They have been taking $106/mo out of my account, and now that I need to make a claim they don&#**;t want to honor the contract.

    Date: 08/24/2022

Thank you for bringing this to our attention.

As noted on the first three pages of your vehicle service contract, ******************** (AAS) is the administrator of your vehicle service contract and has FULL authority over repair procedures, approvals, denials and payments.  We have contacted them to obtain information on the repair claim you have referenced. Your claim was reviewed by the Legal Claims Director for AAS, an ASE-Certified Master ********, who determined the claim had been adjudicated correctly denied your claim for preexisting failure on the engine and in accordance with the terms of the contract.   There are also issues with the start mileage on the contract as the breakdown mileage is several thousand miles lower that the reported start. Service records were requested to try and resolve this and the only one provided is from 10/7/2020 about a month prior to the contract start for several engine related repairs. There is a note on the side of the invoice from your repair facility stating Customer needs engine overhaul or an new engine replaced There is no indication that this was ever done. Since an engine was recommended prior to the purchase of the contract this would make any engine failure preexisting.

The service record sent in also has a company noted as the customer on it. D-P tree **********************. This does bring up the question of commercial use of the vehicle. This was asked about but no determination was ever made on that. The Carfax also shows the vehicle is registered as a commercial vehicle. The title would be needed for review to see who this vehicle is actually registered to. Since there has been misrepresentation of the start mileage, possible commercial usage without the add on, and a preexisting condition there is no way to move this claim forward.

Although CarShield has no contractual obligation to do so and we have in no way violated the terms of the contract, we will refund your last 10 payments as a courtesy upon execution of a Settlement and Release Agreement. Please email ******************************* to confirm the cancellation and refund. Once we receive the email, we will draft the Agreement and email it to you for your review and signature.  Please make sure to include your name and contract number in the subject line for faster processing.

According to page 3 of 15 (Engine 1), All internally lubricated parts within the engine is covered. The valve stem seals is an internally lubricated part within the engine. On the same page of the contract, Number 10 of the contract says seals are not covered if it's stand alone repairs. According to the mechanic, the seal is not a stand alone repair but in conjunction with the repair to the valve stem. Therefore, the service should be covered under my contract but Car Shield denied the claim and I have to pay out of pocket. The contract and service order is attached.

Thank you for bringing this to our attention.

As noted on the first three pages of your vehicle service contract, ******** **** ****** (***) is the administrator of your vehicle service contract and has FULL authority over repair procedures, approvals, denials and payments.  We have contacted them to obtain information on the repair claim you have referenced. PEr their notes, contract *********  has 2 previous claims. The first two were for fuel pump, water pump, and a park brake actuator which are not listed for coverage under your vehicle service contract terms. . The current claim has 3 issues called in on it. First is for an A/C leak from a schrader valve, and the second for a sunroof motor  neither which are not listed for coverage.  The third issue is for the valve stem seals leaking internally to the engine. Seals and gaskets are not listed for coverage per section B.10 of the contract. Since the failure is due to a seal failing this is not covered under the contract. There is no other failure noted to cause the seals to fail so there is no coverage for that failure per the exclusions on the contract. We have attached a copy of your contract for your review and convenience.

If you have any additional concerns regarding this repair claim, you may contact ******** **** ****** directly at ************. As your service contract administrator and the obligated party under the contract terms, they will be happy to assist you with any repair claim related concerns you may still have.

    Complaint: ********

I am rejecting this response because:
The contract say... ENGINE (Gas or Diesel): All internally lubricated parts within the Engine, including engine mounts, timing belt, timing gears, cylinder head intake and exhaust valves, valve springs, valve guides, valve seats and oil pump. The engine block and heads are covered ONLY if damage is caused by a FAILURE of any internally lubricated part within the Engine.  This is considered an internally lubricated part within the engine and the contract does not say EXPECT seals.  And as stated in the previous response, this is not a "stand alone" repair.  Therefore, it should be covered.  Your company play on words to get out of repairing high price repairs.  But this is exactly why your reviews are horrible with the BBB.  I have canceled my contract with you and will not allow you to continue take my money and not stand by your contract

SEALS AND GASKETS: Seals and Gaskets are covered only in conjunction with the repair or replacement of the COVERED PARTS listed in 1 through 9 above. Leaking Seals and Gaskets (as “stand alone” repairs) are not covered by the CONTRACT.

    Sincerely,

I bought a vehicle service plan from CarShield. They told me I could go anywhere and get repairs done if needed. I dropped my vehicle off exactly 4 weeks ago on August 2nd due to issues with the transmission slipping in longer gears. 4 weeks without a car and they didn’t give a rental as part of the agreement. They also asked for me to pay for the breakdown of the transmission so they can determine what the issue is with the transmission. This is ridiculous. They lied and purposely have delayed the process. I had to take my vehicle to a dealer which is 45-50 mins from my house because no one in ******* even wants to deal with this company. The vehicle is a safety concern as it can cause a major accident. I am also filing a complaint with the ******* ********** ** ********* ********** as I am literally afraid of driving the vehicle. The dealership was able to replicate the issue and they still do not want to replace the transmission and I have had all my services done per manufacturer recommendations.

