    We are being harassed by this company for a credit card that was over 10 years old. Recently they tried taking money from our bank account. And now are trying to garnish my husband's wages. This is to the point of being harassment and the next call is to the attorney general. There are specific laws in ******** in regards to credit card collections and that time frame to proceed with action.

    Contacted Blitt and Gaines on 6/16/25 after receiving an advertisement in the mail from an attorney trying to convince me to file bankruptcy because one of my credit card companies was suing me. Had no indication of this. Called them - they gave me another number and that company gave me the number to Blitt and Gaines, who claimed that a cease and desist was attached to my account and that was why they hadn't contacted me. Further tried to claim they had sent mail in April, which was never received. Then wanted information about my current employer and bills. Repeatedly told them I'd be able to make small payments but was legally blind and could not afford to take time off work. Asked about supposed court case and was told a date was not set but if I did not set up a payment arrangement for the minimum payment they deemed I could make, that action would continue in spite of other payments made. Repeatedly tried to tell the agent I spoke with that the questions she asked did not account for all my bills, nor the cost of my medication, and she repeatedly interrupted telling me that was the minimum payment and she had asked about all bills on their list. This was my first ever communication with them. Asked to speak to someone else because the agent was condescending and continually interrupted me even when I was trying to tell her that I didn't understand and conveniently no one else was available. Agent then continued to interrupt, complaining about the length of time we'd been on the phone in spite of the fact that she kept repeating the same answers even when I tried to clarify. Continued to hang the threat of court and court judgment over my head even as I was telling her what I could afford to pay. Took all day to figure out who this company was so I could call and do the right thing after months of not having a job and no communication from them and was met with aggression and an unwillingness to listen, fully answer questions, or work with me.

    Blitt and Gaines withdrew $4,540.92 on June 16. I NEVER authorized this payment to Blitt and Gaines. They illegally and unlawfully took the money out of my account. They did not call me or send a letter saying they would withdraw the money, they sneakily took the money out of my account.I explained to them that I can no longer pay $25 that I used to pay on my payment plan as I am unemployed and no longer receiving unemployment benefits. I spoke to them over the phone regarding this. Their response was-sorry to hear that, call us when you have the ********* they've withdrawn $4,540.92 out of my account, without my authorization and consent. This is robbery and fraud. I have no income. I want my money back. I cannot afford to pay the bank such an exorbitant amount in overdraft fees. I had ******* prior to this in my bank account.

    I am rejecting this response because:
    I have been contacting Blitt and Gaines for the resolution of this matter but they keep making excuses.

    My bank has already submitted all the necessary documents. I dont understand why the unnecessary delay.

    I have called several times, the few times they received my call they wouldnt tell me when my garnishment would be removed.

    I also called my bank and they said the onus is on Blitt and Gaines to remove the garnishment.

    I have not been able to access my bank account for 2 weeks. This is a very unnecessary headache and very deliberate on the part of Blitt and Gaines.

    Since all the paperwork has been received, please remove the garnishment!!

    The other times I have called this week, no one was there to answer the call.

    It is an incredibly frustrating situation and I feel Blitt and Gaines take advantage of indigent, disadvantaged and vulnerable populations because they feel they can.

    This is not right, please be professional and remove the garnishment since you have all the documentation you need.

    I am rejecting this response because: Although Blitt and Gaines have removed the garnishment on my bank account.

    I need them to cease anymore garnishments on my bank account along with any more lawsuits. I have told them ***eatedly that I have been Unemployed since November 2023. I want to clarify a falsified claim you made that my bank reached out to you on June 19, 2025. That is incorrect by a landslide. As you know ************* institutions including Banks, and Courts and Law firms including yours was closed on June 19 also known as Juneteenth, because it is a Federal Holiday.

    I spoke to your *** a few months ago, she said your office is always closed on weekends and Holidays. 

    Now that weve clarified that, lets get back to the facts

    As my bank has proven to you on June 17, 2025 at 1:38 pm via email that I had a negative balance and I am indeed an indigent with no source of income, you had no right to garnish my bank account.

