I was a resident of Elk Ridge Apartment ************************************************************* **** was my parking permit paid through ParkM. I asked the Apartment manager ******** for my money back and she refused. I want $500.00 including Punitive damages for their illegal, unethical, egregiousness, and immoral act. Or I can take them to civil court and proceed with legal acrimony for the maximum amount allowed of $7,500.00. On The evening of Oct 14/15 Elite towing was towing another car from my apartment parking lot, the car they were towing slid off the truck bed and smashed into the back of our car, they left their card and had us take it to a body shop they chose. We agreed. The body shop gave us a rental car and just because we accidently forgot to register the rental with our complex they towed our car. We would not even have had the rental car in the first place if they hadn't negligently smashed our car in the first place. My wife and I were horrified to wake on 11/6/23 to leave for work only to find out that our rental car gone, we missed work for the day and when we asked Elite towing to please wave the tow fee they refused. It is their negligence that we didn't have our own car in the first place. Now they caused us to miss work and charged us $304.81 to get our rental car out, which we only had in the first place because they smashed our own car. We honestly want a refund. Properties have specific rules to follow. This property requires all vehicles to be registered with an online parking permit system. Elite Towing was not made aware of the make, model, or plate of the rental vehicle. Without this information, there is no way for us to know which vehicle belongs to whom. Additionally, the online parking permit system is very user friendly and takes very little time to update information. The vehicle was subsequently towed due to the lack of communication on the vehicle owner's behalf.Customer Answer

I am rejecting this response because: It was YOUR companies FAULT we had to have a rental car in the first place, YOUR company was NEGLEGENT and SMASHED OUR PERSONAL VEHICLE that was registered, If is wasn't for YOUR negligence we never would have had that car int he first place and it would not have been towed and we would not be out the money you charged us. A DECENT company would realize you GREATLY inconvenienced us in the first place by smashing our car then TOWING the rental car, and refusing to release it without charging us. WE SHOULD NOT BE OUT MONEY BECAUSE YOU SMASHED OUR CAR IN THE FIRST PLACE! MY WIFE AND I WOKE UP TO OUR CAR SMASHED IN THE FIRST PLACE CAUSING US UNDUE STRESS AND AXIETY AND WE HAD TO DRIVE OUR SMASHED CAR FOR 2 WEEKS BECAUSE THE BODY SHOP COULD NOT GET IT IN, THEN YOU TOW OUR RENTAL CAR AND MAKE US PAY FOR IT! I do not feel the business made a good faith effort to resolve this issue. Elite towing was aware there was a rental car on the premises, because of their negligence, we feel they targeted us specifically because they are trying to get money back from having to fix our car. They could have let our car go free of charge when they found out we were residence and they chose not to. We were only in that position of having a rental at all because they ruined our car.
I am requesting to please change the status of my complaint to the business failed to make a good faith effort to resolve this issue. They have NOT resolved anything, and to say their answered addressed the complaint in good faith, is untrue, solely based on the fact that they KNEW there was rental car on that property because they wrecked our car, they hadn't received the bill from the body shop yet, and they targeted us and chose to tow our rental car anyway. AND furthermore, once they KNEW it was our car, and we were the residence they smashed into, they refused to let the rental car go free of charge. They had the power to and they didn't.
This is not a good faith effort to resolve this issue, and people need to know these people are predators and target people whom they victimize.

Elite Towing and **************** towed my car despite the new law requiring prior notice to the person who owns the vehicle.I was parked on the only available space due to others who took up all the spaces. I did not park in a reserved spot. I parked to the left of the dumpster where the lighting is very dim and there is no visible signage to the driver, who is facing forward towards a plain wooden fence that has no signs upon it.I walked out to my car to head to work on September 28, 2023, thinking my car was stolen because it was nowhere to be found. I immediately went to the manager office to wait in line to discuss my vehicle's disappearance. The manager told me they towed it because of a sign on the dumpster and they did not check my plate or vehicle information in the current resident file before having it towed. They said to call the Towing company, which they had to provide information for me as well. Upon calling Elite Towing I was placed on hold. When they responded, they said I owed $280 despite the fact that my apartment failed to look at my plates in their file first. I asked about a payment plan and they began to argue about going online to ****** search their website because they could not provide me with it. When I looked online I did not find a payment plan on their website, nor on a review of ************** relating to them. Elite said there is no way to make a payment plan in person. I would have to find the site first then print out a payment plan which they could not help me navigate. They said I would accrue fees by the hour and I told them I don't have a way to find this unknown website and if I found it I would have to print it at a library which I cannot drive to without a car, before finding a way to get myself 45 minutes from home to them with no car. This company did not follow the law: HB22-1314. I would like my money back to pay my rent please.Business Response

I have reviewed the response made by the business in reference to complaint ID ********, and find that this resolution is satisfactory to me. They agreed that the procedures were not followed before the tow, and the vehicle should never have been towed. They refunded my bill! I thanked them profusely.

