EMPOE, LLC (“TEMPOE”) is constantly striving to improve upon the customer experience and this includes explaining the program in more detail. Briefly, our program requires lessees to lease their items for a 5 month initial lease term. Upon completion of the initial lease term our customers have 3 options. Such options include: (1) Purchasing the property by exercising the purchase option; (2) continuing the lease on a periodic basis by retaining possession of the property, in which case additional periodic payment(s) must be made in the same frequency and amount as during their initial term; (3) terminating the lease by returning the property to us in good condition, fair wear and tear excepted. If the lessee does not contact TEMPOE to set up the purchase or return of their leased items, their lease will continue on the same schedule until they make arrangements to purchase the item or return the item. This means that if a customer doesn’t exercise their purchase or return options after the completion of their initial term, their lease will continue for another payment period. After the end of that period, customer will have the 3 options again. This process continues until a customer purchases their leased items, returns their leased items, or reaches their maximum lease term.
Your lease with TEMPOE, LLC was opened on April 17th, 2021 with *********. On May 14, 2021, a TEMPOE agent attempted spoke with you regarding your option to purchase the leased merchandise, however, at that time, you requested we stopped calling you. We have placed you on our do not call list, however, we continued to advise you of the terms of the lease via email.
Therefore, in accordance with the terms of your lease agreement, your periodic payments continued as a Buyout was not completed once you have met the 5th month term. These terms were presented to you before signing of the lease and as well as after.Customer Answer

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint. For your reference, reasons for rejection are included below.
Regards,
******* ******i have never recieved a call or talked to any agent and requested to be placed on a do not call list so that is false information being reported on their end! Also was never called or given options! Their terms were never explained and the advertisement of it when i bought it was lease to own! Paying 2154 for a product that cost $600 is insane and illegal practice! If the refuse to resolve ill have to take further legal action they should refund part of my money i have seen they have done it for others and i will not be satisfied until something is done to rectify illegal business practices

During
the term of your lease, TEMPOE sent you emails on several occasions regarding
your option to purchase the leased merchandise, however, at that time, you
chose not to exercise your early purchase options. The emails were named
"Don't Miss Out, Early Purchase Option Available!" and
"Friendly Reminder - Lease Minimum Term Approaching". In accordance
with the terms of your lease agreement, your periodic payments continued. As
a courtesy, TEMPOE closed your account for the amount paid and will be
issuing a refund of $511.84 back to the method of payment on file. Should you have any additional questions,
please reach out to TEMPOE’s customer experience team at ###-###-####. Our

I had a lease agreement with Tempoe LLC and my monthly payments were deducted from my back account monthly, I never missed a payment. After a year of making payments and paid the amount on the lease agreement, I noticed Tempoe was still collecting payments 3 months after I completed the payments. I called Tempoe customer service about the payments and they informed me about the lease buyout of $800. I asked customer service to deduct the 3 months of payment and I was more than happy to pay the balance, but they informed me the new buyout amount was nor $1200 and I had to pay the full amount for Tempoe to stop charging my bank account. I had offer to pay the balance (3 months - $800) but they refused all the time. I have now a collection charge of $2500 from ******** ****** ******** on behalf of Tempoe affecting my credit score.Business Response

Your lease with TEMPOE originated on October 18th 2016. On April 8th 2017, you were quoted $810.00 to close your lease and it was declined at that time. I have never purchased an item through TEMPOE, I have actually never even heard of this company until a fraudulent collections was added to my account. This needs to be corrected immediately. I have reported this fraud to Experian as well. This company should be sued and liable for the fraudulent accounts they are creating and the trouble they are illegally causing people.Business Response

We purchased a freezer in February 2022 from *****! When it was delivered it was brought to our attention the door was warped! We kept the freezer because the ***** Manager told us that they would replace the door to the freezer! April came and we called again and we were told door was back ordered and with no delivery time given we were then told the freezer was just going to be replaced! Middle of July still no results! Called again and this time we were told that WhyNotLeaseIt had placed a pick up and destroy order on our account for the freezer! They then attempted to have us pay off our loan even though they placed this order and they made it very clear we were not getting a replacement freezer! Freezer was picked up by ***** July 27,2022 and we were given numbers to report to WhyNotLeaseIt so that we would receive a full refund for the defective freezer! Now here we are August 8,2022 and we contacted WhyNotLeaseIt for the status and they give us the run around that we have not returned the freezer and there is nothing they can do because we did not send them an email proving the freezer was returned! Nothing was said about this email on July 27, 2022 when we called and gave them the serial number and all the information they told us was needed to initiate a return! When we reported the numbers for the return the lady told us it would be reviewed and we would either have a refund or an answer in 5-10 business days! All I want is this to be resolved and my money refunded! We never would’ve kept the freezer had we been told they wouldn’t fix the problem or replace the freezer! In my eyes this was fraud!Business Response

I completed the lease and set up payment to be able to own the washing machine and at the time it was for the 11th period with the listed date 11/5/2021 in the amount of $582.96 was what was the remainder to own it. I was doing bi-weekly payments of $101.63
total amount paid: $1,386.19
Tempoe did not stop taking payments after I completed the required payments, which lead to an overpayment to Tempoe of $803.23. I contacted them on multiple occasions with the request to receive the refund for the overpayments that they took. A woman said she sent a request for refund and would be received within 2 weeks, it did not. I did not hear anything back. I contacted again today on 8/2/2022 and they said it was denied because they cannot offer me a full refund of what was overpaid due to their mistake. They resent a request for only 3 last payments of $101.63 which equals a total refund of $304.89
I am entitled to my money they took due to their error. I am being shorted $498.34, IF the request even successfully goes through or if they just do not do it again. It has been 6 months of what should of been my final payment and trying to sort this out for months to get them to stop payments and issue a refund. I just want to receive the full overpayment amount successfully. I have all documentation to prove the amounts and dates.Business Response
