Date contract was signed with Ybarra Professional Builders:1/29/24.Amount paid $74,600 plus $227.66 for bathroom total: $74827.66.Committed to remodel basement, to include:partial demo, frame, insulate rooms, tile shower, install new bthrm. sink, toilet, vanity, new hood, sink in kitchen.Frame in new walls in kitchen, bedroom, ********** stairs, new floors. Move water heater. Ybarra left the job after 3rd installment. The basement was left with just drywall semi complete. Ybarra broke contract. Had to hire another contractor to fix mistakes and finish work.Cost of additional $98,00.Ybarra wanted me to sign a document that absolved them from our contract we both had signed. If I signed they would give me $5,000. I declined to sign. I asked them to return my money. I received a call from their main office in *********. They offered me $25,000.That was not sufficient to cover the cost to redo their mistakes and the money I had already paid out for work and material never completed.I want to get this resolved and get my money back.Initial Complaint

8-10-2024 I had a contract with Ybarra for a driveway apron for $20,000 it was built and supposed to be permitted per contract, turns out it was not permitted and I had to pull a permit for $535 the inspector said it was constructed wrong and needs to be demolished. I hired a contractor to demolish the unpermitted driveway and build a new driveway under my class A permit, then I hired a Attorney to help me recoup my losses. When he sent them a bill they would not accept that the permit number they gave me was fake even though I sent them a letter from the City stating ******* now filing a complaint with their insurance ******* also out Attorneys fee so far of $793.40 & contractors cost $2k to demo illegal apronBusiness Response

Hello this is regarding complaint ***********
We are writing in response to the complaint filed against us regarding the work completed for ***** ******** at ***************************************** we were not given the chance to rectify or correct anything. Even though our home improvement contract had the following listed below Opportunity to Cure: According to the terms outlined in our home improvement contract with ***** ******** we were entitled to the opportunity to address and remedy any issues or concerns with our work before any further action was taken. Unfortunately, ***** ******** did not notify us of the alleged problems or give us the contractual opportunity to cure the issue. Instead, they hired another contractor to **** the work without consulting us. Unauthorized and Unpermitted Work: Based on our understanding, the contractor hired by ***** ******** to redo the work did so without obtaining the necessary permits. This raises further concerns about compliance with local regulations and the quality of the work performed. Breach of Contract: By failing to provide us with notice and the opportunity to address the issue as required under our contract, ***** ******** has breached the terms of our agreement. Their unilateral decision to engage a new contractor without adhering to the contractual dispute resolution process undermines the fairness and validity of their complaint.

I signed a contract with Ybarra Professional Builders to remodel my kitchen for $35,000. They collected $21,750 per their payment schedule. They demolished my existing kitchen and patched the walls. My payment schedule was to include cabinet installation. Cabinets are not installed.Then they asked for an additional $8000. They stopped the work until I paid an additional $8000 for what they called a deposit which they forgot to mention or collect earlier, this deposit was not mentioned in the contract. They know how hard it is for people to live in a torn up home and thought I would just pay up to get my kitchen back. By now I did more research and found they are a slippery operation out of **********. I am convinced they are scamming **** was not going to pay any more than their payment schedule promised. Per the contract, the cabinets were to be installed based on what I had already paid for. They would not start installing the cabinets or proceed with any work until I paid the mysterious $8000.When I objected, They offered me $1500 to end the contract and sign off that I would not take any legal action. I have to hire a contractor to keep working because this mess is maddening. But I have to buy appliances and counter top, flooring, faucet, hardware, lighting that was all paid for within the Ybarra contract and payments I had already made.I want the appliances and other components I have paid for refunded to me. And I would like some compensation for the trauma I have been experiencing. I am a senior who saved my money from working to do this project but they took my money and left me hanging.Business Response

I am rejecting this response because:The response from Ybarra is false.They had a large sum of money ($21,000)from me and demanded more before they would continue working.They had demolished my old kitchen and put in half the cabinets. Thats all I got from them for my money.With the money I gave them I paid for a refrigerator, oven, counter top, sink and more but I didnt get any of these items except a refrigerator I cant use because it is the wrong size. It sits in my living room for over two months now. They wouldnt process the return and wont give me the receipt so I can return it.When I wouldnt pay $8000 more before starting to work again they threatened to sue me for the remainder of the $35,000 job.These guys are despicable. I read a review, too late, that they pray on old people.

Feb 26 2024 we contracted with ****** to tear down and rebuild our deck. It was suppose to be a two week project that lasted until Apr 1 ,2024. They had to re-due the steps three times and there is still a deep step down on the last step. They had to re-due the railing as the cutting was terrible. We had skirting on the original deck, however, it was not in the contract to put the skirting on the new one but they did anyway but then refused to stain it until I insisted. ****** said it wasn't in the contract. They put the skirt on so should finish the job and stain it. Without consulting they put a clear stain on that makes our beautiful new deck look bad with the contrast. Overall the workmanship did not meet the quality that was needed, always having to fix things. It makes me wonder if the foundation is solid. We would like the deck railing reinforced to hold our planters and would like the skirting finish adjusted to match the deck. The company refuses to talk with me, saying the manager will call and never does. I have called or texted on 4/15, 4/22, 4/26, 5/2, 5/3 5/7 and 5/9 with no response or get run around. This deck cost us $23,000 which should include quality workmanship and follow-up if there is a problem as promised from ****** with her sales pitch for this company.Initial Complaint

In January 2024, I signed a Settlement Agreement releasing me from a contract I had with Ybarra Professional Builders due to a pricing conflict for a sunroom they were to construct. They were to demo my porch, porch cover, as well as empty some junk I had in my 12x12 patio area. Two men showed up to work and my husband assisted them with dumping the junk. On day two, we had the disagreement and Ybarra represented to me that the junk removal and the porch rebuild came to $9,000. Ybarra refunded me $6,000 of the $15,000 I had given them. I believed that Ybarra had in good faith constructed my porch according to code. I contracted with another company to build my sunroom, telling them that the porch deck had been built by the prior contractor. Upon construction, I was told that the porch deck was not done professionally and would not pass code. When deconstructing the porch, we saw that it was not done to the standards that Ybarra had promised. They had only bought 3 concrete bases and had used my previous metal bases. Code states that sunroom bases must have crossbeams every 16", which were not done. My new contractor had to rebuild the entire porch, buy new materials which consisted of wood planks and concrete bases throughout. This cost me another $3,400 in materials and labor.I believe that Ybarra should refund me the $3,400 for their poor construction of the deck due to their misrepresentation. Had I known at the time, I would have never agreed to their settlement of $6,000. Being that none of the contractors were ever on site, there was no supervision of these two men who built it, and therefore, had no knowledge of the quality of work we were being given. As the lead contractor, they had a duty to be supervising their workers and make sure that their building quality was up to code, especially when their clients do not possess such skills. The porch deck as built looked to be from a novice and not from a licensed contractor.Business Response