On Sept 6,2023 my car was parked at my apartment complex, *********** without any notice to the tenants had vehicles moved by Elite Towing to another parking lot. My car was damaged in the process. My wife has spoke to man named ***** who said he was quote on quote close enough to the owner of the company. He said if the damages to occur during the towing process he would be more than happy to pay for said damages. Since then we've tried to contact ***** via phone. Only to be given the run around and he has been in the office since then apparently. We called Monday, September 11, 2023, told he wasn't in the office and would be there on the 12th. Called again on September 12, 2023 at around 11am spoke to the same receptionist who said again he is out of the office and would be there Wednesday. I look forward to speaking to a member of the management team. Seeing as this complaint is the only way they respond.Business Response

Properties sometimes request vehicles to be moved from one spot on the property to another for lot work. It is the responsibility of the property to inform their tenants of this, not ours, as we do not have any access to resident information. There is a process to follow when someone claims that damage was caused by a tow truck as there are many fraudulent claims. It seems that the dispatch team misinformed the vehicle owner as to when management was going to be back in the office as they were, in fact, out of town until September 13th. As frustrating as it may be to wait until we determine if a damage claim is valid or not, it can be a protracted process.Customer Answer

I have a parking permit visible inside my vehicle on the Dashboard, so I have rights to park at the apartment I live at. I got a notice this morning and I called this morning immediately when I saw my notice. The woman was very nice and helpful. You can clearly see my parking pass. Without the vehicle information, we are unable to look further into this. It is likely that the parking permit was not visible at the time of the warning, or it was not valid for that property. As long as the permit is clearly visible and valid for that specific property at the time of patrol, the vehicle will not be towed for that violation. Even though the license plate number is registered with the property, we do not have access to that information which is why the permit is necessary. 03/29/2023 My vehicle was illegally towed from the apartment complex where I live.It was towed for being parked in a fire lane. The sign that "states no parking fire lane" is completely weather worn from the sun and Is now a white sign. The sign is also covered by a pine tree branch. The curb is Not painted Red. I have a permit from the Park M vendor pictured which by the way is Not the current parking company that the apartments use and therefore wondering why the sign is still in use.Business Response

The fire lane is marked and as it is a safety violation, it was towed immediately. ParkM is a separate entity and only a **************, so it is not related to this tow. Towing companies are not responsible for any maintenance of the property, including signage, curbs, or trimming of trees. It is unreasonable to think anyone should have to stand on an 8 foot ladder to read the sign, also the permit parking sign attached to the sign post clearly is the only readable sign. I believe a court of law would agree with me as well.

My car shouldn’t have been towed the parking spot I parked in was not handy cap. When they redid the parking lot they didn’t move over the sign. I showed them picture and they could not validate them.

Elite towing practices preditorial towing. They are located 30 minutes from the location I was towed which was a public works building and I was only in the appointment for 45 min. They towed my car with my car seat leaving me stranded with a 6 month old baby! They refused to assist in anyway despite poor labelling and them trolling that specific lot.Business Response

I want to bring to light a towing company that is misusing and abusing their power by unlawfully towing vehicles that are properly registered from their premise.There is a serious auto theft issue in ******** and companies like Elite Towing are a part of the reason people lose their jobs becausethey can't get to work.My son's vehicle was towed a few days ago from *************** apartments. His vehicle was properly licensed and parked. It had been stationary for a few weeks since he back to college. However, Elite Towing towed the vehicle without notifying the property and lied and said they did. They are not responding to the leasing manageras she has inquired as to why they towed the vehicle.Elite Towing has over 300 properties they are connected to ******** which results into at least *****K vehicles that they have access to. There needs to be more legislation around parking, zoning, and giving tax payers a fair chance to survive here in ********.I am requesting that whom everis reading this email, please forward to the appropriate channels. I plan to send this to city council as well as we need to have better policies in place that do not enrich towing companies but rather keep people working hard.Many people use their vehicles for UBER, Lyft, etc...What happens if your car is towed just because the tow guy thinks it looks abandoned? We have specific rules that we are asked to enforce by properties that we service. One of those is making sure that vehicles are not left abandoned or inoperable. We enforce the rules as the property requests. This particular vehicle was give n a warning to move/remove the vehicle within a certain amount of time to avoid being impounded. When vehicles are towed, an email notification is sent out to the email that wee are given. In this case, it does not go to the leasing team, but higher management. The office team members were in direct contact with us, and this can be confirmed through recorded phone records. Additionally, it was admitted that this vehicle did not run and had to be consensually towed out of the impound lot after release.Initial Complaint

My car was illegally taken from a parking spot at ********* apartment complexes located at **** ************ ****** **. Elite towing registered the car as abandoned but did not inform my apartment complex of whether it was abandoned or if someone owned it. They flagged it 9/11/2022 and it was picked up 9/15/2022. The car is registered to show that it is able to be parked on private property through my apartment complex. I received no warning from my apartment complex about the tow. But Elite Towing put a notice on my window to verify they are watching it. However I was on vacation at that time so how am I supposed to get the notification and or see it on the window of the car???Business Response

The property provides us with rules to enforce, one of those being abandoned. We do not have access to property records as the leasing office cannot provide us with resident's personal information. We are asked to patrol the property and tag vehicles as abandoned that are not moving regularly. Elite Towing was enforcing the rules as the property has asked us to according to the agreement that property management completed.
