ORGINAL COMPLAINT: ***After having a fire, my solar panels needed to be removed. Once my roof was **mpleted, I had to call several times to get the put back on. When finally put back on, it has taken several phone calls to get them activated. I was told there were different issues and my electric ** told me I wasn't **nnected to solar. No one ever calls me back and I have to call Posigen every day to get nowhere.****This issues was NEVER resolved!! After several phone calls, dis**vering (on my own) that a permit was not obtained from my town, I still do NOT have working panels!! The permit was obtained, but Posigen never sent it to my electric **mpany to get a solar meter installed on my home, which I would think is the normal installation process. I have made phone calls to my electric ** to be told I do not have solar **nnection as well as to Posigen with no solution or calls returned. My panels are generating solar, but it's useless since it's not going to my electric **. I would like Posigen to **mplete the steps required by them to **nnect my solar panels to my electric **mpany to start using solar power!

Posigen has a solar system on my house that I lease. I've had issues with the inverters back since 2022. I've called since several times asking for help with the failed parts. No one has came or called yet. I keep getting the run around. I wish they would just give or ship me the parts to repair it myself, their customer service is the weakest company around.

      Business Response

Good afternoon. This is ***** with Posigen solar. I would like to start by stating we are deeply apologetic for any inconvenience you may have experienced. Our intent is to provide every customer with the best service possible. If we have failed to do so we will do our best at getting back on track. There seems to be a bit of misunderstanding. In the complaint it states the system has been down or having inverter issues since 2022. Yet, our production portal states the system has produced and reported optimally since September 2022. I have attached a visual representation on the system's production. The solar system is currently experiencing an issue with it's reporting. Meaning the solar data will report to your utility company for solar sellback and consumption, but will not be visible in customer's production portal. I contacted out to our field services department for resolve in reference to your reporting issue. We have attempted to give **************** a call on August 8,2023. Yet, there was no answer. A voicemail was left and another attempt at calling will take place. If there are any questions or concerns you may email us at *************************************** or ************ Option 4.

I have attached 4 snapshots of the monitoring system. If I wouldn't be tech savy, this monitoring system would not be working. I paid for a monitoring system on my agreement form, AT&T did away with 2G and 3G, I asked Posigen to get me up and running, nothing. So I went outside and hooked the system to my home Wi-Fi. Once it finished updating, which took several days due to the backlog, I discovered a issue. I reported it to Posigen several times and no one has came in last few months I been calling. I'm being told my system is not updated to what they are seeing. They are unable to show me. Because I clearly have a production issue and they aren't resolving but want the monthly payment. I'm being told I am over producing. My backlog shows that's not true and I attached the snapshots of it to show. My system is down a average of 100KWH per month from 4 M250 Inverters down. Posigen hasn't gotten a tech out to resolve are try to give me a reduction on my monthly note. I have a agreement they are not holding up too.

Let the record state that I was working closely with Posigen showing them I actually had a issue. The response from Posigen says I wasn't accepting, which is a lie. About 5 years ago i got the Posigen place solor power on my roof. My roof started leaking when rain falls heavily. I paid someone to take a look and fix the roof but was told by the contractor that it was leaking where the solar power was placed. I called Posigen and told them what was happening. Some came out took a look and sealed a part of the area that was leaking but never came back to finish. The water had messed up my painting in son's room and I am unable to complete my light fixture in my bathroom because the water is coming down straight through it. It has now spread through the house. I have called them several times concerning this problem and they have been promising to come fix the problem but no one has showed up. In fact they have stopped taking my phone calls. The only time I hear from them is if my bill is not paid on time. Also I was told that for every referral that I made and the work was completed, I received $200.00. I referred my brother in law *************************** at ************************************************** never received the referral money. I have also tried talking to them about it but to no avail. I am hoping you will be able to help me because this is causing black mold in my bathroom because I cannot fix the area where I need to place the fan because that exactly where the water comes through when it rains heavily. If you are unable to help, please refer me to someone that can.Enclosed please find pictures of the damage that this incomplete work has done and the mold that it has caused in my house.Looking forward to finally getting some help.Sincerely *************************************** *************************** ******************************************************************** Ph# *********************** Posigen Phone number ************

Thank you for reaching out to us. Our team was able to speak with you further about your concerns. After reviewing we did determine that your roof is a non solar related leak that is caused from the overall state of your roof. Please see the ** photos our team was able to take when coming out to the home 4/7/2022. We did do some sealing work as a goodwill gesture but it was not to fully supplement your need for roof repairs. Our team has sent you a follow-up email with the photos as well for your record. We apologize if that confused the situation. Please reach out to your homeowners insurance for further assistance.

Our solar panels have not been actively working since September 2022 - there has been no resolution and they continue to make us pay on the lease agreement that they are in breach of our contract for almost 10 months of with no resolution in sight, no communication with us and truly no customer service. We have tried to correct this directly with them, and to no support and really unsure of what to do.

      Date: 07/10/2023

      Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

[Provide details of why you are not satisfied with this resolution.]

      Regards,

      *****************************

According to Section 10 (Maintenance and Repair) of the agreement, the lessor (the company) is responsible for providing required maintenance and repair to the solar equipment. However, it took seven months to complete this maintenance without any updates, and the system was only repaired because of my persistent outreach, follow-up, and inquiries. We were never once contacted about this outage.

