My car was repossessed in september, i took out a loan in December and missed payments but was never once contacted by loanmax..not once from December to September. They claim they claim that one digit was off in my phone number thats why they couldn't contact me ..but when they sent me a right to cure default in September they sure new how to contact me! They had my address all along as well as phone numbers of my references (my kids) that they never attempted to contact and het my "incorrrect" phone number fixed. They reposessed my car 5 days after i received the letter, i have called numerous times regarding my personal belongings...they cant seem to locate my car, ******* of the ********** office, whin i have talked to every time has blown smoke up my a** with this story of how they dont know where my car is..they cant locate it and they dont have any knowledge of who might have it. She states that she will have to contact her manager....but never has. She also told me that the letter that i received that they were going to now auction my car came from corporate....******** it had her address and phone number on it...and they made sure to keep sending the letters that said they would auction to an old address so that it wouldn't get to me in time. Its now been close to 2 months and they sti have no information of where my car is....how were they going to auction it of they couldn't locate it...all so very fishy. A kindergartener could run this s*** show better. They insult human intelligence..i had valuable items in my car..and that were very sentimental..they have not seen the last of me... ******* better get ready...she is gonna see my face everyday until o get some answers.Business Response

The ******* operates in strict compliance with state and federal laws and has committed no wrongdoing. On December 6,2021, ****************** borrowed $1,510.00. The terms, conditions and cost of the loan was fully explained to ****************** by the *******s personnel and clearly displayed on the loan documents, in big bold print as required by the Federal Truth in Lending Act. At no time did ****************** indicate that she was confused about the terms of her loan.
A review of Ms. ******** account reveals that she never submitted a payment. Moreover, after she obtained the loan, ****************** stopped communicating with the ******* altogether. On August 24, 2022, the ******* mailed a Notice of Right to Cure Default to her in accordance with the law. Finally, on September 21, 2022, after exhausting all means of reaching ******************, the ******* repossessed its collateral. On September 26, 2022, ****************** called the office where she obtained her loan. During that telephone call, ****************** was yelling, using profanities and making threats until the employee ended the call. Thereafter, ****************** never contacted the ******* again. Any inquiries regarding personal belongings in the vehicle at time of repossession can be directed to AAC Recovery at **************.
Notwithstanding the above, the ******* always tries to work with customers as opposed to selling a vehicle. Therefore, in a good faith effort to assist ******************, the ******* has temporarily postponed the sale of the vehicle and is willing to discuss a mutually beneficial settlement agreement. If ****************** is interested,she can contact *******, the *******s Assistant General Counsel at ************ by November 9, 2022. If ******* does not hear from ****************** by November 9, 2022, the ******* will assume she is not interested in redeeming the vehicle and will proceed with selling it in a commercially reasonable manner.

I called the number on your report went to pick up my belongings...the very items that were of utmost importance and value were absolutely missing from my property...this guy said any other property might still be with my car??? Where is my car??? This guy did not repo it...he just got a bin of half of my stuff, all that they didn't want...why would they split up my property? Why would they give half of ot to someone that they dont use to repo..and that does not or never had possession of my car...they gave you a date of tomorrow for auction. This gentleman said that they already sold it ..he said it went to the highest bidder but he couldn't tell me who that was..he also could not explain why he had half of my belonings bit never had my car. This is some shady and completely illegal business. I am goong to call police and file a theft report as soon as i get home. I believe i have rights..and they stole my property... but no one will do a thing about it..and listens to this fill on the blank form response from this business. They had to cover their tracks and try and get stories to match...well i am not this ignorant and monkeys could run this place better *** surely would be more honest.Business Response

The ******* reached out to AAC Recovery and the representative adamantly denied Ms.******** ************* According to AAC Recovery, all belongings that were in the vehicle at the time of repossession were returned to ******************* Further, he denied telling ****************** that the vehicle had been sold. Again, as previously stated, in a good faith effort to assist ******************, the ******* postponed the sale of the vehicle (which is currently located at Insurance Auto Auction in *******). However, ****************** never reached out to *******, the *******s Assistant General Counsel as instructed in the previous response. With that said, the ******* has agreed to further postpone the sale of the vehicle until after November 16,2022. However, if ****************** does not contact ******* at ************ by November 16, 2022, the ******* will assume she is not interested in redeeming the vehicle and will proceed with selling it in a commercially reasonable manner.

