Paying off my debt with this law firm from a past debt I had with **** Funding roughly around $2,700. The original debt was based in **** for years this company has tried to collect on this debt and even placed a judgement order against me with the county court. I have also been garnished by this company as well. I paid off the debt by cashiers check in September of this year. After receiving my payment the company did not provide me with a zero balance letter or something showing that the debt has been paid. After numerous attempts to get this information the company failed to alert the courts to remove my judgment. I have also received interest to my account. I no long reside in **** anymore I relocated to the state of ******** and after asking for them to send me proof of a zero balance they said they wouldnt be able to send me anything due to the state I live in. They told me they do not practice in the state of ********. I have called multiple times to fix this situation but it seems as if Im getting the run around. I have been mislead, hung up on and yelled at. Its been 2 months and I still show no record of the judgement being removed nor have I received any response to my request for clarification if my debt is at a zero balance.Business Response

Please note that Stenger & Stenger does not operate in the state of ********, which restricts the firms ability to correspond with you via mail in that state. That considered, to help resolve this matter, Stenger & Stenger will mail a letter to your ******** address listed in this complaint, showing the balance to be zero. Additionally, the satisfaction of the Ohio judgment has been sent to the court for filing. Lastly, your calls with Stenger & Stenger have been reviewed for quality assurance. The firm did not find any evidence to substantiate your allegations of being misled or yelled at; however, one of the firms call agents did note that she had a technical difficulty following your call being transferred to her on November 7, 2024, stating that you were unable to hear her. In 2021 my account that was under litigation was settled with them for 2100 and the account was paid off in September of 2022. This company refused to file this with the courts and turned around and refiled a garnishment and are now attempting to garnish my wages again even though this account is paid in full. I have the signed settlement offer as well as proof that all payments were sent. This has caused me emotional turmoil and stress and it is ridiculous that this company is attempting to garnish my wages for an account that has been paid in full. I have had to retain the lawyer that initially represented me as this company refuses to speak to me.Business Response

As shown in the settlement agreement you have attached that payments were to start 10/5/21,however, your first payment as shown on your second attachment was made 12/30/21. ********** did not receive any communication between the settlement agreement and that payment in December, thus, the payment agreement was broken on 11/19/21 for failure to make a payment. Due to the payment agreement being broken, the balance in full is due, not the settlement amount of $2,100.00. Thus, Stenger and Stenger, P.C.s attempt to garnish your wages is valid. Further, our office is unable to communicate with you at this time due to attorney representation requiring all communication must go through your attorney. If the attorney is no longer representing you,please have their office send Stenger & Stenger a letter noting the termination of their representation. Even when they get their money owed from one form of garnishment they do not halt the other forms of garnishment they employed. They employ an obviously intentionally slow process every step along the way. My bank account was garnished for approx $800, and even though they got their money they garnished my state taxes several months after the fact. It wasn't until I contacted them did they send out a letter confirming the debt was paid and I was told the state tax garnishment had not been received yet... To give you an idea of the timeline here I filed my taxes in Feb 2024, they did not receive the check from the state taxes until July 19th, my bank was garnished already before I even filed my taxes... From there I was told it could take ***** days to process the refund from the time they received the check (July 19th). After 45 days I called back and was then told it could take ***** days. After 60 days I called back and was told it takes up to 60 days to process a refund, they did in fact receive the check on July 19th, however, they did not process it until July 23rd, so just wait a few more days. (So really it's 60 days from the time they get around to putting your money into their bank account). I then called back 60 days from the 23rd and they had just sent out the check refund. So just so you know these people will intentionally allow you to be garnished even after they get your money and then they will hold it until the last possible day allowable even if you've contacted them over half a dozen times like I did. There is no way to expedite the process, you cannot speak to a supervisor, their **** are farmed out and only communicate with the company via email. So these people are essentially taking short term loans from poor and broke people. Read others comments, this is a regular practice of there's, not just a one off... They said they sent my refund out, it's been 8 days and I still have not received it.Business Response

The refund check for your account was mailed on or about September 20, 2024, to the address listed on this complaint. Please note that Stenger & Stenger does not intentionally employ a slow refund process. The process of refunding a payment may take longer than preferrable due to a variety of reasons, including but not limited to the original method of payment, the bank processing times, regulatory compliance requirements, and reconciliation procedures. This company is extremely unprofessional, and never submitted the release of my wage garnishment. Despite attempting to work out a payment plan that was contributing more than the garnishment, when I tried to check on things since I was being charged double; they all of a sudden couldn't talk to me after speaking with me about my account, which they were not supposed to do. Due to the stress of trying to correct this problem, I am wishing to remove the account from collections as I am making on-time payments via wage garnishment.Business Response

I set up a payment plan with them to stop a garnishment, and fulfilled my end of the agreement. They did not fulfill theirs. My employer has still not received a release from garnishment. The employers suggested having my employerr call to provide a verbal confirmation, but legally my employer is unable to accept verbal releases. Stenger and Stenger should know that.Business Response

