I paid $409.80 to cbs for multiple medical bills for ******** ******** ******** , I made the payment 10/6/22 over the phone with my *** debit card which was settle on 10/7/22. ******** ******** ******** contacted me several months later telling me I still owed these bills which I knew I had paid. I filed a complaint with bbb and didn’t have confirmation I do now that the payment was made to cbs. I have the merchant # and the terminal # of the transaction made to cbs. When I co tasted cbs about this matter, I was forwarded to a manager and he confirmed the payment was made and he assured me he would send a copy of the payment to my email, but said he would have to have his boss send it so it was sent “securely” I have yet to received this email and it’s been multiple weeks, more than enough time to send an email. ******** ******** confirmed that the bills I paid with this $409 payment was never made. This is my second time filing a complaint now that I have the proof the payment was made to cbs.
Merchant # **************** terminal # ********. I got this information from *** who manages my *** account thru my work. When I called cbs with this info, the older gentleman I spoke to confirmed he was looking at the payment of over $400 was made in 10 of 22. I read my email to him and asked him to say it back so I knew he had the correct address and he assured me I would be getting a copy of the payment which I have yet to receive.Business Response

As explained in our email to *** ******, we understand his frustration and apologize for all of the confusion regarding this matter. We did receive *** ******' payment in full of his accounts
************ and ************ with ******** ******** ******** and Clinic on
October 7th, 2022. Those payments were remitted to ******** ********
on or around November 10th, 2022. However, after investigating this
matter, ******** ******** determined that the monies received from our
agency were incorrectly posted to *** ******' accounts. This explains why they were
still showing a balance for *** ******, despite his payment in full to our agency. We
received assurance today that this would be straightened out and the payments
posted correctly.

I have called CBS several times trying to establish a payment plan for an outstanding debt. I was told that as long as a payment plan was initiated within 1 year of my date of surgery, the debt would have no effect on my credit. I spoke to several agents on different occasions, all of which gave me this same information. On another attempt, a representative told me this information was false, and that the debt had to be paid in full. I asked for my conversation history to be pulled, as this was not the information I had been given previously. The representative told me that my request had been sent over to her supervisor, and that someone would reach out to me. I called back when I received no follow up. The representative I spoke with hung up on me mid-sentence, therefore I was still not able to come to a resolution. I tried calling back and was told to leave a message for the supervisor, who again, I never heard back from. I would like to get this debt taken care of before it is reported, however the employees here are making it impossible to do so as they are rude and unprofessional.Business Response

We apologize for the lack of clarity in the communications between you and your account representative. The credit reporting rules state that a medical collection account cannot be reported to the credit reporting agencies before one year has passed from the date of service. It appears you were not receiving callbacks due to your statement on December 6th, 2023 that you were represented by attorney ******* ******* with regards to this matter. According to the **** **** ********** ********* ***, a debt collector may not communicate with a consumer who is represented by an attorney, but must communicate with the attorney directly. We attempted multiple times to contact this attorney to confirm representation; when we were finally able to contact them, they refused to confirm or deny representation. The account never reported to *** ********* credit report and will not.

I am rejecting this response because:I believe this is not in accordance of 15 U.S. Code § 1681b - Permissible purposes of consumer reports.
Per the response, this is absolutely against HIPPA rules. The collection agency should not have any information regarding alleged services rendered. Even if they did sign the HIPAA Business Associate Agreement and they are being legitimate in my first complaint, they should NOT have all the information they just provided and requested too much from *** ******* And it absolutely should not be added and sent to strangers at the BBB. HIPPA is in place to ensure this does not happen and there are hefty fines and possible lawsuits that can happen following misuse of the exact information they just disclosed to you, the BBB. I am willing to not pursue any lawsuit or complaints regarding HIPPA or the fact that I didn't sign nor do I own this debt, as long as it is promptly removed from my credit report with all bureaus.

System response because I was never given the chance to validate this debt. Credit
Bureau System added this information to my credit file without verifying the
validity of this debt they say I owe. I am keeping a record of every document that
you have provided me with and I will not hesitate to exercise my rights.Looking at this bill I have
noticed a few things that let me know that this debt does not belong to me. I
do not spell my name the way it is spelled on this itemized bill. The address
on the itemized bill, I have never resided at, which lets me know that I do not
owe this debt and you have the wrong person.
I have rights under the Fair Credit Reporting
Act. An itemized bill does not prove that I owe anything concerning this alleged
debt. Therefore, I am requesting comprehensive verification of the debt. I need
copies of any written agreements, contracts, and documents that establish my
liability for the debt you say I owe. Provide a breakdown of fees, breakdowns of
interest charges and fees. Proof of your agency’s legal authority to collect
this debt, ownership documents demonstrating that you have the right to pursue
collection on behalf of the original creditor.
Any continued reporting of this
debt to credit bureaus without proper validation will be considered a violation

This account was referred to CBS for collections on July 28th, 2021. An initial notice was sent to Mr. ********r on July 30th, 2021, to the address provided by our client - **** ****** *** ******* ** ****** The letter was not returned by the Postal Service, nor were any of the subsequent five letters - therefore, per federal law, delivery may be presumed. With this in mind, we reject Mr. ********r's allegation that he was not given the chance to validate this debt. The validation period offered by the Fair Debt Collection Practices Act in July 2021 was 30 days; CBS received no notice of dispute from Mr. ********r during this time. As such, the account was lawfully reported to Mr. ********r's credit on November 1st, 2021. A direct dispute was received from Mr. ********r on June 6th, 2022. CBS completed all verification requirements necessary for a reasonable dispute under the Fair Credit Reporting Act, coded the account to report as disputed, and confirmed to the credit reporting agencies that the account was accurately reporting.
Our resources show that we have the correct person, as the Social Security number and date of birth given by our client match those of Mr. ********r. Additionally, we have confirmed that **** ****** ***** ****** ** ***** was a past address of Mr. ********r's; it appears that the first responder may have inadvertently typed "****** Lv" rather than "****** Ln" during intake, as well as misspelling or being unaware of the correct spelling of Mr. ********r's first name. If Mr. ********r still feels that he is not the patient in this case, we encourage him to file an identity theft report with his local police department and provide CBS with a copy of the report.

They are requesting money for medical bills (debt collector). I have made contact with them multiple times to try and resolve my issues but they tell me that they are not my agent so they can’t set up a payment plan but they can collect the full payment or leave a message for my agent to contact me. We received two collection accounts for *** ******** in July and August of 2022, respectively. The total combined balance is $2,316.54. Credit Bureau Systems, Inc. attempted multiple times via phone and email to reach *** ********* but were unable to make contact until December 20th, 2023, after CBS had already flagged the file for legal review due to nonpayment. On December 20th, 2023, the account representative informed *** ******** that payment in full was due at that time in order to stop further collections. We apologize sincerely that no return call was made to *** ******** as promised; however, the answer would have been the same. The file has since been sent to our attorney for involuntary collections - *** ******** will need to contact their office for further assistance.Customer Answer

I am rejecting this response because: I made contact the day I recieved the letter for wage garnishment which was the 13th of January. The 20th was the second or third time I called to speak to “my agent”. I emailed them after I was unsuccessful and was told I needed to contact their attorney when I called the number provided in the picture it was not a lawyers office just a random number. I contacted the bbb and after a couple weeks January 11th I then heard from who I’m guessing was my agent who gave me the actual law firms number. I have recieved no paperwork or phone calls because the information submitted from Baptist Hardin was wrong and I was never given a chance to take care of this.
