I took out a title loan on 5/22/23. I am on a fixed income and get paid monthly on the 3rd. I asked when I took the loan if there were any penalties for early payments or payoff before the six month term, I was assured there was none. I made my July payment on 7/3/23, my payday and continued to get emails saying my July payment is due. I contacted the store to confirm if my online payment on the 3rd was received and they assured me it was and has been credited to my account. They then informed me I have to make Another payment by the 22nd because they have a rule that you can't make a payment earlier than 14 days before the loan due date so I have to make two payments for July.. they even confirmed knowing I get paid once a month on the 3rd. I explained to them that I questioned this very situation prior to taking the loan given I only get paid on the 3rd and like to pay my monthly bill's then so I know how much money I have left for food and miscellaneous expenses. They said if they allow me to wait until the 3rd of August then I will have to make two payments in that month instead of this month. It is a deceptive way for them to tack on extra charges and very upsetting given I specifically asked before signing for the loan.

An investigation into ************************ complaint proved that the company committed no wrongdoing.  On May 22, 2023, ************************ borrowed $505.00.  She agreed to submit 12 monthly payments of $137.12, beginning on June 22, 2023.  The terms, conditions and cost of the loan were fully explained to ************************ by the companys personnel and on the loan documents as required by the Federal Truth in Lending Act.  At no time did ************************ indicate that she was confused about the terms of her loan. Further, based on the monthly income and expense information that ************************ entered on her application, the loans scheduled monthly payment was within her ability to repay.

A review of Ms. *********** account reveals that to date she has submitted two payments (June 30, 3023:$160.00 and July 3, 2023: $137.12).  The payments were properly allocated to outstanding interest and the principal amount borrowed.  As explained to ************************,if she submits a payment early it will benefit her, as a larger portion of the payment will be allocated to lower the principal balance outstanding.  However, as stated in Ms. *********** contract if she submits a payment 15 or more days before a scheduled due date, such payment will be applied to outstanding interest and principal, but it will not relieve her of her obligation to make her regularly scheduled payment on or before its due date.

In closing, the company operates in strict compliance with state and federal laws and has committed no wrongdoing.  However, should Ms. ***************;need further assistance, she can contact *******, the companys Assistant General Counsel at ************.

Thank you again for your assistance in this matter, as well as the opportunity to respond. Please do not hesitate to contact me with any questions or concerns.

I am rejecting this response because: As I previously stated, I questioned and was assured of no additional fees. Perhaps the employee was new and assuming rather than confirming with a manager or more knowledgeable employee being all alone at the business? I have not had problems with this business in the past which is why I was a repeat customer but stunned by the deception to my question. I understand this may be a local mistake and not representative of the company as a whole.

      Sincerely,

      ***************************************

      Business Response

      Date: 08/01/2023

Despite **************************** belief, she incurred no additional fees by submitting her payment early.  She is free to submit a payment early, and again as previously explained, it will only benefit her as a larger portion of the payment will be allocated to lower the principal balance.  Again, it is clearly explained in her contact that if ************************ submits a payment 15 or more days before a scheduled due date, she still has an obligation to make her regularly scheduled payment on or before its due date.

