Complaint is for an invalid warranty period provided by ***. The warranty started before contracted work was complete.- Issued 5 Year Warranty showing Completion Date of 8/30/18, which was prior to completion of contracted work.- ***s subcontractor Green **** Solar completed re-installation of pool solar heating piping 11/2/18.- Owner noticed leak in master BR at rear corner next to lanai & contacted *** in Nov., 2020.- *** repaired leak at ***** parapet wall 11/16/20.- Owner noticed leak on opposite side of lanai with ceiling water stains in back bathroom in early-Sept, 2023 & called ***. After calls not being returned, owner went to the *** office and spoke with ***********************, explaining the inconsistency of the *** warranty vs. the completion of CRMs work. ***** stated this location, under sofit next to parapet wall is a common location for leaks and sent punch crew to look at roof.- Small opening on a vent pipe was repaired with caulk in mid-October '23. - A month later it rained, water stains in bathroom got worse and tested wet with moisture meter.- Owner called *** multiple times starting in October with no response.- On 3/20/24 owner received call from ****** saying she was trying to get warranty repair approved & scheduled.- After several ************* to ******* to determine status with no response owner went to the office on 4/23/24 and was told everyone was in meetings. - Owner emailed *** *** *********************, and ************** responded, We already came out to your house and fixed a rodent damaged lead **** for free last year. Unfortunate that wasnt the cause of the leak and ************** missed the fact that current leak occurred prior to end of the warranty period.- Bottom line - Roof was leaking prior to time the warranty should have expired (5 years after the initial contracted work was completed). The type of leak appears to be identical to the leak that was previously repaired (not sealing up under and against the parapet wall properly).Business Response

CMR completed repairs on this home initially in 2023, even though it was outside of the warranty period and the warranty had been voided due to the roof being affected by Hurricane ***. Additionally, the leak was from a rodent that chewed a hole in the pipe flashing. In response to the warranty period, the warranty period starts based on the completion of the roof portion of the project and the final inspection. Attached is the *** from the county showing that the final permit was closed out on 9/10/2018. Even if I push the warranty date up to 9/10/2018, the warranty still expired on 9/10/2023. We repaired the roof on 10/16/2023 which is over a month after the warranty expired. Which was honestly a show of good faith because it was outside the warranty period and the warranty was voided by the hurricane on 9/28/2022. The homeowner is responsible for maintenance to their home and CMR is willing and able to help but unfortunately, nothing will be under warranty at this point.Customer Answer

I am rejecting this response because: I do not accept a warranty period beginning before all the work contracted for the roof replacement is complete. The initial tile installation may have been completed in September, but CMRs sub-contractor that removed and re-installed the pools solar heating piping was not complete until November 2,2023. More importantly the leak is located where the solar piping was reinstalled.
I also do not accept the warranty period be voided by Hurricane ***. Our location did not experience hurricane force winds and there was no wind damage experienced at our home or in our neighborhood. Subsequent inspections by our home insurer found no damage to the roof, or the flutteror loosening of the tiles that helped CRM obtain insurance coverage for the replacement initially.
Furthermore, Initial attempts to contact CRM about the leak were made prior to the 9/10/23 referenced date. However, my only contact with CRM had with the Project Manager, who was no longer with the company. It took several day to find an address of there current location.
The halfhearted repair that was attempted in October *********************************************************************************************************************** confirm the repair.

CMR's warranty paperwork is very clear on when the warranty starts and ends. The solar install has no bearing on the warranty period of the roof. Nevertheless, the roof is outside of warranty so there is nothing CMR has done wrong here.Customer Answer

I am rejecting this response because: I, as the homeowner, entered into a contract and paid CMR to replace the roof. Included in CMR's scope of work was removal and replacement of the existing pool solar heating piping mounted on the existing roof. Therefore, I paid CMR and they were responsible for hiring their own sub-contractor to remove and re-install solar piping on the roof. It is not legal for CMR to claim that their contractor's work is not covered by the warranty, and their warranty started before all contracted work is complete. The most important fact with this claim is that the current roof leak (that occurred prior to 5 years from the time the solar piping was re-installed) is located in the exact same location of the re-installed solar piping.

