I was charged ***** a since 4/2023 for a service through beyond finance. When I attempted to use this service I was told it wasnt an option. On a second occasion I was told how to use the service and who to email and o didnt get communication back until the day after I needed assistance. I have requested a refund through the company and was told that I signed agreeing to be charged for the service. And while I did agree to that when I attempted to use this service I wasnt given access to it. I am requesting a refund of $538.20. Also in 3/2023 I was told all the ascounts had been settled and no further money was owed but they still took ****** on 5/1/2023 from my account. In your complaint you expressed dissatisfaction with the Better *************** plan. You are requesting a refund of fees related to that program.
We confirmed your enrollment into the program on March 27, 2020. At the time of enrollment, the Account Specialist reviewed your Enrollment Agreement with you prior to your signing. Information about the Better Life Plan fees can be located under the section titled "Better Life *************** Agreement". In reads, in part, as follows:
"Member understands this fee is non-refundable and will only be used in the event a response to a lawsuit is needed in connection to a debt enrolled in Members debt settlement program or Members debt settlement company requires attorney assistance to settle a debt."
We regret that you had difficulties utilizing this service, however Beyond Finance does not manage Better Life ***************.
At the time of your complaint, there was a remaining program fee in the amount of $52.48. Once that program fee was processed, a refund in the amount of $183.58 was issued to your account on file.

As my complaint states I am aware I agreed to the service however when I needed the service it was never provided. On 3/6/2021 I sent notice that I received a court summons and when I called to get the information to move forward I was told my program didnt include assistance if an account was sent to court. I then handled the account with the attorney on my own which I can provide details of and you can review the recorded calls during this time. On 6/9/2022 I again reached out as a second account went to court and at that time I was told to email a certain department. And didnt hear back. I reached out again on 9/20/2022 again looking for someone to contact me. In between these two dates I called on multiple occasions on which Im sure you should have recorded conversations and still received no assistance. I called the day prior to court looking again for last minute assistance as again no one had contacted me. I didnt receive any contact at all regarding this until the afternoon of the court date after I had already appeared in court in the morning. As documented on Nov 7 when I received an email requesting more information and informed them the court date had already come and gone and I no longer needed assistance with it as again I settled it on my own. So while I am aware I signed up for the service the service was never provided when I needed it. Instead I was put off until I no longer could use it. So BLM didnt hold up their end of the contract which was providing assistance if an account enrolled in their program went to court. I had 3 accounts land in court and I took care of them all outside of the debt consolidation program because no one assisted me when it was needed. Therefore I should be entitled to a refund as BLM failed to provide ten service I paid for.Business Response

This company lied to me from the beginning. I was on the phone with them for 2 hours before going with them. I told them I hadn't missed a payment in over 14 years and due to covid I was going through a hard time. I told the man on the phone that I didn't want my credit to go in the toilet. I told I wanted my payments to still be made. He assured me they would be paid. I was told to stop all payments and they would take care of it. It wasn't until a few months later that they were just letting all my debts go into default I called the company and asked them what was going on. They said this is how we settle your debt. I said I told you I didn't want this. You stated this wouldn't happen. On top of all this they knew that 2 companies I had accounts with would not settle with them even before excepting my business. I have been sued by 2 credit cards at this time. They never informed me of these lawsuits. This company has cost me more than my original debt would have been, not to mention charging me monthly fees and 25% of any settlements reach. That's 25% of my original debt I owed. They made $1000's of dollars. Now the companies they say they settled with has told me that they haven't settled anything at all. So all the money I made didn't pay for anything. I believe they should refund me all monies that they received from me since they didn't complete anything they said they would. I ended but firing them when I saw yet another monthly being added to my account that they couldn't explain. Cards that I was told were settled are telling me nothing was settled and I still owe it.Business Response

We confirmed your enrollment into the program on December 29, 2021. At the time of enrollment, the Account Specialist reviewed your Enrollment Agreement with you prior to your signing. Information about program expectations can be located under the section titled "Debt Resolution Agreement" in paragraph 13. "Disclaimer". In reads, in part, as follows:
"The use of Companys debt resolution services will likely adversely affect Clients creditworthiness... ...the client acknowledges and fully understands that the company will not be making the Clients scheduled monthly payments to their creditors."
"... the Company cannot prevent a creditor from taking legal action against them, and the Company cannot offer any guarantee whatsoever that legal actions will not be commenced by the Clients creditors"
At the time of your enrollment, all included accounts were eligible for the program. An account moving into a legal status does not prohibit us from working towards reaching a settlement. At the time of your requested termination, two of your enrolled accounts were in a legal status but no suit had been filed.
At the time of your requested termination, 6 of your enrolled accounts had been settled. Records indicate that we have forwarded you the details of those settlement agreements. Should you need a detailed breakdown of the settlements, please do not hesitate to reach out.

