I sign contract on March 14 2021 for 2 years factoring services. I didn't get factoring services I was promised. I wasn't able to get hold of my representative by phone for almost 1 year. I got tired and asked them to not to renew my contract and I'm switching my factoring as per contract I need to give 30 days notice before it ends. They said I have to pay $***** penalty for early termination and 3% of the remaining balance. I told them I'm not doing early termination but I'm asking you not to renew my contract and I'm going to another company. They said you can't do that without giving penalty. When I read contract it clearly says I need to give atleast 30 days notice and not more than 90 days but than i noticed they didn't put the date on contract from day one. I talked to representative about this issue after 2 hours conversation ****** my representative said that it's expiring on March 15 but I have to call exactly 30 days before it ends. He was lying because as per contract minimum 30 days notice is required and 90 days before I can notify them which I did. So now they want me to pay ***** and 3% because there is no date on contract. If there is no fate than it's not valid contract and they can't even force it because it says clearly I can give 30 days notice to cancel. My cash flow is messed up I paid all that money to them and I had to do *****************. They keep reserves when they said they will give me 100% of invoice. They also lied about fee and they charged me hidden fee and never showed them to me until unless I asked for that. It's all fraud and robbing small business. We have attempted to contact the client to discuss this complaint, but the client is not answering the calls. Calls roll to a voicemail that tells you to send a text message. We sent him an email to clarify his contract and our processes. We left it open for him to discuss with our leadership team further. We are currently awaiting a response.Initial Complaint

Bunch of lier Managers not answering phone,email response or text messages;
They are violating the the contracts ,over charging.When contract renewal period they are promising a lot but all lie.
I hope they are closing down soon.I personally sent email CEO England but still nothing.This company using their customers as a trash.Never ever sign the Contract with this Company .They IT applications is also old and useless. My Company CS Transport has done business with England Carrier Services for over one year. We gave notice as per our agreement that we would be terminating our contract at the end of the contract period. January 22, 2023. During the month of December our truck was down for repairs and we had no income invoices to factor with them. We notified ECS that we were down for repairs. In January we were up and running again and we submitted invoices for factoring. They had put our account on suspension and refused to factor our invoices even though our contract was not up yet. At the end of our contract they are demanding $8600.00 before they will let us leave. Claiming we violated our contract for early termination because we left in December. That's false, they new we were down for repairs and we even tried to factor with them in January but they refused. We have tried to explain to them they that we didn't leave prematurely, and offered to provide the repair invoices during that period. This is harming my Company's cash flow and preventing us from changing to another Company who provides better service. We need your help to bring this to a resolution so we can move on with business.Initial Complaint

On 05/04/2022 we misdirected a payment to a wrong Carrier that factors with England Logistics. They have confirmed over emails that the payment has been received and placed into the wrong Carriers reserves. Six months and 20 emails later, we are still trying to get refunded.Initial Complaint

I am rejecting this response because:I have copys of email stating otherwise also copy of email asking for 2 months before renewal not to renew and we want to terminate at the end of contract there was no response until we were auto renewed and now charged $25000 to leave their hold time is never 4 minutes its hours than they ask for your mc number and ESPN as they see who you are they hang up nothing has been resolved

*********************** after promise dont believe a word and when u call and give ur mc than ***** is available to talk ever, also *********************** portfolio manager same thing also ********************************* ECS factoring retention specialist , avoid them like a plague they will run your bussiness in to the ground, we were factoring 120k a week, they have reps working out of ****** half don't even speak good English and have no idea what they doing, they will hold money from your invoices and than find reasons to keep it and not pay, if someone trying to leave them and they wont respond call us we will gladly tell you how to leave them, this company should be banned from factoring period, all they do is scam people and they are backed by a triumph funding so they resell all your invoices so they don't use their money, worst experience ever the words cant describe what we went through day to day with this nightmare company. We have reviewed the complaint and have connected with the client to address and/or resolve each point.
- The signed agreement states that it will auto-renew without a 30-day cancellation notice. We assisted the client in locating that verbiage within the agreement.
- The clients assigned account manager did change on a few occasions, but not every month. Some changes were due to natural team member turnover. Most recently we moved their account to a senior client service representative due to the clients volume and our desire to ensure the appropriate level of support is provided.
- Our average hold time per internal reporting is less than four minutes. The client was also provided with the direct number of our senior portfolio manager.
- The statement regarding unpurchased invoices was shown to be inaccurate. It was explained to the client that the higher debtor concentration was outside the clients factoring agreement, which is why certain invoices were not advanced upon. This was not due to the clients growth.
- The verbiage in the agreement regarding early termination fees was reviewed with the client. We demonstrated to the client how the fees are calculated and confirmed their accuracy.
- We reviewed with the client the section of the agreement that addresses non-funded invoices and specifically the reasons applicable to the clients account.
- The complaint stated that we are backed by another company and do not use our own funds, which is incorrect. England Logistics has used its own funds to factor clients since it began factoring nearly two decades ago.
At this time, it is our understanding that the areas outlined in the complaint have been addressed and/or resolved to the satisfaction of the client.Initial Complaint

We have been factoring with England since 2017. They had great customer service until last year. They would assign and change our CSR every few months. The motive of a CSR is to be able to get in contact directly with them. They had their direct lines, but they would get mad at us for calling at direct lines, and to call on their toll-free numbers and keep on waiting for hours and hours until someone would answer the call and still not be able to help us out. The same would be with the email, I would send out, and wouldn't get a response until hours or days later. It just got worse now, when they kept on holding onto my invoices, saying that we are still waiting on verification even though I would send them those, and not approve them for days. We are now in a situation where we were on a good payment plan with them to take care of the negative reserves, and just one day they just sent me an email saying we won't be factoring any more loads, and to find someone else. There was no such explanation or anything. I ended up calling them and emailing them, and again, no response whatsoever. I would call, and their CSR would answer, and then just hang up on me. I wanted to be able to talk to the manager, and there would be no one available to talk. And now recently, I haven't been able to get any funding for the past 2 weeks, and I've been trying to reach out to them, and I get a one or two-word response once or twice a week. I tried to do a buy-out to change to another factoring, and they declined due to aging. At this point, I am stuck. I have invoices pending over $10,000, and not being able to get funded, I have trucks on the road that need fuel, and driver pay that needs to go out. How am I going to afford all of this with no payments? I reached out again to England to let them know about the decision from the other factoring, and couldn't get a hold of anyone.Initial Complaint

We had RTS factoring services before, we used to get phone calls everyday offering switch from RTS to England,
After UCC contract ECS holding our funds and not responding to our email and phone calls, even supervisors hang up the phone , England not following up with brokers who wants to pay for the loads we did, many invoices wasn't paid to us 8 months already, we want to leave from England factoring, please issue NOTICE OF RELEASE.
