      I live in ***** Park apartments, which is owned by eucalyptus. *** lived here for about five years. Never been a day late on my rent. Never had a complaint filed on me. I get along good with my neighbors zero issues until the end of December beginning of January of this year. a tenant moved into the apartment adjoining mine. I have made numerous complaints to management, security, and a couple of complaints to the police department. There is ongoing noise sounding like furniture being thrown, dishes being thrown walls,being damaged, doors being slammed. From midnight till mid to late morning nonstop on numerous occasions. I have been told the man will be evicted, but it takes time. He is not even on the lease someone else rented the apartment for him. This kind of situation has caused me to go for nights on end with zero sleep has caused items to fall off my walls and made it difficult for me to even hear my TV in my apartment , its created extreme anxiety on my pets to the point that my pets will not even go into the bedroom anymore thats on the adjoining wall I asked to be let out of my lease two months early so I can move into a Home on August 1 and was basically told that was not gonna happen. so I will have to pay rent in both places for August and September . I believe ****** affords to me the right to quiet enjoyment of my home. This individual is obviously disturbed or impaired in some manner, or would not be acting this way. I am fearful for my safety, and for my mental health living under these conditions. I am suspect as to whether they are even attempting to do anything. I have dozens of recordings of the noise its like living in a war zone. *** had a beer bottle thrown at my back door and busted. My windows egged, and my car has had some minor vandalism during this time as well. The beer bottle thrown was the same type of beer bottle broken right next to his vehicle on the same day. this is beyond the scope of what should have to be tolerated.

      We apologize for the anxiety that this tenant has caused.  We have attached documentation showing eviction for the problem tenant that ************** has complained about. There is a legal procedure to evicted tenants as well as time frame of notification. We have to act accordingly by the law to evict them and it's not as quick as we would like.

      I am rejecting this response because: even after the tenant was affected, he came back and kicked the door. Again waking me up at 4:30 a.m. of course, I was woken up again later when maintenance came to put new locks on the door and to fix the door. My issue is not the fact that hes evicted now as to why I was told we back in March he was being evicted. Should be out by the end of the month. Then again in April then again in May I have no faith in this apartment complex and I dont believe anything they tell me anymore also in retaliation to a negative post on the ActiveBuilding site where we can post and make our rent payments, they locked me out of the ActiveBuilding acct. So I am no longer able to make my rent payments through the app. I have to go out and purchase a money order and take it to the office. I feel like they are more concerned with making things inconvenient for me for speaking up then they were for fixing the problem in the play first place. This problem has been ongoing, and I have emails down from the office where they are trying to say that they were not advised that the problem was ongoing and in fact they were they were. The noise was so bad from that apartment the other day that we could record the sounds of him breaking things, and throwing things all the way out in the parking lot. This creates an extreme amount of stress to live in conditions four out of eight apartments in the row, he lives in and one adjacent were affected. And have been affected over the last several months. It is not just my apartment. I have put in my notice that I will be gone by August 1. I am no longer willing to risk my safety because this individual is not going to respect eviction process either and I fear for my safety due to retaliation from him. As so other tenants as well. I have no faith in their ability or willingness to do what needs to be done to keep their tenants safe.

      When I leave for work and come home my sink if full and overflows on the floor. I think its from the apartment above me and back *** to my apartment. I've called for the past 3-weeks and no response from management.

      Our records indicate that a work order was created on 4/27/23 for ***************************, it was completed on 5/2/23.  Our apologies for taking 6 days to unclog the drain.  My understanding is that we had to get a plumber out there because it was more complicated than our maintenance person could fix.

      I moved into these apartments last year (2022) in June. I then referred someone to these apartments the same year in August. There is a referral program to where any tenants that refer someone to these apartments will receive $100 off their rent. The tenant fulfilled the obligations that were required for me to be allotted the $100 off of my rent. I was told by the manager at the time (Autumn) that I would receive that is February (2023). So I paid $100 less on my rent expecting the $100 credit to my account. It was never credited to my account. After continuously calling the office, going to the office, I was assured that it would be credited and they would take off the late charges. 2 months later and those charges were never taken off and I was being charged late fees for 2 months. After speaking with the new manager (******) and explaining the situation I kept getting told she needs to talk with her boss. Still nothing happened. I have not received any call backs or any kind of solution other than I just need to pay it. Therefore I have paid the full amount. There is no communication with this property staff and that is false advertising. I have already spoken with a lawyer. If this matter is not resolved by the end of next week and there is not a check waiting for me by then for the extra amount I had to pay, I will be going ahead and filing a lawsuit against the property and their staff.

