Upon
receiving the Consumer’s complaint, Republic Finance immediately reviewed his statements
made therein. Importantly, it is the Consumer’s decision whether to apply for a
loan with Republic Finance. Republic Finance cannot discourage anyone from
applying for credit. It is our policy to adhere to the laws and regulations
pertaining to the fair and equal extension of credit to all creditworthy
customers pursuant to the Equal Credit Opportunity Act (“ECOA”) (and
accompanying Regulation B) and the Fair Credit Reporting Act (“FCRA”) (and
its implementing rules and regulations).
As such, Republic Finance’s business operations and branch offices do
not target any specific class of customer nor refuse to grant credit to any
creditworthy applicant on a prohibited basis; that is, we are an equal
opportunity lender. Republic Finance must request a credit inquiry from the
credit reporting agencies to determine the credit worthiness of a consumer for
every credit application submitted. The ECOA and Regulation B do not prevent a
creditor from obtaining information necessary to evaluate the creditworthiness
of an applicant.
Under the FCRA, Republic Finance is obligated
to investigate credit disputes that are complete and meet certain
requirements. According to the FCRA, a
dispute notice is complete when it is submitted in writing directly to the creditor
(i.e., not through a private, non-profit organization such as the BBB) and
includes the following: (1) sufficient information to identify the account in
dispute (e.g., consumer's full name, address, telephone number, and account
number); (2) the specific information that is being disputed and an explanation
of the basis for the dispute; and (3) all supporting documentation or
information to substantiate the dispute, to the extent available (e.g., a copy
of the relevant portion of the consumer report that contains the allegedly
inaccurate information, a police report, a fraud or identity theft affidavit, a
court order, or account statements). Therefore, Republic Finance has determined
the Consumer’s credit dispute is incomplete because it does not meet all of the
three afore-mentioned requirements. If the

I have a issue with the fact that I have two 30days late payments on my credit report that is not accurate and I have receipts to prove it. I reach out the the branch that I was affiliated with, which was in Pear, Ms. I mentioned to the branch manager bout this situation and she stated for me to just file an dispute with the credit bureau and I did. Well they still denied that I paid on time. I need to inaccurate report off my credit because this isn’t right. I have dealt with Republic finance for 7 years and this how they do a faithful and loyal customer like me. February and April of 2020 is we’re they placed in the system for these payments. I have been an on time client of Republic for over a year now I believe. I opened this loan to establish credit I didn’t need the money. Things were fine and the staff was nice until around July. I don’t understand how I could have missed the payment but I did and didn’t find out about it until the payment was more than 30 days behind. I had been turned over to collections before being contacted by Republic to straighten this out and not let it damage my credit. Republic has my cell, my landline, my work number, my email and my address. They didn’t bother using any of those means to contact me. I paid my bill up to date which was two payments. Now this month when I called to pay my Bill they said I was in collections. I’m so irate. I’m on time this month not even a day late. On August 19, I contacted the local office on East Texas St, Bossier City, LA; informing them according to the Servicemembers Civil Relief Act, my account was eligible for a reduction to 6% interest. Kiara, whi works at the local branch continues to tell me, "Our company doesn't do that. We've never done it. I don't think that applies to your personal loan. When asked for the information to contact cooperate foe further assistance, she went on to say, there's not a number available, she was not aware on how to contact cooperate office. I found the information myself, same issue with the cooperate office, pretended not to know or be aware of the SCRA, the agent then hung up on. I have been back and forth between local office, and cooperate since August 17th. Harold Griffin, a supervisor at the cooperate office, I was finally able to speak with him, on August 25, 2022. At that time he assured me my situation would be handled, and he himself would contact me directly with frequent updates, & final decision. I received one follow up call from Jim on September 2, 2022. At that time he informed me all of my paperwork was submitted to the correct department, after Labor Day weekend, the next business day he would notify me with a final decision. As of today September 15, 2022, I have not heard back from Mr. Griffin. I have a payment due today, as a customer who's submitted all necessary documents for reduction, I still do not have the issue resolved. I called the local branch this morning, spoke to the manager, according to her, she was going to contact cooperate and call me back. Prior to me making a call this morning, I have hears ABSOLUTELY NOTHING FROM EITHER MANAGER, THAT I'VE TRIED TO CONTACT. No follow up emails or phone calls. This issue has caused my anxiety to increase, I deal with severe anxiety and depression. I've had to go see a Psychiatrist, as a result to the extensive stress, an negligence concerning my account.Business Response

Upon
receiving her complaint, Republic Finance immediately investigated the Consumer’s
statements made therein. The Consumer states she had requested a 6% rate
reduction on her loan pursuant to the Servicemembers Civil Relief Act (“SCRA”), 50 U.S.C. Appx. §§ 501,
et seq. It is Republic Finance’s policy to fully comply with both the letter
and spirit of the SCRA and to provide relief designed to aid those
Servicemembers who are called to duty in the armed forces. Republic Finance’s
records show that it received the required documentation from the Consumer to
process her request and that her request was approved and processed on
September 13, 2022, prior to her filing this complaint with the BBB. The
interest rate on the Consumer’s loan has been reduced to the 6% ceiling rate as
of the date of commencement of Active Duty or deployment in accordance with the
provisions of the SCRA.
As a part of its investigation, Republic
Finance’s Collections Department Manager (“CDM”) attempted to contact
the Consumer to discuss this matter. Specifically, Republic Finance’s CDM
attempted to reach the Consumer by telephone to discuss this matter on September
15, 2022, and the Consumer answered and stated she would have to call back. As
of the date of this response, Republic Finance has not received a return call
from the Consumer. Republic Finance mailed a letter under separate cover to the
Consumer on September 15, 2022, detailing the aforementioned actions and considers
this matter satisfactorily closed.

