I have received your recent communication alleging that I owe a debt to Space Coast Credit Union (“SCCU”). Pursuant to my rights under the Fair Debt Collection Practices Act, 15 U.S.C. § 1692 et seq. IRS Form 1099-C (if filed) or sworn statement that no such form has been filed with the Internal Revenue Service.
Copy of any judgment (docket sheet and certified judgment), if one exists, together with proof of service.
Identity-theft screen-shot(s) or fraud investigation file if any fraud flag was ever applied to this account.
Sworn, notarized affidavit from a competent witness employed by SCCU who has personal, first-hand knowledge of the account’s creation, maintenance, and current balance, attesting under penalty of perjury that all documents provided are true, complete, and were generated in the ordinary course of business.
Strict Compliance & Cease-and-Desist
Cease all collection activity—telephone, text, email, mail, or third-party contact—until satisfactory validation is provided (§ 1692g(b)).
Cease reporting or re-reporting this alleged debt to any consumer-reporting agency (§ 1681s-2). Reporting unverified information constitutes willful non-compliance and exposes you to statutory and actual damages.
Any failure to supply each of the above items within 30 days of receipt of this letter will constitute your irrevocable waiver of all claims and your admission that no valid, enforceable debt exists.

To the Better Business Bureau:
I submit this urgent, formal complaint against Space Coast Credit Union (“SCCU”) for its reckless reporting and attempted collection of a fraudulent credit-card account (purported balance: $2,100) opened without my knowledge, authorization, or benefit. SCCU’s continuing misconduct violates federal and Florida law so egregiously that—if the account is not permanently removed and all adverse data expunged within fifteen (15) calendar days of receipt of this notice—I will file a multimillion-dollar civil action seeking the maximum statutory, actual, and punitive damages available.
I. Comprehensive Statutory Violations
FCRA & FACTA (15 U.S.C. §§ 1681–1681x)
Willful furnishing of unverified, inaccurate information (§1681s-2);
Failure to implement and follow Red-Flag Identity-Theft Program (16 C.F.R. § 681.2);
Deprivation of my right to dispute and block fraudulent data (§1681c-2).
FCBA & TILA (15 U.S.C. §§ 1666, 1601 et seq.; 12 C.F.R. § 1026)
Liability for unauthorized use exceeds the $50 cap (§1643) because SCCU never issued me a card, statement, or disclosure;
Non-production of required billing evidence within two billing cycles (§1666).
Gramm-Leach-Bliley Act & ECOA (15 U.S.C. §§ 6801, 1691)
Negligent safeguarding of “non-public personal information” (16 C.F.R. § 314);
Failure to obtain or retain any “application signature & bona fide identity verification” (Reg B, 12 C.F.R. § 1002).
Florida Statutes
Identity Theft—§ 817.568 (third-degree felony exposure);
FDUTPA—§ 501.204 (unfair, deceptive practice—treble-damage remedy).
FDCPA (15 U.S.C. § 1692 et seq.) (to the extent SCCU uses third-party collectors)
Collection of a debt that “is not legally enforceable” (§1692e(2)(A)).
II. Verification Burden—Strict Production Requirements
To satisfy the FCRA’s “reasonable investigation” and TILA/FCBA dispute provisions, SCCU must produce all of the following, each bearing an unaltered audit trail, notarized custodian affidavit, and a chain-of-custody attestation:

