      We closed on our house in December of 2021. The sod for our home was installed in November of 2021. Per Fischers own recomendation, sod shouldnt have been installed after October first. And given the time frame I mentioned above, when we finally took ownership of our home, it was literally impossible for us to water our lawn because it was now winter and freezing. The sod is now dead and doesnt grow. Our lawn has only been mowed three times this entire growing season because of how poorly the lawn grows. The backyard also had seed thrown down on it before we took ownership. None of it took due to the same circumstance.

      Dear Better Business Bureau,
      Fischer Homes has researched our customer’s complaint about
      their sod and seed portion of their yard. The fall weather permit documents for
      yard installation suggest a cut-off in early November. However, this varies every
      year and is subject to the actual weather conditions and the lending
      institutions. If weather conditions continue to be acceptable (above 32
      degrees) we fully support the seed and sod installation.

      The November and December temperatures in 2021 were well
      above 32 degrees. In fact, November of 2021 was in the high 50’s and low 60’s
      for most of the month. December 2021 in ****** was the second warmest on record
      with similar temperatures. We have attached the data obtained from ***************
      to support this.
      The yard was installed on November 4th, 2021, and
      Fischer Homes watered and maintained it until the home closed on December 7th 2021. We checked on other yards that were installed in the area around the same
      time and with the proper maintenance look well established.

      Our customers would much prefer their yard be installed and
      not escrowed and placed on a weather permit until the following spring. The
      four to five months of having a graded dirt yard as opposed to an installed
      yard is always the preferred option.
      Fischer Homes respectfully disagrees that the yard could not
      be watered and maintained by the homeowner post-closing. The temperatures were
      very much in favor of establishing the seed and sod by way of watering and
      fertilizing.

      I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, reasons for rejection are included below.

      The temperatures Fischer has referenced are cherry picked from the high of the day. If you google "how cold is too cold to water your lawn" the answer is 40 degrees. Provided is a sample link

      And provided here is the link for the temperature history of December 2021. There was not a single day in December where the temperature wasn't bellow freezing at some point of the day. If the grass had been watered, it would have damaged , frozen and killed the roots of the grass, as mentioned in the article/s. Given the response from Fischer, it seems that they may have continued to water my yard even as temperatures dropped bellow freezing during the night, which resulted in root death of the yard, which meant my yard was doomed before I even took possession of the house.

      Dear Better Business Bureau,

      We are confident that the sod was watered in correctly during the month that we maintained it prior to closing. If there wasn't water applied in December it would have gone dormant. To get another opinion we requested our Quality Construction Manager from the greater Cincinnati office to make a site visit to get his opinion of the yard in its current condition. He responded that the sod is in good condition, but the entire yard needs maintenance by way of weed control and fertilizer.  

      We understand that our customer is not of the same opinion, but we have multiple yards that went in during this time frame that look great. We have a very informative section in our online Homeowner's Use & Care Guide that gives step by step instructions on   growing and maintaining a healthy lawn. This can be accessed by logging into their homeowner portal.
