      On April 25, 2025, Santander Consumer USA issued me a refund of $10.00 and confirmed in writing that my auto loan account had been reviewed and closed. I later learned that Santander had filed for bankruptcy and, in the process, removed my obligation to repay the remaining balance. Despite this, the account is still being reported on my credit file as open with a balance of $18,535, and the lien on my vehicle title remains active. I never filed for bankruptcy myself and have not authorized any transfer or sale of the account. If ******************** sold the account, I did not consent to any binding contract or provide a wet signature to any third party.I have made multiple attempts to dispute this issue with credit bureaus and through consumer complaint channels. This misreporting is actively harming my credit and putting me at risk of repossession and financial hardship. I am requesting that Santander release the vehicle lien immediately and update all relevant reporting agencies to show the account as closed with a $0 balance. No further third-party collection or remark should be associated with this account, as per ********************* own correspondence.

      I respectfully reject Santander Consumer USAs response for the following reasons:
      Unresolved ****************************start="392" data-end="395"> Santanders letter (dated 5/13/2025) says:
      To the extent your original obligation was discharged in bankruptcy, or is subject to an automatic stay under Title 11 this is for informational purposes only.
      I have never filed bankruptcy. If Santander (or an affiliate) already received payment through a third-party bankruptcy, *************** or another loss-recovery channel, continuing to collect or report a balance is unlawful double recovery.
      Refund Implies Overpayment or ************************start="916" data-end="919"> On 4/25/2025, Santander issued me a $10 refund check. That refundpaired with the bankruptcy disclaimersignals the debt was satisfied or overpaid. Yet Santander still reports an open balance of $18,535 and refuses to release the lien on my vehicle (VIN *****************).
      Unauthorized ***************************start="1235" data-end="1238"> Santander claims the account is now serviced by Santander Bank, N.A. I never signed or consented to any servicing transfer. No wet signature, contract, or proper notice was provided, violating my due-process rights and the Truth in ****************************************************start="1529" data-end="1532"> Santander continues furnishing an open/active tradeline with a balance to TransUnion, Experian, Equifax, and Innovisdespite the conflicting discharge languageviolating the Fair Credit Reporting Act (15 U.S.C. 1681s-2) and FDCPA (15 U.S.C. 1692e).
      Missing 1099-C and *********************start="1833" data-end="1836"> If the debt was canceled or otherwise satisfied, Santander must issue IRS Form 1099-C under 26 U.S.C. 6050P and terminate the lien per UCC *****. They have done neither.
      Requested Resolution
      Immediate lien release and corrected title (clear of encumbrance)
      Correction of all credit-bureau data to show $0 balance / closed or discharged status
      Written proof of debt discharge or third-party payoff and any 1099-C issued
      Proof of lawful servicing rights by Santander Bank, N.A. (signed agreement)
      Until these steps are completed, the matter is not resolved.

      Complaint Type: Debt ******************* Reporting Misconduct Nature of Complaint:I am filing a formal complaint against Chrysler Capital, also known as Santander Consumer USA ***** for multiple violations of the Fair Debt Collection Practices Act (FDCPA), the Uniform Commercial Code (UCC), and the Fair Credit Reporting Act (FCRA). These actions have caused me substantial financial, emotional, and reputational harm.Summary of Issues:1.Lack of Pre-Repossession Notice (UCC 9-611):I did not receive any advance written notice of repossession, nor an opportunity to redeem or cure the alleged default before my vehicle was ********** Post-Repossession Accounting or Notice (UCC *****, 9-616):I never received the required notices explaining the sale, accounting of the proceeds, or calculation of any alleged deficiency.3.Breach of Peace:My vehicle was repossessed without any knock, warning, or notice, and my personal property (including a childs car seat and other belongings) was taken. This constitutes a breach of the peace under Michigan law.4.False and Harmful Credit Reporting (FCRA):Chrysler Capital continues to report negative information to credit bureaus without verifying the debt or responding to my dispute requests. This has resulted in a credit denials and ongoing financial hardship.5.Failure to Validate Debt (FDCPA 1692g, 1692h):Despite my formal written request, Chrysler Capital has not validated the debt by providing a signed contract, proof of claim, or payment records. They have not honored their obligation to apply disputed payments properly under federal law.6.Improper Use of Personal Address Information:A collection notice listing my mothers address and sensitive information was mailed in a way that others could view the contents, which is a privacy violation.

