      In 1984 I was heavily pressured into purchasing a vacation unit from a newly formed Vacation Resort named Westgate RESORTS in Kissimmee FL. Never was it explained to me that it was a forced "life long" purchase. I used it for 20 years then my life situation changed. I wrote, called and bargained with several other rip-offs trying to have that death sentence of a contract terminated. All to no avail. I can no longer travel or afford to give my money to a company that serves me no purpose. They once told me that they had a forgiveness plan that would allow a person to have their contract released. But after I applied for it I was denied without an explanation. I can not understand why companies like this is allowed to ruin a senior's life and not get help from the Government or Consumer's Assistance Programs. I owe them no money as my unit was paid off in 1987. Every year the Maintenance Fees increased and now I cannot afford to pay for something that I nor my family members can use. No one will help unless you spend thousands of dollars more to again be let down. I just had that experience with Wesley Financial Group. They too ripped me off. I complained about them and no response. I need some successful help in getting this contract with Westgate Resorts terminated and I am hoping the BBB can find a way. I CANNOT USE or afford to waste my fixed income money on a company that is holding my credit hostage for the owner David S. to load his bank account at my expense. I believe they denied me because of my race and age. They won't even discuss a way for me to be released and that is not fair or legal in my opinion. It's like being in jail with no parole benefits available. I met my end of the contract when I paid it off. Now they want fees for a unit I cannot use and hasn't used in 5 years. I am asking for some help to have this contract released or terminated. I see that CFI is not BBB accredited, that should be grounds for the state of Fl to investigate.

      First, we were disheartened to read of the hardships you may be experiencing. You are a valued member of the Westgate community, and we always hope to assist our owners to the best of our abilities. We were additionally disheartened to read that you may have been taken advantage of by an untrustworthy third-party company. We encourage all resale efforts to go through a reputable performance-based company; one that will charge their fee only after the property is sold. Many companies charge large up-front advertising fees and there is no guarantee of a sale.

      Be advised that we are resending our previous response dated April 15, 2019, as we have addressed your discrimination claims prior. We ask you to understand that your claims from the day of sale are time-barred, as you purchased in 1985; however, as a courtesy, we will address a few. First, we are sorry if you felt uncomfortable or pressured in any way while attending our sales presentation. We ask you to understand that, although Westgate is a sales-driven company, at no point were you forced to stay or purchase a timeshare. You could have ended the presentation after your timed obligation was up and left with your agreed-upon incentive accordingly.

      In regard to your claim that Westgate had a forgiveness plan, this is a verbal allegation we cannot validate. As outlined within your Acknowledgment of Representations document, we do not have any rental or resale programs, nor are we affiliated with any resale companies. We are sorry for any misunderstanding there may have been regarding this.

      We understand the concerns you may have regarding your maintenance dues and taxes (M&T). It is important to understand that the M&T represents the only source of revenue available to pay the cost of maintaining your resort. The Owners' Association is responsible for calculating the resort's annual budget and dividing it equitably among all the owners so that each one pays a fair share of the costs needed to preserve the integrity of the resort's services while keeping the costs as low as possible. If the cost of goods and services to maintain your resort increases, this increase to the Budget is divided amongst all the Resort Owners so that each pays his fair share of the increase. It is also important to know that all of the M&T paid goes directly to the Owners' Association and that the Developer pays his share of the M&T on all unsold timeshare Weeks at your resort, so he has a vested interest in keeping costs as low as possible.

      Lastly, we advised that your claim of Westgate damaging your credit is unsubstantiated, as M&T payments are not reported to the credit bureaus. In addition, we ask you to understand that there is no requirement for a business to be accredited by the Better Business Bureau.

      Ms. ****, Westgate's position stands that your contract is valid and enforceable, and you remain financially and contractually responsible for the purchase regardless of use. We ask you to understand that deeds are perpetual, and you remain responsible for the purchase unless there is a change in title. We thank you for the opportunity to be of service.       The Westgate Resort and Spa (located on Turkey Lake Drive in Orlando, Florida) sales staff sold us a bunch of lies. They saw 2 senior citizens enjoying their retirement and thought we would be an easy mark. After trying to make this vacation ownership work for us, we now understand the lies and exclusion of important information is appalling! We have written to the Westgate executives, but they have only ignored our correspondence. We are well into our 60's and know that this is a case of ELDER ABUSE!