The additional fees incurred from our electricity company due to the outage amount to approximately $2,800 (copies of these bills from our electricity provider are available). Additionally, we have faithfully paid the lease fee of $79.99 per month, even during the confirmed outage by Posigen, totaling $639.92 during the period when the system was non-functional.

Considering the prolonged duration of the outage and the financial burden it has caused, I kindly request the following:

Refund of Lease Fees: I request a refund of the lease fees paid for the eight months during which the solar panel system was inoperative, totaling $639.92. I believe it is fair and reasonable to be reimbursed for a service that was not provided as agreed upon in our lease agreement. This has been discussed as a "deferment" for the next seven months when the new agreement is signed, as mentioned in our email thread: "Due to this, she would approve a deferment of 7 months from 7/10/2023-1/10/2024."

Compensation for ********************* Bills: Due to the non-functioning solar panel system, my household has experienced a substantial increase in electricity expenses. I request compensation for the additional costs incurred from our electricity supplier, amounting to approximately $2,800. These costs resulted directly from the prolonged outage of the solar panels, which is in our best interest as stated in our lease agreement.

Please let me know if we can come to an agreement on the above. I have also reached out to the BBB due to our multiple attempts to contact our Posigen representative, which have resulted in no updates, responses, no repairs, and a lack of communication on our account and the matters mentioned above.

      Business Response

      Date: 07/11/2023

Thank you for reaching out again. PosiGen does not offer compensation for any customer's utility bills. We can not control the varying factors that go into your household's energy consumption and it is not the same for all households. The deferments are usually the basic practice for consistency and fairness that we have in place when the system requires maintenance. We have noted your complaint to perfect our processes going forward and are happy to see the notations of you speaking with our specialist 7/11/2023 on the matter. They are well versed and are actively working on the delivered actionable discussed today. Please be sure to reach out to them for any further questions . We will be happy to assist you!

Filed complaint before and still not satisfied with service or failed attempt at resolution. After everything spent on trying to save money on entergy bills. Not only double and triple energy bills but add in 80 extra every month on posigen contract. Told several months after original complaint, I found out that my system was not working...don't know for how long. I just want out of my contract!!! Was offered a $500 'settlement". That doesn't even begin to cover it!!!

Thank you for reaching back out to us. We want to apologize for your experience and ask for the opportunity to assist you further. We do see that your recent complaint was handled with our specialist and they successfully facilitated the work on your system. In the month of April, you had ***** kwh of production which equals $128.89 in value! You shared that you were in the level billing program with Entergy and that sometimes can play a factor in you seeing the value of your savings. Please be sure to send in the 3 months of utility bills as requested for a full savings analysis. This will allow us to see the relationship between your solar energy and your household consumption. PosiGen can not control the variations in our customers' household energy consumption but we can confirm how your solar savings is reflected on your bill.  We look forward to assisting you and want to thank you for your patronage.

After having a fire, my solar panels needed to be removed. Once my roof was completed, I had to call several times to get the put back on. When finally put back on, it has taken several phone calls to get them activated. A deferment was signed, but I still continue to get texts about non payment (I paid the entire time I didn't have panels!) I was told there were different issues and my electric ** told me I wasn't connected to solar. I called Posigen to inform them and they told me that wasn't the reason and then I was told I have to call my electric ** to resolve the issue. No one ever calls me back and I have to call Posigen every day to get nowhere.

There has been no resolution!  I still don't have solar and I am still getting texts for non payment which should have already been taken care of 2+ months ago!

      ******************,

I am seeing two calls as our manager ******************* spoke to you twice.  Once on Friday and again today.  Please be patience as he mentioned our monitoring team is working on the monitoring portion of the systems communication to UI.  As he mentioned we are fixing the issue and we have been responsive to your request and even offered you a three month credit and accompany deferment which I believe you are aware of.

Please let me know if you have further questions and I would be happy to provide the actual calls time stamps if you require them.

      Sincerely,

You are correct, I have spoken to Mr. ***************;regarding my situation, and he has been helpful and communicating with me.  What you may not understand is I have been dealing with this situation for over 2 months.  BBB gives me 2 choices to respond, accept your communication and close the issue or don't.  My issue has not yet been fully resolved, so I do not want to close this "case" until it is.  I have explained all this to ***** as well and he understands.  BBB only allows me a certain amount of time to respond as well before closing the case as resolved.

      Regards,

Thank you.  I spoke with him earlier as well as sending him the documents he requested.  Once again, unfortunately I am required to reply to you via BBB as reject the resolution so they do not close the case.  Once everything is working properly, I will be sure to answer as satisfied and resolved.

This complaint arises from an incorrect billing and automatic payment withdrawn from my checking account after receiving a written resolution from Posigen stating my billing would be otherwise. Posigen is billing me $18 per month for something they stated would cost $8 per month. Posigen set the automatic billing date and I did not. Supposedly, the date they set causes me to incur additional fees when I am billed. I want the automatic billing date corrected so that I am not incorrectly billed in the future. I want future billing to reflect my past over billing as credit for future billing.
