On 1/16/2024 *********************** representing attorney for *********************************************** agreed to completely dissolve, walk away from, remove and cancel a debt I have with Midland Credit Management.This is documented in several email communications I have between *********************** and my former attorney.To this date 4/4/2024 he has yet to fulfill his legal obligation to the agreed upon terms.1. Update the court records to show dismissed "with Prejudice"2.Show this debt removed and with no open account or balance with Midland Credit Management.3.Remove this debt and record of such completely from my credit reports.In these emails he said many times the paperwork was submitted to the courts when in fact it was not.I have personally called the courts several times and they have confirmed they have no receipt of a motion filed by Stenger&Stenger to modify the court record as agreed.The court has advised on several occasions that this takes them at *** 1-2 business days to enter and correct based on current work load. They were even kind enough to offer their fax number so I could supply it to Stenger&Stenger to get this handled immediately. In the emails *********************** confirmed his client "Midland Credit Management"agreed to dismiss this debt completely, yet it is still shown on their website and on my credit report.I find it incredible that I can look up court records, call the courts, look up Midland records, call Midland, review my credit reports talk to the bureaus regularly and this company can't seem to do anything in almost 3 months.Business Response

I am rejecting this response because:Stenger & Stenger represents ************************** the agreement made almost 3 months ago should have been addressed by ************************* and updated on my report. Given that it took them several months to take care of this matter in the courts I would more than assume they did nothing to ensure that Midland Credit was aware of this and asked to remove in a timely fashion.
************************* will not speak with me as they have Stenger & Stenger in charge of communication.

I paid *****************************. over $1,200 dollars to setlle the dispute for me. It was settled at $2,500, I have made $100 dollars in payments and have bank records of such. I should only owe $1,500 dollars but your website now states a balance for the first time since I have been making payments of $3,285.70 more than the agreed setllement and does not even reflect the $1000 I have ****** paid. Stenger & Stenger, P.C. is in receipt of your BBB complaint #******** wherein you indicate that you retained the ********************* Firm to represent you in this matter, and that the account was settled for $2,500.00, that you have made $1,000.00 in payments toward the account, but the ********************** & Stenger website shows the full balance due. Please note that in accordance with the agreed settlement, Stenger & Stenger was to receive payments of $125.00 per month, due on the 26th of each month, commencing on My 26, 2023. The firm has not received payments in accordance with the above referenced payment terms. While you are more than welcome to pay more than the $125.00 per month, the agreement was for payments to be made on a per month basis, and failure to receive a payment as agreed results in a nullification of the settlement. Stenger & Stenger will reinstate your settlement to provide a $1,250.00 remaining balance, to be paid at $125.00 per month beginning 4/15/2024. Once the final payment is received, you will receive a satisfaction of the consent judgment. I received a notice from my employer stating that I'm being taken to court regarding a wage garnishment. I spoke with them on the phone and was advised that they send a letter regarding a settlement offer that was good until 2/28/24. I was unable to respond due to some personal issues that I've been dealing with. When I asked if a settlement could be done , they refused and stated that I would either have to pay in full or do a payment arrangement. I wanted to pay $500 a month which I thought was fair, but they refused to do that and offered $600. I told them I could not afford that. I spoke with two customer service agents and both them were very rude and unprofessional. Whenever I tried to speak and expand my point, they kept interrupting me. They made assumptions about me being upset during the call, which I was not. I just wanted to get a resolution that worked better for me.Business Response

Additionally, you state that if you do not receive an extension of 15 days on the settlement offer you will pursue legal action for a settlement, and that the call representatives you spoke to were rude and unprofessional. Please note that settlements on outstanding debts are not mandated by any local, state, or federal laws, but are offered as a courtesy, and this offer was given a deadline of February 26, 2024. That considered, to help resolve your complaint, Stenger & Stenger will extend the settlement offers made in the letter by additional fifteen (15) days from the date of this response. This is a debt collector. I had gone into an agreement with them. I was making payments and then I thought I had payed off the debt as the website does not provide you with a balance. Nor did I receive any paperwork indicating that the payments were late. 2 years later, I receive notice of tax garnishment. The paperwork shows the total that I had paid which was $50 less than what the websites history was showing. I explained this to the person I was speaking to on the phone, which apparently doesn't know how math works and she kept saying that it was a typo and that she was showing $450 on her end (after she had just stated she was showing $400 paid on her end). There was zero communication and they decided they could just scam me out of an additional $50.Business Response

First off this is my wife's debt that is being paid off through National Debt Relief. We are trying to pay the remaining balance on this debt through a refinance on our house. However this firm will not even speak to my wife about a debt she owes. They will only speak to another attorney that was on the case. Now in order to get this debt paid the title company needs to know where to send the payment. It would be nice if the place (this one) that has the debt could speak with us so we can pay what is owed.Business Response

Stenger and Stenger filed a civil case on behalf of **************** in March 2022 for the total amount of 1585.00.That amount was garnished and paid in full.It appears that a 2nd case(DUPLICATE) was filed for the same exact issue for the same company, **************** Oct. 2023 and the garnishment has begun today, Feb, 2 2024.The cases were filed with 2 different clerks for the same company for an amount that has already been paid.Thus far as of this writing, ****** has been garnished from my wages.I have attached both cases What I am looking for is for this garnishment to cease and any monies collected be refunded as this balance has already been paid.Business Response

Please note that Stenger & Stenger has previously communicated with your place of employment regarding the past garnishments in 2022. All the garnishment funds that were previously sent to the court in 2021 and 2022 were returned to your place of employment via a mailed check following a hearing on January 26, 2022. The check was mailed by the court on or about February 1, 2022, for the total monies garnished. As such, Stenger &Stenger refiled the garnishment that you reference in your complaint. In Stenger & Stengers communications with your employer, the firm provided them with the date the court sent the check, the check number, and the address it was sent to. To date, Stenger & Stenger has not received any funds from the garnishments. The firm has filed a request with the court to release any garnishment funds in their possession to Stenger & Stenger. If the amount released by the court exceeds the amount listed on the garnishment, a refund will be sent. On November 17, I paid the original creditor my entire balance of $1656. On November 20, I called *********************************************** to update them that I had paid and was told that was incorrect and was urged to pay them the full amount and stop payment on the original creditor. Not wanting my wages to be garnished, I did that and paid them in full as well, $1659. Only the original creditor refused to stop my payment. Neither of the companies could do anything until the payments completely cleared my account. Both payments cleared my account, then the companies need to communicate to see who will be issuing the refund (a debacle in itself). I call the office numerous times and talk to numerous representatives. I email with my own documentation to help the process. I get confirmation on December 1st that *********************************************** will be issuing my refund FROM a representative at Stenger and Stenger, as well as a representative from the original creditor. They tell me 40 days. Takes 30 seconds for them to type in my account information but 40 days to process a refund due to being understaffed. I continue to follow up with emails because its Christmas time, I have an 2 year old and my bills still need paid. I call again, then Im told 60 days. I call again, ** told that should have happened immediately. Every time I call, ** told something different to oh the refund is currently being processed to I dont see any documentation here stating youre to be receiving a refund. *** sent numerous emails with ZERO response to any of them. Today ** told initially that they can see a refund being processed and to call back at the end of the day. I call at the end of the day and am told there is no where indicating Im to be receiving a refund. I spoke with the original creditor today who has documented they spoke with and have in writing they communicated with *********************************************** on 11/30 for them to process the refund. Its now been 53 days since I sent payment with no refund.Business Response
