Advance America is mailing my address junk mail or otherwise to someone who is not me that does not reside at this address of **** *** **** ***** * **** ** *****. Janae L** is the name on these mailings . I have returned these to sender which is **** ******* *** *** , **** ** *****. This is the local Advance America here in Bear. I right on these envelopes to remove this name from their mailing list . Nothing changes they continue to send them . There is no way call them either . I received this email that from Evelyn W***** Advance america will be taking legal action against me.I do not recall ever taking out a loan with them, but the email did come off as threatening so I wanted to make sure this wasn't a scam. CASE NO: ********* AMOUNT OUTSTANDING: $2858.57 This Proceeding issued on you Docket No: - ********* with one of ADVANCE AMERICA INC. Company in order to notify you that after making calls to you on your phone number we were not able to get hold of you so the accounts department of “THE ****** LAW FIRM” has decided to mark this case as a flat refusal and press legal charges against you. We have sent you this warning notification about legal proceedings on March 14, 2022 but you failed to respond on time. Now it’s high time if you fail to respond in the next 12 HOURS we will register this case in court. Consider this is a final warning and we will be Emailing/Fax this issue to your current employer to make sure they take strict actions against you. Your salary and all your wages are confiscated. We will be forced to proceed legally against you and once it is processed the creditor has entire rights to inform your employer and your references regarding this issue and the lawsuit will be the next step which will be amounting to $7456.79 and will be totally levied upon you and that would be excluding your attorney charges. In the complaint, ***** ******* states an
email was received regarding a “$2858.57” debt with Advance America. *****
******* states the email “did come off as threatening so I wanted to make sure
this wasn’t a scam.”
After a diligent search of our records, we
could not locate any accounts using the personal information provided in *****
*******’s complaint. Advance America would never threaten a customer with legal
action that could not lawfully be undertaken, nor would it condone such
behavior by third parties acting on its behalf.
The
communications complained appear to be part of an effort to defraud customers,
like ***** *******, by falsely claiming to represent Advance America and further
using what appear to be improper and illegal collection practices while doing
so. Advance
America has previously communicated similar efforts to state and federal
regulators as well as the Federal Bureau of Investigation and local law
enforcement agencies.

In
the complaint, Ms. ******* states that she has requested confirmation of the
legitimacy of the debt that is being reported as a tradeline on her credit
bureau. Ms. ******* is requesting the late payments to be removed and the
validation of debt.
In Texas, Advance America operates as a Credit Services
Organization (“CSO”) and assists customers in gathering information to provide
lenders for making credit decisions. At the customer’s request, and in
consideration of a loan extended by a lender, Advance America issues a guaranty
to the lender. In the event the customer
defaults, the lender calls for payment on the guaranty. Due to the customer defaulting on the loan
for non-payment, and the guaranty being called by the Lender, the customer will
then owe Advance America the unpaid loan amount, which is what occurred with Ms.
*******.
According to our
records, Ms. ******* entered into a Loan
Agreement, Promissory Note and Security Agreement (“Agreement”) on April 13, 2017. Ms. ******* agreed
to repay an amount of nine hundred five dollars ($905). After multiple attempts
to reach Ms. ******* and not receiving any payments as agreed, her loan was
sold to ***** ********* *** on June 10, 2022.
We recommend Ms. *******
reach out to ***** ********* *** at ***** ******** to discuss mutually
agreeable payment options and concerns related to her credit bureau. If Ms. *******
did not request this loan, she may submit a Police Report or FTC Identity Theft
report to ************************************* to assist in the investigation.

America”) is in receipt of a complaint filed by Mr. ******* * **** ******** ******. We have thoroughly reviewed and appreciate the opportunity to respond.
In the complaint, Mr. & Mrs. ****** state they were offered a
$5000 loan, submitted loan documents, however, was sent “…$2000 in insufficient
funds checks.” Mr. & Mrs. ****** state they “just want money and file bank
fraud on their company so they can’t cheat anyone else.”
According to our records, Mr. ****** entered into a Customer Loan
Agreement (“Agreement”) with the Advance America storefront located at ***** ** *********** ***** ******* ** ***** on June 2, 2023. Pursuant to the Agreement,
Mr. ****** agreed to repay an amount of three hundred eighty dollars ($380) in ten
(10) bi-weekly payments of thirty-eight dollars ($38) due on October 13, 2023. To
date, Mr. ****** has paid as agreed.
According to our records, Mrs. ****** entered into a Customer
Loan Agreement (“Agreement) with the Advance America storefront located at
***** ** *********** ***** ******* ** ***** on June 8, 2023. Pursuant to the
Agreement, Mrs. ****** agreed to repay an amount of one thousand two hundred
seventy-three dollars and fifty cents ($1273.50) in twenty-five (25) bi-weekly
payments of forty-eight dollars and ninety-eight cents ($48.98) and one (1)
final payment of forty-nine dollars ($49) on May 31, 2024. To date, Mrs. ******
has paid as agreed.
The communications complained of appear
to be part of an effort to defraud customers, like Mr. & Mrs. ******, by
falsely claiming to represent Advance America. Advance America would never
deposit funds into a customer’s account only to request their immediate return.
Advance America has previously communicated
similar efforts to state and federal regulators as well as the Federal Bureau
of Investigation and local law enforcement agencies.
We recommend
that Mr.
& Mrs. ****** continue to document all details of any such
communications in the future, not disclose any personal information to the

