I have spoken with several people from this business to set up a payment plan which they blatantly refuse. They have violated several fair debt laws. They will need to be put out of business considering they harass and bully customers as well as violate several laws. It is not legal to refuse payment just because they can't afford to pay in full. They also tell you to use child support money or take out additional loans to pay them. This place is extremely unprofessional.

Not sure Ms. ****** has the correct company for this complaint. Of course we are willing to work with her on payments, but from what we can see we have never communicated a single time with her, other than us mailing letters. We would be more than happy to make payment arrangements and can be contacted any day Monday through Friday from 8am to 5pm.

This business is in place to help people pay off any of their debt, or even go to them with simple inquiries regarding debt, but they don't act like it, and they certainly don't treat their patrons with any respect or dignity as they are unabashedly ignorant customer service representatives who are supposed to be kind and knowledgeable and professional, and weren't any of those things. Information that should have been in our file was omitted. Robin and her supervisor were nothing but Incompetent and belligerent throughout the entire process. I have so much disdain and disgust for this particular company and how they feel it is acceptable to treat another human being that I am content to continue not paying the debt reflected on my credit and letting them keep it indefinitely, because at least this way, I'll never have to speak with another customer service representative or debt collector or supervisor from that company EVER again.

This is not at all what happened. Ms. ******** called our office, treated employees with disrespect when she couldn't have her way, then hung up the phone.

    Consumer Response /* (3000, 7, 2022/12/01) */
(The consumer indicated he/she DID NOT accept the response from the business.)
That is not what happened, I called the office and from the moment they answered the phone they were belligerent with me, not helping me with any of my questions and acting like they didn't have the information I was seeking. I hung up because no business or any person really has the right to treat me or talk to me the way they were. This isn't a he said she said. I filed a complaint, and just because you deny what happened doesn't mean it didn't happen.

    Business Response /* (4000, 9, 2022/12/02) */
Correct, this is not a he said she said. If you would like to contact our office to resolve your account please do so.

gave a move out to chisholm park. they did not accept it cause I guess I needed my room mate daltons approval as well for me to move out. dalton stayed after I did and racked up a debt. after contacting M.A.R.S via phone they agreed to delete from my credit if I paid half. they even got the ceo of the companies permission to do so making dalton sole legal for the debt. after submitting payment they sent me my letter that I requested however they did not include that it would be deleted from my credit report. after contacting them again via phone they denied claims that I had requested it to be removed from my report. in accordance with § 605. Requirements relating to information contained in Consumer Reports (15 U.S.C. § 1681c) section a paragraph 5 states: "Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years." not only is this adverse material keeping me from getting further credit it is also inaccurate and incorrect. the agency refuses to remove it when I call them. I filed with the cfpb.gov and the company response was Mr. ******* was offered to settle his half of the account for 50% and he agreed and made a payment for $1660 in May of 2022. At no point was there a discussion that the tradeline would be removed from his credit. He has called our office several times and this was explained to him on each occasion.

this is not accurate. I requested it to be removed from my credit if I paid half in which they spoke with the ceo who gave them approval to settle and remove me from any legal responsibility. now it is at the point where not only is this adverse material keeping from further credit and getting into my own place but now am considering them to be harassing me to collect a debt no longer owed.

    Business Response /* (1000, 5, 2022/11/15) */
There was never a discussion about removal from the credit bureaus. Mr. ******* contacted our office concerning paying his half of the debt. The amount owed is not a 50/50 split when it comes to our office. Each person is responsible for the entire debt until it is paid. As a courtesy we agreed to take half the balance as settlement for Mr. ******* only, and not hold him responsible for the remaining balance. This is exactly what was done. We have updated the credit bureaus that he has settled the debt.
Mr. ******* was made aware of the debt in 2020 and had plenty of time to take care of it prior to being reported to the credit bureau, but no payment was made until 20 months after it was placed in our office.