I was selling a ring it was appraised at 50k. I put the ring on my finger. after i got home I tried to take it off, it was stuck and stayed stuck no matter what we tried. Well my finger swelled up like a big sausage and it was turning black. i was in major pain, my finger wasabout to pop. Well I had to go to the ** and they surgically removed it because any longer and my finger would nee to be amputated. Now i need to get ******* fixed . I went to LoanMax. I was approved for more than I wanted and he talked me into just taking it. i had dicussed with the loan rep me paying off the loan the next day with my mom's credit card, he said cool. i was led to believe my loan was at 30% interest. The next day, I went out and got the ring fixed i didn't spendn all the loan monet. I had contacted my mother and gave her a copy of the contract, she totally chewed me out because the loan was at 300% not 30% like I was led to believe. i got my mom's card, went on Loanmax.com and I filled in my moms card info in to the paymeent portal. I hit submit and it didn't submit. I tried 10 times, wouldn't submit. I went to the office and advised the guy I couldn't submit my mom's card payment. He said they don't take credit cards **** & m/c don't allow it. That's absolutely not true. They advertize it. Transfer balance and have zero interest fo a number of months. well i adv the guy he said i could. I advised i want to return the amount I didn't use because the contract has right to cancel can't only the whole thing doesn't say that. so i made my first payment with the remaing *** and they took over **** in interest on the 1st payment, only 600 to principal. They lied and cheated me out of paying it off the next day. I was offered a sif, but i have only raised 1/4 so far and lost my mom. I can pay the rest of the original loan amount today **** they wont be losing anything but they'll be making up for the breach of faith. nothing would have happened if i wasn't lied to

On June 8, 2022, ************ borrowed $3,106.00 from the company.  The terms, conditions and cost of the loan were fully explained to him by the companys personnel and fully disclosed on the loan documents in compliance with the Federal Truth in Lending Act.  Despite **************** contentions, it was also fully explained to him when you obtained the loan that the company does not accept credit cards.  The reason the company does not accept credit cards is that the company complies with the *************** rules which prohibit credit cards being used to repay other debt.  Based on the monthly income and expense information that ************ entered on his application, the loans scheduled payment was within his ability to repay. At no time did ************ indicate that he was confused or did not understand the terms of the loan.

A review of **************** account reveals he did not submit his payment as agreed. In fact, to date, he has only submitted one payment on July 26, 2022,in the amount of $1,850.00.  A review of the receipt proves that a proper portion of the payment was applied to the principal amount borrowed.  After ************ defaulted on his loan, the company made numerous attempts to work with him,but he was uncooperative, broke promises to pay, and had limited communication with the company.  Finally, after not having received a payment in several months, on May 17, 2023, the company repossessed its collateral.

In closing, the company operates in strict compliance with federal and state laws, and has committed no wrongdoing.  Nonetheless, in a good faith effort to assist ************, las month, the company  agreed to  postpone the sale of the vehicle and settle his account for the reduced amount of $4,000.00, due on or before July 27, 2023.  *******, the company's Assistant General Counsel spoke with ************ and explained to him that if ************ was interested in the companys offer that he must go to the LoanMax office on or before July 27, 2023,to submit the payment and sign a settlement agreement.   If ************ does not take advantage of the offer on or before July 27, 2023, the company will proceed with selling the vehicle in a commercially reasonable matter.

On May 18, 2022 I took out a loan with LoanMax with parent company Select ******************** for $4.500. We maid our 1st payment on June 9th for $570.23 via online app. On July 21st we made another payment for $1,221 via western union - the online app was down. The payment was never applied we had to call continuously and finally had the payment applied on August 31st (surprisingly to no one adding additional interest to the load because no payment was applied). Because of the lost payment the next payment was not made until Sept 1st for $1,854.42 and the an additional on on September 15th totally $3,888.62. According to the receipt attached dated September 15th even though we had made $3,888.62 in payments on a $4.500 loan the balance remaining was still $3,167.50. Astonished on how this could be we attempted to reach someone with no prevail. Until February my wife received an email with a settlement of $2400 she made one payment and no longer can reach Arodriquez from Select Mgt. Now I am receiving harassing calls from LoanMax stating if I dont make a payment they we repo our car. We have now paid $6,592.48. Account # ******************************************* Now they will not return any calls just text saying they will repose the car if we do not pay another payment. We have already paid well beyond and then some. If you will not answer you phone or take our calls and or respond to emails how to you think we can rectify. This company is fraud front to take what is not theirs. They are about to repose a car over $2,000 which is worth $30,000 and paid in full. They take your money and do not apply payment to raise the percentage rate so you can never possibly be out of debt with them. Again makes a settlement with me then harasses my husband but neither of us can get anyone to respond to us. They also stopped posting our receipts of payment and balance due on our online app. Once we got close to paying off the loan and the interest rate exploded.

