I purchased a 2014 ***** truck from David Stanley on 02-17-2023, it was my first truck and was excited. I took the truck home and 3 days later the check engine light came on, so I took it back to the dealership and I had to wait for my salesman to help me but he came in at a later time so I took it to auto zone and the told me that cylinder 4 had a misfire and cold engine start malfunction, they assured me that it wouldnt be a problem and they took me to a repair place of ******* and got it turned off. Took the truck back home and the check engine light came back on and this time it blink the I drove it home from work it cut off, took back to the dealership and they kept it for a week I had to go check on it and they said it was ready, took the truck home again and the check engine light came back on again so I took it back and they said let try to get you out of it and and pulled up a pathfinder and I declined because I wanted a truck so I took the truck back home waiting for my warranty to kick in so I can get my truck fixed I havent driven the truck but only 200 miles and they say I dont have a warranty just a oil change plan and when I purchased the truck the said I had a warranty, then they said I have to keep the truck for 7 months then I can trade it in for something else and they dont have to inspect vehicles when they get traded in just wash and resale and I said ok I know what I have to do and the finance manager said get a lawyer but we have lawyers here if your looking to *** and when you buy a used vehicle thats the risk you take. The service I received was terrible and now I have to fix a truck that I cant drive and check engine light came on only after a couple of day of purchase. I asked for Mr. ********************** info so I can contact him they said good luck he lives in ********** and they dont even see him. All I wanted is my truck fixed not nothing else but I have to keep paying on a truck that I cant drive until I get it fixed and thats not right.

David Stanley Chevrolet cannot guarantee the condition or history of a used vehicle, particularly old age vehicles with high mileage (as was the case here).  For this reason, all used vehicles are sold as-is. This customer signed a Vehicle "As-Is" Agreement and Buyers Guide acknowledging that potential problems can occur with a used vehicle, such as an illuminated check engine light.  Notwithstanding, as a gesture of goodwill David Stanley Chevrolet agreed to buy the truck back from the customer.  As such, we consider this matter closed.

Im writing this letter of complaint in connection with David Stanley Chevrolet of ********. VIN# ***************** Model: Range Rover Evo Year: 2014 Deal# ****** Buyer: *************************** Co-Buyer: ***************************** On February 17th my daughter and I were financing a vehicle with David Stanley Chevrolet. They didnt disclose anything mechanically wrong with the vehicle prior to financing. The vehicle started having mechanical issues February 17th. The dealership was contacted the following day and they gave us the run around. ****** took the vehicle to a private mechanic where he found several problems and advised her bring it back to the dealership. The vehicle was returned within 72hrs and we asked to exchange it for another vehicle or revoke the sale. I sent an email stating I wasnt signing a contract for a vehicle in unsatisfactory condition that should have been disclosed before purchase.I have payed this dealership 8k as a down payment and before the contract made it to ****** for me to sign they had their property back. I never signed the contract so theres no enforceable contract. *** said my daughter misled them into believing Id sign this contract, so now the dealership is coming after her personally for the ******* in repair fees and the 8k will not be refunded till they get their money. My daughter NEVER misled them, I was 100% willing to sign the contract before I found out the vehicle had several undisclosed maintenance issues. Im not paying for someones incompetence or their dishonesty in trying to push off a lemon. This dealership is literally trying to get me to pay for something that should have been done BEFORE I considered buying the car. This vehicle was delivered in unsatisfactory condition. There grounds are fraudulent misrepresentation, representing the vehicle to be in good and operable condition when they knew it was not. Ive asked them to refund the 8k, its the honest and right thing to do. Kind regards,***************************

Thank you for bringing this to our attention.  A refund was issued on 3/15/23 back to the original payment method (see attached).  We sincerely apologize for the delay in processing this refund.

    Complaint: ********

I am rejecting this response because: David Stanley has not released the funds of 8k back to the original form of payment. I called my cc company today and they said David Stanley Chevrolet has to do that before the refund is processed.
David Stanley Chevrolet has been a nightmare to deal with.

    Sincerely,

    ***************************

    Business Response

    Date: 03/24/2023

David Stanley Chevrolet authorized the release of funds on 3/15/23 at 10:47 a.m. as reflected in the attached receipt, and the money was withdrawn from the dealership's bank account on 3/17/23.  Unfortunately, we cannot control how quickly the refund appears in the customer's account, as that is dependent upon the processing time for the customer's bank/credit card company.  We do not know why the customer's credit card company stated that the funds had not been released back to the original form of payment as of 3/21/23 because those funds were released on 3/17/23. We suggest the customer contact their bank/credit card company if the refund is still not showing, as any delay beyond 3/17/23 would be due to the bank/credit card company.

    Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me.
After dealing with this dealership for over a month I FINALLY received my refund. It took filing a complaint with the BBB to resolve the illegal transaction this company attempted. Managers ***** and *** should be ashamed of the way they treated my daughter (19 yoa) when she went into the dealership by herself. Their actions were unacceptable as grown men. I hope if they have a daughter they look back at the way they treated mine.I hope nobody ever threatens their child like they did to mine. Talking to her in raised voices getting in her face telling her theyre coming after her personally to collect the fees of the repairs that shouldve been done prior to selling us this vehicle.
This dealership and the employees that were involved with this incident should take this opportunity to learn from this experience how to be better business leaders s as nd treat customers with respect and sell them a car that has been through a full service instead of lying like *** did.
This company is a disgrace to the profession for consumers, Id NEVER recommend this dealership to anyone.
    Sincerely,

    ***************************

After contacting this business on 18 October 2022 at approx. 8:30pm I inquired about a car specifically a white 2017 Chevrolet Bolt. When I inquired I asked if this vehicle was still on the lot when given an answer of yes I asked if this vehicle could be held until my arrival. I was told that this vehicle would be held until my arrival approx. 12 hours later. I began a long overnight drive out of my way to secure this vehicle. At **** on 19 October 2022 i called to confirm that this vehicle was still available and was given confirmation on this. At approx. **** on 19 October 2022 I arrived at the dealership to purchase the vehicle they claimed was still on their lot. Upon talking to a salesperson I was told that the vehicle I inquired about had been sold and that they had another one that was a 2020 Chevrolet Bolt Premier for $10000 more. From my perspective(the customer) the dealership seemed to make a bait and switch with the thought that since I drove 12 hours out of my way I wouldn't leave without a vehicle. The nature of this interaction shows a lack of professionalism from the staff at this dealership and shady tactics to ensure they make the most money while having a blatant disregard to customers and their time or money.

Thank you for bringing this matter to our attention.  It is our policy that employees perform further due diligence for customers driving in excess of **************************************************************************************** purchasing.  Our employees are also supposed to advise long-distance customers that a deposit is required to hold the vehicle, as well as the repercussions if no deposit is made.   The employee you were speaking to failed to perform the required due diligence or obtain a deposit.  This behavior is completely unacceptable, and we have disciplined the employee involved.  Unfortunately, the vehicle was sold the night before you arrived by another employee who had no knowledge you were driving from out of state to purchase the vehicle.
We sincerely apologize for the inconvenience we have caused, and we will be happy to reimburse you for your fuel costs.  Please contact ********************************* at ************* and she can arrange this for you.

On 7-18-2022 I purchased a used vehicle from David Stanley Auto Group, specifically on I240 and ******. I went to the dealership today because I had not received my title in the mail. I was handed my title today, October 17, 2022. I asked if my paperwork could be updated to reflect no penalties or a check be made out to me for the penalties. As to both, I was denied. I now have to pay penalties as a result of not having had a title until now. I believe this to be a poor business practice and hope this helps to resolve this issue, not only for me but for others who may have a similar experience. I have video confirmation of receipt as well as the names of those involved, if needed.

    Business Response

    Date: 10/18/2022

According to our records and **** tracking (attached), David Stanley Chevrolet mailed the title paperwork to the customer via certified mail on July 29, 2022 - 11 days after the sale and within 30 days as required by ******** law.  The tracking indicates **** left notice with the customer on August 1, 2022, but the customer never retrieved the title paperwork from the post office.  Sometime after September 11, 2022, **** returned the title paperwork to the dealership as unclaimed.  Has the customer retrieved the title paperwork from the post office after notice was left, she could have timely registered the vehicle and avoided any late fees or penalties.  While we certainly sympathize with the customer, we cannot offer a billing adjustment since we timely mailed the title in accordance with our internal procedures and ******** law.