    I will not withdraw my complaint, till all garnishments on my bank account are stopped, all lawsuits stop AND I also want detailed information on all the accounts you own of mine INCLUDING the accounts that were dismissed.

    I want the original creditors info, when the account was originated, when it was sold to you, all payments made on the Account, all the legal action taken and all legal action you plan on taking.

    As a consumer, it is my legal right to demand this information and transparency.

    You cannot just threaten and intimidate individuals without providing them with information and just litigating against them.

    Once all the information has been received, litigation is stopped and garnishments are stopped, I will withdraw my complaint.

    I contacted Blitt & Gaines on June 12, 2025, after receiving a notice about a different debt. During that call, I was informed for the first time that I was already being sued in a separate case (Cook County Case No. ***********). I was never served, notified, or informed of this lawsuit.The representative falsely claimed that I had been served and that I was represented by Five Lakes Law Firm. I am not represented by ********** and have not had any contact with them in over six months. Despite asking for documentation and clarification, the firm did not provide proof of service or correct the representation error.The firm is now pursuing default judgment based on these misrepresentations. This is misleading, unethical, and obstructs my right to defend myself in court. I believe this behavior is unfair and abusive under debt collection standards.

    I reject this response because it does not adequately address the serious misconduct and misrepresentations made by Blitt & Gaines, P.C.


    The firm falsely informed me that I had already been served with a lawsuit and that a default judgment was imminent yet in their own response, they admit I have not been served. They also relied on incorrect and unverified information that I was represented by ********************, which is entirely false.


    To clarify: ******************** has never represented me in any legal capacity. They are a fraudulent debt settlement company, not licensed to practice law in the State of ********, and were never authorized to act as my counsel. Despite this, Blitt & Gaines filed a lawsuit without contacting me directly, without verifying representation, and without providing the legally required debt validation notice.


    I only became aware of the lawsuit after calling their office on June 12, 2025, about a completely unrelated account. When I attempted to resolve the issue by offering a payment plan and requesting settlement options, I was told they would proceed with legal action regardless. They have refused to offer any legitimate path toward resolution.


    It appears that Blitt & Gaines is using litigation not as a means to fairly collect a debt, but to teach a ****** to a consumer who is asserting their rights after being misled and ignored. This is an abuse of legal process and a violation of fair debt collection practices. Their actions have been aggressive, unethical, and potentially unlawful.
    I request that this complaint remain open and that BBB, along with appropriate authorities, investigate the conduct of this firm further.

    I am rejecting this response because:

    I appreciate the follow-up from Blitt & Gaines. However, I stand by my original statement: on June 12, 2025, when I called their office about a separate account, the representative explicitly told me that I had already been served and that a default judgment was pending. Their denial of this statement is inaccurate.

     

    Regarding the Power of Attorney with ******************** while I did sign one in the past, I terminated my relationship with them over six months before this lawsuit was filed. They never contacted me personally to confirm representation, nor did they send any validation of the debt directly to me. Proceeding with legal action based solely on a prior POA, without confirming ongoing representation or providing notice to me, is irresponsible and misleading.

     

    The firms failure to validate the debt directly with me, and to confirm whether I was still represented, caused me to be unaware of the lawsuit until I discovered it by chance. That lack of notice and misleading communication continues to be my concern.

    I am rejecting this response because:

    I appreciate the follow-up from Blitt & Gaines. However, their suggestion that I misunderstood their representative is inaccurate. On my June 12 call, I was told I had already been served and that a default judgment would occur if I didnt act quickly. That representation was false, and even their own responses confirm that I had not been served and that no judgment was pending.

     

    Their reliance on a Power of Attorney from ******************** is also problematic. I had formally terminated that relationship well before this lawsuit was filed. Despite admitting they never received confirmation from Five Lakes, they proceeded with legal action without contacting me directly or sending a debt validation notice to me.

