I moved out of ********************************************************************** on May 16,2023; my official 30 day notice move out was 5/24/23, which was paid. On May 26, ****, the apartment company contacted me for my address to received my refund. I was a resident of Clearwater Creek Apts in ***************, a ******** property. In February 2021, Clearwater Creek admitted in an email that the fill switch on their washing machine in my apartment failed. It flooded my apartment dumping 150 gallons of water ruining my furniture and belongings. The Manager had the carpet pulled, but left the soaked pad and instructed the carpet men to put my things back on it. Im an asthmatic. Im highly allergic to mold. I found 150k pseudomonas mold spores by a professional mold tester. The Manager told my insurance company the property was habitable and I lost my renters insurance and over $150k clothes, furniture, jewelry, art, etc. I had to share the mold report and as of 3/15/21, they were removing the Sheetrock where it flooded. I told them I was terminating my lease and I became homeless. Pseudomonas from the mold spores in my flooded apartment was found in my sinus and skull during a sinus surgery. Ive been on 2 months of IV antibiotics to kill it. Clearwater Creek knew I was too sick to move out my molded flooded possessions. They harassed me and threatened me. They evicted me on a fake eviction. The latest straw when I disputed the $1296 and $10,069 they placed in collections with ************? 1st Lake Properties illegally added $11 to the collections total making $1296 go to $1307. This is fraud. Please do not rent from these horrible people. You cannot charge someone for an apartment that has mold and violates HUD standards. Nor can you create a fake debt for disputing fake charges to a credit report. Thats illegal. I ask $11376 debt be removed from my credit report seeing ******** raised it illegally by $11.when I disputed it on my credit report.Business Response

Moved into Citrus Creek West (**************) in November to an AC that constantly stopped cooling. Winter wasn't so bad. But when spring came, *********** just had a guy keep adding freon like once a week instead of permanently fixing the leak. Finally moved out after I couldnt take it anymore when INSIDE temp reached 85 degrees in May. Early termination fee is $2700 and they werent willing to waive a portion even though they practically pushed me out the door due to unfit living conditions. I was an ideal tenant. I have had problems with this staff from the moment I contacted them about even looking into leasing one of their apartments. The communication is horrendous. I moved in June 2022 and was supposed to move out March 2022, but was forced to extend my lease to April even though I gave them more than a 30-day notice and moved out a week before my March move out date. I was later contacted in May from the collections agency with $1200 in move out charges and that's after them factoring in my $300 deposit. After reviewing the charge summary, it was like $36 for sheetrock, $28 for Entergy, $1400 for carpet replacement, and $5 for them taking pictures of the apartment. When I asked what was wrong with the carpet, they sent the photos that were taken, and the photos show just normal dirt that any carpet develops over time. They decided to rip the carpet up because of "dark stains" and there were many urine stains underneath. I lived there by myself except for the first month when my boyfriend also lived there. We have never had any animals as both of us are allergic nor do I have any medical conditions that would make me incontinent. I asked when was the last time the carpets were changed, and they told me that doesn't matter, that the stains had to come from me since they decided to rip the carpets up after my move out. She told me they had to change the carpets because they cannot let someone move into an apartment with carpets like that, yet they let me move in with them like that. If the carpets were not changed before I moved in, which they clearly were not, I do not understand how this replacement is falling on me. I don't mind paying for the sheetrock as I did mount my TVs and I guess they aren't satisfied with how I fixed the walls and I have no problem paying the Entergy portion since I had to sign for an extra month, but I know that carpet replacement does not belong to me.Business Response

The Crossings is attempting to charge me for carpet replacement. They are saying the carpet was molded in living room area. I made the collections person *************************** aware that the apartment flooded in April of 2022 due to a roofing issue after a big rain storm and that the apartment complex only cleaned the top of the carpets and did not check for any water damage. My family had severe allergy like symptoms that I thought were coming from the ventilation system but now I realize that water molded under the carpets causing this to happen. The collections person *************************** was rude and unwilling to listen. They initially tried to charge me $2,500 saying that I also owed rent. I have pictures showing that the carpet was not in the condition that they sent me pictures of. I have emailed them and have not received any reply. Also the invoices that I have been sent are conflicting. The invoice for the carpet replacement dates 4/18/2023. The invoice showing that the carpet was inspected and needed to be replaced is 4/20/2023. This leads me to believe that the carpet was going to be replaced prior to them inspecting it and it was later decided to charge me for it because of the molding under the carpet due to the water damage from the storm. I am only requesting that I not be charged for carpet replacement. I did not cause the damage and had to live in mold for over a year unknowingly. I have attached picture of the invoices, pictures of the carpet that I took right before and as I was moving out, and picture of the water damage, and the pictures they sent me claiming that the condition of the carpet was molded. However those images look like they are of the flooring after the carpet had been pulled up or not even the same apartment. I was a resident at 1st Lake properties when my apartment was damaged during hurricane ***. The apartment was filled with mold and was unlivable. I moved into my parents home and was not living at the apartment. ******** has now reported a collections account for the rent during month that the apartment was unlivable directly following the impact of the hurricane.Business Response