This is absolute ****, as i stated i reached out to Loan max multiple times and every time ******* told me they had no information on the location of my car..this to me was unbelievable. With that i had asked ******* every time for her managers information and number, she told me that she was the manager and she was not allowed to give out that information to customers and only at my third call she offered me a customer service number. And as far as picking up my belongings that were definitely not all there, ***** and i and my son talked for about 10 minutes after i saw that the very things i was wanting from my car were not in the bin. I yelled for him as he was going back into building, and asked ***** the rest of my stuff was..he stated..i really have no idea, if its not in the bin its probably still with my car. i asked where my car was, again he said he had no idea and that whomever was the highest bidder at the auction takes the car. So if my car is not sold why was it at auction and how did it get to *******? Why would they take my car this far away way before my opportunity to retrieve it was up? This makes no sense and only reinforces the lies in this corrupt story. When i talked to ******* the number of times, i made it very clear that i was only interested in the property in my car and that it was very important. I now am retaining a lawyer in this matter, this kind of 3 ring circus business will not be allowed to get away with this. I will have my lawyer reach out to the number in the ridiculous response above. Next, although the towing ******* is an independent contractor and not an employee or agent of the *******, the ******* is a customer-focused lender and for that reason conducts ongoing monitoring of its vendor relationships. Therefore, the ******* reached out to AAC Recovery and its representative was adamant that all belongings in the vehicle at the time of repossession were returned to ****************** The ******* has no knowledge of other complaints concerning this towing *******. Clearly, the ******* is confronted with two very different stories and has no reason not to believe the towing *******.
Notwithstanding the above, the ******* always tries to work with customers as opposed to selling a vehicle. Therefore, in a good faith effort to assist ******************, the ******* has temporarily postponed the sale of the vehicle and is willing to discuss a mutually beneficial settlement agreement. LoanMax owes me $5,634.10 from the illegal auction sale of my vehicle and has advised via phone that the check could take 120 days or more. This is unacceptable and I have seen reviews from individuals waiting for a check since last year. They are predatory lenders and I consider both the sale of my vehicle and their refusal to send my funds in a timely manner as theft.Initial Complaint

In January 2022 loanstar title loans sold my truck at auction, for $2300 more than what I owed them. In April 2022 I received a letter from them with the details of that sale and the amount due back to me. The letter listed a phone number to call to finalize my claim and have a check mailed out to me for that $2300 owed back to me. I called and was told the check would be mailed to me within 120 days. To be expecting it certified via ***** 120 days came and went. So in August 2022, now we'll over the 120 days I began calling the company. After several calls and being given the run around I finally spoke with a "manager" who said she did not know how I came up with August but my account showed that my check was scheduled to be delivered to me ON September 9th, 2022. She very rudely stated several times it would be on that exact day I'd receive the check. Well 9/9/2022 came and went... At this point I've been waiting a total of 6 months on the check. I have called a minimum of 50 times. I actually now call on a daily basis. Every day I am told the check hasn't been mailed, they do not know what the delay is. I ask to speak with a supervisor but am told there isn't one available but I'd receive a follow up call from one. Never once have they returned my call. Every day it's the same response when I call. I am at a loss for what to do here. This is just flat out wrong, borderline theft and honestly plain cruel. It's sad how quickly they moved to repossess my vehicle and how they are treating me now. This is disgusting and I was outraged to find out I am just one of countless complaints, exactly same as mine, against this company. Someone please help me get my funds and stop these "legal" thieves from doing this to anyone else. Thank you.Business Response

I was desperate and needed money to pay rent. I had nobody to ask for money and my credit isnt great so I found LoanStar to ******* $5,515. I didnt understand annual percentage rate and all these numbers and terms thrown at me and an Indian accent talking to me. I signed a paper stating I would pay *******% APR on a 5 month loan with 5 payments totaling $12,778.05. I made 2 payments of $1452 when a friend of mine explained to me that ** being robbed and needed to get out of this asap! I hated to but called my Mom. My Mom agreed I had to get out of this so we called and they said we owed an additional $7037. We paid a total of $9941 after 3 months on a $5515 loan. How is this legal. I call it predatory. This company preys on young, broke desperate people who dont know what else to do and feel trapped.Please help me try to end this crime and not let it happen to others and help me get a partial refund. An investigation into Ms. ********* complaint proved the ******* committed no wrongdoing. On June 16, 2022, ******************** borrowed $5,515.00. The total cost of the loan, including the fees and interest were explained to ******************** by the *******s personnel and fully disclosed on the loan documents in compliance with the Federal Truth and Lending Act. Based on the monthly income and expense information that ******************** entered on her application, the loans scheduled monthly payments were within her ability to repay. At no time ******************** indicate that she was confused about the terms of the loan.
A review of Ms. ********* account reveals that she did not submit her payments as agreed. As explained to the ********************, she could have submitted more than the minimum monthly amounts due in order to reduce the outstanding principal balance. Also, in the loan documents the ******* warns, in large BOLD print that the loan is a costly way to borrow money and encourages borrowers to attempt to repay it as quickly as possible. Most of the *******s customers pay off their loans in a short period of time which significantly reduced the amount of interest the borrower pays.
In closing, the ******* operates in strict compliance with state and federal laws and has committed no wrongdoing. On September 16, 2022, ******************** paid her account off in full. With that said, the ******* considers her account closed, and will assume the same with regards to this matter.