First, this is the definition of predatory lending. There is a reason the ************************ has driven these companies out of our state. I originally received a loan of $1215 in 2020. Over time, I have paid over $2500 toward to totality of the loan, over double the original amount given to me. In an attempt to move on from this, I requested a 10 Day Payoff letter from LoanMax, in which they offered the payoff amount of $966.08. Due to the age of the loan, and them never coming to pick up the vehicle, and due to the fact that the vehicle was stolen and only recently recovered, which I have a police report to verify, I offered them $400 on 5/17/23 to settle the loan. I was met with horrific customer service and representatives who wanted nothing more than to talk down to me and note that they have credited my account and not charged interest as some sort of good will, while still demanding $800 to settle the loan. When I again dismissed this offer and told them that I believe they are "Loan Sharks" the gentleman on the phone, ***, decided to say "Deal is off that'll be $966 now". They aren't customer focused, they aren't acting in good faith, and even in my darkest days I should have known better than to let these people take advantage of me. I would like to pay off the loan for $400 so this nightmare can finally be over.

I paid off my loan almost 4 months ago, mailed in paperwork they told me I HAD TO SIGN in order to get MY TITLE back (which were authorization sheets for them to take payments from my credit card) which makes no sense because all of those transactions were already taken out of my account every month, so why do i need to sign them only when I am requesting my title back? Anyways, I signed the papers and mailed them back in and 4 months later I still do not have my title! I left several messages and never received a call back. I JUST WANT MY TITLE!!!! WHERE IS IT?

***** sold my truck for what I owed them on the title loan. but they also sold it for $2,377.50 over, and they sent me a letter with a claim number saying they owed me the money and I cannot get them to pay me. I can't remember the exact date but it's going on a couple years now and I get the same runaround when I call the numbers they gave me to check on my refund. All they ever tell me is that the check is still being processed. I've called several times going on a span of almost 2 years now. All they do is tell me the same thing and they won't pay me or send me my check. I'm going down to the office personally show them a copy of the letter they sent me and all they did was give me a number that they gave me the letter that gives me the same runaround. I'll be more than happy to give you the claim number my VIN number for the truck and all information you need. I don't know what else to do please help thank you. I am rejecting this response because:

Since March 28th, I have been texting to the person at local office, have not gotten any respond or answer at all since March 28th, even tried calling them, no call backs. The person that finally got ahold of someone on May 3rd, who is my father, is the first time we finally got a hold of someone, which I'll be giving my authorization for my father. However, that does not excuse the fact that I have not heard from anyone, no call backs from anyone or replies to my texts since March 28th. Since been trying to get a hold of someone from local office and waiting to hear from someone from local office, then all of the sudden, the local office put out a repo order without any warning and without giving ** a chance to get anything from someone at local office for my father to make a payment and/or pay off the loan.

I was wrongfully fired by the area manager for this company after being sick with the flu. I had documentation of a dr note that I was going to send that weekend until I was informed by my ex co worker that I was needing to pick up the things that I had left at the office. I had let this area manager know that the note was good through Friday as I was given until then off from a Dr. I was going to fax her the dr note as it needed to be sent through her email and that is when I was texted from my ex co worker about my employment status.I had alos made an appointment with a gyno the week before on a Friday as my co worker at the time was going to be covering the store, and the area manager was gone for three days on vacation and wasn't able to get in contact with her about this appointment. My co worker ended up being sick that day and when I had informed my area manager who I also wasn't aware that she was showing up about this she told me if I went to this appointment I would not be allowed to come back for the rest of the day. That day it was brought up that she was getting tired of BOTH of us and I questioned why she hadn't mentioned it before. The only things I had ever done was be sick and I always had dr notes. She wanted details about what was going on with me and knew that as illegal information. She never had a conversation with me after that day.