    *** ********,

Thank you for bringing this to our attention.  We appreciate the opportunity to review your complaint and help you with the resolution of this matter.

After looking over the repair claim notes from your service contract administrator, ****** *** ****, we have found that you have had 3 claims paid during the life of your service contract totaling $2, 834.92.

Your most recent claim in July of 2022, was denied after your repair shop did a test to determine that the cause of failure was your thermostat.  The thermostat is not listed as a covered component under your service contract terms.

As a gesture of goodwill and in a good faith effort to resolve this matter for you, we can refund the cost you paid into your coverage, minus the claims paid of 2834.32.  This would leave a refund of 235.08.

You should receive your refund, mailed to your **** ***** *** address within 10-15 days.

Thank you again for giving us the opportunity to address your concerns.

The mechanic informed me that it appeared that Car Shield was looking for an excuse to not pay for the repairs and when they could not find one, they appeared to be trying to create one. On August 10, 2022, four months from my initial call to Car Shield, I was informed that they were denying the claim because I had no proof of oil changes and maintenance. This is far from true. Additionally, the mechanic clearly stated that he did not agree with their findings based on what he saw when he dismantled the engine. And neither did their first two representatives. It was evident that the car had oil and new partsevidence that the car, although an older model, was being maintained. Car Shield has collected money for premiums from me for years with no problem. Car Shield was well aware of the fact that I bought the car used, the age of the car and wrote the policy based on the age of the car and the mileage. But when I needed them, they failed to deliver the services for which I had been paying. Car Shield scammed me. I cancelled my account after they denied the claim. And they had the nerve to try to make an automatic draft from my bank account even after I cancelled the accountAnd to add insult to injury, Car Shield sent a threatening letter when they could not extract further payments from my funds. Car Shield is a scam and should have to compensate all of the customers/victims that they have taken advantage of, misled and scammed. I contacted Car Shield regarding taking my car for repair service. I was told to take it to a mechanic that accepts/works with Car Shield. I, in turn, on April 12, 2022, took my vehicle to a recommended mechanic who agreed to work with Car Shield. The mechanic informed me that the motor was no longer operative. Car Shield instructed him to break down the motor to determine the cause behind the motor not working. The mechanic informed them that all fluids were at the correct levels and that there were no signs of any leaking.

As noted on the first three pages of your vehicle service contract, ******************** (AAS) is the administrator of your vehicle service contract and has FULL authority over repair procedures, approvals, denials and payments.  We have contacted them to obtain information on the repair claim you have referenced.  Your claim was started for engine concern.  Your repair facility found rod bearing failure on Cylinder 3.  After the first inspection the oil was found in poor condition and metal particles showing in oil filter and on oil dipstick.  *** source of metal was not confirmed. *** 2nd Inspection sent found failure of cylinder 3 rod bearing with and large metal particles in oil pan.

*** service records received from indicate the vehicle had traveled over ***** miles since last oil change was performed per Carfax report confirmed oil change at ******* miles. *** claim start date shows mileage is now 186,526.  Your vehicle traveled **** miles since last oil change was performed. An earlier record shows an oil change at *******.

Based on the information your claim was adjudicated incorrectly per terms of the contract. *** failure was most likely caused by normal wear and tear at that mileage. Your vehicle is still within manufacturers mileage interval for oil changes. Due to continued operation your contract has coverage for root cause of failure which is crankshaft/bearing coverage. Due to claim delays, process errors, and the difference in costs being minimal between that repair and an engine repair AAS will be moving forward with an engine repair.  Please contact AAS at ************ with any additional questions or concerns.

Per their notes, there were 2 pre-claims called in on your contract. The first claim was for catalytic converters which are not listed for coverage in Section B of the contract. There was also a concern for water in a light assembly also not listed for coverage.

There is a more recent pre-claim called in where your repair facility reported the vehicle needed a coolant service and thermostat and the vehicle was overheating. The coolant service is a maintenance item and is not covered. The thermostat is not listed for coverage and the contract does not cover failures due to overheat. So there is nothing covered under that complaint either. All of this is correct per the terms of the contract. We have attached a copy of your contract for your convenience.

Furthermore, you were informed during the recorded sales call that ******************** is the administrator of the contract, it is also listed several times in the contract and your payment are made through MEPCO which is our payments processing company.

As a courtesy, CarShield will refund your last 10 payments upon execution of a Settlement and Release Agreement. Please email ******************************* to confirm the cancellation and refund. Date: Tue Aug 16 I had obtained a quote for extended warranty on my car. The price was expensive and I made it clear I was not interested and wanted time to look at other options. The person on the phone got agitated and tried to pressure me into purchasing their services on the spot. They have been calling me twice a day since then while I am at work and otherwise busy. I was finally able to answer their second call today (Fri Aug 19) and when I told them I was not looking for coverage they just hung up on me. Completely unprofessional experience with this company.

I cancelled my policy with them. They told me I wasn&#**;t eligible for any refund. It was because they said it was because it was month to month, and that I hadn&#**;t done that in the first 30 days. There is no policy that I can see and I asked for them to send it to me. I had the policy for two years. I never made a claim on the policy.
