      Moved into the apartment complex at this company ***** ***** and the people above me have a dog that constantly pees off the balcony. It falls onto my balcony and causes a horrendous urine smell. I cannot use my balcony I cannot open my window. I have fallen sick from being on that balcony for more than 5 minutes to record videos of what is going on. My pets have fallen sick for being out there on the patio. I've spoken with them in their office at clear accord departments on multiple occasions with no resolution. I have sent them emails and videos showing them proof that this is happening it's happening and nothing has been solved. I get told it will be fixed and nothing has happened. I simply want for the dog and the upstairs neighbor to stop peeing off the balcony and for them to come and clean the balcony replace all of the damaged carpet and make my patio which is in part of my least livable livable and safe.

      I am writing to report the negligence and deceptive business practices of Aspen Heights Sam Houston. I lived at this poorly managed apartment complex for just short of two years during my academic career at *** ******* ***** **********. While I was there, I resided in one apartment unit for about a year and a half and then I had to be moved to a new unit in January 2022 due to an extremely irrational, **** addict roommate who regularly lied to the leasing office regarding myself and her animal. To get straight to the point, Aspen Heights has proven to be negligent, unprofessional, and deceptive. To address their negligence, they regularly ignored and avoided any issues there were on the property. To give the apartment complex a better appearance, they would paint over the black mold in the complex. More specifically, there was an area in the mail room on property that had black mold growing behind the baseboard that they proceeded to remove the baseboard and paint over the mold before putting the baseboard back over it. They proved to be very deceptive when it came to charges. I was fined countless times wrongfully. Now that I am gone, they are trying are trying to charge me wrongfully or items that I was never given due to the negligence of their staff and the supposed holy name of a bedroom that was cleaned thoroughly prior to my move out. To make matters even more ridiculous, there was a charge tacked on to the previous month's rent to cover any restorative costs. Also, the unit that I moved into was completely filthy when I moved in. My other friends at the complex have had to complain to the leasing office or the state of filth they were greeted by when they moved in.

      The air conditioning has not worked correctly for a month. My unit is especially hot and there has been no attempt to fix the issue.

      I was advised by an employee, *****, that I should have my rent check returned because the amount was $160 over my rent and I was eligible for rental assistance hitch would be paying for that month. She advised me she would refund the fees. Not only did she not refund the fees I was faced with additional fees by the manager ******** ******, in direct defiance of their agreement with the city of phoenix emergency assistance program that they would not pursue additional eviction measures they did. Incurring additional fees.

      They provide accommodations for my disability to treat the pest infestation I have dealt with since I moved in.

      They refuse to provide emergency services when my tub stopped draining forcing me to stay in a motel because I couldn’t take a shower.

      They continue to accuse me of not wanting them to enter my apartment when my teenage child is home alone.

      Most of this is pure ridiculousness, bullying and abuse of power. It most certainly is not what I pay market rate for my apartment and probably one of the highest rents in the building because they have also given discounts to other tenants and offered lower rates and shorter leases to new tenants.

      This dispute is about Sunrise in Biltmore in Phoenix, AZ which is managed by Asset Living. I put in a maintenance request for a leak above my shower that caused the drywall to collapse on June 22nd and as of today August 7 is still not complete. June 29th they came to tear out the drywall to investigate the cause of the leak with no extra measures taken to possible mold or the fact that this was toilet water leaking into my apartment. June 30th there was no apparent work. July 1st they put a blower in the bathroom to dry it out presumably they fixed the toilet wax ring in the apartment above me. Weeks go by with no more work. I complained to the leasing office on Tue, July 26th by email, when they said they had staffing issues and trying to catch up on work orders. 2 days later still no update so call the office and the Manager ***** is still giving me the run around and doesn't know about my work order or my complaint from a couple days before. Friday a maintenance guy comes to look at the 1/2 done work and assumes the last guy did the work properly and schedules painters to come replace the drywall. They said they had staffing issues but they're farming the job out? Why the long wait and excuses? Now it’s August 2nd and they come out to replace the drywall. This is literally lipstick on a pig as a they don’t tear out the damaged poop water drywall and over the next few days I see new stains. Even if they think its finished that they close up the wall they still haven't painted the wall to protect the drywall in the following days. So now 6 weeks into this ordeal I still have to find other ways to bathe myself. Maintenance doesn’t care about doing the work correctly, the integrity of the building, or safety of its occupants. The leasing office doesn’t seem to care either and actually hung up on me when I called. I had a friend look at the pictures I took and said it looks like black mold and rotten wood to load bearing walls so still major repairs are needed.
