I am rejecting this response because: I have not lived in Texas in over seven years. I dispute this as this is not my account and they have failed to properly validate the debt per FCRA. This is fraudulent and my attorney and I will be suing for my $1000 plus attorney fees if this is not immediately removed from my credit file with the three bureaus. THIS COMPANY IS VIOLATING MY CONSUMER RIGHTS (FCRA) violated 15 usc 1681a(2)(B), 15 U.S. Code 1681b(a)(2), 15 U.S. Code 1681(A)(2), and 15 usc 1692j(a) as well as other statutes that will be named in our lawsuit. I will be contacting the FTC and Attorney General’s office and encourage others to do the same.

Not sure of the date, sometime in 2018, ****** submitted a collection to this fraud agency stating I owe over $3500 from the school when in fact ****** will not dismiss the collection by this agency. This is a fraudulent company and quite frankly ****** has joined them in that category. I don't care about paying the agency, it's being paid through the school directly. I owe $3,000 even now. I don't need this on my credit report when it's in good standing now with the school. This should be immediately withdrawn and paid off because it's being paid directly through my payment portal on the website with the school. They should be shunned for picking such a fraudulent company that isn't even accredited with the BBB to begin with. I want this GONE from my credit report as paid in full. I'm not paying them. You have DEFRAUDED me for the last TIME! Notice to AGENT is a notice to PRINCIPLE, notice to PRINCIPLE is a notice to AGENT! It has come to my attention that ABILITY RECOVERY SERVICE#**********, Amount: $6,980, *********************** received payment on a debt that was canceled and still preceding to collect from me. I demand that the following account be removed immediately: Per 15 U.S. Code § 1605, the finance charge is an INSURANCE that protects the lender in the event that the obligor defaults. The payment status of this account is in default, which means you received INSURANCE money! This account was then illegally listed on my consumer report as a collection/charge-off. According to the IRS any amount over $600 dollars, where a creditor cancels a debt, a 1099c form must be sent to the obligor or consumer. I never received my 1099c for this canceled DEBT! Therefore, you are coercing me into paying the balance, which is FRAUD-in-the-factum. Since insurance money was collected, the IRS identifies charge-offs or canceled debt as GROSS or INCOME! Income does not get reported on the CONSUMER REPORT and TAX FRAUD has been committed! I am rejecting this response because: The basis for my dispute Ability Recovery Services LLC, JOSEPH,ABILITY RECOVERY SERVI Acco, **********,$6,980 -was required to notify me prior to 03/01/2021, or no later than 30 days after.
ABILITY RECOVERY SERVI Account failed to notify me about reporting derogatory info. to Equifax, Experian, and Transunion In section 603(p) 15 U.S.C. ss 168s-2(a)(7)(A)(I); The notice required under subparagraph (A) shall be provided to the customer prior to, or no later than 30 days after 03/01/2021, furnishing the negative derogatory information to a consumer reporting agency described in section 603 (p), 15 U.S.C. ss 1681s-2(a)(7)(B)(I). Plus broke commercial law under UCC § 9.501 that all notices were timely and properly given by dated certified mail receipt. They were not met. I asked for documentation &received no response.
Also, ABILITY RECOVERY SERVI Acco" failed to give me my "Mini-Miranda" five days prior to placing this derogatory item on all of my credit reports, per Section 807(11) & FDCPA §809, which is $1000 per violation and the state of TX allows treble damages.
Under § 809. Validations of date and Mini-Mirandi under Section 807(1)Ability Recovery Services LLC, JOSEPH failed to send me my initial communication before placing this alleged derogatory status on my credit reports further violating the FCRA, I understand that according to the Fair Credit Reporting Act, failing to provide this notice can result in a penalty up to $2500 and can be enforced by the FTC, and that my state attorney general can also enforce this with a $1000 penalty as well.
I attached a copy of the law and the actual document from the federal reserve
ABILITY RECOVERY SERVI Accois held liable as well for defamation and in the state of TX a creditor is who collects their on debt is considered a debt collector under FDCPA. ***** v. ***** 980 S.W.2d693(Tex.App-San Antonio 1989 reh.den.) citing ****** v. ***** 936 S.W.2d 654(Tex.App-Dallas 1996 writ dism'd w.o.j.)
RESOLUTION
I will if the account is not taken back and removed from any and all credit bureau reports, I will turn this over to **** *. FDCPA, TDCPA, and FCRA national Attorney to look and take over this complaint.
Therefore, provide me documentation of notification (i.e. a copy of the notification sent), and proof that it was delivered to me in a timely manner (i.e. a dated certified mail delivery confirmation with my signature).. 30 days before or 30 days after 03/01/2021the date derogatory reporting was started with the bureaus as you have listed or DELETE the reporting. A “strong presumption” of receipt applies when notice is sent by certified mail, because it creates actual evidence of delivery in the form of a receipt. Santana Gonzalez v. Att’y Gen., 506 F.3d 274, 279 (3d Cir. 2007) (emphasis added). A “weaker presumption” arises where delivery is sent via regular mail, for which no receipt, or other proof of delivery, is generated. I do not believe it is accurate and would rather not have to spend more time than necessary for both of us to resolve this situation. Even it's been transferred Ability Recovery Services LLC, JOSEPH is still responsible for reporting under the FCRA