The associate made the faults actuations about my payment to all of my references. Because I had spoke to her in the morning, and I told her that I would be in to pay the payment. She admits that she called me but I told her she was wrong because if she would have called she never had to call my references. And Discuss anything about my account. I told her that I was going to speak to her boss and she said go ahead I don't care.When I spoke to her boss her boss said that she was sorry and that she was going to relate this to the regional manager. And that the regional manager would get back to me. Well I had to call the regional manager because nothing was done. My information was given out there and all I get is sorry. The manager said it's because there is a client with the same name and she got confused. Well that goes to show how many times the client knows my information about my account. During the morning of August 16,2022, ************** contacted the company and asked when his payment was due. The employee explained to him that his payment was due the day prior (August 15, 2022). In reply, ************** stated that he would be in later that day to submit a payment. Later in the afternoon that same day, while making calls to late customers, the employee tried to reach ************** on his cell phone number. Unfortunately,the employee did not review **************** account prior to calling him and had forgotten that she spoke with him that morning. When she did not reach **************, she contacted two of his references. Again, the employee mistakenly thought the company had not had contact with ************** in over a month and reasonably believed it lost contact with him. When the second reference, *************** was called, she put ************** on the telephone. At that time, ************** reminded the employee of their morning conversation. In response, the employee politely apologized for the mistake. Despite **************** contentions, the employee never disclosed any personal or loan information to **************** references.
In closing, the company operates in strict compliance with state and federal laws and has committed no wrongdoing. *********************** has properly notated **************** account and no further calls will be made to any of **************** references. Furthermore, the employee has received additional training and understands the importance of reviewing an account prior to making calls to customers. Car was sold at auction for over $10k over what I owed in October 2021. In February I call them up and they have me fill out paperwork with them to receive my funds. Told me it would take 120 days. Fine. Every month I call about the status until we're at 130 days. Still nothing. ****** (receptionist for repo ****** covers for her "manager", who is never around, nor return any of her phone calls. It's 2 months late now, I'm going into financial ruin because I counted on my money to be available to me, and may end up homeless. They know all this. Don't care. Won't send me my money. Before this business tries to claim that my comments proved the company committed no wrong doing; I'll gladly will also post a link to a public Dropbox and ****** drive with the phone calls backing up my claims of them knowing they owe me money, but are refusing to give it to me. In my eyes, and a lot of attorneys that's theft. So, D****h and Miss "Manager", I'd say cut me the check by Monday because now that I see other people are going through it, there's enough evidence to go full on class action law suit. Get everyone you still owe money to, paid off. I've been nice. I've been patient. And you guys have done nothing, except get rich off what's not yours. You've ruined an innocent man in the process, so I can only do the same back to each of you and your poor excuse for a business. Long story short, in February I initiated a title loan from Loan Star Title Loans on my Hummer H2, you could say this was one of those 1% types of title loans, from my perspective it was to educate myself on some Market moves. That being said I've completely found factual reason to at least QUESTION the affiliation of their true intentions in regards to their customers. For example, taking advantage of the UPRISE in crime in the area and the effects it's had amongst the community. Most importantly last night, 8/4 /2022, AT 4:01 PM, literally the customer service rep ENTIRELY misconstrued the TRUE REALITY of the ACTUAL terms regarding SURRERENEDERING my truck VS, having it REPOSSESSED by lacking COMPLETE transparency, nor ever even going into true depth beyond roughly one aspect, more specifically if the AUCTIONED VALUE was greater or smaller than the actual balance that was owed on the Lone at that present time. Finally, as I was ASKING for SIMPLY 30 minutes of time to ****** my decisions at hand, the rep literally threatened that they could be already out to repossess the truck, whenever in fact they just had FACTUALLY learned about my new address change from that 11 minute phone call.Business Response