I received a check in the mail for a loan in February of 2022. I received a payment booklet in April of 2022 and made my first payment of 199.00. I tried to make a payment the next month and they blocked me from the website and said to call a number for help in making payment. I called the number and used the prompts then was placed on hold and after 45 minutes I hung up and tried to call again. I kept getting placed in long holds and was never able to get ahold of them. Now I got a summons to court and in the filing they stated that I didn't make any payments which is untrue and I have the bank statement to prove I did. I initially received an unsolicited check in the mail from Republic Finance Services. It came as my daughter was starting college and we desperately needed some extra money. I refinanced twice over the course of the next year and the processed was very rushed and I didn’t feel as though my questions were answered correctly. The total of all of my loans was was supposed to be just over $6,000. I asked for a statement of all of my loans and was sent a statement from 2/1/2020. I have never received anything from the original loan in 08/2018 and what payments were credited from all of those payments. Now, paying over $300 every month for 2 1/2 years (less 3 months at the beginning of the pandemic…which I called and made arrangements and they said they wouldn’t report to the credit bureau but they still did) I still owe $5,000+??? According to the statement received in the mail for the most recent consolidated loan, I have paid $5451.49 in interest and $4623.51 in principal. So, I’ve paid over $10,000 and still owe over $5,000??? I can’t even get a straight answer on what my balance is to pay this off. I asked how this can be legal to charge that much in interest and was told they follow the rule of 78??? What even is that? That’s the first I”m hearing of this. I am rejecting this response because:
We had a discussion over the phone which consisted of him telling me that I signed the papers and therefore everything was good on their end. He stated that they are heavily regulated and cannot engage in predatory lending. I asked him to provide me with a detailed accounting of all amounts dispersed to me and all payments made. He stated that he would mail them to me and I have not received those yet for review. He also did not have a payoff amount, but said he would look into it. I explained that the paperwork signed was not in a plain language that the average person (anyone other than someone with a masters degree in finance) could understand. I was originally told that the interest rate was 36% and there was no early payoff penalty. He informed me that the interest if front loaded and I was responsible for paying that interest first. I still don’t understand how the amount I received and the amount I have paid thus far equals a 36% interest rate.

Republic Finance is reporting inaccurate information on my credit report. The general manager had the issue researched and notified me in January of this year that the issue would be corrected and my credit report would be updated in 48 hours with all negative reporting s removed as I have never paid this account late and it was paid in full years before it’s maturity date! I closed on my new house in March and had to change my loan type because of their incorrect and negative reporting of my file. I am also being affected by the incorrect and negative reporting on my file. This wrong information reported by Republic Finance on my credit is costing me thousands of dollars in interest.Business Response

As requested by the BBB guidelines, we have left all personal identifying

refer to the consumer as "the Consumer."
In her
complaint, the Consumer disputes the way certain information regarding her
Republic Finance account is being reported to the credit reporting agencies. Republic Finance
immediately investigated the Consumer’s complaint and her statements made
therein. Republic Finance is committed to
providing the credit reporting agencies with accurate information and is
mailing a letter under separate cover to the Consumer regarding the resolution
of this matter.

I am rejecting this response because:REPUBLIC Finance has failed to update this information on my credit file that they advised would be addressed last year. They were even reporting that I was late after the account had been paid in full. Their inaccurate reporting on my credit file has costed me a higher interest rate when I financed my new home as well as higher interest rates with my credit cards!

Republic Finance immediately reviewed the Consumer's statements made therein. Under the Fair Credit Reporting Act ("FCRA"), Republic Finance is obligated to investigate credit disputes that are complete and meet certain requirements. According to the FCRA, a dispute notice is complete when it is submitted in writing directly to the creditor (i.e., not through a private, non-profit organization such as the BBB) and includes the following: (1) sufficient information to identify the account in dispute (e.g., consumer's full name, address, telephone number, and account number); (2) the specific information that is being disputed and an explanation of the basis for the dispute; and (3) all supporting documentation or information to substantiate the dispute, to the extent available (e.g., a copy of the relevant portion of the consumer report that contains the allegedly inaccurate information, a police report, a fraud or identity theft affidavit, a court order, or account statements). Therefore, Republic Finance has determined the Consumer's credit dispute is incomplete because it does not meet all of the three afore-mentioned requirements. If the Consumer has any additional information to satisfy the requirements set forth above, she is welcomed to submit a complete dispute notice directly to: Republic Finance, LLC, Attn: Credit Dispute Team, 7031 Commerce Circle, Suite 100, Baton Rouge, LA 70809-1394. Upon receipt of the Consumer's complete dispute notice, Republic Finance will investigate the dispute, correct any inaccuracies that may be discovered, and report back to her.
