I purchased an air conditioner listed as 10,000 BTU, worth $530 with dimensions of 21.5" X 19" X 14.5".
I got a 5,000 BTU unit worth $191, with dimension of 16" X 13" x 12".
I purchased another air conditioner of 18,000 BTU listed as open box. The unit was physically damaged; parts inside rattled when picked up and when the unit was turned on, it wobbled so bad it almost fell off the table.
I purchased a dehumidifier that, when turned on it, gave an error code and does not collect any water.
These purchases cost me $450 for broken and deceptively advertised items. The discount place states they are not responsible for mismarked items. Mismarked items or deceptive advertising?? This is a racquet.Business Response

For the past week I have used Mac Discounts for purchasing items at a price at a discounted price. I bid on several items for my home and classroom. When I bid I knew there were fees associated with the purchase. The fee that I am filing this claim for is based upon a Buyer Premium fee. The Buyer Premium fee is put on the invoice after the sale is final. My complaint is that Mac Discounts does not give notice in their terms and conditions as to how the fee is derived and therefore is assessing fees to the consumers full disclosure as to information on the rate or how the fee is determined. After making several purchases I noticed the fee varied from $3 to $60. Therefore there’s no way the consumer knows the final purchase price for the items until the invoice is paid. There are other fees that are disclosed as to how they are assessed, but not the buyers premium fee. In one case the buyers premium fee was more than two of the items that I had purchased. I would like a full refund of all fire premium fees made on my purchases at Mac Discounts and I would like the company to disclose to consumers how this fee is derived. I have attached several pictures of invoices with the buyers premium fee.
Sincerely,

The fees associated with auction participation are disclosed multiple times prior to bidding. All bidders are required to agree to the Terms and Conditions of the Auciton when an account is created. Here is the section relating to fees:
2.11. Buyer’s Premium - M@C may, in its discretion, charge a buyer’s premium, lot fee or other service charge on items sold (including any applicable sales or value added tax or similar taxes in the relevant jurisdiction at the current rate). All such charges will be indicated on the specific auction terms and conditions. If charged, the buyer’s premium shall be collected directly from each successful User, in addition to the lot fees, sales tax and purchase price as bid.
In addition, the specific auction fees are displayed to the bidder once again prior to placing a bid on an item. Specifically, the attached image is the page displayed to Leslie Maben prior to the bid being placed. All fees are clearly stated - 15% of the final bid price plus $2.00.

Purchased 8.4.16
Paid $33.81
Business posted the item for sale as a Electric Pressure Washer with Spray Gun. The picture listed for the item was shown as the PowerSmart brand. Upon picking up the item I noticed this was not the PowerSmart brand, but the Hyper Tough brand sold at Walmart. No big deal. But on top of this, I remove the item from my vehicle this past weekend to test it out. What this business labeled and gave me as a pressure spray gun, has a manufacturers label on it stating it is actually a cordless pole saw!! This false advertising and fraud by the company. I am including photos to show what was advertised for sale, as well as front/back photos of the item they claimed was a spray gun for the pressure washer. Notice the yellow bar code label they put on the item stating it was a spray gun, and then the other photo (with the item turned over) showing the manufacturers label stating it is a cordless pole saw!
I don't want this company telling me it was my job to inspect the item during pick up when clearly there employees go around mislabeling stuff to rip people off.Business Response

If the item received was not the item listed in the auction, please return it for a refund. There is nothing malicious or fraudulent behind a simple mistake by the individual building the auction. It is always easier to contact us directly rather than venting online. Bring the item to any location between 12:00 pm and 6:00 pm to have the item reviewed by management.Customer Answer

Better Business Bureau:
I accept the response from the business, and will return the item as requested to see if they offer me a refund. I was able to finally speak to someone on the phone about this. However, now the business has blocked me from using there website wich is very unprofessional!!

The item in question was sold as an Open Box item. The listing was 100% accurate, and described the item being sold. Per the terms and conditions of the auction, and Open Box item is :
Open Box items were sold by a retailer, and potentially used before being returned by the customer. Open Box items may be damaged or have an opened box with missing pieces, so unless the condition of a specific item is explicitly stated, you should not make any assumptions about it other than that it may be ripped, scratched, non-functional or otherwise damaged. All Open Box items are sold AS/IS. M@C makes all items available for inspection prior to bidding, it is the responsibility of the User to inspect all items before placing a bid on the Site.
All bidders have the opportunity to inspect items prior to bidding. If they elect not to inspect, we offer a Buyers Assurance option where the bidder can purchase a return policy for the item. If the bidder elects neither option, then the item is sold as/is and all sales are final.