    Consumer Response /* (3000, 7, 2022/11/16) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I never agreed to the debt. I gave a move put notice which os why i didnt attempt to pay full. Roommate dalton stayed afterwards and racked a bill. When i called m.a.r.s i said "if i pay half, will u remove ot from my credit report and make dalton soley responsible for the other half?" The gal on the phone messaged her ceo which i was told that they would go ahead and do it. I requested a letter in whi h they said they would email me a receipt, once payment is made theyd send me the requested letter. Of course i paid thinking theyd hold up to their end of the agreement which wasnt. The email never even included that it would be removed as i had requested. On top of this during the dispute process i asked them about my move out notice and they said none was given. This company and chisholm park the original property name when i was living there
I feel is only doing this cause they had to renovate their property. If u go back its am entirely different complex. Talk about rags to riches. When we first moved in we got an apartment with water damage and black mold everywhere for a couple of months. They finally moved us where again the unit was properly cares for. There was a leaking roof, electrical issues, and even the patio had foundation issues and was cracked and leaning towards the parking lot. I strongly feel chisholm park and mars are trying to get money out of tenants through debt collectors and harassing us to get the full amount of whatever they are asking just cause they can. They said it was found abandoned but that's not true. I had given move out notice for myself ****** and not ****** in which ****** shouldve still been there. I dont know if dalton gave his move notice or if he just left at end of contract. I dont talk to him as this debt has now destroyed our friendship. M.a.r.s has not honored their agreement with me. If they are so confident that i didnt request to move out or request to the removal from my credit than i want a copy of all phone records and recordings that were had with them. As a debt collector youd think theyd have some sort of recording. If they cant provide phone recording, i want it deleted immediately and compensated $1,000 for being harassed, for being lied to, for tactics to collect a debt not owed. In accordance with law 15 U.S.C 1681c (a) states information excluded from consumer reports. Except as authorized under section (b). Section b states the report is is being provided to an insurance company for purpose relating to engaging in the business of insurance other than property and casualty insurance. If we go back to u.s.c 1681c section a paragraph 5 says any other adverse item of information, other than records of convictions of crimes which antedates the report by more than 7 years. This mean the adverse collection is in violation of the fair credit reporting act. This is not a conviction, the account is also no longer in collections with my name. Please delete immediately from credit report. If not i want a copy of our phone calls including the one where mars claims i called and only requested the to pay half. I know i asked for it to be removed from credit report as i was super excited and told all my family members about the lovely news that never came true cause of mars and their lies

    Business Response /* (4000, 11, 2022/11/28) */
There seems to have been a large miscommunication when you spoke to the representative on your account. We will submit the deletion to your credit, please give this a 30-60 days to update, and if you have any questions please contact our office.

    Consumer Response /* (2000, 13, 2022/11/29) */
(The consumer indicated he/she ACCEPTED the response from the business.)
I will accept it being deleted from all reports, screen shoted the response from them. Will follow up in 30-60 days to ensure it gets deleted this time.

Well, you could start by calling our office at XXX-XXX-XXXX and we could take your payment over the phone without giving out your address. Or, you could come to our office and pay cash with zero trace of anything about you.

How exactly is this a complaint about our company?

    Consumer Response /* (3000, 7, 2022/09/28) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I am not able to come to your office. I am not able to call as to i dont think you understand in protetuve police company at the time. Is there a way i can pay this online?

    Business Response /* (4000, 9, 2022/09/29) */
Yes, you can pay on our website, or you can go to Walmart and do a MoneyGram, or you can go to your bank and do a bank wire. You could call our office from a payphone too if you're worried about calling from a personal phone.

When this collection agency notified me that the have a debt from Mission Point Apts. I immediately notified them that the debt was in dispute. It is not for rent covered under my lease, it is for a service promised that was never performed and therefor deducted from my last month's rent. I have a legitimate dispute with Mission Point and instead of researching it and responding, MARS put this on my credit and is pursuing the debt.

    Business Response /* (1000, 5, 2022/09/02) */
The charges are from rent, pet rent, late fee, & water billing. We received the dispute from Ms. ******, and validated the debt. See attached for a breakdown of charges. You will see at the beginning of April there were charges totaling $1,059.09 and after a payment of $409.09, receiving credit for the deposit of $150, then adding back in the two water bills ($31.33 & $15.67) the remaining balance is $547.00

    Consumer Response /* (3000, 7, 2022/09/05) */
(The consumer indicated he/she DID NOT accept the response from the business.)
THIS IS NOT FOR RENT, PET RENT, LATE FEE OR WATER. All of those charges were paid. The balance represents $600 for carpeting that Mission Point had promised to provide me and never did. See Kim Kirby as she made the promise. I lived with dog pee infested carpeting for 18 months and they refused to live up to their agreement. I did not violate my lease agreement and everything that was billed to me according to that agreement has been paid. Do your research.

    Business Response /* (4000, 9, 2022/09/07) */
If you will review the charges attached to the previous answer you will see exactly how the balance was figured. Our company in no way makes the charges, or has anything to do with what is charged. Our goal is to help resolve balances placed in our office.

    Consumer Response /* (4200, 11, 2022/09/09) */
(The consumer indicated he/she DID NOT accept the response from the business.)
Account sent to collections is fraud. My contractual obligations for rent etc. have been met. The balance represents the cost of carpeting the corporate office promised to replace and did not. Those are the facts. I do not owe Mission Point for rent or anything else. Go back to the client and ask them for the facts not fraudulently created documents.

    Business Response /* (4000, 13, 2022/09/12) */
Please provide the paperwork where Mission Point stated they were replacing the carpet.

The charges have absolutely nothing to do with carpet, and only consist of rent & water bills. Attached you will find a move out condition form. Please review and find there is nothing about carpet anywhere on the charges.

    Consumer Response /* (4200, 15, 2022/09/13) */
(The consumer indicated he/she DID NOT accept the response from the business.)
That is because they have sent you fraudulent documentation. I was dealing with them for over a year about this and finally took my money back the only way I could. I DO NOT OWE FOR RENT, WATER OR ANYTHING ELSE. If you do not remove this from my credit and send this back to your client, I will pursue legal action for putting false charges on my credit.