After deciding to cancel the agreement with Beyond Finance I called them at 11:06 a.m. on April 5, 2023 to notify them of my request to cancel. The phone call took approximately 4 minutes to cancel and the representative confirmed during the call my contract was in fact cancelled and they were no longer representing me for their services. I received an email several days after on April 7, 2023 and Aprils 8th confirming all activity had ceased and no further representation was to take place and we felt all was in order and at that point. I was not told nor was aware any contact had been made to any creditors at any time that they were planning to work with on our behalf. I found out a week later both my wife and my credit card account was closed by one of the creditors as a fax was sent to them on April 7, 2023 and processed by the creditor on April 11, 2023 in which they claimed they had ***** of ******** and that our account was to be settled by them using that ***** of ********, although that ***** of ******** was nullified via the phone call on April 5, 2023 as confirmed on my phone call with them. They acted outside of the agreement as it was cancelled by the time they faxed over the *** and account settlement information to several creditors. Now my wife and I have had the accounts that were in excellent standing and not in any delinquency closed with balances which is going to have an adverse affect on our credit and rating for some years to come.Business Response

In your complaint you expressed dissatisfaction with the impact your enrollment into the program had on your **** of America credit cards.
Our records reflect that you called in on April 5, 2023 seeking clarification on when your deposit would reflect as processed rather than pending. The agent you spoke with provided you with insight as to when you could expect to see the payment reflected as such. There was no discussion about termination of your program at this time.
The ***** of ******** was sent to **** of America on April 7, 2023 at 1:54 AM. Later that same day you called in to request to terminate your program. Your termination was processed as requested.
We understand that the Enrollment Agreement advises that it may take up to 4-6 months prior to being able to reach out to your enrolled creditors, however that is not a guarantee. Each program is handled on an individual basis, and occasionally we are able to reach out prior to the 4-6 month timeframe.
Review of your account has shown that you have discussed this matter with an Account Manager and provided valuable feedback as to how we can enhance our processes to positively impact the customer experience. Should you have any other questions or concerns, please do not hesitate to reach out.

Upon cancelling our agreement Beyond Finance has a responsibility to provide information to it's customer for any contacts that were made that might impact our credit and credit standing with any financial institutions. They also have a responsibility to contact any financial institutions and remove the *** that was sent. My account was active for an additional 5 days after the fax was sent on 4/7/23. Beyond Finance did not take responsibility and did not notify me or the financial institutions of the voided agreement and voided ***. Had they at least informed me of the actions they took that same day it could have been avoided. I stand by my complaint that Beyond Finances negligence in informing me and the financial institutions of the cancelled *** was detrimental to my good credit standing with **** of America since they only closed it due to that fax 5 days after it was sent. They informed me that had I contacted them or had Beyond contacted them to let them know I was no longer seeking debt settlement both my wife and my account would still be active. This is not a simply miscommunication it's a negligence to provide information once a customer cancels and is no longer making them any money.Business Response

Beyond Finance provided a detailed process for when they are to begin contacting creditors. This process that was discussed by several of the Beyond Finance employees stated that they DO NOT contact any creditors unless two milestones are met
These milestones are that the deposit account they were managing had to contain at least enough funds to pay off one debt settlement and the second milestone is that the account needed to be overdue in order to start any communication.
At the time they instructed me of this approach up until the day I terminated the contract my Beyond Finance account did not contain enough funds to reach any settlement for any of my debts, nor were any of my credit accounts overdue at all. This was a misleading plan
All credit accounts were paid and in good standing when Beyond Finance sent these letters out and I was never informed of this deviation from the original plan they detailed to me several times. I am requesting that they also send letters out to any other creditors they contacted revoking the same POA to avoid further damage to my credit.

