  I have been living in my apartment at the **************** since June 5th, 2022. I have had my garage parking space (number 17) since June 17th, 2022 without any issues until July 4th, 2022. On July 4th, I went and ran some errands and arrived home around 8:30pm, when I went to leave for work on July 5th, 2022 around 6:30am, my car was missing from the garage. After making a 911 phone call, it was discovered that Elite Towing of ****** had towed my car without notification. After speaking with the leasing office manager at ****************, it was discovered that my vehicle was towed by mistake as my garage space had been paid for and a part of my on-going lease. After retrieving my vehicle, I noticed multiple scratches, dings, and gouges along the passenger side, roof, and rear end of my vehicle as well as a paint chip/***** in the drivers front wheel. I contacted Elite towing immediately and they let me know that I needed to send the damage photos to ********************************************************** which was completed on July 5th, 2022. The lady also stated that I needed to go in person to complete a damage claim form which was completed on July 6th, 2022. I had reached out to Elite towing via email on July 11th, 2022 to get a status on my claim. I did not hear back so I reached out via phone on July 13th and 20th, 2022 with a response the manager needs to get back to you, I am only a dispatcher. I then sent my complaint to the Attorney General on July 21st, 2022 which in turn formed a response from Elite Towing on July 27th, 2022. Elite Towing stated that they are denying my claim and they suggested filing a complaint with the BBB. I have made multiple attempts to hold this company accountable for the damages caused during an unauthorized tow to no avail.

  The photos prior to towing show minor damages such as chips and scratches, which is what is being claimed on the damage claim. The damages the vehicle owner is claiming are inconsistent with damages that the hydraulic boom system on a tow truck would cause.

  I am rejecting this response because:
  First of all how did the tow truck fit in the garage most tow trucks are 7ft 6inches to where its unable to fit in that parking garage and the vehicle was parked in lot 17 in a tight space with a vehicle next to it when I recovered vehicle was full of hand prints and grease spots all over where I took the pictures I had to clean off all handprints and grease spots to notice all the damages that where done That vehicle is washed weekly and wax to where I noticed if theres any scratches or dings to where those where not there before and vehicle was illegally towed under House bill 22-1314 of ******** law

  House Bill 22-1314 was not in effect until August 10th, 2022, over a month after the vehicle was towed. The vehicle was released at no charge to the vehicle owner as a favor to property management, but was considered a valid tow. Regardless, under HB 22-1314 40-10.1-405 subsection (3)(b)(I)(C-H), there are violations that do not require a 24 hour notice prior to being towed; one of those violations is no parking permit.

  Regardless of the house bill damages where done by elite towing  as well the tow bill was voided because manager didnt know how to do her job if not she would of had to pay for it and so on thats why she was fired. I am requesting the before and after photos of the tow that was conducted on July 4 2022 in order to prove that these damages where caused by elite towing. If elite towing doesnt resolve the damages done to the vehicle this will be going to small claim courts and a SHERIFF will be delivering paperwork to elite towing company for the damages that where done.

  Our trucks are powered by hydraulic booms and only touch the tires. The damage you are claiming is inconsistent with damage that would be caused by a hydraulic boom system. Normal rock chips and scratches that happen throughout the life of the vehicle is beyond our control.

  Apparently yall cant read the previous messages. The vehicle doesnt have scratches or dents anywhere else in the vehicle  and again the damages where were I had to clean off the **** PRINTS AND GREASE SPOTS and again how did the truck fit in the garage where a tow truck doesnt fit. And still you dont provide proof that I ask the before and after pictures and per sage guidelines you are supposed to take before and after pictures. As well you just said that supposedly they go around the wheels where one of the damages where done so you have proven yourself guilty there for one. If elite towing is not going to take responsibility this will be going to court. I have given elite towing many opportunities to resolve the problem but yall are just going around circles. If this isnt taken care off AGAIN THIS WILL BE GOING TO SMALL CLAIMS COURT AND A SHERIFF WILL BE DELIVERING PAPERWORK.