1 Wet-ink, signed credit-card application (front & back).
2 Government-issued photo ID, front & back, captured at application.
3 KYC supporting documents: proof of address, SSN card copy, employer info.
4 IP-address logs, geolocation data, MAC/device identifiers, & timestamped session metadata for account origination and first use.
5 In-branch surveillance video (with unbroken timestamp) if opened in person.
6 Voice recordings of any phone activation, with expert-verified voiceprint match.
7 Itemized billing statements, merchant authorization logs, and EMV chip transaction metadata.
8 Internal Red-Flag rule alerts & override justifications.
9 Comprehensive fraud-investigation file notes (all versions).
10 Board-approved identity-theft-prevention policy in effect at the time of account opening.
Failure to deliver every item above, in admissible form, renders SCCU legally incapable of “verifying” the debt under 15 U.S.C. § 1692g(b) and 15 U.S.C. § 1681i(a)(5)(A).
III. Demands & Litigation Notice
Immediate and unconditional deletion of the fraudulent account from all consumer-reporting agencies, internal systems, and downstream data furnishers.
Written statement—under penalty of perjury—confirming I owe $0, have no past, present, or future liability, and that negative reporting will never reappear.
Delivery (via certified mail & secure portal) of the entire documentary set listed in Section II, or a sworn declaration that it does not exist.
If SCCU fails to fully comply within 15 days (by July 15, 2025), I will commence a civil action in the United States District Court for the Southern District of Florida seeking not less than $2,500,000 in compensatory and punitive damages, plus attorneys’ fees, costs, and any additional relief deemed just and proper. Grounds will include willful FCRA violations (statutory damages up to $1,000 per violation; punitive damages uncapped), negligent identity-theft facilitation, negligent data-security practices, and violations of Florida’s FDUTPA and §817.568.
This letter constitutes final pre-litigation notice. All further communications must be in writing only to the postal and e-mail addresses above. Any telephone contact will be logged as additional FDCPA violations.
Requested BBB Action
Open an immediate case file under BBB rules, require SCCU’s written response, and post the outcome to SCCU’s public BBB profile.
Forward this complaint to the Consumer Financial Protection Bureau (CFPB), Federal Trade Commission (FTC), and the Florida Office of Financial Regulation for concurrent enforcement.

There were 3 unauthorized charges taken from my checking account from a company called ********. As soon as I noticed them I contacted customer service, I also noticed my phone number on my account was incorrect. The girl took the info and said they would look into to it. I have NEVER heard of the company, never used them, and dont know anyone out of the country and definitely not the people the money went to. Ive gone to my local branch and they have been NO help to resolve this issue. I was told by a worker I have used this company in the past but they would give me no proof, Sendwave was no help either. According to the electronic fund transfer act, the most I can be liable for is $50.00, Im out a lot more than that. It is deeply troubling that Space Coast Credit Union has failed to take the necessary steps to secure my personal data and verify the accuracy of this account before reporting it, despite the severe impact it is having on my financial stability and peace of mind. This reckless disregard for my rights as a consumer is a clear violation of the Fair Credit Reporting Act (FCRA), specifically 15 USC 1681i, which requires that all data furnished to credit reporting agencies must be accurate and promptly corrected when errors are identified. Furthermore, under 15 USC 1681n, Space Coast Credit Union is exposed to substantial legal liability for willfully failing to comply with these obligations, including actual damages, punitive damages, and attorney's fees. The continued presence of this false balance on my credit reports is not just a minor oversight but a severe breach of my rights, resulting in unnecessary financial hardship and emotional distress. As previously indicated, we did communicate with the consumer on April 22, 2025 via letter, and weve made an ******* attempt to resolve the situation. At this time there is no new information that SCCU is at liberty to disclose, due to confidentiality. SCCU would appreciate BBBs assistance with closing this case.

I am writing to lodge a formal complaint against Space Coast Credit Union for their reckless and unlawful actions in handling an identity theft case involving a fraudulent credit card account opened under my name. I demand that the Better Business Bureau intervene and address these violations immediately.The account in question was opened using fraudulent information, and Space Coast Credit Union is in violation of the following laws:1.The Fair Credit Reporting Act (FCRA) (15 U.S.C. 1681 et seq.) This law ensures that individuals are not held liable for fraudulent accounts. By allowing the fraudulent account to remain open and reporting false information to credit agencies, Space Coast Credit Union has violated my rights under the ****, which includes ensuring accurate information is reported and promptly investigating disputes regarding fraud.2.The Fair Debt Collection Practices Act (*****) (15 U.S.C. 1692 et seq.) Space Coast Credit Unions failure to close this fraudulent account and the subsequent attempt to collect on it, despite being aware of the fraud, is in direct violation of this act. The ***** prohibits the collection of debt that is not owed by the *********** be very clear: the address listed on the application for this account was a *** PO Box, which is not a valid residential address and raises a significant red flag. Additionally, the phone number listed, ************, was confirmed as fraudulent through an investigation by the *** in collaboration with T-Mobile, who identified it as associated with a fraudulent T-Mobile account under my name.I demand that Space Coast Credit Union immediately close this fraudulent account, remove any and all negative reports related to it from my credit history, and cease any further attempts to collect on it. Furthermore, I insist that they provide written confirmation that they have corrected the situation.Business Response
