I bought a Rainbow vaccuum cleaner, and financed all but $1,000. The contract was an interest free loan (same as cash) for 1 year. If it was not paid off, interest would start on the 13th month and continue through the 18th month when the contract would end. The default down payment for a 18 month contract was either $350 or $450. I made a $1,000 down payment, and my monthly payments were to be $218.09. I get the first statement and they have set me up for straight forward 18 month contract (not same as cash) with 18% interest. I called them, and they adjusted the automatic draft so the loan would be paid off within a year. Next month's statement comes, and they deduct the $218.09, but record me paying $154.20 with interest then applying the remaining $63.89 on the next month's bill. The loan was still set up for 18 months, and still accruing interest. On the next phone call I told them I was going to pay the loan off that (this) month. I set up the payoff, it was drafted, then they deducted an overpayment of $218.09. When I called them to straighten this mess out, they informed me that it would take 4-6 weeks for them to process the refund. I told them that was unacceptable, that the money needed to be back in my account next week, and that I was going to contact BBB, and share my experience on social media.Business Response

This customer had a Same As Cash option on their loan. All Same As Cash loans have interest starting from the inception of the loan. The interest is waived when the customer pays in full before the Same As Cash date expires. This customer set up a payoff, and had also set up a normal monthly payment for the same date. This was not an error on the part of Belmont Finance. Refunds of overpayments are system generated and this customer will be sent their refund on approximately 05/11/23.Customer Answer

[Please type your response here.]When I talked to a lady from Belmont Finance on a recorded phone call, (April 28, 2023, at 10:44am) I was told I would have my refund in seven days or less. May 11, is 9 business days/two full weeks from April 28.
In addition to that, the numbers on the front of the contract do not match with the terms of the contract. The contract states several things that the numbers do not support. According to the promotional sales clause (letter I), no interest will be paid during the same as cash promotional period. Belmont tried to charge interest every month until I paid it off in full. If Belmont takes interest before the 12 months SAC is over, do they repay the interest if the contract is paid within the promotional period? If so, why is that not clearly stated in the contract? IF someone has paid x amount of interest over n amount of months (less than 12), and the amount of interest paid would pay off the loan, will Belmont allow the interest paid to cancel out the principal. If not, why?

Attached is the last monthly statement received from Belmont LLC. They claim they did not charge interest. According to this statement they did charge interest. Please see attachment. Please see previous response for questions regarding how this amount would have been handled should I have stayed on this billing plan. I may not have been charged interest when it was all said and done, but throughout the process I was wrongly charged interest with little to no explanation of origin.

We did not claim to not charge interest on this 18 month contract. The terms of the loan are clearly stated under the Federal Truth-In-Lending Disclosures section of the customer's contract, and the terms of the contract were verified with the customer on 01/28/2023. The customer paid the principal of this loan within their 12 month SAC promotional period, and all interest was waived for this loan. As stated previously, the customer has been sent a refund of their overpayment.Customer Answer

On April 10, 2023 I was contacted by *********************** from Belmont **************** He stated that he could enroll me in an "Income Contingent Repayment Program for my student loans, that after 6 monthly payments of $175, the balance of mt loan would be forgiven. He stated that if I paid $650 that day, I wouldn't have to make ANY further payments, & he could prepare the contract right then, email it to me for signature & finalize it. My loan serviced through Aidvantage would be canceled. He had all my information - SS #, balance of my loan, address, date of birth, etc. & said Belmont Financial was directly part of U.S. *********************************** Services. I stupidly signed up for the ************ charged my **** $650. Only then did I think to check the legitimacy of this company. I tried to disapprove the charge but it had already cleared. Belmont Finance is continuing to report an increased balance every month to the credit bureau. Its been over 7 years & this account by law (FCRA) should be removed from my account. They have been contacted several times about this practice, but it still continues.Business Response

I received a rainbow system and changed my mind about the purchase and wanted to give it back to the seller. They gave me the run around about who to talk too. Finally talk to someone and they (with kids in the background playing) and the representative said HELLO and I said is this rainbow. She said that I had to called on 17th of January which was a holiday and called the very next morning on the 18th of January she my my 3days up on the 17th of January which I was calling on the 14th to the 2ladies that came to my house.. the 2ladies knew we were trying to return the cleaning system.. they some scammers... ***** went online to delete my account and I can't get into the account....Business Response

I have no ideal who Belmont **************** I have never heard of them before. So I looked up the company, I have no loans with this Establishment, no children that would take out a loan here for school. My child is 13 years old. My Credit Union called me due to the suspension of fraud because out of the 15 years I have banked with them, this transaction did not sit right with them. I am so glad they brought it to my attention and that's exactly why I have been banking with ***** County Credit Union for over 15 years. The is no resolution to be made, I do not affiliate myself with this company, my bank has cancelled my debit card and it this happens again, I will pursue charges against them.Business Response

