      Miracle Ear (*******************. by ******** *********, ** *****) product. The trial began in mid-April and after extensions ended on May 11th. On that date I explained to the on-site specialist that I found the hearing aids to only be partially beneficial and I was unsure whether they met my needs. She showed me the purchase agreement that clearly states that I have 45 days to return the hearing aid and that I will be "promptly" refunded the $4,995 paid. That is not what happened at all. I decided the hearing aids were not benefiting me well within the 45-day period so I made an appointment to return them. When I sat with the on-site person again, she explained she had talked to "management" and they are "not willing to allow return" of the product. She stated that management had decided that my purchase was retroactive to the beginning of the trial and not the date of purchase, so the 45-day warranty had expired. I responded that I had researched ** law on the issue and will be filing a civil action to get my refund. When I attempted to leave the hearing aids, the hearing specialist said I must take them with me and she would not accept them. I left them on her desk and walked out.A few days later, the specialist called me and stated management had changed their minds and now they are willing to extend the warranty and I should come back and meet with her. I did so. She made adjustments to the devices and provided written notice of the warranty extension. This happened two times until finally on July 25th, she accepted return of the hearing aids and stated I would be refunded the nearly $5,000 in 5-7 days. Following several calls and emails requesting my refund, to which I did not receive a response for over two weeks after the refund was due. Finally, the on-site person sent me an email stating she would reach out to management and update me. Her updates have been that she has no updates and does not know why management has not processed the refund.

       I am rejecting this response because:  Miracle Ear advertises on all their documents that they provide prompt refunds to dissatisfied customers.   They then notified me they would refund my $4,995 within 4-5 days.  They held my funds for a month.  This is not acceptable and does not align with any of the information they communicate to their potential customers.  I am suing in small claims court for punitive damages and interest.