      It appears there was simply miscommunication - I have had a discussion with the new manager on the process and where things took a nosedive.
      I am waiting on the documentation to be uploaded and will not only be applying the concession but will be removing any associated late fees.

      I have had NUMEROUS problems with the property staff at the Magnolia Creek Apartments complex owned by Eucalyptus Real Estate company. Previously the main sewage drain line for my building backed up and flooded my apartment for 4 days straight-they wouldnt turn the water off and didnt call professional plumbers until the 3rd day of the constant flooding. Once they fixed the drain line they sent staff to every downstairs unit in my building except mine to clean up the water and to disinfect and dry out carpet. So I purchased my own equipment to rectify the 2 inches of contaminated sewage water covering my hallway, bathroom, utility closet and both bedrooms. I waited 2 weeks and still NO ONE CAME TO MY UNIT. I contacted them several times with no response nor resolution. I did some research and found that the cdc considers any carpet and Porous materials left sitting in Sewage water for more than 48hrs be disposed of due to risk of viruses and bacteria growth and contamination. It had been 2 weeks and my carpet were still damp despite using a wet/dry vac and a carpet cleaner every day in attempt to remove all the water. I then pulled up the sopping wet carpet and padding in both bedrooms and put it in large black trash bags and drug it out onto the porch where it sat for another 2 weeks for I cannot lift the bags into the dumpster and property staff didnt bother to remove it even though its a lease violation to have ANYTHING, especially trash, left sitting outside our units. Finally chewed the managers **** out when he knocked on my door to ask about the trash bags(mind u they were sitting in between mine and my neighbors front doors but he didnt bother asking the neighbors about it-he just assumed it was my doing even though *** never had anything left outside my unit before). but then 2 different times this past week property staff has unlawfully entered my unit-no 24 hr notice prior to entry nor any emergency reason. Trespassing and invasion of privacy!!

      The trespassing that the tenant is complaining about is when we do our yearly preventive maintenance, and we give adequate notice to all the tenants.   Tenant threatened to shoot our maintenance or anyone else that goes into her apartment.  So, the carpet has not been replaced because she was hostile, and manager took the shooting threat seriously.

      I am rejecting this response because:the flooded apartment and sewage soaked carpets incidence happened over a month before Hiring the man who illegally entered  my apt to work at that property. The law says landlord must give 24hr notice BEFORE entering apts unless its an emergency-changing the ac filter(which is the excuse he gave me for being there) is not an emergency and when I asked him for the filter to swap it out myself they didnt have any filters or anything but a clipboard and keys with them. Management sent out a message 30min prior to them attempting to enter my apt. Which is NOT reasonable notice according to the law nor the lease agreement. I did not threaten to shoot the maintenance man-I told him that hes lucky he doesnt get shot when illegally accessing peoples apartments. He responded with everybody has a gun these days and I shoot back. Better know how to aim because I dont miss.
      Slamming my door as it was being opened by maintenance and yelling what do u think you're doing? Then arguing with him about whether or not he was going to enter my apt anytime in the next 23hrs before he was legally permitted to do so, over a month after they failed to clean up and dry out my apt from being flooded w sewage water for 4 days, is not a valid reason for either of their failures in following landlord/tenant laws and responsibilities nor would The maintenance man have responded to the work order regarding my ac unit he tampered with-which I submitted after the trespassing incident. They need to get their facts: personnel involved, date, nature of occurrence and their not legally valid excuses/reasons for NOT doing their job, straight

