On August 4, 2022 I paid the three dollar fee to park at the common grounds parking lot near new realm brewing Company. I left a ticket on my dash and left the car and came back before the three hour time was up. There was a boot on my car when I returned stating that I had not paid the parking fee which clearly I had because the receipt was face up on my dashboard shown in the picture attached. The attendant who booted and unbooted my car told me that since I had paid and it was clearly in the dash that I should dispute and my money would be returned to me within 48 hours. I have emailed and called every contact I can find for Empire parking and nobody will respond to me and it has been almost 2 weeks.Business Response

I am rejecting this response because:receipt was sent to your company the day of. As this was literally weeks ago. See receipt attached, again. The receipt was in the window it is hidden on the dash cant be seen from the angle of your picture because of the way the dash is shaped. Why has your company not responded to any of my 4 emails about this? Going through a third party to get my money back should not be the only way to hear from you.

Hello, my car was booted but this company at the place I LIVE AND PAY for parking monthly! The leasing office then said that they would have me credited by this company! I have not received a credit and now they towed my vehicle which now is incurring other charges with the company they contract to tow vehicles! They shouldnt have booted my car to begin with and then to tow it is crazy! But the kicker is *** been trying to reach them for over a week to get a release form from them to get mh car from the tow yard and no one has answered! I got a call back from a. Man named ****** in the earlier part of last week, he claimed someone would be out to me and they have yet to show up or even call me to resolve this! Im going to be responsible for a huge towing bill due to their negligence and the fact that they illegally booted my car from the beginning! This company has done this to several people within my community and its sickening because its really nothing we can to but abide by their wait times and rules! We try to call and all they have is a answering service! Like I said this is beyond crazy and Im about to open a civil suit against them!Business Response

This vehicle is not registered or was not registered the Parkeaz which is the system the that is used for residents and guests to park. We had reduced the fees to 225 but this was not paid. The vehicle was towed as the fees were not paid. Just for context reasons the vehicle was booted June 21 2022 and went unpaid until it was towed July 26 2022. She has had several opportunities to pay before the vehicle was towed, and several after. We have reduced the fees by $150 to no avail.

My husband paid for parking this morning (8/3/2022) when he got to work (which both the *** website and EPS answering service confirmed when we called), confirmation number ********. He parks in this deck outside of his office every time he goes into the office for work and ALWAYS pays without issue. Under duress this afternoon, he paid to have the inappropriately placed immobilization device/boot removed as he was desperate to make sure that one of us could make it to pick up our children on time (which he was supposed to be the parent to do this afternoon). This is OUTRAGEOUS and ABSOLUTELY UNACCEPTABLE... we deserve a refund of his parking for today, refund of the immobilization removal fee ($75) that was ONLY paid under duress, and compensation for the inconvenience/risk subjected to our family/time spent having to dispute this matter/time away from work for the other parent having to walk out of a meeting and miss work to pick up our children/potential TBD late fee that *** be assessed for late pickup of our children... based on the negligence of EPS.Initial Complaint

Hi.Im a resident at ******************* in *******, **. My apartment company has merged with Parkeaz which is owned by EPS. Yesterday when I went to get in my car, they had placed a boot on my vehicle. My car was in my correct spot that I paid for in my annual renewal. I asked them why this happened and it was because my car had a temporary tag on it since it was new. I asked why that matters since my spot is connected to my name, apt number, and description of my ************* you my temporary tag had not expired yet either (8/14/22). I had to pay $76 dollars to then get this boot removed even though I paid for that spot already. This to me seems like a scam and I want to report it.Business Response

Your vehicle must be registered in parkeaz. this is a must. Your tag that was on that vehicle was not registered in the system. Each tag has a space on that property. Please review the screenshot that was taken at the time your vehicle was booted. Note the tag is missing from the list. We will not be assisting you in this matter.Customer Answer

I am rejecting this response because: this photo that you have provided does not convey what you are trying to prove. This photo is just a list of plate numbers with nothing tied to them. Regardless, Ive registered and paid for my spot in the time that was required of me with full description of my vehicle associated with my I.D. and apt number. It is absolutely ridiculous to paying for a boot when my own car was parked in my parking spot. Otherwise, what is the point of inputting all of that information? It sounds like your logistics need to improve on your end.

