When I think “Westgate”, I no longer think of the fun and exciting vacations I was promised. Now I think of all the frustration I felt when I initially found out that everything the salesman sold me on was a load of BS. I think about the disappointment my family and I feel every time we try to book a vacation and can’t because there is never anything open. I think about the irritation of being defrauded and still expected to pay tens of thousands of dollars for nothing. I have one week that can only be used during specific times AND only during odd numbered years. This makes it terribly difficult to vacation. Funny how in the multiple hours of being harassed, no one mentioned that I would also have to pay fees to separate my week on top of the ridiculous amount of the monthly payments. The irony now is that I am working more to pay for a useless timeshare and not spending as much time with my family. What a joke.Central Florida Investments, Inc.

order to receive the promised gifts, you were only required to attend the
presentation for 90 minutes and had no obligation to remain past that time or
to purchase. We ask for you to understand that it would have been at your
discretion to inform the sales staff or closing officer of any discomfort to
ensure proper action was taken and refrain from purchasing if your concerns
were not addressed to your satisfaction. While Westgate is a sales-driven
company, at no point were you forced to stay or to purchase a timeshare
Regarding your concerns about
availability, please allow us to briefly explain your
ownership and some benefits you have as owners. On July 9, 2019, you purchased
an all-season week in a 2-bedroom villa for use during the odd-numbered years with the first occupancy in 2021 at
the Westgate Vacation Villas Resort. Keep in mind that you
purchased under the floating use plan for reservations, wherein you do
not own the use of a specific unit, but a certain unit type, based on
availability. Therefore, you have the right to occupy your villa at your home
resort during your current year and season of ownership without being charged
additional fees. To improve the likelihood of securing desired travel dates,
Westgate allows owners to book reservations up to eleven (11) months in advance
of their travel dates. Any reservations outside of your contracted usage rights
are considered owner benefits (e.g., exchanges, split weeks, etc.),
which are also based on availability and subject to the Westgate Resorts
Internal Exchange terms and conditions, as indicated on your Acknowledgment
of Representations document. Additionally, please be advised
that the terms for splitting your contracted week are disclosed within the Public
Offering Statement.
Our
research has concluded that you were given full and fair disclosure of the
purchase terms and conditions. As consumers, it was your responsibility to
review the terms of the purchase to ensure they fit within your financial means
and travel needs. For Westgate’s and your protection, the written documents
signed and initialed by the parties are considered the expressions of our
mutual understanding of the purchase transaction. Please know that Westgate too
is bound to comply with the terms of the written documents, which constitute the
only verifiable evidence to establish the terms of your ownership. Please also
be advised that you remain responsible for the financial and contractual
obligations associated with the timeshare regardless of whether it is utilized.
With that being said, it is Westgate’s position that your contract is valid,
enforceable, and it will not be cancelled.

Reading some of Westgate replies and this seems to be there answer below. But do they take responsibility for there Sales Reps who lie to us. Unfortunately not everyone reads all the disclosures they are signing when putting their trust in Westgate. basically you are forced to pay maintenance yearly whether you can afford it or not. Then your credit will be ruined if you don't pay. Total scam. So regret buying this timeshare feel trapped. I would definitely part of the class action suit or hopefully news coverage on Westgate scam. Can't even give it away not even Westgate wants it back without getting paid. Customer rating 1 star insane.
YOur position stands that, contrary to your opinion, full and fair disclosure of your purchase terms was provided on each day of sale, and your current contract is and will remain valid and enforceable for as long as you own. appreciative of your long-term ownership and are disheartened to learn that you
have recently become dissatisfied with a purchase you once believed in. We ask
you to remember that it was your right to end the presentation and refrain from
purchasing a timeshare. At no point was Westgate’s permission needed to leave.
Additionally, Westgate cannot control whether you chose to exercise your consumer
rights and ultimately, the choice to make the purchase was yours.
Please understand that
Westgate does hold its employees responsible for the things they say. If you
are able to provide supporting documents for your claims, we will review them and
respond accordingly. However, in the absence of such
documents, no form of verbal communication can or will supersede the contract
agreement made between you and Westgate. As you have also stated that you did
not read the disclosures at the time of purchase, please be advised that it
would have been your responsibility to read what you were agreeing to and
signing. Please also be advised that any failure to read these disclosures
during the signing process or within the rescission period that you were provided
does not invalidate the contract.
We also understand your
concern regarding the affordability of the maintenance assessments; however,
keep in mind that your signatures and initials on the executed contract
documents confirm that you agreed you had the financial capacity to enter into
the transaction. You were also provided the information needed to make an
informed financial decision at the time of purchase, along with the costs
associated with travel. Please understand that as the consumers, it was your
responsibility to review the financial obligations associated with the purchase
to ensure that the purchase fit within your financial means.
Regarding your concern about
credit reporting, please be advised that it is your responsibility to maintain the
financial and contractual obligations that you agreed to at the time of
purchase. Should the obligations associated with your ownership not be
fulfilled, please understand that Westgate is well within its rights to report
data regarding this matter to the credit bureaus accordingly.
Please
also understand that your timeshare property is deeded real estate that you can
sell, transfer, or will to whomever you choose. As you may know, Westgate does
not assist with these processes. While you claim that you have been
unsuccessful in doing so, please understand that this does not negate the fact
that selling the property at your own discretion is always an option. As
for your concern regarding the Legacy Program, please understand that
Westgate chooses to offer this voluntary program, and as such, it is at
Westgate’s discretion whether fees will be assessed.
With regard to your concern
about the rating, please understand that duplicate complaints initiated by
unscrupulous timeshare exit companies that prey on owners with false promises
have become common. Please also understand that the frequency of these
repetitive complaints does not lend them any credibility or merit; however,
they do suggest manufactured form letter allegations by the numerous exit
companies currently flooding the market.
Please know that you are well
within your rights to escalate your complaints to any outside forum as you see
fit. Westgate will continue to address your concerns in a similar manner regardless
of the escalation path you choose. In the absence of documentation that would
negate your signatures from the executed contract documents, your contract will
remain valid, enforceable, and will not be cancelled.