I am representing a client for the sale of their home, and we needed to obtain payoff statements from Stenger and Stenger for a few judgments. They are holding the payoffs hostage, and it's been over a week since we sent in our first request. They tell you to direct the requests to their email or fax number they provide, yet when you call to follow up to see why we haven't gotten them yet, they tell us "the request hasn't been uploaded yet" and then refuse to provide any further information. We sent in three email requests, a fax request, and called three times and they still won't provide the information. They are now the only reason our client's home sale will fall through, and they will be liable for not providing the payoffs in a timely matter.Business Response

Stenger & Stenger, P.C. is in receipt of your BBB complaint #******** in which you indicate that you have made several requests for a payoff letter regarding multiple judgment accounts, but you have not received the requested documentation despite it being over a week since the first request, and that your clients home sale will fall through due to the delay.
Please note that the firm received your first request for a payoff letter on the judgment accounts on Tuesday, August 20, 2024. While this initial request did not contain proper authorization or identifiers regarding the accounts in question, the second follow up email Stenger received on Wednesday August 21, 2024, did contain the required information. Stenger & Stengers records indicate that the payoff letters for the requested accounts were emailed to your desired email address on August 28, 2024, five business days after the firm received the required information. Stenger & Stenger believes this to be an acceptable turnaround time for a request for documentation.

I was being sued for a debt and worked out a payment plan with them. I actually fell behind in payments and ended up going on medical leave due to medical issues. I reached out to them at the earlier part of this year and sent a certified letter to help me get back on track and offered some type of payment options , but was open to suggestions. I have not been back to work a single month and I am hit with a garnishment to where how I am I supposed to catch up on all my bills when I tried reaching out to extend the payment period but at a lower amount. This makes not sense I try to do the right thing and pay what I owe as much as I can and I still get no response or even a letter back stating anything.Business Response

In response, the firm attempted to call you via the contact information we had available; however, the firm was unable to reach you. Note that your letter did not include contact information beyond your name and address. So Stenger &Stenger, had garnished my funds and over garnished my funds. I've been reaching out to the company for several weeks and spoken to upper management, but continue to get the run around. I've called the courts and they can't do anything because they are waiting on documents from ************************************************ So I call back to them and they claim they sent documents out, so I call the courts and again they say they haven't received anything from this company. I am being forced to pay a bill that was paid ten years ago . I received today that I must repay ******* that I paid out of my own checking account. To *************** to whom I am contesting today Because I am disabled, a senior citizen, and the tactics taken by the debt collection agency that I state both past and future are being forced to repay *************** again. This is a form of Senior Citizen Abuse. I have paid this payment in full on November 8, 2019 through my checking account under my name ************************************************. I am seeking restoration of my name in the public and seeking an apology, along with financial restoration for the amount of money that I was forced to pay above the amount that was owed to *************** in the amount of $1000.00 and a public apology to the Court System in *************** in the city of ********, *************. I received a letter from stenger and stenger in the mail, It said my wages would be garnished for $882. I called them and set up a payment plan. Instead of a debit card number they wanted my account and routing number. RED FLAG! I gave them one for an account that I keep empty for Bills...ETC They asked what day I get paid, Which is Friday. Okay, So because I get paid at the end of the week, The payment doesn't process until the following Monday. I put the money into my account Monday, and the payment did not process. Also, I was charged a return fee by the bank. Stenger and Stenger never notified me of the missed payment and proceeded with the garnishment but continued withdrawing from my bank account at the same time. I called them and asked about stopping the bank payment and they would NOT. Also, Stenger and Stenger did not communicate to my Employer payments made directly by me. So now, I have been over garnished by $307 and some odd cents. The reason I am due a refund is because, THEY ARE USING SNAIL MAIL FOR GARNISHMENT PAYMENTS! With all the digital technology and ability to move money electronically, Why are we using the **** which takes up to 10 days for delivery? What a joke. MY account Balance is now positive over $300 and counting and it could have been avoided had Stenger and Stenger given my employer the correct account balance. Get it together. Furthermore, a release of garnishment is likely not to come before my next pay period, so I'll probably be garnished again. I talked to one of their representative's and they said it can take 60 days to receive a refund. SERIOUSLY? That is unacceptable. So Stenger and Stenger has taken from bank account, garnished my check at the same time. That is almost half my pay checks they were taking. Plus, they have took much more than the amount owed. Get a release to my employer and print a check to return the funds you basically STOLE.Business Response

Stenger & Stengers records indicate that this account has been satisfied in full. Any funds received in excess of the judgment amount will be refunded to you. To date, Stenger & Stenger received $36.24 in excess funds via a garnishment payment received July 17, 2024 and has issued a refund check to the address listed on this complaint. Additionally, the garnishment release has been emailed to your place of employment. Please note that garnishment transactions are conducted in accordance with the Kentucky legal system requirements.