I wanted to bring to your attention an unfortunate experience I had recently with CMR construction and roofing. I engaged their services for a project, but I am disappointed with their pricing, lack of communication, and contractual obligations.Please check their reviews also and you will see that Im not the first , and sure not the last that they scammed.Im 70 years old and its predatory behavior.Firstly, I found their pricing to be significantly higher than the market average. I've since had 3 quotes from other roofing companies, and all were significantly lower than the price CMR quoted. Furthermore, I encountered difficulties in communicating with CMR Roofing. They are slow to respond, unhelpful, and quite frankly rude. Effective communication is the cornerstone of any successful business relationship, and their lack of responsiveness has left me feeling frustrated and neglected.To compound matters, I discovered a clause in the contract I signed with CMR Roofing and Construction that stated I would be required to pay 25% of the amount awarded from the insurance company if I chose to go with another roofing company. This clause was not brought to my attention before signing, which is both unethical and unprofessional. Businesses should ensure that all terms and conditions are clearly communicated to clients before any agreements are made.I believe it is crucial for businesses to operate with integrity and transparency. Unfortunately, my experience with CMR Roofing and Construction has fallen short of these expectations. The issue is the customer is refusing to pay CMR now. This is not really a complaint as it is more of a disagreement of the payment due. This should not need to be the BBB's concern. I am rejecting this response because:CMR massively over quoted the job to be done, which I had no knowledge of when signing the original contract. As stated before, I was quoted by 3 different companies, each $30,000 less than CMR. I cant afford to pay the quote CMR has offered for the roof, therefore I need to go with a different company. I was not aware of the fee listed in the contract, and it was suggested by the attorney to drop the fee. Why would I have to pay this fee? CMR did nothing, except place a tarp on the roof. Is that worth $11,000?

In March of 2023, CMR had me endorse over a check for $45000 from my insurance company to install a new tile roof. After repeated phone calls and email correspondence on my end, I still have no roof. CMR has a call scheduled with the client tomorrow at 1 pm. This was setup prior to this complaint. It seems the complaint is a little premature. The permit was one of the major hang *** here. City of ****** is taking many months for permits. At times it takes the clients calling or going to the permit office to get them pushed through. I am reaching out to formally address a serious issue involving CMR Roofing and Construction, relating to an unauthorized contract and the subsequent handling of an insurance settlement at my residence, located at *******************, In 2021, under the guise of conducting a free roofing inspection, I mistakenly signed documentation provided by CMRs representative, Mr. ******** This document was misrepresented as a routine formality for the inspection process. Unfortunately, due to my status as a tenant without ownership rights, and not fully reviewing the electronic document, this led to significant and ongoing disputes concerning the homeowners insurance settlement.CMR Roofing and Construction has inappropriately been listed as a signatory on the insurance settlement check intended for property repairs, creating considerable confusion and delays. Despite numerous attempts by the homeowner to rectify this situation and remove CMR from the settlement, there has been no adequate response or corrective action from the company. Moreover, the protracted nature of this litigation, which concluded only in 2023, demonstrates that CMR did not incur any expenses for material as no repairs were initiated, directly contradicting their claims for compensation.Throughout this dispute, CMR has made several unjustified attempts to claim substantial fees from the homeowner, ranging from $12,000 to $4,000, without providing any detailed invoices or justification. Initially, they even attempted to impose a 25% cancellation fee on the homeowners insurance settlement, falsely claiming pre-purchase of materials two years prior to any settlement agreement. These actions are clear violations of ethical business practices. Additionally, Florida Contract Law asserts that any agreements entered into without proper authority are legally invalid. My situation highlights how a simple misunderstanding regarding a "free roofing inspection" sign-up has morphed into a three-year nightmare, revealing a pattern of behavior that could only be described as deeply disturbing. As stated before, in 2021, I signed what I was led to believe were routine electronic documents necessary for a free roof inspection at the property I rented. Unbeknownst to me, this action would entangle both the homeowner and myself in protracted legal and financial complications that persist to this day. This ordeal underscores the deceptive practices CMR employs, exploiting customers' lack of understanding for substantial financial gain.
Firstly, it is important to clarify that I am not biologically related to the homeowner, nor his wife. Our shared surname appears to be a point of confusion for CMR. I am NOT their daughter. This false assertion that I am his daughter has been grossly stated and misrepresented by CMR on this platform, adding unnecessary confusion and bias to the proceedings.
In response to CMR's assertion regarding the incurred costs, I again request detailed invoices for the expenses they claim, specifically those related to attorney fees and drone usage for the roof inspection. Despite CMR's insistence on these costs, no documentation has been provided to substantiate their claims. I am willing to settle these alleged costs upon receipt of these invoices, as it is my intention to resolve this matter transparently and equitably for the homeowner.
It is shameful that CMR has invested considerable effort and resources in attempting to extract money from the homeowner's insurance settlement for non-existent services. No work has been performed on the property, no materials have been ordered, yet they persist in their claims for substantial financial compensation. This aggressive pursuit, focused solely on benefiting financially from a technicality, paints a woeful picture for anyone considering doing business with CMR.
As an older woman, the irony of this situation is particularly striking, as CMR insists that I am daughter of Mr. ***** and his wife, who I am sure are both younger than I, adding to the absurdity of the ordeal. I am now faced with the dilemma of trying to resolve this misunderstanding, a burden that no consumer should bearespecially when no actual services were rendered.
Again, CMRs lack of response to repeated requests for documentation of the alleged costs, which the homeowner requested as well, and their attempts to remove negative feedback from platforms like the BBB only exacerbate their lack of transparency and accountability. These actions are not only unethical but also potentially illegal, violating Florida Contract Law which clearly states that contracts entered into without proper authority are legally invalid.
This prolonged dispute has not only caused considerable emotional and financial strain but also stands as a ***** warning to potential customers of CMR. Their aggressive and deceitful business practices, lack of basic customer respect, and disregard for legal standards are alarming and necessitate immediate intervention.
I implore the BBB to facilitate a resolution that upholds fairness and transparency. CMR must be held accountable for their actions and compelled to provide all relevant documentation to clear any claims against the homeowners insurance. It is imperative that CMR dissociates from the insurance settlement to allow for the necessary property repairs and to bring an end to this prolonged and unjust nightmare.