with an original contract as he requested and is looking to have the account

I used Advanced America's services in 2019 - 2021 when I was suffering a hardship. I was able to get back on my feet and no longer needed their services. Months after no longer using their services I would receive text messages or phone calls where they would attempt to solicit new promotions or services. I requested to have my information removed and placed on the do-not-call list. Time would pass and again attempts to solicit services from me where I would again request my customer data to be removed from their systems to which they agreed to. I just received a notice that in February of 2023, there was a data breach and my private information was compromised.
This was quite ironic because even though I had requested since 2021 to have my data removed from their systems, from February 2023 to August 2023 I have received over 209 texts and phone calls as well as hundreds of emails from spearphishing scammers claiming to be Advanced America or other loan companies. There were days I would receive up to 20 calls and texts about loans I never applied for.Business Response

Ms. ****** states, “I just received a notice that in February of 2023, there
was a data breach and my private information was compromised.” Lastly, Ms.
****** states she is receiving “…over 209 texts and phone calls as well as
hundreds of emails from spearphising scammers claiming to be Advanced America
or other loan companies” and “…up to 20 calls and texts about loans I never
applied for.”
We regret any inconvenience this event may have caused.
Supporting Ms. ****** and safeguarding her information are at the center of
everything we do at Advance America. Cybersecurity presents an ever-evolving
threat for all businesses; it took time to complete a thorough investigation to
identify any customer personal information impacted. We are confident this
incident has been contained and there is no ongoing threat to our system. We
have also implemented additional security measures and protocols to further
fortify our network, and we will continue to look for ways to bolster our
network security.
Upon receipt of Ms. ******’s correspondence, her account was
reviewed to ensure it has been notated that she does not wish to receive
marketing communications from Advance America.
Advance America is required under state and federal regulations to
retain certain customer information regarding Ms. ****** and her transactions
with Advance America.
Advance America has no reason to
believe the communications Ms. ****** refers to in her correspondence are
related to the event that occurred in February 2023. The communications may be an effort to
defraud consumers by falsely claiming to represent Advance America and other
companies. Advance
America has previously communicated similar efforts to state and federal
regulators as well as the Federal Bureau of Investigation and local law
enforcement agencies.
We recommend that
Ms.

I am a man not a woman why and I being referred to as Ms ****** and Ms ***** ******? I am a cisgender man and have been a male since birth. This is insulting and entirely unprofessional assuming someones pronouns. This BBB course of action is absurd not only is Advanced America evading any wrongdoing they are denying negligence from mishandling customer cardholder data. They are also denying documented proof of the damages they caused. This is entirely irresponsible. A notification letter does not fix the inquiries to ones credit score nor the lost time from harassing emails, disruptive phone calls, and text messages ALL OF WHICH could have been avoided had Advanced America removed cardholder data when the customer requested.Business Response

addressing “any wrongdoing they are denying negligence from mishandling
customer cardholder data.” Mr. ****** states that Advance America is “denying
documented proof of damages they caused” and “a notification letter does not
fix the inquiries to ones credit score nor the lost time from harassing emails,

As stated in the September 7, 2023, response, we regret any

I applied for a loan and received a call from an individual claiming to be from Advance America calling from ************. This person left a voicemail and I asked my wife to return the call as I was unable to and we desperately needed a loan due to substantial medical expenses. She called and confirmed all the information with this person, including our banking info.
I then went through a process to “link” my bank account so that Advance America could see our info. A couple of hours later, this same gentleman called back and began telling us that they would need to do a deposit of an amount between $700-$900 to “confirm the bank account.” This person then instructed us that to return the funds, we would need to go to a store such as Walmart and get a card to repay the $700-$900 “test deposit”. At this point, we ended the call and did not proceed. Now we have to change ALL of our banking information since this person had it, and this includes going to each institution we pay our bills to and stopping payment on things that are pending, which is going to put us even further behind.Business Response

of a complaint filed by Mr.
******** *******. We have thoroughly reviewed and appreciate the opportunity

In the complaint, Mr. *******
asserts the following:
“I applied for a loan and received a call from an individual claiming to be from Advance America calling from *************”
Mr. ******* states the reason they needed a loan was due to “…substantial medical expenses.”
Mr. ******* states that his wife contacted the individual back and “…confirmed all the information with this person, including our banking info.”
Mr. ******* states he was told the company would have to deposit funds into his account to “confirm the bank account” and the amount would be “…between $700-$900”. He was later instructed to “…get a card to repay the $70-$900 ‘test department’.”
Mr. ******* states he did not proceed, however, he feels he must change his bank account information due to “…this person had it”.