On February 23, 2022, ****************** and ****************** borrowed $4,133.00.00. The total cost of the loan was fully explained to them by the *******s personnel,as well as on the loan documents in compliance with the Federal Truth and Lending Act. Based on the monthly income and expense information that ****************** and ****************** entered on their application, the loans scheduled monthly payments were within their ability to repay. At no time did Mr. or ****************** indicate that they were confused about the terms of the loan.
A review of Mr. and Ms. ******** account reveals that as of today, they have submitted two payments totaling $2,107.20. The last payment they submitted was on May 3, 2022. After Mr.and ****************** defaulted, the ******* has tried to work with them, but they have been uncooperative. On August 4,2022, ****************** contacted the *******. Despite his contentions, at that time the employee explained to him that he could voluntarily surrender the vehicle at any time by simply taking it, and the keys to the office where he obtained his loan during normal business hours. Further, it was explained to ****************** that if the sale of the vehicle generates a surplus balance, the ******* will mail it to him in accordance with the law. Finally, at the end of the conversation, ****************** provided the employee with his new address and stated the vehicle was in the driveway.
Notwithstanding the above, the ******* is a customer focused business and always tries to work with customer as opposed to repossessing a vehicle. With that said, the ******* has postponed repossession activity and is willing to discuss an alternative payment arrangement with Mr. or ******************* If they are interested, Mr. or ****************** should contact *******, the *******s Assistant General Counsel, at ************ by August 24, 2022. If ******* does not hear from either of them by August 24, 2022, the ******* will assume they are not interested and proceed to enforce its rights under the contract.

I went to pay off my title loan and was told I could only pay it off in cash. I went to the bank and got the cash and went back to loan max, just to be told that I dont have authorization to remove the lien because Im new by the employee. This has taken may hours out of my day. Im refusing to pay any late fees because the company cant train the employees. I want my title released to me without any penalty because Im not sure when I can make it back to the business. My work schedule doesnt allow me to make it in during business hours. On August 3, 2022, ******************** came to the LoanMax office where he obtained his loan and stated he wanted to payoff. The employee at the office that morning explained to him that she was a new employee and was unable to release his lien immediately, but later that day, her supervisor would be able to release the lien. ******************** was not happy with that, was rude to the employee and left the office. *********** is sorry ******************** is upset; however, his lien would have been released that same day had he paid off.

With that said, if ******************** would like to take advantage of this offer, he should go to the LoanMax office to submit his final payment and sign a settlement agreement on or before August 16, 2022. Otherwise, the company will assume he is not interested in the offer.

6/14/22 Loan Max Title Loans repossessed my truck. The repo man illegally repossessed my truck. The repo man breached the peace. Backed into my grandmothers yard almost hitting two children playing outside. Then hooked to my vehicle with me in it and attempted to drive off. Repo man tried using deception to get me out of the vehicle. Saying that I can pick up the vehicle the next day for $300. Repo man then used law enforcement to remove me. The consumer protection laws state that repo companys cannot use deceptive acts or have law enforcement assistance to repo vehicles.Business Response

Thank you for notifying the ******* of Mr. ***** complaint. We appreciate the opportunity to respond.
An investigation into the grievance proved the ******* committed no wrongdoing. On February 2,2022, ************ borrowed $300.00. The terms, conditions, and cost of the loan were fully explained to ************ by ******* personnel and clearly displayed in large, bold print at the top of his contract as required by the Federal Truth in Lending Act. At no time did ************ act confused or indicate that he did not understand the terms of the loan.
A review of Mr. ***** account reveals that he never submitted a payment and limited contact with the *******. After ************ defaulted on the loan, the ******* made every effort to work with him, but he was uncooperative. Finally, after not having received a payment from ************ in several months, the ******* repossessed its collateral. Next, although the towing ******* is an independent contractor and not an employee or agent of the *******, the ******* is a customer-focused lender and for that reason conducts ongoing monitoring of its vendor relationships. Therefore, the ******* reached out to the towing ******* and its representative adamantly denied Mr. ***** allegations. The ******* has no knowledge of other complaints concerning this towing *******. Clearly, the ******* is confronted with two very different stories and has no reason not to believe the towing *******.
Notwithstanding the above, the ******* is a customer focused lender and always tries to work with customer as opposed to selling a vehicle. With that said, the ******* is willing to discuss a mutually beneficial settlement arrangement with ************. If he is interested in redeeming his vehicle for a reduced amount, ************ should call *******, the *******s Assistant General Counsel at ************, by August 15, 2022. If ******* does not hear from ************ by August 14, 2022, the ******* will proceed with selling the vehicle in a commercially reasonable manner.

An investigation of the grievance proved the company committed no wrongdoing. On September 20, 2021, ****************** borrowed $650.00. A review of his account reveals that to date, ****************** has not submitted a payment. Despite ******************' contentions, the company has not repossessed its collateral and the employees adamantly deny stating otherwise. Although the company committed no wrongdoing, it always tries to work with customers. With that said, should ****************** want to settle his account for a reduced amount, he should call *******, the company's Assistant General Counsel at ************, by August 5, 2022.