CMR holds it stance on this situation. There was full transparency from the very beginning from CMR to the client. However, this was not the same from the client. In the rejection there is mention of them being unaware what they were signing. However, within a matter of a week, they had retained an attorney on the claim to go after the insurance company. CMR was in touch with the client every two weeks throughout the entire time. It wasn't until it was time to settle the claim that any of this came up. In the beginning, ***** and ****** were husband and wife. Then later on it was mentioned that ****** was the daughter. Whatever the relationship, the fact of the matter is that the client ****** was not authorized to sign the contract. Yet, she still did. But none of this was brought up until the money was issued. At the end of the day, we can go back and forth on the BBB for as long as it takes, but nothing positive has come from that thus far. We have allowed ************** out of any agreement and any financial obligation. We also informed the attorney who settled the claim to remove CMR from the check (Which honestly shows the validity of the agreement between the ******* and CMR, but I digress). All of this doesn't absolve the fact that ************** illegally signed the agreement and therefore we reserve our rights to pursue damages if that is necessary.
****************** claim that she thought the document she was signing was just for the inspection. However, there were 7 documents that were signed, all of which was AFTER the said inspection. Again, with the amount of documentation CMR has on this file, we feel confident that there is negligence on behalf of the Gavins. Even still, we are having our legal counsel review the file in its entirety. Once that is done we will reach out to the Gavins for a proposal for settlement. We look forward to resolving this. CMR would not have spent years of time and thousands of dollars in resources if we would have known ****** was not authorized to sign. That still poses the most important question, If the Gavins didn't think they were in contract with CMR, then why were we in direct communication about all of this for as long as we were? Why did the Gavins allow CMR to attend inspections, submit documents to their attorney, and work out the final build numbers so the claim could be settled?
CMR doesn't feel that the BBB platform is the place for this type of back and forth. This is probably best suited for the attorneys to discuss.