I cant believe you can actually say those words full and fair disclosure of your purchase terms was provided on each day of sale. When so many complaints say the same thing promised to help rent and sell timeshare. So with that added security more like sales tactic why not invest in this timeshare. We bough 20 years ago and still majority of complaints say the same thing. Funny how Westgate claims they do not buy back but if you do find a buyer Westgate has to approve the sale and can deny it and at that point Westgate will decide if they will buy it back from you. Either Westgate Resorts is going out of business, or they are an unbelievably foolish company!!
They refuse to take back my ownership of 19 years; a paid-in-full contract and a maintenance fee that is currently $1200 annually. First, they say they are going to give me a deed back and when I asked for it in writing, they sent me an affidavit and then subsequently sent me a collections notice saying they are sending my file to their attorney’s to start the foreclosure proceedings. The only reason I can see for their denial is this: They must be in dire straits for the $1200. A business that has received tens of thousands of dollars from us cannot find it in their hearts to relieve me of this financial burden at my age.
Now they are threatening me with foreclosure because I am behind in paying the maintenance fees, after paying a mortgage for close to 20 years. Westgate nauseates me!Central Florida Investments, Inc.

I signed a contract in December 2022 for odd years and was given a letter with a free 4-day/3 night stay at the Westgate Lakes resort after three months of having the ownership. I was just about to book the free stay when another agent called me to see if I wanted to update my contract to a yearly contract. What they did not tell me was that if I accepted the contract over the phone, the free stay would be null and void. I just tried today to book the free stay and the woman who I talked to was adamant that I was lied to and then hung up on me when I tried to ask her more questions about the stay.
I then tried to contact the new contract team and the representative I talked to, but no one would answer. I was on hold for 25 minutes and they hung up on me after I waited all that time.
I kept trying and left messages, and no one has contacted me back as of yet. I am going to cancel this new contract and try to sell the old contract. The customer service with this company is horrible and they lie at every turn. One person says, "Yes, you can still use this free stay," and another says, "No since you signed a new contract, that stay is null and void." I just want the truth and for a business to tell it to me straight. I run my own business and if I did any of the things Westgate is doing, I would not have any customers left.
I will never EVER purchase another timeshare from this company as long as I live.Central Florida Investments, Inc.

I am posting this complaint on behalf of my parents, in hopes of making sure anyone who reads this will be aware of this horrible business. WESTGATE is a scam and a bully of a company. They sold my 83-year-old father a timeshare that they knew he was incapable of using telling him he could lease it or sell it as a good investment. Both of which are lies. My dad is hearing impaired and my mom has advanced Parkinsons. When I call Westgate to discuss with them the issues about retaining ownership, they keep giving us the runaround, Do. Not. Purchase! West gate resorts is a timeshare SCAM!!!They target young and or inexperienced buyers and predate on them with predatory sales tactic. They have ruined my credit for a time share I did not want. They sold me dreams of employment as well in some sort of Ponzi pyramid scheme. They were willing to tell me anything for me to sign fully taking advantage of my ignorance at the time. For almost 3 months i tried to cancel my account and was led on run arounds and dead end lines with voicemails they never returned. I was even Given the sales associates direct number incase i had any issues, a number that was never answered despite calling them dozens of times in the weeks following the purchase. Now they are foreclosing the property that I didn't even want. Westgate resorts will ruin your life!!!!They pressure you into contracts with no way out!!!No wonder They only have 1 star on the "BBB"Central Florida Investments, Inc.

