This is in regard to Account *************** of Missouri (TBOM/VT) Account # *******************, Account Opened: 12/29/2018. I have items on my credit report that are not mine and were never opened by me. Even recently an Amex card came on my report I NEVER opened and thankfully that was removed. There was another incident years ago with items coming on my report that were not mine and I am trying to buy a house and there is an item that is not mine and never opened by me on my credit report. I sent in a complaint and so far Equifax replied they verified it belongs to me. Well, that is impossible. I have gone to the local police department and got a police report which I am including along with my identity theft report from the government website identitytheft.gov. I have called legal aid and they said by law it should be removed in 4 days. My mortgage broker says so also and that I can file a lawsuit if it isn't removed because I am being harmed financially and being prevented from buying a house. I don't know what the problem is at the credit bureaus but it isn't my account and I have never received any benefit from this account and have no knowledge of who opened this account. There is no balance owed on the account but it is not mine. My DOB is 7/15/1982 and the last 4 of my SSN is ****.Customer Answer

It is not possible that you have had a complaint with the exact same wording because I personally typed this complaint myself with my own two hands and submitted it. I also got the police report myself and signed it in front of a sworn officer. This is my complaint that was initiated and written by me and not a third party. My complaint if for illegal credit reporting practices by Equifax. They have repeatedly ignored the content of my dispute in which they illegally re-inserted a previously deleted account from my credit report with them maliciously violating my my rights as a consumer under the laws under which they're supposed to operate. I explicitly told them that I'm disputing against them for them illegally re-inserting the **** bank account a spelled out in "15 U.S Code 1681i(5)(B)(ii)(iii) Reinsertion of negative items". I call and demand to speak to a manager and told I will get a call back which never happens. Before asking for escalation I have the rep pull up my docs and read to me that they have my specific dispute at which time they agree that under my dispute, that there is no reason for them to contact **** about the account verification since my complaint is way beyond that. This all stems from Equifax stating the only reason the account was added back is because it was supposedly reported back by the creditors(original and 3rd party to which it was sold). The rep also acknowledged that they see the official statements from original creditor ****, saying they haven't reported acct in over a year and to "leave them alone regarding any future disputes because they have nothing to do with the account". The 3rd party, HP Resurgent also provided a letter stating they never reported the account since they are not the original creditor. Both provided these declarations to the ***** Equifax still come back in the end with "contact creditor who verified the account and accurate" which has nothing to do with my dispute to them. They clearly don't care about my rights as a consumer and feel they can just continue to operate with malicious disregard as if they are untouchable. I want the account permanently deleted once and for all, or I will seek full monetary damages.Customer Answer

At the time verbally Equifax assured me that they were Now clear on my dispute then the next day they all of a sudden closed the complaint committing the same violation by not processing my actual dispute which is against them which I know for a fact is a stall tactic to frustrate consumers whose rights they continue to violate. them for my consumer rights violation which has nothing to do with the
original creditor. So I want Equifax to respond to them illegally
re-inserting the previously removed account from my credit report. Their defense verbally was that the creditor "out of the blue" reported back after almost a year. I asked which creditor and they got combative saying "obviously Sofi since its a SOFI account." I stated that SOFI sold the account to HP Resurgent almost a year ago and not to talk down to me when I know what Im talking about. I further stated that they repeatedly refuse to respond to my method of verification request so I can know which creditor "supposedly" reported the account back onto my credit report. the next days following I kept getting alerts that Equifax change my report noted SOFI sold account to 3rd party. I then mentioned no matter who even though they wouldnt tell me since Equifax was in possession of letters from BOTH creditors stating they do not and will not be reporting anything related to that account, which they provided via the ****. **** even stated to leave them alone and don;t contact them about the account as they have nothing to do with it for over a year. In the end Equifax action says: 1-the dont care about consumer law or my rights they violated with the illegal re-insertion 2- they dont care what the original creditor and secondary credit provided to the **** supporting my case...they are going to do what they want no matter the tremendous financial damage being cause to me with every passing day this account remains on my report. It's almost as if they beg to be sued or be part of class action law suits with their behavior. I was already on the fence about the over 6 figures in damages/loss last summer because the repeatedly insisted that there was no freeze on my report and any financial losses that occurred was because the banks/lenders were making a mistake. After a few months of me screaming and asking for escalations, they finally admitted to finding not 1 but 2 internal blocks on my profile for which I still have not received an explanation but was confirmed to have been the cause of the damage to my financially on the business and personal side. So now I see that there is no "turning the other cheek" with them because they continue to act in purposefully malicious manner when it comes to the consumer law as it relates to the rights of consumers.

Hello, my name is ***************************. I am writing this to delete the following information on my credit report files. The items I need deleted are listed below in the report. I am currently a victim of fraud and identity theft and I did not make these changes. I now ask that the items be deleted to correct my credit reports. I reported the theft of my identity to the ************************ and I also have enclosed copies of the ************************s Identity Theft Affidavit. Please delete these items as soon as possible! Based on, 15 U.S. Code 1681c2 a consumer reporting agency shall block the reporting of any information in the file of a consumer that the consumer identifies as information that resulted from an alleged identity theft, not later than 4 business days after the date of receipt. I am rejecting this response because it states that I should contact the creditors. However, I have done so and have provided proof of these letters of charge off debt that do not belong to me and that I did not authorize to share this information with Equifax. The creditors have provided me with this proof and I have submitted this proof back as well. No response means non compliance. That is identity theft. Equifax continues to ignore my requests for removal/ block off of these two accounts on my file which I have made clear do not belong to me and must be removed immediately from my consumer report. I have received mail stating that actions required from myself such as submitting proper identification have not been done, however, I have proof and witnesses, notaries, and lawyers that are aware of the circumstances.It is the responsibility of the consumer agency to comply in accordance with the written instructions given by myself on multiple occasions.
All of this is being organized carefully to pursue litigation.

I sent my Letters off December 6, 2022. I told the credit Bureau to Re- investigate every piece of information on the accounts that I have listed below. Also I have attach the letters I sent out and here is the **** tracking# **********************.According to the **** the **** investigate consumer report means a consumer report or portion thereof in which information on a consumers character, general reputation, personal characteristics, mode of living is obtained through personal interviews with neighbors, friends, or associates of the consumer reported on or with others with whom he is acquainted or who may have knowledge concerning any such items of information.They stated my account was verified but how is that possible if they did not do a proper investigation according to the law. I have been disputing these 2 late payments for the last year as they are inaccurate. There are 2 late payments reporting as 30 days late as of January 2022 and 30 days late as of February 2022 on Credit Acceptance. Under 15 U.S. Code ****b - Permissible purposes of consumer reports, these alleged late payments should not be reporting nor ever reported because they were paid on time. I've asked for proof and statements that were on file with Equifax and received nothing to validate these lates. I'm asking that these 2 lates be removed from my credit report.Customer Answer