I started with this company 11/12/2021, and finished 08/2022. Very misleading and scam. Come to find out the employees are in sales, but we're led to believe they are finance and debt experts. Many of them are not located in this country and do not know anything about debt or finance. The employees make false claims that people who sign up with the program will save money, commonly 50% of the debt, if we sign up with them, they are there to help, etc., but with their 25% fee for every settlement added on, we actually don't save 50% or anywhere near there. In addition, they have this other company called "Above Lending" and initiate a "graduate program". For this "graduate program" they provide a loan with extremely high interest ($20,000 in debt would end up costing $40,000 total for the life of the loan), and then convince people that they should agree to this loan because they pay off the remaining debt owed to creditors. With that interest, plus the 25% that they charge initially for each settlement, I'm paying way more than they claimed and did not save anything. Beyond Finance does not don't disclose everything honestly. For example, the companies that agree to "debt forgiveness" arranged through Beyond Finance end up sending ****-C forms and claim the forgiven debt as a "loss". The debt forgiveness ends up being added on as "income" to the tax returns of those who agreed to this program. In my case I owe $5,000 in taxes because of the extra "income" that was added on. When in reality, I am fully paying for this debt and then some - probably at least 3x my original debt, but instead of the money going to creditors it instead goes to Beyond Finance. I did not save any money, and the debt forgiveness was definitely not an income in any way which is how it was classified. I feel mislead, lied to, and scammed. Please look into this, I would not be surprised if someone initiated a class action lawsuit based on these types of unethical practices.Business Response

We confirmed your enrollment into the program on November 12, 2021. At the time of enrollment, the Account Specialist reviewed your Enrollment Agreement with you prior to your signing. Information about program fees can be located under the section titled "Debt Resolution Agreement" in paragraph 11. (a). "Program Fees". In reads in part as follows
"The Client agrees to pay the Company a fee in the amount of ***** % percent of the balance of each debt enrolled into the program..."
All fees earned by Beyond Finance were in alignment with the expectations set forth in your Enrollment Agreement.
Additionally, information about potential tax implications is covered under the same section in paragraph 10. No Legal or Tax Advice. It read in part as follows:
"Client acknowledges that the settlement of debts and any savings thereby achieved through the Program may result in tax consequences to the Client. The Client shall be fully responsible for any and all such tax consequences and may receive tax forms in which their compromise and/or reduction of debt was reported. Clients should consult their Tax Advisors for any and all tax assistance and information."
Beyond Finance does offer the opportunity to be reviewed for eligibility for assistance from Above Lending, however we do not determine any of the parameters of the potential Graduation Loan. Moving forward with a loan from Above Lending is not required and Beyond Finance would have continued to service your accounts had you opted to remain in your program.

After dealing with my house flooding from Hurricane and other cost of living increases I was finding it difficult making all my payments to my creditors, as my only income is Social Security, so I contacted Beyond Finance. I chose them because of their positive reviews, which I now believe dont honestly include all the complaints against them. My fault for not checking BBB first. I made my first deposit/payment 9/8/22 for $378.39. I canceled on 4/7/23 because I hadnt been clearly told that their fees were on the actual amount due (including interest & late fees) on each account at time of settlement NOT negotiated amount, making the fees ridiculously high. I have paid $2648.73 and was charged $2437.25 of which only $1673 went to creditors. When I opted out of Beyond I requested that my deposit for ***** not be taken. I received an email that my ***** payment was canceled yet they took the money anyways. They settled one account and made a $40 payment on a $1030 settlement at time I opted out because I realized that after settlement offer plus fees I would only have saved $26, yet actually cost me much more in interest and late fees. They argued continuously with me about my mistake in leaving the program, I had to repeatedly say I wanted out. Out of 12 accounts, one was settled, the majority have been charged off which I now have to deal with. My credit is destroyed after entering with 700 score. I just needed help reducing my interest rates and payments but they have you ignore any communication from creditors in order to get them more open to make a deal. I want my $378.39 returned to me. For what they helped me with $764 is more than enough for all the damage they have done. Its going to take me years to repair my credit.Business Response