      I purchased my vehicle on February 18, 2023 and entered contract with this company. It has been nothing but one lie after another anytime I speak with them. It has been nothing but problems. The company has for the last 2 years been taking 100% of my monthly payments and putting it towards interest. I already have a high interest rate of 21.6% and for the last 2 years no percentage of my payment has been applied to my principal. I recently realized this after we ran into some hardship and looking at my past statements. They claim all of my payments are going toward interest due to late payments. This is also untrue. I have documentation that I had payed on time for over the first year. Yes while we had some financial difficulty recently due to a medical reason this company has done nothing but threaten us , falsely report to the credit bureau's negatively affecting our credit rating so that we can not even refinance the loan elsewhere to get away from this predatory loan company. Upon speaking to several representatives over the last 4 months to try to get an amount to pay and make arrangements to pay it I have been told 4 different totals, and each time I speak to a new representative they claim the last one i spoke with was not calculating this or that or just flat out lied to me and then they would promise they were telling me the truth and accurate information. upon research i have found out this company has had several lawsuits for predatory loan service issues and they do not have the right to pay 100% of my payment toward interest and nothing toward my principal. At this rate I will never get my truck payed off and stuck in a never ending cycle of their abuse. The initial amount financed 02/18/2023 was $34,618.51 and they still say i have a principal balance of $33, ****** after 27 months of payments of $869.48. Broken down appropriately with my interest rate I should have already payed $18,402.93 toward my principal.

      Ongoing Billing Error and Misapplication of Payments Dear Santander Customer Service,I am writing to formally address a recurring issue regarding the misapplication of my payments on my account. Despite making additional payments intended to cover outstanding late fees, Santander has consistently applied these funds toward the principal balance instead. As a result, the late fee continues to carry over month after month, causing an ongoing and compounding error.I have made multiple attempts to resolve this matter through phone calls; however, each time, the issue remains uncorrected, and my requests to properly apply the extra payments toward the outstanding late fees have been denied.This persistent error, resulting from Santanders internal system or processes, is causing undue harm to my account standing. I respectfully request an immediate review and correction of my account to ensure that the payments made are properly allocated to the corresponding late fees. Failure to address and correct this error may result in escalation, including but not limited to filing a formal complaint with the appropriate regulatory authorities.Please provide a prompt response confirming the correction of this matter.

      I purchased a truck in March of 2022 and have made $700.00 monthly payments while living paycheck to ********. Sister cosigned for this loan, then filed Chapter 13, and had to relinquish responsibility for the truck. She did so without placing the truck in the Chapter 13 schedule. Sandhander refused to correspond with me even though I was the person making the payments and am the principal on the title. I became behind on payments and verbally communicated. Without notice, my truck was repossessed. They told me that because it was under a bankruptcy, they did not have to communicate with me. I spoke to the sister's attorney and they advised that this is not correct and that they were legally obligated to notify you. I have not received any statements or correspondence from Sandhander for several months. I obtained a loan to get my truck out of repossession, however, Sandhander refused to provide the company providing the loan the exact amount I needed to get the truck out of repossession. They have neglected to help me and Have provided less than poor customer service. The scehduled day for auction is the 9th of May, 2025, and even though the auction can be avoided, they are exploiting my situation and refusing the help I deserve.

      Checked was cashed without my signature. **** currently has check and its for hail damage in which State Farm is not able to cancel check because it has already been cashed without my authorize signature.

      Someone forged my signature and here is the check to prove it. As you can see the on the signature they misspelled my last name which is committing fraud. Because the check has been cashed by someone. State Farm is not able to reissue payment or even cancel it which means currently my car can not receive repairs. I mailed the check for Santander endorsement and even included a letter stating thats all I needed in order to cash the check. I also included my information in which they were suppose to mail check back to me. Again as you can see on check. Whoever signed it signed Springfellow and not ************.

      Purchased a car December 16, ***************************************************** license plate because the car does not have a title so I cannot get it registered it is now May 6 and still no proof of title to get the vehicle register so I cant complete my daily job of delivery the temporary tag I have in my window expired March 16, 2025