      We have been trying to cancel our timeshare with WestGate for a slew of reasons, but they refuse to let us! Wherever we have tried to use it the staff can't help us and they just transfer us from person to person and department to department. We've expressed this to WestGate and yet they STILL refused to help us! They are nothing but a headache and we want to be rid of them. They bullied and pressured us into buying the timeshare after giving us a sob story about her childhood, which I feel might not even be true considering nothing else these people told us was true either. They promised us tickets to Disney park, but of course, those never came, even after we stayed at this "90 minute presentation" for over 3 HOURS!! They started bribing us with snacks and disney paraphernalia for our son who was only 3 at the time. They also made it seem like a once in a lifetime deal and that they never sell for such a low price. We bought it and when we tried to use it the whole booking process was so convoluted that we were completely unable to use it. I really hope you can help us out, because this business truly needs to do better. We made a purchase of something they claimed to have and yet they can't make good on it. We need your help.

      We are additionally sorry for any inconvenience you may have experienced due to the length of the presentation you attended and if you felt uncomfortable or pressured in any way. Since there may have been offers presented on a first-come, first-served basis, depending on the available inventory, the representative may have expressed some urgency regarding the offer. However, you were never obligated to remain past the agreed-upon time to receive your incentive, nor were you obligated to purchase a timeshare. As for your concerns regarding your incentive, a review of your tour confirmed that you received discounted tickets in exchange for touring.

      Regarding your claim of being unable to cancel, please be advised that, once your state-mandated rescission period has ended, we are unable to offer release at an owner's request

      I have nothing good to say about Westgate. They are a terrible company that has no qualms about being shady to land a sale. I'm pretty sure some of what they said is even illegal- like telling me I was buying real estate when there is not a property that I own. Sales staff relied on intimidation when their lies weren't working and refused to take no for an answer. At one point, we were dealing with FIVE different salespeople. It's obvious that this was not a case of a salesperson being misinformed. When 5 different people are all telling the same lies, it is not a coincidence, it's how they do business. This is even more evident when they did not allow time for me to review the contract so they could continue to deceive me!

      Beware of Westgate and their deceptive salespeople. Since 2008, we have seen a repeated pattern of misrepresentation and manipulation. We have tried to get out of our timeshares because of the rising costs and terrible yearly expense. They will not consider our needs or desires. We have had enough! There were promises of owning a deeded property and being able to pass it down through the generations, but there is no property. We want out of the timeshare to avoid handing our children a lifetime of debt that conveniently was never mentioned. All the claims about where we could go on luxury vacations were complete misrepresentations... for us, false claims. There are always difficulties with availability. When we can get a vacation, it's not the unit we paid for. Why are we forced to pay nearly $5,000 a year in maintenance fees that are elevated annually only to be disappointed constantly? We advise no one purchase a timeshare with Westgate. We want out of our timeshare. They will not consider it.

First, be advised that your claim of there being no deeded property is unsubstantiated, as we can confirm you purchased deeded real estate. As a part of the Floating Use Plan, you are not entitled to a specific unit, but rather a specific unit type, based on availability. Our records show that when you were booking your contracted week, you were advised that your contracted room type was not available and accepted an alternate room type. We have forwarded additional information about your ownership to the email address we have on file.

      We understand the concerns you may have regarding your maintenance dues and taxes (M&T). Please be advised that multiple documents, specifically the Contract for Purchase and Sale and the Acknowledgment of Representations, indicate that M&T is estimated. You received copies of these documents on the day of the sale. It is important to understand that M&T represents the only source of revenue available to pay the cost of maintaining your resort. The Owners' Association is responsible for calculating the resort's annual budget and dividing it equitably among all the owners so that each one pays a fair share of the costs needed to preserve the integrity of the resort's services while keeping the costs as low as possible.       Westgate Resorts is a joke and a rip off! "Leave a legacy" for your family, they said along with a lot of other misguiding sales techniques convincing me what a great investment it was. NOT!!! My kids are NOT interested in this "legacy"! I have paid them over $27,000 in 7 years! NEVER once did I use it! In the last 13 months, much has changed. I lost a third of my income September of 2021 and I started Chemo treatments November of 2021. I sent a letter to Westgate explaining in detail my circumstances and requesting to be released from the contract as I have NEVER USED the property and NEVER WILL!!! You would think they could at least respond! NO RESPONSE! I was financially no longer able to make payments and had to stop them. Now, they are ATTACKING my credit after 7 full years of not one missed payment until April! STILL NO RESPONSE to my letter even trying to come to an agreement on settlement. ISN'T $27,000 enough free money for them!!!