I have been living in Citrus Creek East since 2018. Since then 1.My carpet has been completely wet 3 times due to no fault of my own and it still wasn't replaced: Water heater broke and water wet the entire carpet including my closet ruining clothes and shoes; Water from the Washer in another apartment leaked into my apartment; and then the washer in my apartment leaked all over the floor in my unit. After each MASSIVE water leak they only replaced the padding and dried the carpet with an industrial dryer. The carpet was old when i moved in and it's even more worn and ragged due to the leaks causing mildew to grow.2. I have made several complaints and work order requests regarding the stove in my apartment I have explained numerous times to the "manager" that only one burner on the stove is operable and the vent above the stove doesn't work at all. The "manager" said they were trying to find parts for the 24 year old stove and apparently the search for these parts has been unsuccessful. It has been impossible to reach someone at the corporate office and whenever i call the corporate office the receptionist takes the complaint and promises that someone will contact me and they NEVER DO.Business Response

Sawmill mill apartments owned and operated by 1st lake properties has knowing placed myself and my family in an apartment with unlivable conditions. I have pictures, requests and documentation of the conditions in question. I want to say that they KNOWINGLY placed us in a dangerous living environment and I need them reported, and I want to file a lawsuit. They should not be able to operate apartments in the condition they do, its criminal. The pictures attached are from move in Feb 14, 2022. An outside company came to clean the vents March 24, 2023 and they told me that there was so much mold in our vents it was horrendous. Black mold is deadly and I want reimbursement and to move without penalty.Business Response

On 8 April 2022, we rented a two bedroom apartment from ******** in ********, **. We informed the manager we will only be there until the end of December 2022. We paid a pro-rated amount for the first month rent then the normal rent for the remaining months. In October, we informed the new manager we were departing on 30 December so that we would not incur another month of rent. In November, we let her know again and filled out the 30 day notice form. On 30 December, we cleared the apartment and departed. We were in contact with the manager the whole time and she assured ** that our security deposit would be sent to our new address within 30 days. We paid a $1,100 security deposit. We were aware that $100 of it was non-tefundable so we should have gotten $1,000 back. When we got the check, it was for $656.00. We were charged $294 rent and a $50 late charge. The receipt said we moved out the 7th of January which was not correct. We left on 30 December. When I called the manager she stated because we left 8 days early, we were charged rent and a late fee. This is completely false. Our first month rent was pro-rated so the we would pay our rent on the 1st and the month would end on the 31st. The manager said I should not have been charged a 50 late charge and she was going to get with her boss about getting ** back our $294 as well. Since that time, I have called the office three times and no one answers. I called the corporate office about the error and was told I had to contact the manager. This is completely unacceptable. We left when we said we would within the required dates of the contract. We are being taken advantage of and they are stealing our money. Any assistance getting this situation resolved would be greatly appreciated. Thank you.Business Response

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.***************** is a liar. We were in communication with her in November and gave clear notice we were moving out on 30 December. We informed her that the previous manager had pro-rated our first month rent so that we would be starting a new month's rent on the first of each month. She had me fill out the form to vacate on 1 December even though we told her we were leaving November. I asked if that was too late for her records (30 day notice requirement)? She said it would be fine. Nothing was said in any of our communications (3 times) that we had to to stay until 7 January to avoid penalties. We made it clear we were leaving before the end of the month in order to not have to pay more rent for ******** She acknowledged everything we told her. When we left (30 December) she was out of town and not available to come and inspect the apartment and get the keys. I asked her what she wanted me to do and she said leave the keys in the apartment which I did. There has been nothing but deception and false claims made in her statement letter. If the company will not refund me the money that was due to us, I want to formally request a negative rating be placed on this company so others won't have to suffer the financial loss as we have.