On August 11th I ***** ******** was attempting to get a 10,000 loan from a man named ****** ***** who said he was with Advance America. He told me he would deposit random amounts of money totaling $1,781 into my account for good faith and that I in return would cash in 1,750 back to him and after that transaction my 10,000 would be in my account. He sent me a barcode that was verified by my bank ******. The 10,000 never came into the account because he said I had a negative balance. So he said we had to wait until that Monday the 14th where he would deposit an other amount totaling $2,179. He said once I returned the money the 10,000 would be in my account by 9am that day. I went to ******* like he asked and the money center said there was an issue with the transaction and it came from his end. I called and texted that I called my bank n they confirmed it was indeed from his end. He asked me to send a screenshot of my account balance and I did so. After that he never returned my calls or text n now my bank account is negative $3,108 the total fir the mobile deposits he made to my account. I had no idea this was a scam because I never borrowed such an amount before n thought this was normal. My bank says I can’t recoup the money and my balance remains negative. In the complaint, Mr. ********
asserts the following:

Mr. ******** states he was sent a barcode, however, he never received the loan proceeds he was promised.
Mr. ******** states he was told he would need to get an additional deposit and would be requested to send back a portion of those funds as well.
Mr. ******** provided the phone numbers that were provided to him “***********.and ***********.”
Lastly, Mr. ******** provided a screenshot of the loan approval document naming “Advance America USA” as well as the barcode that was sent to him.
After a diligent search of our
records, we could not locate any open or closed accounts for Mr. ******** using
the personal information provided in his complaint. Advance America would never
deposit funds into a customer’s account only to request their immediate return.
Advance America no longer operates brick-and-mortar locations in the state of
Washington, nor do we offer online loans to Washington residents. Advance
America is not affiliated with the business name “Advance America USA” nor do
we own the phone numbers “1-707-********” or “1-707-********.” Lastly, Advance
America does not have knowledge of or record of Mr. ********’s loan request.
These
communications appear to be part of an effort to defraud customers, like Mr.

I got a loan from Advance America back when my car got impounded. Well, when I was told I couldn’t get it back. I forgot about repaying the loan and didn’t. So now I have a collection from them. Whenever I tried calling today 08/19/23 they transferred me to the collections department. The lady there told me that I was not coming back in their system. Even tho on my credit report it shows I owe them money. So she gave me a number to a third party seller. I called the number and it sent me to cox communications… when it was supposed to be ***** ********. I call plaza them self from finding their number online and I sit on hold for 11 minutes and no one answers the phone then I get sent to voice mail. I’m just trying to resolve what I owe so I can clear my credit report of collections that I owe to a payday loan company. It would be much appreciated to have this resolved. The collection has also been added, then removed then readdes again the collection is over two years old but it states it’s been opened for 2 months. Not only that but it dropped my credit report 14 points because there was a error saying that it went up a dollar and when it went down an dollar it caused a hardship and my score declined.Business Response

the complaint, Ms. **** asserts the following:
“I got a loan from Advance America back when my car got impounded.”
Ms. **** states, “Whenever I tried calling today 08/19/23 they transferred me to the collections department.”
Ms. **** states the person who assisted her could not find an account and provided a number to a “…third party seller.”
Ms. **** states she has attempted to contact “…***** ********” however, has been unable to reach someone.
According
to our records, Ms. **** entered into a Consumer Agreement (“Agreement”) with the
Advance America storefront located at ** ** *** ***** ***** *** * ******* ***** ** ***** on May 29, 2018. Pursuant to the Agreement, Ms. **** agreed to repay
an amount of four hundred fifty-five dollars and fifty-six cents ($455.56) on
or before June 20, 2018. After multiple unsuccessful attempts to contact Ms.
**** and collect on the past due balance, her loan was sold to ***** ********,
LLC on December 6, 2020.
Ms.
**** did in fact contact Advance America to inquire about her debt. Ms. ****
was advised she did not have an active account, however, the account she did
have was sold to ***** ******** and she would need to contact them for further
information. We have escalated Ms. ****’s complaint to ***** ********. Further,
we recommend Ms. **** continue to contact ***** ******** at (**** ******** to discuss
mutually agreeable payment solutions as well as her concerns related to her credit
bureau.