      I filed an app in dec of 2022 i was denied cuz i **** a sister property money. So I ended up paying said sister property off. So i refiled. By refile i mean pay a 2nd app fee but without filing out a 2nd app they jsut reran the first 1. So i got approved. So I moved into ********************** on Feb 28, 2023. I later received a 14/30 to get rid of my dogs. Then after that I had an incident to where the police where called due to my dogs and kid getting out while I was asleep due to being sick. So long story short my kids went to police protective custody for 3 days i got them back. My dogs stayed with me. After that incident I was giving a notice that the apartment broke my lease. On their reasoning in the notice it stated lies. Only 1 thing was true and that the incident involving my kid getting out. But to say my house isn't furnished enough to their likings is because I was running a dog kennel out the apartment is completely false. And that my dogs are put bulls which in fact the are not pit bulls but instead American bully which I have paperwork proof to prove otherwise. Then the apartment manager told me that a maintenance was attacked but when asked to show me a bite or a scratch or any evidence of a person getting attacked. She couldn't find any evidence to prove her story. Then she went on to tell me it don't matter they are aggressive dogs even tho I have proof to prove that they aren't aggressive at all. Then she went on to say I lied on my application. I told her no I wasn't given a second app to fill out after paying a 2nd app fee. Cuz when I first filled I didn't have the dogs and when I filed The 2nd time I had to dogs. All I did was sign the money order over and that I was told I would receive a phone call once I'm approved or not. Which I was. Then I was giving a stink messed up apartments. The breaker to the ac/heater keeps flipping. The hot water was off for a week my ex made request to get water fixed but I ended up fixing it myself. They bathroom light switch doesn't turn off. I had to unscrew the light bulbs to get lights off. The bathroom rub had the seal that seals it to the floor gone. ******** blamed that on my dogs I have proof they didn't that. The toilet seal that's seals to the floor was also gone. ******** blamed that on my dogs I got proof that they didn't as well. The fridge part was brown for 3 weeks. They had several requests about that too. The reason my kids ended up being taking was cuz of lack of food in the fridge but ot was broken. We where buying meals nightly so we don't waste money buying uncessary amounts of food. ******** told me that ****** worked and it's on us. Come to find out it was a bad part.

      ************** was asked at the time of application if anything needed to be updated or changed.  This would be the time he should have let us know about his dogs. Which our pet policies state that American Bullies fall under the umbrella of the Pit Bull breed, and not allowed. He answered "no."  So, he was issued a 14/30 for not disclosing the two dogs upon his return to reapply.  The day after the issuing of the 14/30 two of his 3 children were walking the dogs and they got loose from them, while his 3 yr old got out as well and was wondering the property in only a diaper and t-shirt in the cold, while ************** was asleep.  Maintenance was called about a small child wandering property with no one around, that's when police were called and dogs got aggressive, but no one was bitten.  His children were taken into custody that night by ******* PD for a variety of reasons.   As for the water heater, ************** told maintenance that he fixed it and wouldn't let them enter.  Same thing occurred with the refrigerator, maintenance went to check on it and heard the dogs barking being unsure if they were kenneled, did not enter.  Manager called him and he stated they were, so maintenance then went back and checked the refrigerator, and the temp was reading 21 degrees on freezer and 51 degrees on refrigerator.  Everything was working fine.  ************** called back the next day and maintenance went back out, ************** had it pulled out from wall and turned off. It was in good condition when turned back on.  He is claiming his children were taken because of no food in the home due to refrigerator not working, which is false. 

      As for, the A/C he had never mentioned anything about it, or the seal around the bathroom tub. He did mention the fixture in the bathroom, and it was working fine. 

      ************** has been evicted and lease terminated, drafted by our attorney.

      I applied to the ********************** in ******* ** over 3 weeks ago. I paid the fee and explained to them that my pay stubs were a little off due to vacation and illness. I then got permission for them to go based off of December pay stubs, and to my calculations of every check i got in December, I made well over the required amount. After numerous attempts to get an update from them they kept making up new documents or paystubs they needed from me. I called them yesterday for, yet again, another attempt for an update and they proceeded to tell me I didnt make enough money. I then told them I had a co-signer if i needed one. After all of this back and forth they then proceeded to tell me they would not have any available units by the time I needed to move ( first of march) even though they told me when i viewed the apartment and the following day when i applied that they had 3 available apartments by the time i needed to move. As i was on the phone with them yesterday they proceeded to tell me none were available after I was told multiple times that there was 3! I have been waiting for 3 weeks to hear back from them and I am now nearing the end of my current lease and I have no place to live due to them being, for lack of better words, sketchy. I admit I am partially to blame for not trying to find something else but it is ridiculous the way i was treated. I feel like I was discriminated against due to my age even though I have good credit, steady income, a co-signer, and perfect rent history. I feel as if I am owed an apology due to the way I was treated and these people need to be reprimanded for the horrible way they do business.