     

    To date, they have still not provided the debt validation they promised, despite acknowledging that I am within my 30-day window. Additionally, they continue to refuse to communicate directly with me, even after I clearly informed them that I am not represented by Five Lakes.

    I was denied a fair opportunity to resolve or dispute this debt before a lawsuit was initiated in my name. I am still open to communication and resolution, but I stand by my concerns regarding their misleading and noncompliant debt collection practices.

    I received a letter in the mail at the end of April stating that Blitt and Gaines had reached out to my employer to start garnishing 25% of my paycheck from a fraudulent debt from almost 10 years ago. I contacted Blitt and Gaines on April 28th 2025 to let them know that this debt was fraudulent. They stated that they would be sending me paperwork to report and investigate the fraud claims. They stated that the paperwork would take 7-10 business days to arrive. I never received any paperwork and I have called several times. It is now June 11th, 2025 and I have yet to receive any paperwork and cannot get ahold of anyone with their company. They are now about to garnish my third paycheck. Blitt and Gaines has offered no assistance or cooperation, only rude employees and excuses. You can never get anyone on the phone and they never return voicemails.

    I am rejecting this response because: this information is incorrect. I called your office before May 12, 2025 to discuss this as fraudulent, and further explained to your agents the situation. I have contacted your office numerous times and have left several messages. I even put in a request online for a call back via your website and was still not contacted. I have now requested this paperwork four different times and was told that it would be re-coded and sent out as soon as possible. I was also informed after the third time it was re-coded that if I dont receive the paperwork, that it could be emailed to me. The agent I spoke to a week ago told me she would need to check with a supervisor and would return my call in 24 hours. It is nearly impossible to speak with anyone in your office without getting the complete go around or multiple excuses, hence my original complaint.

    I still have no received the paperwork that I originally asked for. This has now been an 8 week ordeal and my 4th paycheck is about to be garnished. I have tried to make contact with this office multiple times in the last several weeks and still dont have any answers. I keep going in circles with staff and being told, this will be recoded and youll get the documents in 7-10 business days. I still have not heard back from a supervisor about emailing the documents to me since mailing them is such an issue. Blitt and Gaines has been completely uncooperative with sending the requested documentation in a timely manner.

    I had a judgement placed in my name for the amount of $3239.38. When I received notice, in person, I immediate went and got a money order. I put the case number on the form along with a letter. The debt has been paid on April 10. The company received the funds and cashed the payment sent to them roughly April 21. They still have not submitted to the courts that this debt is satisfied. No one answers their phones or emails.

    I set up a payment plan with Blitt and Gaines and have not missed a single payment. Today I called in to make a payment with my card like I do every month. I called 3 times waiting for a *** but kept getting sent to voicemail. I left a voicemail stating I need to make a payment before they close. No one ever called me back to make a payment. They are now closed for the weekend. I would make a payment online but I do not have my account number and their website does not allow you to look up your account. I will now be kicked off this payment plan for missed payment after a year of paying and only having 2 payments left. This is ridiculous there is no way to look up your account number.

    I contacted the three major credit bureaus to dispute a *********** debt on my credit report and was advised to reach out to the lender directly. Over the past two days, I called *********** to request Form 1099-C for tax documentation related to a fraudulent account charged off under my name on March 28, 2019.I was informed that the Venture Account card ending in 6986 had been assigned to Blitt & Gaines Attorneys, resulting in a judgment against me. When speaking with ******, a supervisor in ***********'s Fraud Department, I asked why the charge-off still appeared on my credit report. She explained that, although *********** no longer owned the debt, it would remain on my report, and I would need to dispute it directly with the debt buyerwho has refused to validate the debt.Additionally, Blitt & Gaines pursued legal action, obtained a judgment, and prematurely issued an order that did not grant them the legal authority to freeze my ******** account.Per IRS Section 6050P, creditors must issue Form 1099-C for canceled debts exceeding $600. Since this debt was written off six years ago, I should have received the form by January 2020 for proper tax reporting.I am requesting the removal of this fraudulent account from my credit report as soon as possible.
