I am rejecting this response because: I have previously spoken with this company regarding cancellation of the contract and no further business, however they continued to fraudulently charge me for services never provided.did arrive when arranged, but without a supervisor. Again, he did not complete the services listed, and again sent confirmation that all services were done. I called the supervisor again and stated that their company was not holding to their contract at all and that I no longer wanted to continue with their services. Even after trying to allow for correction, the company still did not provide the services contracted for and wanted to charge me anyway. Moxie is attempting to charge me $432 for early cancellation, when they never even held their end of the contract. They should not be able to charge customers for services never provided! This is a completely fraudulent business practice.Business Response

I am rejecting this response because:
I am no longer willing to have any of your technicians come back to my property. I allowed someone to come twice, and both times the technicians lied about what they did. I dont trust your company at all.
You need to now refund the early termination fee that you charged to my account, You cannot fraudulently charge me for services never provided, or expect me to continue to allow a company that lies about work to come perform any more service.
Again? I tried to allow your company to correct the mistake, but I was only lied to again.Business Response

I am rejecting this response because: it has been 9 business days since Moxie responded to BBB that they would be reaching out to me, and I have yet to get a refund or hear back. If I waited ine more day, my window to reject their responses would have expired and they are playing a time game hoping i miss the deadlines. This is the very reason that I filed a claim to begin with.
Their response is meaningless and i demand my contract be terminated and the funds deducted from my account be returned.

I am rejecting this response because: it is vague. Just stating that the company can extract the system and "revisit your contract" provides me no information about what I can expect moving forward, other than I knowing I will no longer have the system. Assigning "someone to remove them and follow up on the billing portion" is similarly vague. I work from home and am available most days but I am reluctant to have the company come and remove the system without more detail about the accounting/billing piece.Customer Answer

After this latest message to the BBB, the business contacted me by telephone and informed me that they would not negotiate with me in any way on the finance portion. They were willing to remove the equipment but said that the finance portion is between me and Wisetack. This was the very reason I rejected the company's last offer. It's also the reason I didn't think I had the ability to cancel within 3 days. The fact that the company outsources it's financing and that everything was a done deal on the same day the inspection took place, had a chilling effect on my ability to cancel within three days of the signing. I don't trust that the company will do anything except remove the system for which I'm now paying.Business Response

I have reviewed the data once again and we honored the agreement. Because the stations are dug into the ground, the workers ere never asked to stop or leave and they were given access to the home. Contractors adn team dug the house.and set the stations with written approval based on the contract the customer signed. . There is nothing that was not part of a signed contract and the hired teams completed the work as the customer was home and allowed the team to complete the job.Customer Answer

Hello, In response to your questions seeking clarification:
The work was originally done on May 28, 2023. The company's "Termite Agreement," which I signed electronically on one of their employee's iPads, is not dated. That form has already been uploaded to this site.
As just indicated, I signed the Termite Agreement electronically using one of their employee's iPads. I also signed the loan agreement for WiseTack, the company's financing arm, the same day and in the same way. I was not able to read all of the terms at the time. Both of those agreements have already been uploaded to this site.
My first protest of having my rights violated in writing was on 10/9/2023. That was done in the form of a letter to Moxie and that letter has already been uploaded to this site.

I have reviewed all the documents on the initial contact with BBB. Our contractual agreement remains in place and we have our copy on file. Our response remains consistent and we continue to stand by our work. In researching the steps necessary; we abided by our agreement and the services and equipment were rendered. The process in question is one that requires digging and installation to which the customer could have requested the. process be stopped. I am rejecting this response because: The company is wrong. Over the phone, two of their employees have told me that if I cancel the termite contract they have every right to remove the bait stations and that all I paid for was “installation.” Nearly $12,000 to have one man use a power drill to push the self-drilling plastic stations into the ground around my home in less than 1 hour. How would the result have been any different if I canceled as they were putting them in or anytime within the first three days? Moxie pest services had an agreement to provide pest control to my property. They are unresponsive to phone calls, emails, and texts. They came once to provide pest control, but did not perform a follow up visit as per their own statement and our agreement. ******** from Moxie Pest Control has blatently ignored our messages requesting a follow up visit and now we have cochroaches in our house due to the blatent negligence of Moxie Pest Control. We demand either a refund or for Moxie Pest Control to provide services as per our agreement.Business Response

On or around 5/6/22, Moxie sent a tech to my house that thought no one was home. As I watched from the guest bedroom the tech walked up to my front door and threw granules down and then walked back to his truck where he sat there for 15 mins then drove off. I called Moxie to ask them when the tech was coming back and they said he wasn't, he *******d my house. I informed the *** of what the tech had done and she apologized and said they would send somebody out the following week. The tech that came the following week did almost the exact same thing the first tech did. I called to speak to a manager and asked if I was still in contract he said no, at that point I told him I am done with Moxie, the manager told me no one will get sent to my house unless I call them. November rolls round a tech is sent to my house, I call Moxie and ask them when did I call for a tech, they inform me that I didn't. I told them I am not paying for a ******* I didn't request they refunded me my money. April 28 2023, yet again another tech is sent to my house, I call Moxie ask again did I request this ******* they tell me no, that I will not be charged as it was in my account notes. I get an email today thanking me for my payment. They charged me $150 for the April ******* that I was told I would not be charged for.Business Response

A salesman from Moxie Pest Control showed up on our doorstep in August 2023 and we agreed to have pest control for $189 per quarter. In August we we were charged $100 twice. On Saturday September 23, 2023 a Moxie representative came by and sprayed our house and we were charged $189 which we thought was our 1st quarterly service and charge. Then we were charged another $189 yesterday, September 25, 2023 and when we called to dispute the double $189 charge were told someone else came by our home and sprayed again so we were charged another $189! We then cancelled all future services due to the fraudulent $189 charge and were charged $453.60 for cancelling future services. We were charged a total of $853 in two days for one pest control application. Moxie Pest Control is a scam business.Business Response