I had a loan through Belmont Finance for a Hyla vacuum. I paid the loan off early (money left my bank account on 12/30/2022) and inadvertently overpaid by around $435. I spoke with someone on 1/4/2023 who said that it takes 4-6 weeks to receive a refund check. I requested that this be expedited due to the amount overpaid and need to access funds for bill payments. I was told a request would be put in for that and to call back the following week. Upon calling back on 1/12/2023, I was told that they couldn't provide a status on the processing of the overpayment, but that they would put in another request for it to be expedited. In calling today (1/27/2023, 28 days after money left my account), I'm told that requests for expedited processing on my overpayment wouldn't be able to be accommodated, that they cannot provide a status update on when I will receive my overpayment, and there is nothing that can be done. My account allegedly was closed 3 weeks ago (on 1/9/2023 upon their records reflecting receipt of payment) but I have no idea where the refund is, my requests for assistance are denied. I was told by the last "customer service" representative that no one told me it would or could be expedited, that I cannot speak to a supervisor, and that my account of previous conversations is false based on their internal notes in the system. Additionally, my credit report does not reflect the closed account and still reflects that a balance is owed. This This is NOT a reputable company.Business Response

This customer's refund was actually sent 3 weeks(01/30/2023) after the overpayment(01/09/2023). The customer was never told that they could not speak to a supervisor. A supervisor left a message on 1/30/2023 to follow up on the customer's request on 01/27/2023 to speak to one. We got started with Belmont Finance LLC on February 12, 2022 when we purchased our rainbow vacuum system. Things started out great, but I then noticed that they double charged us for the month of April and I requested that the duplicate payment be transferred over to the month of May and an employee on the phone said they could do that with no problem. Come ***** we see that we are late on a payment for the month of May as they never transferred the payment to be used for the month of May. Another lady on the phone said that they actually had just sent out a check and she could see that it was in transit to be delivered to our house. That of course never happened, so I called again and at that point I was told that was also not true and that nothing was sent out to us, but that they did a refund to our bank account which we never received. Since then, there are several transaction made on their end where they have taken hundreds of dollars from us yet they say we are $300 behind in payments which is not true. They just keep giving us every excuse possible. We have talked to our bank and they have even said Belmont Finance LLC has stolen from us and they have never sent anything- we already knew that. Our bank put up a block against Belmont so they are no longer allowed to touch our bank account due to fraudulent charges. They just keep racking up our balance. They are thieves and from what I have read, they have done this to SO MANY people. I do not understand how this establishment is still active. We are strongly considering a lawsuit for theft if we do not receive all the money they have taken from us. They can not get away with stealing from so many people.Business Response

This account has had multiple NSFs and CC chargebacks. Belmont did process two authorized payments in April. One from the customer's recurring ACH and one CC payment submitted by the co-buyer. The CC payment was rescinded in June. There were no payments to be refunded for this account as the funds were not received. BEWARE!!!!!!!!1. Before the company tries to respond & be like "I don't have an account" or "call to speak with a representative after pressing 2" I have done all of the above. After 3 representatives & one supervisor which you can never speak too I still have no clue how this company is still in business. I will seek a lawyer cause charging daily interest is insane!!! Only half your payment goes to principal then the other goes to interest. They sent me a statement and one of my entire payments didn't even go to any principal amount it went too all interest!!! How the heck does that happen?? DO NOT USE THIS FIANANCE COMPANY!! THEY WILL HAVE YOU BOUND IN A CONTRACT FOR ALMOST DOUBLE THE ************** DO YOURSELF A FAVOR GO TO A **** AT LEAST THE **** DONT MISLEAD YOU & CHARGE DAILY INTREST!!! I called on Friday and owed $175.00 then call on Tues & owe $180.00!!!! They can't explain where the extra $5 came from either. Representatives are not helpful nor knowledgeable at all. Neither are the supervisors. My monthly payments are $105.00 with a $15 late fee if applicable. They told me the extra money was from interest but the statement I have shows $52.76 in interest for my current bill but received a separate notice about being $70 behind after I made my last months payment in full!! Not one person can explain how I went from $52.76 to now $80....that's not even the $70 from the separate notice I received?!?!?! They sent me an itemized email & that is even worse looking at random amounts charged & no explanation for any of it They go "well your in a legally binding contract"...well not if your fraudulently misleading & can't explain what your company is charging, how & when. I have paid Belmont $500 why is it reporting last payment on April and they are still reporting on my credit report late, they have sold this debt and refuse to charge it off. I took out a loan with this facility, then paid off the loan and they tried to get money from my back account which caused a NSF fee of $29. The customer had an *** scheduled on the same day a check was received to pay off the account. The customer failed to cancel the *** payment and was charged a NSF fee by their bank when the payment was returned. There was no error on our part, and we will not reimburse the customer's bank fee.