      I would like to apologize for the oversight on our part.  There was some miscommunication on emails and getting income verification back.  At the time we did have available units, but we cannot hold a unit without credit approval.  So, those approved first and pay the deposits get the next unit available, that's why she was told end of February so they could get next unit ready.   They had leased out the current ones to those who were approved first and had deposits, It had nothing to do with her age.

      Rachel is the absolute WORST. Would not let us see the property before we signed the lease. The demo version is NOT like the one they forced us into. Upon going in property noticed it smelled like cat pee. There was poop in the middle of the floor. Took pictures of everything. Recorded the conversation/argument we argued for over an hour because within ten minutes of seeing the place noticed there was mold. Etc. so we said nvm we want our money back to stay where we are currently. Said we signed the lease couldn’t have our thousand dollars back. Have a 2 year old. 1 year old and 16 day old so money isn’t something we can just give away. She repeatedly called us stupid because supposedly we only cared about the “cosmetics”. There was literal mold on the building. We have photos. The recording of her calling is stupid. Even the dude who went over the paperwork said he wouldn’t live there and we were right. She then said “I’ll let you out of this situation if you pay two more months rent”. After I already paid 1,000.00. She took our money. Forced us into a unit. Won’t gice the money back. Called us stupid. Which we have on recording. Etc. there’s way more to it. She was disregarding of how we felt and only cared about “hitting her quota”. Do NOT rent from this place. Then we were told after we signed for “1405” that a pipe burst so we’ll be moved to “705” due to flooding. My first indication should’ve been a tenant before me complained to the office as I was waiting on the waiting area he’s been waiting a week for them to fix his pipes they’re leaking all over his house. I expressed to her my kids shouldn’t be isolated from 80% of a house if I’m paying 1100.00 a month for it. She shrugged her shoulders and said “all you care about is cosmetics”. I then expressed if that’s how you see it cool. It’s unsafe for my kids and nobody in they right mind will want to come over there. That place was disgusting. Kept trying to force us to stay and said keeping money if don’t.

      This is not an accurate description of what happened. They did not want to see the unit before they signed the lease. They were shown the unit and were told any issues they had with the unit could be fixed. The concerns were relatively minor and cosmetic in nature, which this person took out of context.  There was not poop in the middle of the floor- it was piece of dirt/debris. The manager said she would gladly move into the unit.  Their deposit and first months rent has been refunded, and we are cancelling the lease without any penalties. This sounds like the person wanted everything to be new, which for the age of the building is not realistic, but we do want any residents that are moving in to be happy with where they are living and will do what is possible (cleaning, make ready, etc) to make sure they are happy.

      I have paid $500 in rent and my rent is $674 a month. I only owe $174 left and my current leasing manager Tamara ************ is a bully, she is constantly making me pay late fees, constantly talking disrespectful to me. Constantly bullying me. Yelling at me. Adding late fees when I already explained my situation about why it isnt in full. Ive been communicative about everything going on and she is the only manager *** had an actual issue here since I moved in in April. And also they have black mold in a lot of the buildings and apartments. My apartment still smells like mold and mildew.

      The resident is upset because she paid late and is required to pay late fees, which it appears she is also admitting in her complaint. The manager showed her where this is in the lease, and the resident is claiming that she did not have to do this in the past. As far as how the manager is speaking with her, the resident has sent her boyfriend and another family member who is not on the lease to speak with the manager about the situation. Our policy is only to discuss any terms of the lease with adults that are on the lease, which again the resident didn't like. 

      As far as her complaints about mold, we have reviewed the work orders, and all work orders are completed. Maintenance will be checking her unit for any current issues that were not reported tomorrow morning.

      I have constantly had issues with the company not having the lack of support for on call duty in case of emergencies. I have had a pipe explode and attempted to contact the facility. Call Magnolia village of where Im living and the on-call number is only a texting number there is no way to get a hold of on call other than dialing 911 and even then I am unable to stop the water from flowing into my house due to no contact with an on-call maintenance and this occurrence is today December 24, 2022, but always trying to get hold of a staff member for emergency purposes is a no go into unfortunately, I am not the only person having this issue and is unable to contact on-call maintenance

      On the 24th it was extremely cold and below freezing.  There were many emergency calls to our ER number and she was on the list of handling the issues with a pipe freezing and breaking just as quickly as our maintenance men could do over the Christmas holiday.  On the 25th and the 26th we worked to resolve this issue.  Thank you.
