I am not reliable for this debt with ABSOLUTE RECOVERY SERVICe. I do not have a contract with the credit agency that is trying to report this to my credit report . They did not provide me with the original contract as requested.Business Response

This consumer had an account placed for collections with our company by ***************************** on 7/24/2020. This consumer electronically disputed this account 3 times on the following dates 1/25/2021, 3/18/2021, and 8/27/2021. All 3 disputes were answered within the required thirty day time period, and the account information including the tenant ledger, final accounting statement, singed lease contract and a copy of a monetary judgement awarded to our client during the eviction process were provided to the credit bureaus to which our agency reports. These documents in addition to the docket number here in ********* ********************** located at ********************* were sent to the credit bureaus and the account was marked as disputed.The docket number is *******. The consumer can come physically to our office located at *************************************************** and pick up a copy of the validation documents or he/she can also write to us to request the documents be mailed directly to them or lastly, the consumer can call our office at ************ and we will be glad to assist.
Our agency does not buy or sell debt. All accounts are assigned by the original creditor(s). We have contracts with our clients that we represent and are not required to have a contract with a consumer/ debtor whose file has been placed for collections. The account must derive from a written contract in order to be reported and this account meets all legal qualifications to be furnished to the bureaus to which we report.
Lastly, this consumer has NEVER contacted this office my mail or telephone but has filed numerous disputes and now a complaint? There has been no attempt on this consumer's part to ask for more information, discuss the details of the balance owed, nor resolve the matter. Again, if this individual would like assistance, that is what we are here for. To answer questions, resolve disputes and conflicts between landlords and tenants, and legally collect monies owed to said landlords while trying to assist the consumer by offering payment plans and arrangements that best suit their needs. We cannot help someone that does not allow us to do so.
Lastly, if a consumer/tenant breaks a contract due to non-payment, they ARE liable to the original creditor to repay monies owed that derived from said contract.

18811805 was filed by this same consumer on 1/13/2023 and the BBB sent me an email stating the complaint should not have been against our company, it should have been filed to the apartments in question. Please see the attachment.
As to this complaint, this matter has been validated and is reporting to the credit bureaus as a disputed account. I do not know how this consumer came to the conclusion that this would be removed from his credit. He was never told that or received it in writing from our company or the original creditor so it is somewhat confusing, just like the initial complaint that should have been against the apartments, not our company.
Our company does not purchase accounts. All accounts are assigned by the original creditor. We have no legal authority to reduce a claim amount or cancel a claim based on a consumer complaint that was misguided or for any other reason for that matter. In a case of true identity theft where a police report is filed and the authorities believe it to be an honest case of ID theft, we would then ask that it be deleted based on the fraud/crime committed but this is not such a situation. I am sorry that the consumer remains unhappy but it needs to be taken up with the correct entity, not our company.

Original account was through ************************. I paid my rent on time every month except 1 month. I paid every fee that I was charged. All of my utilizes and everything was kept up. I never received any phone calls or emails or text messages regarding the account with ************************ after moving out. Current account says I owe $930. I have since contacted this collections agency by email, phone, and mail. I have not heard back since about said account. I asked specifically for an itemized receipt of everything owed that amounts to that $930.Business Response

This consumer had a balance placed with our office by ************************* on 11`/11/2021. The consumer has disputed the amount placed and her written dispute will be answered within the required time period. This consumer has only contacted our office by EMAIL 1 time and that was on 8/11/2022, almost a year after the account was placed. Our agency has attempted to discuss this matter by phone for over 8 months now but we have yet to receive a call back from our efforts to reach her. The consumer was told via email that our agency does NOT communicate with tenants via email but we would be happy to assist by phone or mail. On 8/16/22 we received a validation request from this consumer. The information requested will be sent out no later than 9/15/22. In the meantime, this person can call or come in to our office to discuss the matter. She also can contact the involved rental property office for additional information.
Our company does NOT purchase accounts. They are assigned by the original creditor. We do not have the authority to "write off" an account as we do not own it. Attached is the final accounting statement from the creditor. As previously stated, all materials will be sent to the consumer including but not limited to the lease contract the consumer signed, the ledger of charges and payments as well as the attached final account statement.
Rather than filing a false complaint, this consumer could have contacted us by phone, told us why she does not agree, and we would forward that to our client in an attempt to verify what was sent to us is correct. Disputing and filing complaints will not cause this matter to go away.
Lastly, if the consumer wants to discuss the matter, we can be reached at ************. In the meantime, efforts shall continue and the amount placed will continue to report as open but disputed, per the law.

I am rejecting this response because:The first date mentioned, November 2021: I was never told by the property or property management company about any owed balances. I moved out in October and never heard from them.
All I am looking for here is the reasoning why I have this debt collection of $900+ in detail. I have contacted this collections company by phone, but I have never received any calls from said company. I did receive the email that said I could only call or mail for inquires. For what Inquire I was told specifically to write a letter and send to you. I have the inability to come physically to your office as I live nearly a thousand miles away from *******, **. I have not received any voicemails from this company in past 8 months. I only recently got this collections account on my credit report within the past 6-8 months, not a year as claimed. I have given my information, mailing address, etc. to this company. Now I know I should hear back in September, 1 month to date from when I sent the letter. A phone call/voicemail would be a great way to update me on the status of this. All other collection agencies have contacted me about my debts except this one. I intend to pay this debt off as soon as I receive in writing what is being charged to total to $900+.

The copy of the consumer's charges are attached. The allegation of attempting to resolve this is somewhat false. The consumer was told when she called how to dispute an account and she did send a written request for validation. By law, we have 30 days to respond and we have already marked the account and reported to credit as a disputed item as required by law. The consumer sent an email and I immediately responded the same day telling her that our agency does NOT communicate with tenants/debtors via email and ask her to call to discuss the debt. She did call but would not speak about the charges and simply demanded an address to send her dispute to. Our response to her dispute will actually be mailed out of office today or Tuesday but I am going to go ahead and attach all the documents that she will be sent showing why and how the charges were incurred. The bulk of the charges are damages done to the unit she was renting including the floors, the refrigerator and the stove.
Our agency does not purchase debt. All accounts are assigned by the original creditor as are the amounts assigned. If this consumer disputes all portions of the charges, we will not ask her to pay any disputed amount. That does not mean that the account just goes away. The account will only be closed if requested by our client, **************, or if the account is paid or included in a bankruptcy filing. If this person wants to contact our office via phone at ************ we will be happy to let her know what amount the claim can be settled for. Repeatedly filing disputes and false complaints are not going to cease the collections process in this matter.
Again, we will be glad to try to work with this person on obtaining an amount from our client that the account may be settled for or by setting this person on payments over time to clear the balance. Please see the attached. It includes the final account statement from the property, the tenant application and the lease agreement signed. **This is basically a duplicate of our first response to the initial complaint. We are under no legal obligation to continue to respond to duplicate disputes or complaints.**

The facts in the dispute are false and all information has been provided to the consumer as requested. This consumer just continues to file complaints and disputes but has failed to speak to anyone in regards to this in order to try to resolve it. If she gets the management company to pull back the file, she can have them contact us. We have reached out to our client who stands by all charges in this matter. Our agency will NOT continue to spend time answering false allegations included in disputes sent to us or allegations included in complaints as all aspects of this matter has been addressed. We attached the entire file to our previous response and will do so again now. This consumer cannot claim to have not received the information as it was mailed and also provided via our last response to the BBB. I am sorry this consumer remains dissatisfied but we do not own the account. If the consumer wants to contact us,we will see if the matter can be settled for a lesser amount but that is all we have the power to do.
