Beyond Finance did not fully disclose or communicate with me at the start of the program or at any time, all information regarding the agreement and processes of the contracted services, service fees and the disbursement of fees, cancelation processes and associated fees related to settlement, and fees related to unsettled debts related to cancelation of the program. Beyond Finance stated I would be charged ****% fee on each settlement, NOT 25% as which was the fee they actually took for themselves. This fee was taken from my dedicated account funds which, Beyond Finance had communicated with me at the start of the program, the account was for paying the enrolled debts. They also stated I would have full access to this account at any time. It would seem that Beyond Finance was the only entity with access to my escrow account. There was no way for me to access the account, and they took over $2,025 as their fee that was not communicated to me that they would be receiving as a payment to themselves all at once and at a rate I was not told about at all. The only thing that Beyond Finance did to recieve over $2k, was pay a couple hundred dollars to one settled offer. They missed the second payment that was owed in January, due to they took the rest of the escrow account and stated to me there was no money left to pay my creditor. I am fully dissatisfied and disappointed with this service and feel ripped off for a service that wasn't completed as required. The service was also charged at the wrong rate. I was told ****% of each settlement. They also did not disclose they would be taking all of the money out of the escrow account for themselves all at once, therefore making it impossible to pay the creditor. Now, they will say I did not stick to the schedule. But I did send an extra payment of $250 months before, everything would have been covered, except this company lied and was not transparent with me, and now I'm in a way worse situation due to them.Business Response

In your complaint you expressed dissatisfaction over the fees related to your program.
We confirmed your enrollment into the program on July 15, 2022. At the time of enrollment, the Account Specialist reviewed your Enrollment Agreement with you prior to your signing. Information about program fees can be located under the section titled "Debt Resolution Agreement" in paragraph 11. (a). "Program Fees". In reads in part as follows:
"Company will not earn any settlement fees for services until: (i) a successful resolution is received on an enrolled debt; (ii) Client approves the new terms; and (iii) Clients first payment has been made towards new agreed upon terms. The Client agrees to pay the Company a fee in the amount of ***** % percent of the balance of each debt enrolled into the program..."
A settlement was negotiated and authorized by you on December 12, 2022. The first payment was made towards that settlement on December 30, 2022. The first portion of the fee owed towards that settlement was taken on January 5, 2023. Beyond Finance met all established expectations prior to earning a portion of the fee.
Additionally, review of your account determined that after the settlement was approved, you called in to request that your payments be temporarily lowered. The agent assisted you with this request and advised that adjusting your deposit could jeopardize settlements. This adjustment to your payment did not allow there to be enough funds in your account to continue with the settlement as negotiated.
Your dedicated savings account was held with ******************** Technologies and accessible to you through them.

In your complaint you expressed dissatisfaction with fees related to your program.
We confirmed your enrollment into the program on February 16, 2022. At the time of enrollment, the Account Specialist reviewed your Enrollment Agreement with you prior to your signing. Information about program fees can be located under the section titled "Debt Resolution Agreement" in paragraph 11. (a). "Program Fees". In reads in part as follows:

This company was not authorized to withdraw from my trust account for a total amount of $576.79. it was set up to pay for a debt. consolidation account. I was told on Feb 15th, by both the Beyond rep. ******* and the CFT supervisor that I would be receiving a full refund of $576.79. moments after I was told that I would be receiving a refund Beyond withdrew $189.79, $189.79, $197.21 totaling exactly $576.79. they did not have authorization to do so. that was to be refunded because I cancelled the program, after realizing they did not meet what was promised. I am seeking a full refund of all fees, they had only settled one account not both.Business Response

5 years ago I hired Beyond Finance to pay off my debt and withdraw monthly payments of $384..57 from my checking account. I hired Beyond because I had had a Heart Attack and was not able to work and pay off my debts as they were. Beyond told me that they would settle all debt in 4 years, but this is not my issue. At this point only one creditor remains, Citibank, which has recently settled for *******. This was on 2/22/23. Beyond told me that my account at beyond currently totaled $2054.24. I calculated that with 7 more payments to Beyond of ****** I will have enough funds in my Beyond account for Beyond to pay off ********* and deduct their own fees totaling *******, by Oct. 30, 2023, leaving a balance on my Beyond account of $405.90. However Beyond Finance wants to continue to withdraw $****** through to and past the beginning of ****. This is thievery. Beyond has had their representative call my repeatedly, 5 times now, and I feel harassed. I told them that my agreement is that they continue to withdraw $****** monthly from my account through October 2023 and that they pay off the Citibank Account by the end of October, and pay their service fee of $*******. This would leave a balance of $405.90 in my account at Beyond.Business Response

