I own a condo at a complex that consists of 48 units. We recently had a special assessment meeting, during which we voted to ratify or not the special assessment/ to obtain or not a loan in the amount of $1,950,000. I asked for the detailed breakdown as there were multiple violations identified. The tally sheet provided by AMS is discrepant with the breakdown they provided during the meeting (pros/cons/ number of abstained as well as the number of participants - this was documented by multiple owners). I was voting by voice both rounds and I was against ratification. The tally sheet the company has provided shows my vote result as a yes. My vote result was FALSIFIED. There are other owners whose vote results are discrepant as well. Based on the above findings 52% of the owners signed the petition requesting a revote. AMS never replied to my email to address the petition. On the top of that they excluded me from the list of notifications. I am finding from other owners that The Motion was passed. This company violated WA state law >> In addition to vote rigging, some homeowners were not notified about the meeting, they didnt send proxy forms. Additional consideration: Monthly assessment presented by AMS is based on the full amount, while the interest should only accrued on the money currently advanced. A standard commercial construction loan advances progress based payments. It is also very suspicious that the full amount is being requested upfront as there are multiple projects lumped in the estimate. The homeowners are asking for bids that support the $1,950,000 project, the loan agreement to check the conditions. AMS ignores all requests. This is a fraudulent company that violates laws on a daily basis.