It does not show what these plates are attached to as far parking spots and it does not show if these parking spots have been renewed. Wouldnt my parking spot pull up as renewed and what vehicle is parked there? Your system is clearly flawed.

this is a time stamp photo of the property list of vehicles. Yours is not there. If you need some help remembering your temp tag number i will post it for you. P3566245 This list is in order as follows, Numbers first as in if your tag was ***** it would show between ***** and *****. From numbers it then moves to the alphabet and works the same. In the time stamped picture, you can clearly see your tag is missing. We do not control the alphabet or the app. This is controlled by parkeaz a completely different company. This is a formal complaint against Empire Parking Services regarding their predatory booting practices and promotion of unsafe and distressing interactions between their employees and the general public. On the morning of 8/3/22 at 8AM I walked out to my car in my apartment complex's parking deck to find two boots on my car and a sticker. As a resident of my apartment complex for going on one month and having registered my car at move-in with my complex, I was confused. I called the number on the sticker, received an automated answering service which would only provide an email for disputing the booting. I called again, received the automated answering service, and opted to request a technician to come out to my car so I could "pay in-person" - still no context on why my car was booted. Within 30 seconds I received a phone call from a man who refused to give his name, said he worked for Empire and would be at my car in a few seconds. When I walked back out to my car, a man in an unmarked, beat up ****** Altima drove up to me and asked if I was the one asking to remove the boot. When he finally stepped out of his car, I saw the first and only clue that he worked for Empire with his blue polo shirt. He refused to give any details about why my car was booted and said he was only able to process my payment. After I refused to pay without him giving me any rationale for why my car had been booted, he drove off and up into my complex's parking deck - no attempt to resolve the issue beyond telling me to email their dispute email as he sped away. As a young woman in an urban area, this experience was incredibly frightening, especially with the constant human trafficking schemes in *******. Empire Parking Services' license to operate the city of Atlanta should be revoked on the grounds of predatory business practices and gross negligence in promoting unsafe and distressing interactions between its employees and the general public.Business Response

Your vehicle was removed without charge, but you should have been. You know your vehicle must be registered in the parking app and was not. This is what lead to your vehicle being booted. We enforce the rules of the property. Had your vehicle been towed for the same thing you would have been charged $275. Follow the rules and you will not be booted.Customer Answer

Thank you for your attempt at resolving the concerns I raised in my complaint but unfortunately, all you have proven is that you are incapable of reading. Well over 50% of my complaint involved the manner in which your employees communicated with me and I can only assume with other customers. The intentional withholding of information (e.g., rationale for why you boot someone's car but not another, etc.) both via phone and in-person with your on-site representative is inherently deceptive and creates an tone of intimidation. This is in addition to allowing your on-site employees to drive around and approach customers in beat up, unmarked cars - especially in the early hours of the morning with young female customers all alone in parking garages, this is incredibly unsettling, frightening, and once again, promotes a tone of intimidation. In the human-trafficking capital of the ****, *******, it is the responsibility of legal, supposedly good-intentioned businesses like Empire to conduct business in a manner that does not instill fear for safety in their customers, particularly young women. I would appreciate you revisiting your employee training and ensuring a safe, unintimidating experience for future customers so no one else will have to experience the same fear and unnecessary intimidation that I experienced during my interaction with your business and employees.Sincerely,

I cannot speak to your experience for the following reason. I am not here to play he said she said as the tech noted something completely different, they what you say. I am sorry you feel you were treated poorly but our techs have rules to enforce that were not followed resulting in your vehicle being booted. Our tech that spoke to you at around 8:41 am noted that you just wanted to argue. We have several people that call for boots to be removed. Our techs cannot stay on the phone arguing with you. If you have a dispute that should have gone through the dispute process which is outlined when you pay. We were visiting ******* and my wife wanted to go the fabric store at 881 ***************. The store is located in a building labels ***********. We pull to the front of the store and parked. We both see the signs that say parking for *********** and neither of us thought any thing about it since the fabric store was in the same building. We go in and after a couple minutes I decide to leave. There is a man in the lot about to put boots on the car! I proceeded to ask why he was booting the car. He just pointed to the sign and kept putting the boots on. My wife and I are senior citizens and didn't really see any other option out but to pay the ****** money. We pleaded with the man...we weren't even there five minutes. He was parked in the lot when we got there and he could have told us it was private parking. Not a great was to tread out of town visitors or senior citizens. If that man's mother only knew how he treated us....nothing but disrespect.Business Response

The *************** signs at the entrance tell you you cannot park and the sign that A&P would be the condos you parked at saying AP only we have no obligation to tell you anything further.