Beyond Finance did not fully disclose or communicate with account holders all information regarding the agreement and processes of the contracted services, service fees and the disbursement of fees, cancelation processes and associated fees related to settlement, and fees related to unsettled debts related to cancelation of the program. Beyond Finance stated during the initial signing of the contract there would be no fees or settlement fees for account canceled at any point during the program. Beyond Finance was not willing to negotiate settlement fees for incomplete settlements. Account holders were of the understanding that there are no settlement fees for unresolved and incomplete settlements in the program. Beyond Finance representative clarified all fees were not applied to the account until the account was settled and the customer satisfaction was met.On three different occasions, Beyond Finance did not disclose or update contract agreements when removing settlement accounts and did not provide accurately update account information prior to removing accounts. Each incident, an account holder had to advocate accurate information to Beyond Finance to adjust account funding and disbursements.Beyond Finance is refusing to reimburse funds in shared account to account holders. They state we owe settlement amount to an incomplete settlement. No information was provided about settlement amount, nor it being due immediately at time of closing the account. In your complaint, you expressed frustration over the fees associated with Beyonds debt settlement program, and the disclosure of those fees. The fees associated with the program are outlined below:
There are no fees for signing up for the program. Beyond will not earn any settlement fees for our services until (1) we reach a settlement with a creditor for one of your enrolled debts, (2) the client approves the settlement, and (3) the first payment is applied towards that settlement. Since we reached settlements on 3 of your enrolled debts, and at least 1 payment has been made towards each of those settlements, Beyond is entitled to a settlement fee for each. This information is outlined in section 11a (Program Fees) of your Debt Resolution Agreement.
As outlined in section 17 (Withdrawal from the Program), there are no penalties or obligations associated with canceling the program. However, upon cancellation Beyond is entitled to any unpaid settlement fee that was earned prior to cancellation. Any unpaid fees will be deducted from the clients remaining balance in their dedicated account prior to disbursement. Furthermore, if the remaining dedicated account balance does not cover the full unpaid fee amount, electronic debits will occur from your bank account provided in the amount of $50 until the remaining fees have been paid, as stated in your signed Direct Debit Authorization.
Finally, there are service fees associated with your third-party dedicated account with CFTPay. These fees were listed in your CFTPay Account Agreement and consist of a one-time account set up fee of $9.95 and monthly account service fee of $10.75.

This message does not address the core of my concerns in the following areas:
1. Authorization/Settlement approval - I was never notified, nor approved to the settlement offer. I am the primary on the account.
2. Customer Satisfaction guaranteed or your money back a Beyond Finance rep stated a if we were not satisfied with the program, we could opt out of the program free of any charges and settlement fees. Please honor what your representative stated. ******* stated we could cancel anytime without penalty (including settlement fees).
3. General: I have called numerous times about a single situation, each time receiving a vastly different responses to resolving the same issue. There have been numerous incidences, each one requiring several conversations to resolve the issue. There is more confusion using your company to settle debt, I am unhappy with the services that have been provided. I am requesting a refund of all services, settlement fees, any other fees associated with our account. Please all funds in the dedicated account back to the account holder's bank account immediately.