    Complaint: ********

I am rejecting this response because:

I never received a notice from ******** to pick up anything. The first receptionist I spoke with on 10/15/22, stated it has been a common issue with other customers (not receiving notice). I see that it was sent back to the dealership 9/11/22 but I was never called, notified in writing or otherwise that they had my title in possession. In fact, I have two voicemail messages on 9/16/22 regarding the title of my trade. I spoke with someone the same day who never mentioned having had the title to my new vehicle. I can see the tracking clearly. I NEVER received notice (known issue), I was never called to come get it, I incurred penalties while they had procession of my title. I regret having done business with this dealership. I was warned but didnt heed the warning. After receiving my title 10/17/22, I purchased my tag 10/18/22 including all penalties. I do not recommend doing business with DAVID STANLEY AUTO GROUP.

    Sincerely,

    Crystal ******

It is our policy to send title paperwork certified mail to ensure there is a verifiable record that title was timely mailed to our customers in accordance with ******** law.  We are not affiliated with **** and are not responsible for any alleged failure of **** to deliver the item and/or leave notice.  Per official **** tracking, notice was left by the post office to retrieve the item and it was never picked up.  It is the customer's responsibility under ******** law to title the vehicle within 30 days of purchase.  Delays in receipt of title paperwork should be reported to the dealership immediately so we can help remedy the issue before the 30-day period expires. Since this customer never notified us prior to the expiration of the 30-day period (August 18, 2022) that she had not received her title, any late fees or penalties accruing after this date would be her responsibility. To the extent the customer has a complaint against ****, it should be taken up with them directly.

I bought a 2020 Chevy bolt EV from this dealership on September 1st 2022. The purchase price of the vehicle was $29,904. The dealership had sold me the vehicle while it still had a huge safety recall on the batteries. Also they had failed to inform me that the vehicle did not have the DC fast charging port on the vehicle which has become the industry standard for charging stations. After owning it and fighting with them for almost a month, I am extremely scared to drive the car anywhere for the risk of it catching on fire and one of the few places I can charge it is at my house. I informed the salesman of my needs before buying the vehicle and they neglected to tell me that the charging stations would be very few and far between. All I want is a vehicle that I can charge anywhere and the batteries to not possibly kill me in a fire. Please help.

    Business Response

    Date: 09/29/2022

The Bolt battery recall has been completed by GM in phases by specific VINs due to battery shortages and delays.  The battery recall was not active for this VIN at the time of sale, as such David Stanley Chevrolet was not able to perform the recall prior to sale.  At the customers request, GM fast-tracked the recall for this VIN and immediately sent a battery to David Stanley Chevrolet, which the dealership received on September 28, 2022.  It typically takes 2 days to complete the battery recall, so the dealership is coordinating with the customers to arrange a rental or alternative vehicle while this recall is performed.  GM never issued a stop sell on this vehicle,so the vehicle is safe to drive while the recall is pending.

All 2020 Chevrolet Bolts come with general charge ports and can charge anywhere.  A fast-charging port is an option, but it is not standard to the 2020 Chevrolet Bolt, and a standard 2020 Chevrolet Bolt with a general charge port cannot be converted or upgraded to a fast charge.  The vehicle purchased was a standard 2020 Chevrolet Bolt, so it did not come equipped with the fast-charge option.  We are working with the customer to ensure he is fully satisfied and have been in communication with him regarding his options.

David Stanley Chevrolet has spoken directly with the customer to address the matters contained within the complaint.

The dealership cannot guarantee the history or condition of used vehicles, therefore all used vehicles are sold as-is, including the used 2019 ******* Tuscan purchased by this customer (see attached As-Is). After the sale, the customers vehicle began exhibiting problems and was taken to a certified ******* dealership to perform necessary repairs (both warranty and non-warranty).  As a courtesy, David Stanley Chevrolet provided the customer a loaner vehicle while her vehicle was in the shop and paid for all repairs that fell outside the manufacturers warranty. The customer was never without a vehicle and all repairs were performed at no cost to her.

David Stanley Chevrolet assigned title to the customer and timely mailed the title paperwork to her on July 22, 2022 (see copy of title and **** tracking, attached).  Per **** tracking, the customer received the title paperwork on July 28, 2022.  The customer is in possession of all documents required to title and register the vehicle; all she needs to do is take the title paperwork to a tag agency to complete this process.  If she has any further questions, the employees at the tag agency should be able to assist.  The dealership has also offered to walk her through this process.

The customer must schedule an appointment with David Stanley Chevrolets service department to have the *********************** performed.  To schedule the appointment, she should contact our service manager *********************** at **************.  If she has any questions regarding the Superior Finish product itself, she can contact ********************* at **************.

David Stanley Chevrolet has gone to great lengths to make the customer happy.  We hope we have resolved this matter to her satisfaction.
