number: ************ I CLEARLY did NOT give your agency written authorization or written instructions to report this information. Your agency is conspiring with these creditors against me in committing aggravated identity theft and I have sustained defamation of my character just to name a couple damages should this matter escalate to court. It is not equitable to me, the consumer of how your agency conducted your investigation. Your agency, has violated my consumer rights and violated federal law; theres proof in 15U.S. Code 1681, 15U.S. Code 1681a , 15U.S. Code 1681b(a)(2), 15U.S. Code 1681s-2, and 15 U.S. Code 1666b of the Fair Credit Reporting Act and15 U.S. Code 1692g , 15 U.S. Code 1692a of the Fair Debt Collection Practices Act, which is noted below. Ms. ****** has had a total of four (4) loans with Mariner,and entered into the loan in question on May 18, 2017. Ms. ****** made sixteen (16) loan payments,but failed to submit additional payments as contractually agreed, resulting in the account being classified as a charge-off account on June 27, 2019, and eventually sold to ************************ (***********) on November 10, 2020.

Mr. ********* entered into the loan with Mariner on July *******, and defaulted on the loan by failing to submit payments as contractually agreed. The defaulted account was sold to ************************ (Brightwater) on September 29, 2022. Mr. ********* was provided a copy of the loan agreement and all related documentation at the time he acknowledged the terms and signed the loan agreement. In order to protect the confidential information of our customers, ********************** requires verification of the requestors identity prior to providing additional copies of loan or related documents.