On November 3, 2022 I spoke to ************************* of beyond finance a debt settlement company to resolve my credit card debt. ***** did not give me correct information and told me it would take 1 to 2 months to contact my creditors and begin to settle my debt. It is now going on 5 months and I thought one of 19 credit accounts were settled but it turns out that I just received a bill from them and nothing was done by Beyond Finance even though they advised me that a settlement offer was accepted and payment would be made in February of 2023. This has been a nightmare beyond my control. I call and chat and no one follows up or helps me. I get the same canned responses each and every time. Requests to speak to a supervisor have felt on deaf ears. I am giving this organization $1300 a month since November 4 th 2022 and nothing has been done. On 03/30/23, I removed all of my accounts from Beyond Finance due to the lack of settlements they were working towards. They did settle one account that I am still making payments towards. I was informed that my monthly payment would stay the same despite the other accounts being removed. With that math I am paying over $450 into my dedicated account for a monthly payment of $180. I understand there are fees with the program, however with removing all other accounts the payment about should be lower. I was on chat about the subject and was then strung along by the person saying they are reviewing my account. 30 minutes later I'm told there are computer issues. My entire experience with this company has been absolutely horrendous.Business Response

The below information is a screen shot from my account as of 3/30/2023.My ************** Acct #: ******** (as listed with *********************** is still showing one payment left.Reduced debt by: $82.62 Balance At Settlement:$582 Settlement Amount:$499.38 Payment Plan 1 payments remaining.The last payment on this account was to be paid on 1/30/2023. After it was still showing 1 payment left, I called Beyond Finance on 2-27-2023 and spoke with ******. She was getting a Supervisor involved as payment was showing in transit to **************. Supervisor told her to contact the accounting department to find out were payment is and to possibly resend the payment to **************. ***** said she will contact me on 3/2/2023 with an update. ****** called me back on 3/2/2023 and said she is contacting accounting. On 3/20/2023 I called Beyond Finance again and talked to ********* she said that she put in a ticket it the IT department for them to update the dashboard and for me to call back next week. I told her that I would not call back again on this issue, if it was not updated that I would file a complaint. I hung up and called ************** and spoke to ******. He said that this account was paid in full on 1/3/2023. On February 2nd 2022 I enrolled in beyond finance. 12 total accounts. I pay $504 monthly and I on December 9,2022 I was sent an email to approve a settlement option for discover. I approved the negotiation amount. I was not notified of any changes and was expecting to see this satisfied and settled. When I called beyond finance I spoke with someone that stated the settlement was a poor deal and they were no longer working to accept that option. I had no idea. Since December I have been trying to negotiate with discover, sending in all documents and offers from discover to the documents@beyondfinance email option. Nothing has happened. I now have been sued and have a court date to attend. Im furious. Im paying $504 each month and now also risk being garnished or worse. I need assistance and I need it now. I would have never enrolled discover into this program if I would have known that beyond finance would have not done anything. I have received many offers to settle from discover over the last 14 months and was told to forward the email and ignore them.Business Response