I was contacted by Beyond Finance asking if I had credit card debit. At the time I was paying all my credit cards minimum payments. They told me they could help me get my credit card balances under control. They asked what I owed on each one I told them. They said they could help me get a lower payment. They figured out how much my debt was I was to pay them $380 a month. They would put my money in a holding account so when the credit card companies came up with a lower balance I would have money to pay off the accounts. Well I thought everything was going great, thought I was paying off the credit cards and such. I was contacted by a lending company thats affiliated with Beyond Finance called Beyond Lending twice the first time I told them no thank you at this time. Then the called me a second time saying I had only two accounts left to pay for. That I could take out loan for $11,000 whatever I didnt use would go back to me. I could use it to put back on my loan. Which never happened because Beyond Finance took the money I got from loan and paid all the credit card companies off. All the money I paid in before the loan, they just placed fees on it. Astronomical amounts. Which eat up all the money I paid to them the entire time I paid them which was $8000 for almost 2 years. Now I am stuck paying a loan for another 5 years after just paying 2 years already.Business Response

During your time in our program, you deposited a total of $8,250.89 through regularly scheduled deposits. Additionally, a deposit from Above Lending in the amount of $8,568.67 was received into your dedicated account on August 11, 2022.
The debits from your dedicated account are outlined below:
Settlements were reached with 8 of your creditors. The total combined amount of payments made to those creditors is $11,095.82. For each of those settlements, Beyond Finance earned a settlement fee of 25% of your enrolled debt amounts. The settlement fees earned during your program equals $5,084.76. More information regarding settlement fees can be found in your section 11.a of your Client Enrollment Agreement.
There were 2 fees associated with your dedicated account. The first is a one-time account set-up fee in the amount of $9.95. The second is a service fee that is charged monthly and is in the amount of $10.75. The total combined amount of these fees is $267.95. More information regarding these fees can be found in your CFTPay Account Agreement.
Finally, at the time of your enrollment, you opted into the ***************** Club membership. The cost of this membership is $14.95 per month and is debited from your dedicated account. I entered into an agreement with beyond finance to settle my debt. On 9/14/22 They charged me $14.95 a month in order to pay for legal services to *************** to provide debt relief. I only made one payment which was not enough to pay for any of the debt yet I was still charged the **** a month and it was not utilized at all as they didn't need to contact any lawyers on my behalf. At the time of your program enrollment with Beyond Finance, you opted to enroll in ***************** (BLP) *********** which provides limited legal services to its members such as discounted fees for common legal matters, identity theft monitoring, and assistance in connection to your debt settlement program for a monthly fee.
The monthly fee for BLP is $14.95. This fee is charged each month from your dedicated account. This fee in part goes to a lawyer or law firm to secure the availability of the law firms services IF you should need it during the duration of your program. Services are not necessarily used for each settlement reached; it is used on an as needed basis, such as when working with an aggressive creditor, for example.
Details of the fees and what the service provides is detailed in your ***************** ********** Agreement, which you signed on September 4, 2022.

Our previous response stated that your account was closed on February 14. It takes several days to update your account status, so the 14th was the day it was officially closed in our system.
As previously stated, if you believe that one or more of the debts enrolled is not yours and was taken out using your personal information and without your permission, please go to the ************************ website at ***************************** and complete an online identity theft form. Please submit the completed form to the creditors in question.
The fees associated with our program are outlined in the enrollment call and accompanying documentation. Deductions from your dedicated account include 2 payments to 1 of your creditors, a one-time account set up fee, monthly fees associated with your dedicated account, as well as Beyonds earned settlement fee for reaching a settlement with 1 of your creditors.
However, we regret your negative experience and any frustration you have faced. As a gesture of goodwill, we have made the decision to refund you in the amount of $848.76, which is the total amount of deposits you have made into your dedicated account.

This is a debt settlement company. My debt was paid in full in December. I called they stated last withdrawal from my account would be ******** I ask for it in email. Never received email. On their dashboard it showed another payment coming out in Feb. I called. They stated that was the last payment and it would be $60. Again I asked for an email. Got no email. Called them back on speaker phone. With witnesses in room. Let them know they were on speaker with witnesses. I ask for it in email multiple times. They kept saying before they could send emai it had to be approved. I was on hold. They said they got the approval. They would send email showing last payment of $60 & none after. They now have on their site. Scheduled another $288.45 withdrawal for March. They were paid in full December 3rd 2022. I have a file of pictures. I have requested this information on multiple dates, yet the emails never state what was said over the phone. I've spent a lot of time dealing with this over and over. Send the exact amount you believe you are owed. I will forward it to my attorney, and act accordingly to his advice. If he agrees to the amount and terms. Easily fixed, ill send a check.