I had hired CMR Construction and Roofing back in 2020 to complete a new roof on my house . During that time I had to deal with leaks and issues inside my house to the walls ,ceilings and sheetrock that had suffered mold and was crumbling . Getting a hold of these people was very hard and and took weeks before I got any response from them .The only thing they did was put a tarp on my roof and the rest of the issues I was left to deal with . I had left messages , emailed and even texted to try and get my other issues resolved because they told me , I would get a roof in about 3-6 months from start . This was never the case and they new it . I have been dealing with my HOA about my roof since we started in August of 2020 . Since about 7 months ago , my HOA said I had to get tarp off roof and fix it or they would take me to court . CMR did nothing to help to help me get out of my jam and the guy I dealt with in the beginning never spoke to me again (*************** ) . Nobody at that company was accountable to me or anything . I was all alone . So , I had to hire a new company to do my roof and fix the inside of my home knowing that if I cancelled the job CMR would get 25% of any insurance proceeds if some were forth coming . I had no choice , It was either do the roof or get taken to court by my HOA . In the process I have had to take out loans and pay thousands of dollars in interest charges on these loans to do the jobs . All this with no help from CMR . My reward being now I have to give CMR 25% of the insurance proceeds because I didnt use them because they gouged the price of the new roof and I got pennies on the dollar . I think it is so unfair they should get anything at all when I paid a lot out of my pocket and they did nothing .I am seeking to cancel the 25% they want because all the money I've paid , I got a lot less from the insurance and they should get nothing . CMR tarp this particular roof three different times. Additionally, this customer signed a contingency agreement based on the approval of the insurance claim. To this day there is still not an insurance approval and there is an attorney handling the file. CMR was going to replace the roof for the homeowner for a specific amount and CMR was going to withdraw as the contractor with the attorney. However, in that timeline, the customer decided to go with a cheaper contractor to replace the roof. CMR has stayed on as the contractor of record to help get the client all of his money as well as recoup our cost. The customer needs to pay CMR for the work that it has completed on the home. The roof could not be replaced in the beginning because it would have disrupted the claims process. All of this has been heavily documented within our files.Customer Answer

I am rejecting this response because:I reject 95% of what they said . The only truth they spoke was that they put tarp on my roof of which they got paid . The other responses I firmly deny . They never gave me any documentation of any sort .
These has been going on for 4 years and they haven't contacted me for anything .
They NEVER came to me with a offer to replace at a lower level , not one person .
I told the lawyer handling the case my HOA was coming after me and taking me to court , showed him documents and he said find a cheaper contractor . CRM never offered to go lower . Never heard from them .
I had NO choice in this matter . I waited 4 years for them to do something and nothing was done .

While we totally understand and sympathize with the client's frustration, the insurance company is the one who drug this out for nearly 4 years. We tarped the home on three occasions and to date have not been paid for those services. We also have had numerous communications with the client via phone call and email, all documented. I am rejecting this response because:Again , These statements from CRM are incorrect . As I told you before CRM gouged the price of roof which they never told me what it would be . They never offered to renegotiate cost . Its the **** they play . The attorney
told me to go ahead and get quotes because there was never any new offer from CRM . The insurance company was never going to pay their ridiculous quote . I included a payment CRM received from my insurance for the tarps .
They got paid , thats all they did and NO MORE .. I refuse to give them their blood money for nothing . I had no choice in situation ....
I had to take a lot less and owe loans and thousands of dollars in interest for a project they way overestimated to make money and knew the insurance was not going to pay and forcing me to get other quotes so as to bring in their infamous cancellation fee of
25% . This is just outrageous and I have contacted the Attorney General about them and their practices . Turns out there are a lot of people on my street with the same issues . We all talk .

CMR Construction showed up to my house and informed me that since my roof was 20 years old that it should be replaced and that they would deal with the insurance company. I am a 75 year old widower who lives alone and I trusted them. Once the claim was approved in July of 2023, my insurance company sent me a check for $58,475.95 payable to ********* CMR informed me to sign it over to them and that they would keep 25% of the check and send me back the remaining 75% until the project got started and materials were ordered. I never received my 75%. Since August of 2023 I have sent dozens and dozens and dozens of emails, left many many voicemails, spoke with many different people at CMR and my roof is still not done. I have been getting the run around from them since August 2023. I am now dealing with many health issues and need to return to *********** where my daughters live and need to sell the house but can't until this roof is completed. I have attached a copy of the check, contract and several emails from CMR saying they are looking into why the 75% of the check wasn't sent back to me and emails from them talking about scheduling but nothing has been done. They also requested I get the solar tiles removed from my roof ASAP which I did right away back in August and haven't had a heated pool since then. I am rejecting this response because: I am not resolving this matter until CMR shows up. I have many emails from them since August 2023 until now stating "I would be put on the schedule in a few weeks ". I will close this complaint when the job has been completed and inspected.