Beyond Finance appears to be a predatory credit assistance company. I signed up three years ago for a debt resolution program. The terms seemed beneficial, but as the program continued, it became apparent that what was offered was not what was delivered. Settlement offers were withheld, advice was given that led to legal action against me for multiple accounts. I removed multiple accounts from my program and resolved the remainder. Beyond Finance makes a fixed percentage on enrolled debt. This means that no matter how much they reduce debt, they are still owed the same commission. They lack any motivation to reduce debt. It was even confirmed to me by a representative of one of those removed accounts that they use a fixed percentage for debt resolution companies like Beyond and that number is typically substantially higher than if direct negotiations between creditor and borrower were to happen. This means that Beyond Finance is more expensive than direct negotiations, even before their 25% commission is added. At the end of my debt resolution program with Beyond Finance, the math works out that that they reduced my debt by $27 (on a nearly $21,000 enrolled debt account). That counts their monthly fees and commissions as part and parcel of the debt. To add insult to injury, Beyond Finance is refusing to cancel future "deposits" from my bank account even though I have paid all of my enrolled debt and ALL of their fees. They have been contacted 4 times now since my program ended and still refuse to resolve the matter. It is obvious to me, and should be to anyone else, that this is a bad-faith actor and predatory agency, seeking to profit from people in desperate financial positions. All consumers should avoid Beyond Finance and ANY organization that does not have **************** to assist and provide the lion's share of benefit to the consumer. While the response from the company does resolve the matter of the Beyond Finance refusing to remove future deposits even after 4 points of contact & being assured such would be expedited (the did finally do that), it DOES NOT answer questions of predatory financial practices or pervasive lying by the representatives of this company. Beyond Finance is NOT transparent when initiating an account that they will be paid the same fee (in actual dollars) no matter the degree of debt reduction. They regularly hide (meaning not sharing with the consumer)settlement offers. They encourage consumers to practice no communication &no payments to the original creditor at the same time. What they fail to inform their customers of is that this will almost certainly lead to legal action, which conveniently Beyond Finance will only assist with if you pay them more for such a program.
Upon being confronted with all of these behaviors in both chat and phone conversations, the Beyond Finance representatives' responses are to ignore and simply state that they "are not bad faith actors" or "predatory". They do not provide evidence to contradict these statements as they cannot. Beyond Finance has ZERO "skin in the game" and rely on desperate consumers not understanding or having the time to do research to take advantage of the situation and line their pockets. They pretend like their fees are non-existent when calculating debt reduction. Let's explore that dishonesty. If a company reduces your $10,000 debt by 50% and then charges your a 25% fee (based on ENROLLED debt),then the accurate figure is that they reduced debt by ONLY 25%. They will never display it that way because there is ALWAYS going to be that account that they resolve for less than 25% reduction which means you actually end up paying MORE for that debt than had you resolved the matter directly with the creditor. We confirmed your enrollment into the program on March 25, 2020. At the time of enrollment, the Account Specialist reviewed your Enrollment Agreement with you prior to your signing. Information about program fees can be located under the section titled "Debt Settlement & *********** Services Agreement" in paragraph 11. (a). "Settlement Fees". In reads, in part, as follows:
"Company will not earn any settlement fees for services until: (i) a successful settlement is received on an enrolled debt; (ii) Client approves the terms of the settlement; and (iii) Clients first payment has been made towards that settlement. The Client agrees to pay the Company a settlement fee in the amount of ***** % percent of the balance of each debt enrolled into the program"
Additionally, information about potential legal impacts are covered under the same section, in paragraph 13. "Disclaimer". It reads, in part, as follows:
"Clients enrolling in the Program may be sued by their creditors for nonpayment and Clients must take this into consideration when determining whether or not to enroll in the Program"
Beyond Finance clearly lays out the costs related to the program under the section entitled "Program Snapshot". This section provides you with a breakdown of estimated program settlement amount and estimated program fees.

The response from Beyond Finance may be technically true, but it is piecemeal & incomplete. They fail to address the fact that they knowingly & willfully withheld MULTIPLE settlement offers from my original creditors.They rely on the documentation alone, & NOT what their actual service reps ******* which IS NOT that the fees are FIXED based on enrolled amount.Beyond Finance does not have "skin in the game".They ******* their services as if they will save you money.THEY WON'T.They saved me $6 over what I would have paid had I negotiated directly with my creditors.Would it have been more of a hassle?Yes, but I wouldn't have needed to pump money into a company that has no fiduciary role.I would also like to point out that since filing my original complaint with BBB, Beyond Finance has commenced daily (sometimes multiple) calls.This is harassment.I did not request nor do I see the function in direct comms.My relationship with Beyond Finance is over. My purpose for filing this claim is to inform Beyond Finance that I believe them to be a bad-faith actor & that hopefully they will either change their ways or consumers will know better than to use them.If Beyond Finance wishes to communicate further with me, they will do so through the US ************** or not at all.Any further contact will be viewed as harassment & I will seek legal remedies to end such behavior.If Beyond Finance wishes to "resolve" this complaint, they will publicly &completely admit & apologize in their response to concealing creditor settlement offers, for misdirecting me upon enrollment as to the fee structure &admit that they have no financial risk when they re******* consumers.All should be done via this BBB complaint.Short of that, I would say this complain cannot be resolved & would only serve to demonstrate the points made herein.Alternatively,any official documentation on Beyond Finance letterhead of the above listed admissions & statements would be accepted & posted to my response.
