This tow company towed my car unlawfully because it was in private property and they did not tell me about towing it when I was outside with it. The Battery had died and I needed a jump so I was going to have my friend jump it but they didnt have cables so I pushed it into the parking space and it shouldve been good for three hours in the parking space hence the sign for retail parking for three hours. My car was only parked there for 30 minutes before it was towed. They did not even put a notice on my car. They did not contact me or approach me and tell me anything about towing the car when I was just there. So this elite towing illegally towed my carInitial Complaint

I don't know if it's legal, or if they still do it, but they used to pay people $50 bounties for calling in cars. I worked at a place with a small parking lot on ****** downtown, and the minimum wage employees would race each other to call in cars, to the point of totally neglecting their job to do it if necessary.Initial Complaint

Elite illegally towed my car from ********* bar on Friday night, Nov 1st. When I called them they stated they had photos of me leaving the bar at 9:30pm and when I told them I hadn't left for the 4 hours I was there, they said they had proof and "we'd see about that." The bar manager came out after calling them and gave me cash for the tow money, put me in an ***** and got me to the tow yard as this company supposedly could not bring my car back once towed. I gave the tow company the cash from the bar, had to pay extra on my debit card as they'd given the bar manager the wrong amount and then I finally saw the photo of a shorter lady dressed in skinny jeans with a guy in a baseball cap. I arrive by myself in a skirt with a shawl. I was told I'd get copies of my photos and could call back on Monday to see about a refund. I was told they should be able to compare the footage of me at the tow yard to that taken at the bar but there were no guarantees.Initial Complaint

Elite Towing towed my vehicle. When I called them they told me they dont know anything about it and no record of my vehicle ever being there. When I called the police they told me it was towed by Elite towing. When I called back she continued to deny any knowledge of my vehicle and refused to inform me they were in possession of my property. I had to show up in person for the lady to admit that my vehicle was in their yard. I was about ready to strangle this woman but kept my cool, paid the ******, and left. There must be some legal issue with stealing my vehicle and denying it when they are called out directly. When I drove my truck home my gas milage was 5mpg lower than usually, continuously.Business Response

It's possible that the vehicle owner called during the commencement of the tow, which in that case, the vehicle would not be visible in the system. Without more information, I cannot confirm that this happened. Regardless, the vehicle owner was given a discount on storage for the inconvenience.Customer Answer

The image of the text attached is not from our company. We are not Elite Recovery, LLC, and this company is located in *****.
If the owner's vehicle was towed from a residential property, they will not be charged to retrieve their belongings. If it was towed from a commercial property, we are at liberty to charge the hook fee (base rate) of $239.88 to retrieve their belongings per PUC Rules and state law:
"For a Commercial PPI, the towing carrier may charge up to the appropriate maximum
base rate, as established in subparagraph 6511(b)(I), for the removal of personal
property. For a Residential PPI, the towing carrier may not charge for the removal of
personal property."Again, the text that the vehicle owner received was not from our company.

Unlawfully towed vehicle, parking sticker was present under review mirror but no visible from the photos taken from Elite towing. When we physically went to pick up vehicle Elite employee acknowledged that the parking permit was in fact present and a reimbursement would be issued. This event occurred on May 15th 2024. We reached out today to inquire about the refund and were told that the employee did not see the parking permit on the window and that a refund would not be reimbursed but I was physically present to witness the employee acknowledge the parking permit and say a reimbursement would be issued.Business Response

My car was towed at my apartment complex ************** apartment on *************** (***********************************************************************) at 12:32 am on march 18 . With a visible parking pass placed on the rear view mirror issued by the leasing office without prior notice of 24 hours as per the New law. The company demanded over $253.32 at the time of our interaction and I explained to them that there was a parking permit present and displayed on the vehicle. They claimed it was expired and towed without any notice. I miss work and my wages were affected.Business Response

As described in the complaint, the vehicle was towed in the early morning hours of March 18th. In the first photograph attached you will see that the temporary permit that was issued by the property, and displayed in the vehicle at the time of the tow, had expired a month and a half prior to the tow, on February 5th at 11:59pm. According to new legislation passed in August 2022, among other parking violations, 24 hours notice being placed on the windshield prior to the start of a tow is not required if, "THE VEHICLE IS PARKED WITHOUT DISPLAYING VALID AUTHORIZATION IN A PARKING LOT MARKED FOR THE EXCLUSIVE USE OF RESIDENTS."
The second attachment provided shows a sign at the entrance of the property. 1 of the 17 signs that are on the property, that state parking on the property is by permit only, and any vehicle that is not authorized to be on the property is subject to be towed at the vehicle owners expense. When the vehicle in question was called in to be removed from the property for displaying a permit that was 6 weeks expired, it was not provided a 24 hours warning, per the statute, and was immediately removed from the property.

************************* requires all vehicles to have a permit while parked on property. This is evident by the "permitted parking only" signs throughout the property. Additionally, it is the resident's responsibility to let their visitors know that they need a parking permit. In HB22-1314 40.10-.1-405 Subsection (3)(b)(I)(A-H), it lists the violations that do not need a twenty-four hour notice.
HB22-1314 40.10-.1-405 Subsection (3)(b)(I)(H) states: The vehicle is parked without displaying valid authorization (parking permit) in a parking lot marked for the exclusive use of residents.
Lastly, the vehicle owner was not told that he would be "charged extra." He was informed that the price continues to go up hourly, so the longer he waits, the more the charges will go up.

That is not what was said at all and additionally I asked for the 4 pictures of the vehicle (required by law) to be sent to my email and was told they sent them never have seen those pictures the lady I spoke with on the phone last night to get my car back redused to give me her name and refused to give me a manager's name completely unpleasant and unprofessional. Also they have no indoor lobby to wait it I had to stand outside in 9 degree weather while the lady running the window took her sweet time getting everything arranged then proceeded to tell me that I would have to enter into a payment plan to get my vehicle back. The last thing I would like to know is how at 3 pm on the 11th to 2 am on the 12th the price to get my car back went from 301 dollars to ****** in a matter of 11 hours?