      In regard to your investment concerns, allow us to direct you to your Public Offering Statement, which you received on the day of sale and states that "the purchase of a time share period should be based upon its value as a vacation experience or for spending leisure time, and not considered for purposes of acquiring an appreciating investment or with an expectation that the time share period may be resold."

      As for your concerns about the credit bureau reporting, be advised that, as Westgate extended a loan that was both agreed upon and acknowledged by your execution of the documents on the day of sale, we are well within our rights to collect on said loan. As part of our collection rights, we are entitled to report data about the loan if we so choose. It is up to you to ensure that you are maintaining the financial obligations contracted with Westgate as agreed.

      Lastly, we understand the concerns you may have regarding the willing of your timeshare. As each owner's situation is unique, we encourage you to consult with a professional legal advisor regarding what will happen to the property in the event of an owner's passing.

      We were bullied and lied to by Westgate into purchasing a timeshare from them. Yes, bullied and lied. They had told us it would be an investment and that the resort is exclusive to members only. They also told us that reservations can be had at my discretion and availability was boundless. All of this was false. This has caused nothing but pain for my pockets. I have been making monthly payments of $313.87 and $545.00 every other year. I have paid in excess of $12,000 and only used my timeshare ONCE. They earned our business through deceptive sales practices, predatory lending, and material omissions. If you are ever approached by someone for Westgate, don't believe a thing they say.

      Westgate only cares about money and not the wellness of their customers. They have been ignoring me and not remotely empathetic of my concerns about their company. They seem to have lots to hide as well. If they had nothing to hide, why did they rush us through the signing of our contract? Why did they conveniently fail to disclose the important facts of owning a timeshare? If this company has nothing to hide, they will not mind responding to me, in writing of course because I can no longer trust anything they say. They have betrayed my trust and cheated me and my late husband out of $20,000 plus interest, as well as a never-ending black hole of fees. We got involved with Westgate in December 2014 when looking for Disney tickets. We had to pay $40.00 for a presentation with a promise of free breakfast, 4 Disney tickets and other gift cards and that our money will be refunded. We got there the next day, and were introduced to a saleswoman, who gave us a tour of the property. They wanted us to get into purchasing an "apartment" plus all the other travel amenities they included. They told us we could rent our apartment to other people if we did not use it, we could sell additional weeks that were part of the package and make enough profit that the timeshare would pay for itself. When we came back to Westgate in 2017, after paying for one week in a one bedroom apartment, we had to pay $120 extra because we came back on a "premium week". We originally paid $785.00 for that week, plus the $120. After doing the presentation and with the promise of changing us to a two bedroom apartment, we got into a first contract with them for $7,637.94 in 2017, we could use our week in April of 2019. When we came back in 2019 they got us into another contract for $8,488.80 saying we were acquiring the other half of our apartment. What hurt the most is in both contracts we purchased life insurance. When my husband passed away and I made the claim they said he was not included.

      As it is not possible to validate verbal statements, the Developer requires all owners to complete the Acknowledgment of Representations document. With this document, the Developer strives to eliminate the possibility of any misunderstandings with regard to what may have been presented to you, which may have influenced your decision to purchase. Acknowledgments #3 and #5 show that you purchased this property for personal use, that there were no representations made regarding investment or resale potential, and that the Developer does not have a rental or resale program to assist you. You received a copy of this document on the day of sale.

      With regard to your concerns about your husband not being covered by your mortgage insurance, please refer to your Waiver for Loss of Life, which you received on the day of sale and shows that you purchased single mortgage protection, which only covered you. In addition, the closing officer advised you of this fact during

      Hunkered down here for Hurricane Ian. On the 6th floor with 2 elderly disabled family members when the elevator stopped working. Have complained via phone and in person and was told they did their due diligence by contacting their 3rd party elevator company who is waiting for clearance to come fix it.