In response to the rejection of our response to the above identified complain find the following:
1. Complainant lists as a basis of dispute that Ability Recovery Services, LLC was required to notify consumer no later than 30 days after 3/01/2021. Ability Recovery did send a validation letter dated March 11, 2021 setting forth consumer's rights . This letter was sent regular mail as required by law. This letter, and a series of subsequent letters to the consumer were not returned to us as a bad address.
2. The Mini-Miranda was contained in the letter identified above.
3. Under separate cover, directly to the consumer, a copy of the letter will be forwarded to the complainant.

I received a pre sorted letter from them stating that I owe them for an unpaid debt of 2945.14 from ** *********** ***** I. I have no knowledge of this debt and will not be paying a debt that was opened fraudulently in my name. Someone tried in the last week to open a credit card in my name as well. I received a notification that my credit score dropped 40 points due to a delinquent emergency room bill that was placed on my credit report. I called Ability Recovery and spoke with a female who tried to convince me that I was seen at a hospital in 2017 and skipped out on the bill. I thought this was some kind of joke because I have never been to an emergency room in my life. She proceeded to say that I may have forgotten about it since it happened in 2017. I explained to her that I have no knowledge of this bill and will not be bullied into paying for anything I knew nothing about. Please investigate this fraudulent business. I was notified that i had 6 new collection accounts on my credit profile from ability recovery service when I first called I was told there was no information connected to my name social security number or address (potential violation fdcpa states debt collectors can not deceive you) I had to call trans union then ability recovery service again before finding out what was going on no one had ever sent me not 1 letter or phone call to attempt to collect,verify, or validate a alleged debt before reporting a alleged debt from 5 years ago under the fair. Credit reporting act (fcra) I have 30 days to respond with a validation letter to validate the debt witch I never got the chance to do witch is yet again another violation they were told about the alleged debt 07-11-22 and reported it to the credit bureaus 08-17-22 so even if they did send a bill and I had the chance to send a letter to validate the alleged debt and wait for there response they didn't even have the time to give me the 30 days but they never sent anything or even called witch is a violation and if they say it was do to not having the right information about me that would mean they have reported inaccurate information to the credit bureaus witch also is not allowed under the fdcpa the have said the debt was validated yet has failed to produce a hippa release or any contractual agreements or breakdown of any fees connected with the alleged debt however since they violated my consumer rights by never contacted me or give me the 30 days im entitled to so I could ask for validation by law it was never a possibility when I made a phone call a week ago in an attempt to validate all they validated was my name and address and since i was a victim of identity fraud that validates nothing I spoke to them and told them that next year any debt under 500 will be removed in 2023 they told me that wasn't true witch is another statement to deceive me in a attempt to collect I would like these accounts removed asap!!!Business Response