After hurricane ***, a rep from CMR did roof inspection and signed us up for roof repairs/replacement. After downpayment from insurance proceeds was made, no roofing materials have arrived, no roof work has commenced and 2 years have gone by since ***. HOA is breathing down my neck to get roof fixed. In 2020, *********************** and two other men from CMR Construction and Roofing, whose name I dont remember, knocked on my door and told me that my roof looked like it needed to be replaced and asked me if it had any leaks. I informed them that we had roof leaks, that were caused by a hurricane, repaired through a homeowners insurance claim with The Peoples *************** told me that the insurance company should have replaced the entire roof instead of fixing the leaks because the roof was old and new leaks were going to keep occurring. Even though I was no longer using the Peoples Trust as my homeowners insurance, CMR said they can litigate the case in court and have the Peoples Trust pay for a new roof. I then agreed to have CMR take The Peoples Trust to court for the amount for a new roof. It took about two years for the case to be decided. I was awarded $38,000 for a new roof. I sent the check, by certified mail, to CMRs *************************************************************************** I was informed, by ****, that my roof replacement is job #**-3415. Then we picked out the tile colors and started the approval process with my HOA. CMR informed me that materials can take 44 weeks to arrive; March 2024 was the estimated arrived time. My last phone conversation with CMR was at the end of 2023. I spoke to ***************************. She reconfirmed March as the estimated arrival time for the roofing materials. March passed and at the beginning of April, I called my new CMR contact person(***************************), but she did not answer the phone. I left a message. She emailed me and informed me that she is no longer my contact person and that she asked CMR to reach out to me. *** been unsuccessfully trying to reach CMR since April 5th. The phone numbers for the two CMR construction headquarters(Naples and Lantana) that Ive been interacting with are not working.Business Response

Here we are, almost 2 weeks later, and I feel like I am being avoided again. CMR did not continue replacing my roof like **** stated. I am rejecting this response for a few reasons. I was informed, by ****, that he had access to the tiles and materials, and that the project would finally start in approximately a week, and would take a few weeks to complete. I think I was misinformed because that was three weeks ago, the project has not started, and I havent spoken to or heard from **** since then. CMR roofing and construction was paid in full ($38,000)over a year ago. Ive been waiting for over a year for CMR to just start the project. My roof has leaks and the hurricane season is quickly approaching. I am concerned about the leaks getting worse and accruing more internal water damage(attic, ceiling, walls, baseboards, etc.) None of my calls(to ************ and ************) have been answered or even retruned. On March 20, 2021 I contracted with CMR to replace my roof damaged by Hurricane ***** with a stone coated steel roof. CMR has not completed the roof replacement. The roofing they insrtalled was was not installed in compliance with the roofing manufactures installation guidelines. CMR did not offer to replace the roof. I had the roof inspected by an Registered Roof Observer and an ******* Registerd Engineer both of whom stated the roof needed to be replaced. I also obtained infromation from the roofing tile manufacturer that supports the need to replace the roof. CMR did not offer to replace the roof. So I sought the advice of an attorney who suggested filing a complaint wiht the ********************* **************** The complaint is dated October 2022 and was filed soon there after. There were two potential completion dates in the contract, The first was to complete the work prior to a wedding rehersal dinnner my wife had been honered to have been asked to host by her Grandson. The second to start after the dinner and complete within 6 months of the date of the contract. CMR chose to start work to complete it before the wedding rehersal dinner. The work was not completed by the contracted date and an industrial size roll off thash container was in the yard for the rehersal dinner. CMR still has not completed the work. There were financial penalties in the contact for not completing the work on time and in additon to not replacing the roof CMR has not paid the penalties. In short is has been nearly 3 years since the roof was to have been complete and CMR has been giving me the Royal Runaroud to avoid repalcing the roof and paying the penalties. They have had 2 people inspect the roof and neither have submitted written or complete verbal reports of their findings. They delayed the review by the ******************** Lisencure Borad by telling them we were in negations to settle the matter.