We have owned a timeshare with Westgate since 2008. When we traveled to a Westgate Resort in August of 2022, we were required to attend an owners update, which we embraced because it was time for us to use their buy-back program because we were ready to sell. They told us that we couldn’t sell because we only had half of the deed and needed the other half to be able to sell. This required an upgrade, which we did not want to do, but eventually did, based on all the misrepresented facts that we later discovered.
The reason we wanted to sell in the first place is because Westgate hides all their fees from you. We have the referral program fees, a deposit fee when checking in, Cruise and Travel fees, and Interval exchange. The fees range between $50-$99 and certainly adds up over time. This does not include the maintenance fees and monthly mortgage payments. The last time we went on vacation, we used our deeded week plus our Bonus week and we still had to pay $599 out of pocket. Why did we sign a contract, pay the mortgage and maintenance fees if we still have to pay so much when we use it. This is not how it was sold to us, and it certainly is NOT a cheaper way to travel, that’s for sure!
We have paid them way too much and they are getting greedier by the day. We are in our 70’s and cannot take much more of this.Central Florida Investments, Inc.

First
and foremost, we are saddened to read that you no longer wish to be owners with
Westgate Resorts and that you have not been able to use your timeshare ownership
as it was intended. We also regret any inconvenience you may have experienced
with regard to our Owners’ Update Meetings. although encouraged, you are never under any obligation to
attend or accept an invitation. However, any gifts offered may be contingent on
your attendance. Please be advised that the Owner’s Update Meetings are merely
a tool Westgate utilizes to advise owners of new developments and opportunities
that they can possibly take advantage of. But
again, there is no obligation to attend or to purchase.
While
Westgate may acquire properties from owners from time to time through upgrade
sales, foreclosures, and the exercise of its Right of First Refusal (ROFR),
it does not have a buyback program. The ROFR allows the Developer to
match offers to purchase a property from an owner under the same terms being
offered by a third-party purchaser; however, this option does not constitute a
buyback program.
Additionally,
your claim of being told that you could not sell because you only had half the
deed and needed the other half to be able to sell is a verbal allegation that cannot
be substantiated. As an owner of a timeshare real estate interest, you are able
to use, rent, will, or sell your property; however, this activity would occur
at your discretion. there are certain criteria that have to be met in order to
complete the process. First, the account has to be in good standing to even
start the process. Westgate has up to twenty-four (24) months to record the
Deed for your contracted inventory; however, should you find a buyer prior to
the completion of the recording of the Deed, your buyer may be able to do a
loan assumption. When you do find a potential buyer, please reach out to our Name
Change Department at 1-800-249-0545 to further assist you in
the process.
With
regard to your claim about hidden fees, please be advised that all fees
associated with the account are outlined between the executed documents which
include the Contract for Purchase and Sale, Closing Disclosure, Public
Offering Statement, and Acknowledgment of Representations (AOR).
Any fees for use of owner benefits that are not contractual in nature
are specific to Westgate Resorts Internal Exchange program as referenced
in the executed AOR. Furthermore, please be advised that if you use your
week within your year and season of ownership, at your home resort there will
be no additional fees. In reference to having to pay $599 out of pocket for
your stay, we ask you to understand that you travelled using your bonus week
and not your contracted occupancy. As such, please refer to the Bonus Week
Disclosure in Account # 60499166035 which clearly states that the cost to
use the bonus week in a 2-bedroom was $599.
With
respect to your claim that the timeshare is not a cheaper way to travel, please
be advised that you were provided the costs associated with travel at the time
of purchase. It was your responsibility to evaluate the costs and savings to
ensure that the timeshare fit within your financial needs. We can also confirm
that there are various owner benefits that offer discounted travel
opportunities, based on availability.

We are fed up and it shows that we are not the only ones ripped off by them! How can these thieves continue with their lies? All we wanted was to take our kids to Disney and we ended up with a rubbish timeshare that cost thousands of dollars! They are telling people in their presentation that timeshares are a real estate investment. That it was an increase in value and that a benefit could be generated. This is not the case; this is a waste of time and money. When we went to that presentation, we were never told that there would even be maintenance fees. They not only lied but also mishandled the financial statements at the time we signed the documents. They never provided us with our copy of the legal documents. Your sales team are well orchestrated scammers. They were despicable enough to lie about the people who make a business out of timeshare rentals. They took out financing for this crap at an extremely high interest rate. We were never told the actual cost when fees and interest are taken into account. Don't believe them when they say that having a timeshare with them will allow you to take more vacations. Don't believe anything they promise. If you find yourself in a situation where Westgate is involved, FLEE! We need to come together and bring these criminals to court. They are hurting families with these useless timeshares. Westgate is a nightmare. Do a little more digging and you'll find that Westgate has been sued multiple times over many years. What a dirty company! Shame on Westgate!
